Act, 2015, it be pointed out that at the public participation meeting held March 19, 2020
associated with this application, there were no written submissions and one oral
presentation by the landowner regarding this matter and that all considerations were taken
into account in Council’s decision passing this resolution;
AND THAT Zoning By-law Z456-2003, as amended, be further amended by changing the
zoning on the lands owned by Agostino and Julie Cipolla identified as Concession 4 Part N

THE PURPOSE of this By-law is an amendment to change the zoning regulations on a
994 m2 (0.2 acre) parcel of land from Village Residential (R1) zone to site-specific
Village Residential (R1-XX) zone to permit front yard setback for the existing dwelling of
1.8 m (6 feet) where the permitted minimum is 7.0 m (22.9 feet); to permit existing
accessory building floor area of 120 m2 (1,291 ft2) where the permitted maximum is 65
m2 (700 ft2) in the R1 zone; and, to permit existing accessory building height of 5.5 m
(18 feet) where the permitted maximum is 4.5 m (14.7 feet), in Zoning By-law Z456-

2003. The subject lands are located at 55866 First Street, north side, east of West
Street.
THE EFFECT of this By-law will be to fulfill conditions of Consent Application E90/19 to
rezone the retained lands comprising existing dwelling reduced front yard setback and
oversized (combined floor area and height) accessory building.

SUBJECT: MUNICIPAL WATER METER READING SOFTWARE
BACKGROUND
Over the course of approximately 20 years the methods of obtaining municipal water meter
readings have advanced from a labour intensive manual reading method to the current
automated drive-by reading system.
DISCUSSION
Incorporating bi-monthly readings collected from the field to the Keystone financial system has
been accomplished with the use of Nsight software. This software is server based and specific
to Neptune water meters which has been in use in the Municipality of Bayham since November
2010. Neptune Technology Group has informed the municipality that support of the current
Nsight software will be phased out over the coming years. The replacement software, Neptune
360, is a secure cloud based, data management platform. Neptune employs the use of offsite
Amazon servers located in Canada. This cloud based platform eliminates the need for server
maintenance and or upgrades while providing one of the highest levels of data security,
redundancy, and disaster recovery. Additional benefits include retaining data ownership
specific to water utilities, ability to integrate and access data analytics across departments as
well as migrate easily from a mobile to a fixed network, identify potential leaks, excessive
consumption, and reverse flow to proactively resolve issues more efficiently and effectively
while aiding in conservation and rate planning.
Transferring to Neptune 360 now will reduce costs associated with upgrading Nsight to the Elgin
County supported server environment. Evans Utility and Municipal Product Supply Inc. is the
authorized distributor for Neptune Technology Group and has provided the following software
quotation:
•Supply and install Neptune 360 software including testing, training and 2020 subscription
-$8,066.40+HST.
•2021 annual subscription fee $3,326.40+HST
Staff respectfully recommends moving forward immediately with the conversion to be funded
from the Water Reserve with the 2021 annual subscription fee incorporated into the operating
budget.
RECOMMENDATION
1.THAT Staff Report PS -02/20 re Municipal Water Meter Reading Software be
received for information;
2.AND THAT the Council of the Corporation of the Municipality of Bayham authorize
the purchase of Neptune 360 software from Evans Utility and Municipal
Product Supply Inc. Inc. for a total of $8,066.40+HST.

NOTICE OF THE PASSING OF
ZONING BY-LAW Z702-2020 BY
THE CORPORATION OF THE MUNICIPALITY OF BAYHAM

TAKE NOTICE that the Council of the Corporation of the Municipality of Bayham passed By-
Law No. Z702-2020 on the 5th day of March, 2020, under Section 34 of THE PLANNING ACT.
AND TAKE NOTICE that any person or agency may appeal to the Local Planning Appeal
Tribunal in respect of the By-law by filing with the Clerk of the Municipality of Bayham not later
than the 10th day of May, 2020 a notice of appeal setting out the objection to the By-law and the
reasons in support of the objection.
THE PURPOSE of this By-law is to amend the zoning on 4006 m2 (1 acres) of land from an Estate
Residential (ER) zone to a site-specific Estate Residential (ER-9) zone to permit maximum
accessory building floor area of 157 m2 (1,690 ft2); to allow an accessory building in the front yard;
and, to allow an accessory building to be located closer to the front property line than the main
building in Zoning By-law Z456-2003. The subject lands are located at 9743 Plank Road, west
side, north of 5th Street.
THE EFFECT of this By-law will be to permit a new oversized accessory building of 139.4 m²
(1,500 ft²) floor area, in addition to the existing 16 m2 (172 ft2) floor area accessory building (pool
shed), within the front yard and closer to the front of the lot than the main building.
ONLY INDIVIDUALS, CORPORATIONS AND PUBLIC BODIES may appeal a by-law to the
Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated
association or group. However, a notice of appeal may be filed in the name of an individual who
is a member of the association or the group on its behalf.
NO PERSON OR PUBLIC BODY SHALL be added as a party to the hearing of the appeal
unless, before the by-law was passed, the person or public body made oral submissions at a
public meeting or written submissions to the council or, in the opinion of the Local Planning
Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.
The complete By-law is available for inspection in the municipal office during regular office
hours.

THE PURPOSE of this By-law is to change the zoning regulations on 57.8 ha (143 acres) of land
from Agricultural (A1-A) to site-specific Agricultural (A1-A-33) to allow supplementary farm dwelling
floor area of 372 m2 (4,000 ft2) for supplementary farm dwellings to a maximum of two (2) mobile
trailers and one (1) permanent building to accommodate up to twenty-four (24) seasonal farm
labourers, in Zoning By-law Z456-2003. The subject lands are located at 56398 Calton Line, north
side, east of Plank Road.
THE EFFECT of this By-law will be to recognize the existing supplementary farm dwelling and allow
two additional supplementary farm dwellings with combined floor area exceeding the maximum of
167 m2 (1,800 ft2).
ONLY INDIVIDUALS, CORPORATIONS AND PUBLIC BODIES may appeal a by-law to the Local
Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or
group. However, a notice of appeal may be filed in the name of an individual who is a member of

THE EFFECT of this By-law will be to recognize the existing supplementary farm dwelling in a portion
of a farm building for up to eight (8) labourers; to permit second supplementary farm dwelling in the
remainder of the same building for up to eight (8) labourers; and to permit a third supplementary
farm dwelling in a portion of an adjacent farm building for up to eight (8) labourers, with combined
floor area exceeding the permitted maximum floor area of 167 m2 (1,800 ft2).

Nothing is more important than protecting the health and well-being of all Ontarians.
Since first learning of COVID-19, Ontario has taken decisive action to stop the spread of
the virus.
Our government knows that an increasing number of municipalities are responding to
the COVID-19 outbreak by diverting resources to essential services, instructing non-
essential staff to work from home and suspending in-person meetings. We appreciate
that the current situation is not “business as usual,” and that meeting statutory timelines
associated with decisions on planning applications can be difficult, if not impossible.
In response to requests from municipalities and the Association of Municipalities of
Ontario, our government intends to introduce legislation in the coming weeks to allow
for the suspension of specified timelines associated with land use planning matters that
could be applied retroactively to the date that an emergency was declared. If passed,
these changes would provide authority for the Minister of Municipal Affairs and Housing
to give municipalities time to focus on the COVID-19 outbreak.
If approved, municipalities and planning boards would still be able to make decisions on
land use planning matters during this time if they so desired and can consider using
electronic and virtual channels as appropriate to engage and solicit feedback from the
public on land use planning matters. It is vital for the economy that we move the
administrative process along to the best of our collective ability in order to continue the
important job of creating housing and keeping infrastructure projects moving.
Municipalities that instead wish to pause their consideration of planning applications and
direct their resources and attention to more immediate priorities would be permitted to
do so without the threat of appeal.
We know that such a change could have a significant effect on your municipality’s land
use planning matters, but it is necessary to ensure we can all offer our full support to
help our health care sector to stop the spread of COVID-19.

Our government also supports growth paying for growth and ensuring municipalities
have the tools to ensure complete communities are built. Therefore, we will also be
proposing amendments to the Development Charges Act to ensure these important
principles would continue during the COVID-19 outbreak.
If passed, our proposed changes would allow municipalities to continue to use their
existing development charge bylaw during the COVID-19 outbreak and for a short
period thereafter. We know that if a municipality’s development charge bylaw is
scheduled to expire in the coming months it would be difficult to replace given the
current situation. We are taking this measure to ensure municipalities can continue to
count on this vital source of revenue for local infrastructure and services.
We have also extended the current Environmental Registry of Ontario posting related to
community benefits charges until April 20, 2020. The extension of the Environmental
Registry of Ontario posting along with the proposed development charge changes will
allow municipalities more time to consider the alignment of future development charge
bylaws with the new community benefits tool to support local growth.
Let me assure you that our government is working to support you, our municipal
partners, and will continue to work collaboratively to keep all Ontarians safe.

Dear Valued Customer, March 31, 2020
We are reaching out to you since your facility is located on a portion of a railway line
leased by CN to the Ontario Southland Railway (OSR) in 2013 and referred to as the
Cayuga Line.
Recently, the OSR advised CN that they would cease operating the Cayuga Line on
April 30th, 2020 and would therefore return it to CN on that date. In accordance with
the Canada Transportation Act, CN has 60 days after April 30th, 2020 to decide
whether it would resume operations or offer it for sale pursuant to the Act.
CN has reviewed the volumes of traffic moving on this Line and based on traffic
volumes and needed investments, decided not to resume operations and proceed
with the discontinuance process.
Accordingly, CN will soon publish in newspapers its offer to sell the line to any party
interested in continuing its operations. If no agreement is reached for the transfer of
the line, CN will then offer the line to governments at net salvage value.
CN continually invests in our network to ensure the safe and reliable service levels.
In 2019, CN spent $3.9B in capital investment the network alone, including $1.6B
just in maintenance. CN expects to spend the same amounts in 2020. Unlike airlines
and trucking companies, CN pays the full costs of all infrastructure maintenance
improvements. Often times, CN is faced with the decision of discontinuing
operations over parts of its network when there is not sufficient traffic to support
the viability of the line. The discontinuance process will, under certain conditions,
result in a short line operator taking over CN’s responsibilities to operate the railway
line.
The Cayuga Line
Traffic over the Cayuga Line has declined significantly over the past 10 years to a
point where CN placed the line on the Discontinuance List and moved forward to end
operation on the line. In 1998, St Thomas and Eastern Railway (“STER”) operated
the line until December 2013, where they informed CN that required investments
would not permit the continued operation over the Cayuga Line.
The very short notice provided by the STER to CN had the effect of stranding cars
and goods at customer facilities and on CN network after the operations had ceased.
CN worked with CPR and the OSR to provide interim services to the customers until
the completion of the discontinuance process. The discussions led CN to grant
operating rights over the Cayuga Line to the OSR that remained in effect since 2013
and until their latest notice was received advising CN stating that they would cease
operating the line after April 30th, 2020.
CN has made the decision not to resume operations over the Cayuga Line given the
low volumes of traffic and investments required to keep providing our customers
with a safe, reliable and cost-effective service that our customers expect.
The Canada Transportation Act (“Act”) outlines the discontinuance process followed
by Canadian railways. In the current circumstances, the Act requires that CN must
first seek interested third parties to acquire the railway line for continuing railway
operations. If no interested parties are found, or no agreement is concluded within
the specified negotiation period, or if the transfer is not completed, we must offer all
of its interest in the railway line for not more than its net salvage value to the
relevant governments, transit authorities and municipal administrations.
CN remains available to work with customers to find alternative arrangements to

Participation – Chief Administrative Officer
The Chief Administrative Officer presented a report regarding electronic
participation in Council meetings during emergencies. On March 18, 2020, the
Ontario Legislature passed Bill 187, Municipal Emergency Act, 2020, which
received Royal Assent and is now in force. This Act allows councils to conduct
meetings remotely.

2. WARDEN’S REMARKS AND COVID-19 UPDATE FROM THE CHIEF
ADMINISTRATIVE OFFICER
County Council observed a Moment of Silence in memory of Councillor Linda Stevenson,
City of St. Thomas.
The Warden welcomed everyone to the County’s first ever Council Meeting conducted by
teleconference and expressed his support of the actions taken by the provincial
government and the local and provincial public health authorities to respond to the
COVID-19 pandemic. The Warden assured residents and businesses that the County is
committed to responding cooperatively, responsibly, and with the full strength of their
resources to this community health crisis.
The Warden presented an update on the County’s Covid-19 response to date. Most Elgin
County services continue to operate, although often in a different format. Residents are
encouraged to visit the County’s website or to call County Administration for more
information. Senior staff and the Emergency Management Coordinator have been
working proactively for weeks and are making informed and important decisions to
protect citizens and workers. On behalf of Council, the Warden expressed Council’s
commitment to supporting staff and the community.
The Chief Administrative Officer expressed staff’s commitment to doing their part to
support the directives of Council, public health experts and the Government of Ontario in
helping to slow the spread of the virus in this community and commended staff from
across the organization for their leadership, flexibility and support.

services to the County’s citizens and its Local Municipal Partners.

6.2 COVID-19 – Director of Financial Services
The Director of Financial Services presented a report regarding the economic
hardships created by the COVID-19 pandemic. Many of the County’s Local
Municipal Partners have implemented or are considering tax penalty relief to their
residents. As residents delay payments to the County’s municipal partners, the
municipal partners will begin to experience cashflow issues, which will make it
difficult for them to meet the March 31 deadline for the levy payment to the
County.

The Chief Administrative Officer presented a report regarding the continuity of
service during the COVID-19 pandemic. In the event that Council or its
Committees is unable to act due to the current situation, the COVID-19 Delegation
By-Law will allow Council to delegate temporarily its authority and powers to make
decisions by elected Council to a body comprised of specified members of Council
and the Chief Administrative Officer/Clerk of the Corporation, subject to

Special Council Meeting – COVID-19 Update, CAO Julie Gonyou

Thank you, Mr. Warden and Members of Council.
As the COVID-19 situation continues to develop, Elgin County staff are committed to doing our part to
support the directives of Council, public health experts and the Government of Ontario in helping to
slow the spread of the virus in our community.
We have adapted as many services as possible to encourage service delivery online or over the phone.
We are leaning into providing continuity of municipal functions, in particular, essential services, while
maintaining a safe environment for staff and the public.
On a daily basis, we have implemented a number of new processes and staff have embraced these
changes and they have done a remarkable job adapting to this evolving situation.
Staff across the organization are working together to support our essential service areas. Your
leadership team has been working around the clock to ensure staff and the public are informed, work
environments are safe, and guidelines are prepared to ensure continuity of operations.
As time goes on, we expect that ongoing adjustments to the way we offer services will be required. While we
have some concerns, in particular, staffing of our Long-Term Care Homes and the availability of supplies and
Personal Protective Equipment, we remain calm.
Without question, I am most thankful for our absolutely incredible team who has been shifting duties
and learning new tools – in order to address the challenges we are facing during these unprecedented
times. We are sharing the workload and are thankful to County Council for your support.

Elgin County Council met this 14th day of April, 2020 in the Council Chambers, at the
County Administration Building, St. Thomas at 9:00 a.m. with Warden Mennill in the
chair. The Councillors and some staff participated electronically by video conference.
2.WARDEN’S OPENING REMARKS – COVID-19
The Warden acknowledged the community’s efforts to slow the spread of COVID-19 and
thanked residents for their strict adherence to physical distancing. With the recent spike
in positive cases in Ontario, the Warden highlighted the importance of practicing physical
distancing and emphasized that staying home is the safest thing people can do for
themselves and their families. The Warden also encouraged residents to follow the
directives and guidelines set out by the Province and Southwestern Public Health.

Program allocations as recommended by the Rural Initiatives and Planning
Advisory Committee, with amendments as suggested by the Chief Administrative

6.4 Electronic Bidding Update – Purchasing Coordinator
The Purchasing Coordinator presented an update on electronic bidding. The
presentation provided data demonstrating that electronic bidding offers a reduced
workload for County staff and prospective bidders and that the uptake of
information technology to a level sufficient to partake in e-bidding is virtually
universal among large and small businesses.

6.5 Tourism Membership and Program Fees – General Manager of Economic
Development
The General Manager of Economic Development presented a report on the
economic impact of COVID-19 on local businesses. Because the tourism industry
has been hit particularly hard, Elgin County Tourism will be postponing and
cancelling some of its tourism programming and services for 2020.

6.6 Cycling Master Plan Update – Director of Engineering Services
The Director of Engineering Services updated Council on the progress to date with
respect to the implementation of cycling facilities as well as proposed future projects
and minor revisions to the current plan.

6.7 Roadside Environments – Director of Engineering Services
The Director of Engineering Services presented a report on the intent and options
for municipalities to manage roadside environments. The current Road
Maintenance Agreement includes a responsibility to remove vegetation to the road
property limits once every 3 years. Flexibility exists for member municipalities to
perform mechanical cutting or to allow naturalization of the right of way. The
eradication of invasive species and noxious weeds can be managed following the
County’s spraying policy.

6.8 Contract Award of Three Tenders – Asphalt Crack Sealing, Cold In-Place
Recycling with Expanded Asphalt Material, and Granular ‘A’ Shouldering –
Director of Engineering Services
The Director of Engineering Services presented a report on the contract award of
tenders for Asphalt Crack Sealing, Cold In-Place Recycling with Expanded Asphalt
Material, and Granular ‘A’ Shouldering. These three tender awards represent nine
(9) different projects within the Capital Budget. All of the low tenders submitted
were wi thin the approved budget amounts, and no capital surplus is anticipated at
this time.

6.10 Contract Award – Warren Street Intersection Improvements Tender No. 2020-
T20 – Director of Engineering Services
The Director of Engineering presented a report regarding the contract award of the
Warren Street Intersection Improvements. Three (3) contractors submitted bids for
the tender, which closed on March 31, 2020. R. Russell Construction submitted the
lowest compliant bid for the project. Work on the project is tentatively scheduled to
start on April 15, 2020 with substantial completion anticipated to be achieved by
May 22, 2020.

6.11 COVID-19: Changes to Fees and Charges – Director of Financial Services
The Director of Financial Services presented a report outlining the hardships
COVID-19 will impose on businesses, families and individuals as normal economic
activity has been restricted in an attempt to slow the progression of the virus.
Providing levy penalty relief will assist the local municipalities in offering tax relief to
their residents as they deal with the financial ramifications of the COVID-19 crisis.

6.12 Clearing Exemption Application – Pt Lot 40, Concession SE of the North
Branch of Talbot Road, Township of Southwold – County Solicitor
The County Solicitor presented an update on the Clearing Exemption Application
identified above. The County Solicitor received some information inconsistent with
statements made during the course of the Hearing, and he directed the Tree
Commissioner to hold any Permit authorizing clearing of the woodlands until the
issue could be investigated. The County Solicitor was later advised that the
Developer had resolved the tree removal dispute to the satisfaction of both involved
Objectors, and as a result, the Tree Commissioner completed and released the Tree
Clearing Exemption Permit to the Developer.

MEDIA RELEASE
April 1 6 , 2020 Long Point Region Conservation Authority – LPRCA Campgrounds: May 1 Opening Date Delayed
Long Point Region Conservation Authority is delaying the May 1 opening date for all LPRCA campgrounds.
LPRCA is committed to the health and safety of the public and our staff. We are making the decision to delay the
opening date to protect public health and are doing so as recommended by public health authorities. On April 3,
2020, the Ontario Government amended their list of essential workplaces and ordered seasonal trailer parks and
recreational campgrounds closed as of 11:59 p.m. on April 4.
To help limit the spread of COVID-19 and to ensure that visitors to LPRCA campgrounds have the best possible
experience when it is safe to reopen, LPRCA has made the decision to postpone the opening date. LPRCA will
continue to monitor the public health emergency and determine a point when LPRCA properties can reopen.
Further updates will be posted to the LRPCA website and social media accounts.
At this time, payment deadlines for seasonal campsites have been deferred. Campers with seasonal sites at
LPRCA campgrounds are being contacted by email with further information. Those who have made overnight
campsite bookings are also being contacted by email to be notified that their booking will be cancelled and a
refund will be issued automatically. The overnight booking cancellations are currently operating on a rolling two-
week schedule as we evaluate prospective opening dates. This means that overnight bookings scheduled for
later in the season are not being cancelled at this time and campers will be contacted directly as the situation
progresses.

SUBJECT: 2020 Q1 Variance Report
BACKGROUND
The Q1 (first quarter) financial reports are provided for Council’s fiduciary review. This report
provides a summary of current revenue and expenditure to March 31, 2020 and variances to the
Operating Budget and Capital Budget.
The Operating Budget and Capital Budget is at expected levels given the cyclical nature of
operations and the current COVID-19 climate.
DISCUSSION
The financial implications resulting from the COVID-19 Pandemic cannot be fully evaluated at
this time. As this situation unfolds, there will be additional costs and lost revenues resulting from
items such as the purchase of necessary emergency supplies. Staff are tracking the costs
resulting from COVID-19 and will continue to monitor financial impacts associated with the
same. Work to act strategically with Elgin County Municipalities continues.
On March 19, 2020, the Council of the Corporation of the Municipality of Bayham passed the
following resolution effective March 19, 2020:
THAT notwithstanding By-law No. 2019-025, the Rates & Fees By-law, the
Treasurer be authorized and directed to defer the imposition of all new penalties
and/or interest on all property tax and water/wastewater utility accounts for non-
payment or late payment until April 30, 2020; it being noted that such deferral is
being taken in response to the current COVID-19 Coronavirus pandemic.
Since this time, a number of municipalities have taken financial support action beyond April 30,
2020. On April 6, 2020, the Province of Ontario announced it would defer property taxes in
unorganized territories. Through these measures, Ontario is giving taxpayers in unincorporated
areas 90 extra days to pay without incurring interest or penalties. This action is complementary
to previously announced financial support to municipalities that deferring the upcoming quarterly
(June 30) remittance of education property tax to school boards by 90 days. In making this
decision the Province commented:
This will provide municipalities with the flexibility to, in turn, provide property tax
deferrals….to local residents and businesses.
The Municipality of Bayham continues to work to provide relief and support to residents and
businesses coping with the impacts of the COVID-19 Pandemic. In considering financial policy,
it is important to also consider impacts on municipal revenues and municipal cash flow. For
reference, the March 19, 2020 – April 21, 2020 deferral policy resulted in a levy budget
deviation of $14,693.85 and a user fee deviation of $2,371.00 1.
Considering the aforementioned, abilities of the financial system and expected cash flows staff
could only respectfully recommend consideration of the following COVID-19 Financial Policy:
Tax Levy
1.Deferral of application of penalty or interest on current amounts for 90 days from the
February 28, 2020 tax due date.
a.Excluding penalty and interest applied prior to March 19, 2020
2.Deferral of application of penalty or interest on current amounts for 90 days from the
May 29, 2020 tax due date.
Water/Wastewater Consumption Fees
1.Deferral of application of penalty or interest on current amounts for 60 days from the
March 31, 2020 due date.
a.Excluding penalty and interest applied prior to March 19, 2020
2.Deferral of application of penalty or interest on current amounts for 60 days from the
May 31, 2020 due date.
The above policies do not apply to supplemental tax bills and/or past due amounts. Penalty and
interest will be applied to non-current amounts.
The above policy will result in 2020 budgeted interest and penalty revenue amounts not being
met.

THE CORPORATION OF THE MUNICIPALITY OF BAYHAM
BY-LAW NO. 2020-029
A PROVISIONAL BY-LAW TO PROVIDE FOR DRAINAGE WORKS
IN THE MUNICIPALITY OF BAYHAM IN THE COUNTY OF ELGIN
KNOWN AS BRANCH ‘C’ OF THE RICHMOND ROAD DRAIN
WHEREAS the Engineer Spriet Associates on behalf of the Municipality of Bayham in
accordance with Section #78(1) of the Drainage Act, R.S.O. 1990, requests that the following
lands and roads be drained by drainage works:
Parts of Lot 111, Concession STR, Municipality of Bayham
AND WHEREAS , the Council of the Municipality of Bayham has procured Engineer Report No.
220091, prepared by Spriet Associates, dated April 3, 2020, which is attached hereto as
Schedule “A”, and forms part of this By-law.
AND WHEREAS the estimated total cost of constructing the drainage work is $20,900.00;
AND WHEREAS the Council is of the opinion that the drainage of the area is desirable;
NOW THEREFORE the Council of the Municipality of Bayham enacts as follows:
1. Engineer Report No. 220091, dated April 3, 2020 and attached hereto, is hereby
adopted and the drainage works as therein indicated and set forth are hereby
authorized and shall be completed in accordance therewith.
2.1 The Corporation of the Municipality of Bayham may borrow, on the credit of the
Corporation, the amount of $20,900.00 being the amount necessary for the drainage
works or other tendered and awarded amount by Council.
2.2 The Corporation may arrange for the issue of debentures on its behalf for the amount
borrowed less the total amount of,
(a) grants received under Section #85 of the Act;
(b) commuted payments made in respect of lands and roads assessed within the
municipality;
(c) monies paid under Subsection #61(3) of the Act; and
monies assessed in and payable by another municipality, and
such debentures shall be made payable within five (5) years from the date of the debenture
and shall bear interest at the rate established by the Ontario Ministry of Agriculture, Food and
Rural Affairs pursuant to the Tile Drainage Act as of the date of passing of this By-law.
By-law No. 2020-029
A special equal rate sufficient to redeem the principal and interest on the debentures shall be
levied upon the lands and roads as set forth in the attached Schedule "A" to be collected in the
same manner and at the same time as other taxes are collected in each year for five (5) years
after the passing of this by-law.
4. For paying the amount of $0 being the amount assessed upon the lands and roads
belonging to or controlled by the municipality, a special rate sufficient to pay the
amount assessed plus interest thereon shall be levied upon the whole rateable property
in the Municipality of Bayham in each year for five (5) years after the passing of this
Provisional By-law to be collected in the same manner and at the same time as other
taxes are collected.
5. All assessments of $500.00 or less are payable in the first year in which the
assessment is imposed.
6. This By-law comes into force on the passing thereof and may be cited as the “Branch
‘C’ Richmond Road Drain”.

BY-LAW NO. 2020-030
A BY-LAW TO PROVIDE FOR FINANCIAL POLICY IN
RESPONSE TO THE COVID-19 PANDEMIC
WHEREAS on March 17, 2020, and pursuant to section 7.0.1(b) of the Emergency
Management and Civil Protection Act, the Lieutenant Governor of Ontario, at the
recommendation of the Premier, declared that a state of emergency exists throughout the
Province of Ontario relating to the COVID-19 pandemic;
AND WHEREAS on March 21, 2020, and pursuant to section 4(1) of the Emergency
Management and Civil Protection Act, the Mayor of the Corporation of the Municipality of
Bayham declared that a state of emergency also exists in the Municipality of Bayham relating
to the said COVID-19 pandemic;
AND WHEREAS By-law No. 2019-025 and By-law No. 2020-045 enact financial policy
pertaining to Rates and Fees;
NOW THEREFORE notwithstanding By-law No. 2019-025 and By-law No. 2020-045 the
Council of the Municipality of Bayham directs the Treasurer to enact COVID-19 Financial
Policy as follows:
• Tax Levy
o Deferral of application of penalty or interest on current amounts for 90 days from the
February 28, 2020 tax due date.
Excluding penalty and interest applied prior to March 19, 2020
o Deferral of application of penalty or interest on current amounts for 90 days from the
May 29, 2020 tax due date.
• Water/Wastewater Consumption Fees
o Deferral of application of penalty or interest on current amounts for 60 days from the
March 31, 2020 due date.
Excluding penalty and interest applied prior to March 19, 2020
o Deferral of application of penalty or interest on current amounts for 60 days from the
May 31, 2020 due date.
• The above policies do not apply to supplemental tax bills and/or past due amounts. Penalty
and interest will be applied to non-current amounts.

for the purposes of the local municipality, and;
WHEREAS it is necessary and expedient to levy on the whole rateable property according to the
last revised assessment roll of the Municipality the sum of $895,000 for the capital program of the
lower-tier municipality for the current year,

BEING A BY-LAW TO ES TABLISH A LEVY FOR THE YEAR 2020 TO
ADOPT TAX RATES, PROVIDE FOR PENALTY AND INTEREST IN
DEFAULT OF PAYMENT AND THE COLLECTION THEREOF
WHEREAS Section 290 of the Municipal Act, S.O. 2001, as amended, provides that a local municipality
shall in each year prepare and adopt a budget including estimates of all sums required during the year for
the purposes of the municipality, and;
WHEREAS By-law No. 2020-044, passed by Council, adopted a capital improvement plan for 2020 in the
amount of $2,919,932 and in lieu of the municipality providing for the 2020 estimated amortization of fixed
assets and;
WHEREAS Section 312 (2) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that a local
municipality shall pass a by-law to levy a separate tax rate on the assessment in each property class, and;
WHEREAS Section 307 (2) (b) of the Municipal Act, 2001, S.O. 2001, c.25 requires tax rates to be
established in the same proportion to tax ratios, and;
WHEREAS it is necessary and expedient to levy on the whole rateable property according to the last
revised assessment roll of the Municipality the sum of $4,865,551.07 for the purposes of the lower-tier
municipality for the current year, and;
WHEREAS certain regulations made under Part IX of the Municipal Act, 2001, S.O. 2001, c.25 require
reductions in certain tax rates for certain classes or subclasses of property, and;
WHEREAS by action of the Municipal Property Assessment Corporation, provision was made for the taking
of the assessment of the Municipality, as the assessment on which the rate of taxation for the year 2020
should be levied;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM
HEREBY ENACTS AS FOLLOWS:
1. THAT the current estimates for 2020 set out in Schedule “B” are hereby adopted.
2. THAT the tax rates required to raise the current estimates for 2020, set out in Schedule “A”, be
hereby adopted, and levied for the year 2020 upon the whole of the said assessment of the
Municipality, according to the last revised assessment roll.
3. THAT for the purpose of providing for the County of Elgin general levy the tax rates set out in
County of Elgin By-Law 20-08, be hereby levied for the year 2020, upon the whole of the said
assessment of the Municipality, according to the last revised assessment roll.
4. THAT in addition, for the purposes of providing for the public and separate school education
purposes, the tax rates set out by the Minister of Finance under Regulation 6/20 of the Education
By-law 2020-045 - 2 -
Act, be hereby levied for the year 2020, upon the respective portions of the said assessment of the
School supporters of the said Municipality, according to the last revised assessment roll.
5. THAT the assessment contained in the assessment roll of the Municipality of Bayham, as made
pursuant to Province of Ontario Regulations, be hereby adopted and confirmed as the assessment
on which the rate of taxation for the year 2020 shall be levied.
6. THAT the said assessment roll be hereby adopted and confirmed as the last revised assessment
roll for the said Municipality and be used with the above noted rates to calculate said taxes as
summarized in Schedule “C”
7. THAT all taxes and other special rates shall be paid in the office of the Tax Collector or Treasurer of
the Municipality of Bayham.
8. THAT taxes for all properties shall become due and payable one-half on or before August 28, 2020
and one-half on or before October 30, 2020, and non-payment of the amount, as noted, on the
dates stated in accordance with this section shall constitute default.
9. THAT on all taxes, which are in default on the 1st day following the above noted due dates, a
penalty of 1.25% shall be added and thereafter a penalty of 1.25% per month will be added on the
1st day of each and every month the default continues, until December 31st, 2020.
10. THAT on all taxes in default on January 1st, 2021, interest shall be added at the rate of 1.25% per
month for each month or fraction thereof in which the default continues.
11. THAT penalties and interest added in default shall become due and payable and shall be collected
as if the same had originally been imposed and formed part of such unpaid tax levy.
12. THAT the Collector shall cause the same to be mailed to the residence or place of business of such
person indicated on the last revised assessment roll, a written or printed notice specifying that
amount of taxes payable.
13. THAT all by-laws inconsistent with the provisions of this by-law are hereby repealed.

THE CORPORATION OF THE
MUNICIPALITY OF BAYHAM
BY-LAW NO. 2020-031
A BY-LAW TO CONFIRM ALL ACTIONS OF
THE COUNCIL OF THE CORPORATION OF
THE MUNICIPALITY OF BAYHAM FOR THE
SPECIAL COUNCIL MEETING HELD APRIL 27, 2020
WHEREAS under Section 5 (1) of the Municipal Act, 2001 S.O. 2001, Chapter 25, the powers of
a municipal corporation are to be exercised by the Council of the municipality;
AND WHEREAS under Section 5 (3) of the Municipal Act, 2001, the powers of Council are to be
exercised by by-law;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it
advisable that the proceedings of the meeting be confirmed and adopted by by-law.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM ENACTS AS FOLLOWS:
1. THAT the actions of the Council of the Corporation of the Municipality of Bayham in
respect of each recommendation and each motion and resolution passed and other
action by the Council at the Special Council meeting held April 27, 2020 is hereby
adopted and confirmed as if all proceedings were expressly embodied in this by-law.
2. THAT the Mayor and Clerk of the Corporation of the Municipality of Bayham are hereby
authorized and directed to do all things necessary to give effect to the action of the
Council including executing all documents and affixing the Corporate Seal.
READ A FIRST, SECOND AND THIRD TIME and finally passed this 27th day of April, 2020.
