AND TAKE NOTICE that the Council of the Corporation of the Municipality of Bayham will hold an electronic public meeting on Thursday, June 18, 2020 at 7:30 p.m. to consider a proposed Zoning By- law amendment under Section 34 of the PLANNING ACT. Please reference the subject Agenda on the municipal website for the electronic meeting link. THE PURPOSE of this By-law is to change the zoning on a 34.2 ha (84.6 acres) parcel of land from an Agricultural (A1) zone to a site-specific Agriculture (A1-XX) zone to permit “kennel use” in addition to the permitted uses in the A1 zone and to recognize the kennel facilities, in Zoning By-law Z456-2003. The subject lands are located at 54945 Vienna Line, south side, west of Brown Road. THE EFFECT of this By-law will be to allow a kennel for the boarding of dogs in an accessory building with floor area of 9 m2 (96 ft2) and within a fenced area of 600m2 (6,458 ft2) approximately 35 m (114 ft) south of the existing dwelling. The campaign is asking municipalities within the Thames Valley District School Board to light public buildings or art gold on June 25th as this would have been the last day of school. The City of London has already approved the lighting of its public buildings for the occasion. Since Grade 8 and Grade 12 Graduation and Commencement Ceremonies have been postponed, we are asking you to join us as we recognize these graduates for their accomplishments. The City of St. Thomas will be receiving the correspondence on the June 8th agenda and I anticipate that we will approve the lighting of Jumbo for this occasion. Box 1118 Kitchener, ON N2G 4G7 Phone: 519.741.2200 x 7278 Fax: 519.741.2705 jeff.bunn@kitchener.ca TTY: 519-741-2385 May 15, 2020 The Right Honourable Justin Trudeau, Prime Minister of Canada Office of the Prime Minister 80 Wellington Street Ottawa, ON K1A 0A2 Dear Prime Minister Trudeau: This is to advise that City Council, at a special electronic meeting held on May 11, 2020, passed the following resolution regarding universal basic income: “WHEREAS The World Health Organization (WHO) on March 11, 2020 declared COVID-19 a pandemic, pointing to the growing number of cases of the coronavirus illness around the world and the sustained risk of further global spread; and, WHEREAS in response to the COVID-19 pandemic, the Province of Ontario and the City of Kitchener have declared a state of emergency under the Emergency Management and Civil Protection Act; and, WHEREAS the City of Kitchener has approved the Early Economic Support Plan, which provides financial and economic support measures to help reduce the financial strain on citizens and businesses during the COVID-19 pandemic; and, WHEREAS Statistics Canada has reported that the unemployment rate has risen to 7.8 per cent, with 1,011,000 jobs lost in March 2020, and that the COVID-19 pandemic has impacted the employment of 3.1 million Canadians; and, WHEREAS the Federal government has announced $82 billion in relief funding for the COVID-19 Economic Response Plan, utilizing tax deferrals, subsidies, loans, and credits to support citizens, businesses, and industries; and, WHEREAS according to a 2018 Parliamentary Budget Office report, a Canada-wide basic income of the type previously piloted in Ontario would have an annual net cost of $44 billion; and, WHEREAS a universal basic income would likely have many positive effects, including reducing poverty, reducing strain on health care and social assistance systems, supporting businesses and the economy, reducing crime, as well as reducing administrative complexity and creating efficiencies for those in need of financial and economic support measures; THEREFORE BE IT RESOLVED that the Council of the City of Kitchener urges the Ontario Provincial government to pursue a partnership with the Federal government for the establishment of a universal basic income; BE IT FINALLY RESOLVED that this resolution be forwarded to the Right Honourable Prime Minister of Canada; the Honourable Premier of Ontario; the Minister of Children, Community and Social Services; the Minister of Municipal Affairs and Housing; the Association of Municipalities of Ontario; the Local Members of Provincial Parliament; the Region of Waterloo; all Municipalities within the Province of Ontario; and, the Federation of Canadian Municipalities.” Yours truly, J. Select conservation and energy efficiency initiatives, such as the Broader Public Sector Energy Reporting Regulation, were moved to the Electricity Act, 1998. Ontario Regulation 397/11 (Energy Conservation and Demand Management Plans) was replaced by Ontario Regulation 507/18 (Broader Public Sector: Energy Reporting and Conservation and Demand Management Plans). No changes were made to Ontario Regulation 397/11 when it was replaced with Ontario Regulation 507/18. Ontario Regulation 507/18 Broader Public Sector: Energy Reporting and Conservation and Demand Management Plans enacted under the Electricity Act, 199 8 dictates the process for the compilation, submission and publication of annual energy reports and energy conservation and demand management plans. Section 5 of Ontario Regulation 507/18 specifically states that on or before July 1st annually, each broader public sector organization must compile, submit and publish a summary of the organizations two years previous calendar year annual energy consumption and greenhouse gas emissions which must include a list of the energy consumption and greenhouse gas emissions for the year with respect to each operational category. Further, on or before July 1 of each year, each broader public sector organization must compile, submit and publish a summary of the organization’s annual energy consumption and greenhouse gas emissions which must include a list of the energy consumption and greenhouse gas emissions for the year with respect to each operational category. DISCUSSION The Municipality of Bayham has tracked and analyzed operation energy and energy efficiency data since 2011. The Municipality of Bayham Municipal Energy Plan - Local Action Plan on GHG Emissions satisfies the requirements of Ontario Regulation 507/18. TERMINOLOGY Green House Gas Emissions - kgCO 2e/yr The kilograms (kg) of equivalent carbon dioxide (CO 2) units of Green House Gas emissions attributed to the energy purchased and consumed for each operation. Green House Gas emission factors are based on Environment Canada’s National Inventory. Green House Gas Intensity - CO 2e/m2 The equivalent carbon dioxide (CO 2) units of Green House Gas emissions per square metre of an operation. Energy Use - ekWh/yr The equivalent kilowatt hours of energy used per year for each operation. WHEREAS Sections 42, 51.1 and 53 of the Planning Act, RSO 1990, Chapter P.13, as amended, authorizes the enactment of by-laws respecting the conveyance to the Council of the Corporation of the Municipality of Bayham of land for park or other public recreational purposes as a condition of development or redevelopment of land within the Municipality; AND WHEREAS the Council of the Corporation of the Municipality of Bayham has established an Official Plan that contains specific policies with respect to the provision of lands for park or other public recreational purposes and this By-law is intended to be in conformity with such policies; THEREFORE the Council of the Corporation of the Municipality of Bayham enacts as follows: Definitions 1) THAT for the purposes of this By-Law, the following definitions shall apply: “Act” shall mean the Planning Act, as amended; “Cash-in-lieu” shall mean the payment of funds equivalent to the value of the amount of land that the Municipality would otherwise have been entitled to acquire for park or other public recreational purposes as part of a development; “Consent” means the process referred to in Section 53 of the Act; “Development”, which includes redevelopment, means the construction, erection, or placing of one or more buildings or structures on land or the making of an addition or alteration to a building or structure that has the effect of substantially increasing the size or usability thereof, including the addition of a second or third dwelling unit or the addition of a residential dwelling unit to a commercial building accessory to the commercial use; “Mixed-Use” shall mean the use of land, buildings and structures intended and designed to contain both residential and non-residential uses within the same building or on discrete portions of the same property; “Municipality” shall mean The Corporation of the Municipality of Bayham; “Public Use” shall mean the use of lands for public purposes by a public authority including a Federal, Provincial, County or municipal government or a publicly-funded school, college or university. “Subdivision” shall mean the process referred to in Section 51 of the Act. Geographic Applicability 2) THAT this by-law applies to Development within the geographic boundaries of the Municipality of Bayham. By-law 2020-053 2 Official Plan Policy and Dedication Rates 3) THAT parkland dedication and/or cash-in-lieu of parkland shall be required for Development in accordance to the Municipality of Bayham Official Plan Section 8.18 Parkland Dedication policy and rates, as attached hereto as Schedule “A”, in accordance with the Act. Timing of Land Conveyance 4) THAT the conveyance of land for public park or other public recreational purposes pursuant to this By-law, shall be required as follows: (a) As a condition of approval of a plan of subdivision or condominium prior to the release of the plan for registration; (b) Prior to the approval of a description under Section 50 of the Condominium Act, R.S.O. 1990, Chapter c.76; (c) As a condition of approval of a consent prior to release of conditions for a consent; (d) Prior to the execution of a site plan agreement; (e) Prior to the issuance of a building permit for land proposed for Development; or (f) Otherwise in accordance with the terms of an agreement entered into between the owner of the land and the Municipality. Cash-in-Lieu of Land 5) THAT the value of land shall be determined subject to Section 42 of the Act: (a) As of the day before the day of the issuance of the building permit in respect of the Development, or, where more than one building permit is required for the Development, as of the day of the issuance of the first building permit. (b) In the case of a consent for residential purposes, or in the case of a consent for commercial or industrial purposes, prior to the issuance of the building permit in respect of the Development, or, where more than one building permit is required for the Development, as of the day of the issuance of the first building permit, the owner is required to convey payment of Cash-in-lieu in accordance with the following: (i) the payment collected by the Municipality in the amount payable provided for on Schedule ”B” of this By-law, or any amending By-law; or, (ii) the owner has the option to retain an independent accredited real-estate appraiser to provide an opinion of value, conducted to the satisfaction of the municipal staff, with all costs associated with the appraisal to be borne by the owner of the property, in accordance to the rates provided for on Schedule “A” to this By-law, or any amending By-law. Timing of Payment 6) THAT for a subdivision, condominium, consent, site plan or building permit, cash-in-lieu By-law 2020-053 3 of parkland shall be paid prior to the issuance of a building permit. 7) THAT for consents provisionally approved prior to the passing of this By-law, and where a condition has been imposed requiring the payment of Cash-in-lieu, Cash-in-lieu shall be collected by the Municipality in the amount payable provided for on Schedule “B” of this By-law, or any amending By-law, and paid in accordance with the imposed condition. Credit for Previous Conveyance or Cash-in-Lieu 8) THAT in accordance with Section 42(7) of the Act, land and/or cash-in-lieu required to be conveyed and/or paid to the Municipality for park or other public recreation purposes pursuant to this by-law shall be reduced by the amount of land or cash-in-lieu previously received by the Municipality pursuant to sections 42, 51.1 or 53 of the Act in respect of subsequent development. Exemptions 9) THAT notwithstanding any other provisions of this By-law, this By-law shall not apply to any of the following: (a) Where the proposed Development, pursuant to section 41 or 51 of the Act, is for a Public Use as defined in this By-law; (b) Where the Development consists of making an addition or alteration to a residential building, provided the number of dwelling units within the residential building is not increased; Force and Effect 10) THAT this By-law shall come into force and take effect on the day of the final passing thereof. MAYOR CLERK By-law 2020-053 4 SCHEDULE “A” TO BY-LAW 2020-053 Municipality of Bayham Official Plan, as amended, excerpt: 8.18 Parkland Dedication In order to acquire and develop parks and open space areas, the Municipality shall require parkland dedication and cash-in-lieu of parkland in accordance with the following polices: 8.18.1 A dedication of five percent of the gross area of land proposed for development or redevelopment and/or a dedication rate of one hectare per 300 units or the equivalent cash-in-lieu, of the gross area of lands being subdivided for residential purposes. 8.18.2 A dedication of two percent of the gross area of land proposed for development or redevelopment or the equivalent cash-in-lieu, of the gross area of lands being subdivided for commercial and industrial purposes. 8.18.3 Where land in a draft plan of subdivision is to be used for any use other than residential, industrial or commercial purposes, Council may require conveyance of land for park purposes or equivalent cash-in-lieu at a rate of five percent (5%) of the gross area of the land proposed for development. 8.18.4 The monies received from cash in lieu payments may be used to purchase park and open space areas elsewhere in the Municipality or, for any other public recreational purpose. 8.18.5 The Municipality may accept cash-in-lieu of the land dedication to be paid into a special account and used as specified in the Planning Act. Council will consider cash-in-lieu of parkland dedication under the following circumstances: a) where the required land dedication fails to provide an area of suitable shape, size or location for development as public parkland; b) where the required dedication of land would render the remainder of the site unsuitable or impractical for development; and/or, c) where it is preferable to have consolidated parkland of a substantial size servicing a wide area. 8.18.6 Where new development or redevelopment is proposed on a site, part of which has physical limitations or hazards, then such land shall not necessarily be acceptable as part of the land dedication under the Planning Act. All land dedicated to the Municipality shall be conveyed in a physical condition satisfactory to the Municipality, and shall meet minimum standards in terms of drainage, grading and general condition. By-law 2020-053 5 SCHEDULE “B” TO BY-LAW 2020-053 1. Cash-in-Lieu of Parkland Fee - Consents for residential purposes: In the case of a consent pursuant to Section 53 of the Planning Act, the payment of Cash-in-lieu of land for each created lot as follows: Amount $2000.00 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW No. 2020- 054 BEING A BY-LAW TO CONSIDER EXEMPTION BY CASH-IN-LIEU OF THE PROVISION OF PARKING REQUIREMENTS IN ZONING BY-LAW Z456-2003 AS A CONDITION OF DEVELOPMENT OR REDEVELOPMENT (“CASH-IN-LIEU OF PARKING BY-LAW”) WHEREAS Section 40 of the Planning Act, RSO 1990, Chapter P.13, as amended, provides that where an owner or occupant of a building is required under a by-law of a local municipality to provide and maintain parking facilities on land that is not part of a highway, the council of the municipality and such owner or occupant may enter into an agreement exempting the owner or occupant, to the extent specified in the agreement, from the requirement of providing or maintaining the parking facilities. AND WHEREAS the Council of the Corporation of the Municipality of Bayham has established an Official Plan that contains specific policies with respect to the provision of cash-in-lieu of parking and this By-law is intended to be in conformity with such policies; THEREFORE the Council of the Corporation of the Municipality of Bayham enacts as follows: 1) Definitions: “Act” shall mean Planning Act, as amended’ “Council” shall mean the Municipal Council of The Corporation of the Municipality of Bayham; “Planning Coordinator” shall mean the Planning Coordinator of The Corporation of the Municipality of Bayham 2) THAT the criteria for considering applications for exemption from the parking requirements of Zoning By-Law No. Z456-2003, shall be in accordance with the Municipality of Bayham Official Plan Section 8.19 Cash-in-Lieu of Parking, as attached hereto as Appendix 1, in accordance with the Act. 3) THAT the exemption shall be by site-specific agreement between the owner and the Municipality, which shall provide among other matters for a parking levy in the amount of ONE THOUSAND ($1,000.00) DOLLARS for each parking space below the number which would have been required by By-Law Z456-2003 had not the exemption been granted. 4) THAT the amount referred to in Paragraph (3) above shall be reviewed by the Planning Coordinator and/or designate(s) on a five-year basis to ensure it remains appropriate. 5) THAT the Planning Coordinator and/or designate(s) are authorized to recommend to Council for consideration request for such exempting agreement(s). 6) THAT when applications for minor variance which would have the effect of reducing parking spaces are considered, that the Committee of Adjustment consider whether or not they should more appropriately be considered by Council pursuant to Section 40 of the Act, as amended. By-law 2020-054 2 7) THAT the Exemptions under these criteria shall be by agreement pursuant to Section 40 of the Act, as amended. 8) THAT this By-law shall come into force and take effect on the day of the final passing thereof. MAYOR CLERK By-law 2020-054 3 Appendix 1 Municipality of Bayham Official Plan, as amended, excerpt: 8.19 Cash-in-lieu of Parking In order to acquire and develop public parking areas, The Municipality may accept cash-in-lieu of the provision of on-site parking into a special account and used as specified in the Planning Act. The monies received from cash in lieu payments shall be used to purchase public parking elsewhere in the Municipality or for any other public parking purpose. Council may consider acceptance of cash-in-lieu of vehicular parking under the following circumstances: a) Where the required provision of on-site parking is restricted or limited due to the available lot area, the shape, physical limitations of the land or the location of parking for the intended use; b) Where the required provision of on-site parking would render the remainder of the site unsuitable or impractical for development; and c) Where it is preferable and in the public interest to have consolidated publically accessible parking located elsewhere in the Municipality. THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW No. 2020-055 BEING A BY-LAW TO REQUIRE APPLICANTS TO CONSULT WITH THE MUNICIPALITY OF BAYHAM PRIOR TO SUBMISSION OF A DEVELOPMENT APPLICATION (“PRE-CONSULTATION BY-LAW”). WHEREAS Sections 22(3.1), 34(10.0.1) and 41(3.1) of the Planning Act, RSO 1990, Chapter P.13, as amended, provides that Municipal Council may, by by-law, require an applicant to consult with the municipality before submitting a request to amend the Official Plan or before applying for an amendment to the Zoning By-law Z456-2003 or before submitting plans and drawings for site plan approval; AND WHEREAS the Municipality of Bayham Official Plan contains provisions, as in Section 8.5.1.1 and 8.5.1.2, as attached hereto as Appendix 1, requiring pre-application consultation for Official Plan Amendments, Zoning By-law Amendments and Site Plans; AND WHEREAS the Council of The Corporation of the Municipality of Bayham deems it appropriate to require pre-application consultation with applicants submitting development applications to have an opportunity, in consultation with the applicant, to clarify the information and materials that the applicant may be required by the municipality to submit with the application; THEREFORE the Council of The Corporation of the Municipality of Bayham enacts as follows: 1) Definitions: “Act” shall mean Planning Act, as amended’ “Applicant” shall mean: (i) a person or public body requesting Council to amend the Official Plan of The Corporation of the Municipality of Bayham under section 22 of the Act; (ii) a person or public body applying to Council to amend the Municipality of Bayham Zoning By-law Z456-2003, under section 34 of the Act; (iii) a person applying for Site Plan approval of plans and drawings under Section 41 of the Act; “Council” shall mean the Municipal Council of The Corporation of the Municipality of Bayham; “Planning Coordinator” shall mean the Planning Coordinator of The Corporation of the Municipality of Bayham “Record of Consultation” shall mean: (i) the date, or dates, that the Consultation Meeting is held; (ii) a copy of a written summary of the proposed application to amend the Official Plan, to amend the Zoning By-law, or to obtain Site Plan Approval, as the case may be; (iii) a copy of a written statement identifying the information and materials from Section 8.5.1 of the Municipality of Bayham Official Plan that may need to be submitted with an application. 2) THAT the Planning Coordinator and/or designate(s) are authorized to: (i) conduct pre-application consultations for Official Plan Amendments, Zoning By-law Amendments and Site Plans; By-law 2020-055 2 (ii) identify the information and material necessary for processing Official Plan Amendments, Zoning By-law Amendments and Site Plans; a. prior to submission and acceptance of a development application, as items necessary for the application to be deemed complete under the Act and Municipality of Bayham Official Plan; and, b. during the processing of development applications in cases where information and materials cannot reasonably be provided at the time of submission of the application. (iii) waive the requirement for a pre-application consultation when, in her/his opinion, it has been deemed to be unnecessary for a complete review of the application. 3) THAT an applicant shall: (i) Provide payment of pre-consultation fee, in the amount payable provided for in the Corporation of the Municipality of Bayham Rates and Fees By-law No. 2019-025, as amended, or any amending by-law, to the Municipality; (ii) deliver to the Planning Coordinator or designate(s), a written summary of the applicant’s proposed application; and, (iii) include in the written summary, the location of the subject property, the current use of the property, and a short summary of the proposed application including servicing requirements and financing requirements. 4) THAT applicants shall pre-consult with municipal staff prior to submission of Official Plan Amendments, Zoning By-law Amendments and Site Plan applications in order to identify the information necessary to the processing of an application. 5) THAT the Planning Coordinator or designate(s) shall: (i) determine the written form or format of the Record of Consultation; (ii) determine whether the applicant’s written summary shall be submitted at the date of the Consultation Meeting or prior to the Consultation Meeting; (iii) determine whether more information or material is required from the applicant other than the information contained in the written summary, for the purpose of conducting the Consultation Meeting; (iv) prepare a Record of Consultation; and, (v) deliver the Record of Consultation to the applicant within thirty (30) days of the date of the last consultation meeting. 6) THAT this By-law shall come into force and take effect on the day of the final passing thereof. MAYOR CLERK By-law 2020-055 3 Appendix 1 Municipality of Bayham Official Plan, as amended, excerpt: 8.5.1 Amendments 8.5.1.1 The Municipality may by by-law require a Pre-application Consultation meeting with an applicant prior to the submission of a complete land use planning application. The applications shall include any privately initiated planning application as provided for through the Planning Act. The purpose of the meeting is to identify the complete application requirements related to reports or background studies for land use planning matters to be addressed or considered through the land use planning application review process. 8.5.1.2 The Municipality may require reports and background studies needed to make timely and informed decisions on all land use planning matters in accordance with the requirements of the Planning Act. Background studies may include but are not limited to:  Land use planning and design;  Environmental and natural heritage;  Natural hazards;  Transportation;  Municipal servicing and infrastructure;  Cultural heritage;  Other land use planning matters arising through the pre application consultation that are of public health and safety;  Land use justification report;  Agricultural impact assessment; and/or,  Archaeological assessment. These studies will address how the land use planning application fulfills the requirements of the Provincial Policy Statement 2014 and its updates and revisions; the County of Elgin Official Plan; the Bayham Official Plan; the policies and regulations of any public agency or body having an interest in the application. THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2020-058 A BY-LAW TO AUTHORIZE THE EXECUTION OF AN AGREEMENT BETWEEN THE CORPORATION OF THE MUNICIPALITY OF BAYHAM AND THE CORPORATION OF THE COUNTY OF ELGIN WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous of entering into an agreement with the Corporation of the County of Elgin for the provision of an Indemnity Agreement; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk be and are hereby authorized to execute the Agreement attached hereto as Schedule “A” and forming part of this by-law between the Corporation of the Municipality of Bayham and the Corporation of the County of Elgin for the provision of an Indemnity Agreement; 2. AND THAT this by-law shall come into full force and effect upon final passing. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the actions of the Council of the Corporation of the Municipality of Bayham in respect of each recommendation and each motion and resolution passed and other action by the Council at the Council meeting held June 4, 2020 is hereby adopted and confirmed as if all proceedings were expressly embodied in this by-law. 2. THAT the Mayor and Clerk of the Corporation of the Municipality of Bayham are hereby authorized and directed to do all things necessary to give effect to the action of the Council including executing all documents and affixing the Corporate Seal.
