CALL TO ORDER Mayor Ketchabaw called the public meeting to order at 7:30 p.m. and asked those in attendance for this Planning Public Meeting regarding a Zoning By-Law Amendment application by Mark and Rosmarie McCord to place their name and contact information on the sign-in sheet provided at the podium. 2. DISCLOSURES OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF No disclosures of pecuniary interest were declared. 3. CHAIRMAN'S REMARKS ON THE PURPOSE OF THE MEETING The Chairman stated the purpose and effect of the proposed amendment. 4. PURPOSE AND EFFECT OF THE PROPOSED AMENDMENT A. Application submitted by Mark and Rosmarie McCord The purpose of the public meeting is to consider an application to change the zoning regulations on the 38.5 ha (95.3 acres) retained lot from an Agricultural (A1) zone to a Special Agricultural (A2) zone; and to change the 0.47 ha (1.1 acres) of severed lands from an Agricultural (A1)zone to a site-specific Rural Residential (RR-XX)Zone in Zoning By-law Z456-2003. The new residential lot is created surplus to a consolidated farm 2 2019 Planning Meeting Minutes November 7, 2019 Mark and Rosmarie McCord operation. The subject lands are located at 57761 Glen Erie Line, on the west side of Elgin County Road 55. The effect of the by-law will be to fulfil two conditions of consent. Firstly, to recognize residential use and to prohibit the keeping of livestock in the oversized accessory building (barn) for the severed lands; and, secondly, to change the retained lands to an A2 Zone in order to prohibit new residential dwellings. 5. John Spriet presented a topographic map and explained the map and the benefit to Mr. Racz as well as the need for a legal outlet. WW-02 WASTEWATER PUMP REPLACEMENT BACKGROUND Within the 2020-2029 capital budget (WW-02, $425,000) staff outlined the completion of the replacement of submersible wastewater pumps at both the wastewater treatment plant and collection system pumping stations. On October 1, 2019 the Council of the Corporation of the Municipality of Bayham approved in principle the 2020-2029 capital budget. The majority of the subject pumps have reached end of useful life while benefiting from a proactive preventative maintenance program. The replacement program will provide equipment reliability, energy efficiency, system compliance, reduced maintenance, and mitigate pump failure. DISCUSSION In order to effectively comply with the requirements of the wastewater systems environmental compliance approval (ECA) staff are respectfully recommending replacing the pumps with the same rating as the existing pumps. This will eliminate the need for both mechanical and electrical alterations as well as ECA amendments. Capital Item No. WW-02 is funded through the wastewater reserve and will facilitate the replacement of 20 new pumps and 5 new mixers while staying within the 2020 budget allocation. Nevtro Sales Inc., a Municipality of Bayham essential service provider within the quality management systems, provides the following quote: - Nevtro Sales Ltd. — supply and delivery of 20 new submersible wastewater pumps and 5 new mixers with a 12 month manufacture warranty = $375,231.17 +HST The Municipality has successfully worked with Nevtro Sales Ltd. during the first phase (2019) of wastewater pump replacements as well numerous water and wastewater projects over the past 15 years. Nevtro is an authorized water/wastewater pump dealer and service provider for many of the surrounding municipalities and counties as well as the Ontario Clean Water agency. Staff have found their service to be consistent with projects being completed on time and on or below budget. Staff respectfully recommend moving forward with Capital Item No. WW-02 to expedite the pump order and avoid increased costs as anticipated in the first quarter of 2020. RECOMMENDATION 1. The subject lands are designated "Agriculture" on Schedule "A" Land Use and "Hazard Lands" on Schedule "B" Constraints of the Official Plan and zoned Special Agricultural (A2) on Schedule "A" Map 2 in Zoning By-law No. Z456-2003. The purpose of this By-law is to allow for a site-specific Official Plan policy on a 27.6 ha (68 acre) parcel of land to permit the severance of a second surplus farm dwelling in the Official Plan of the Municipality of Bayham. The subject lands are located on the north side of Best Line, east of Somers Road known as 54728 and 54744 Best Line. The effect of this By-law will be to create two surplus farm dwellings from one original farm parcel. PUBLIC PARTICIPATION: As required by the Planning Act, the public meeting notice was circulated to all property owners within he required 120 metres distance, as well as, the required agencies and the County of Elgin. The public meeting was held on October 17, 2019 at the Municipal Council Chambers, 56169 Heritage Line, Straffordville, with the appointed Agent present. County of Elgin Manager of Planning preliminary comments were received by email on October 7, 8 and November 13, 2019. At the time of writing this report, no public comments have been received. DISCUSSION: Please reference the planner's memorandum dated October 30, 2019 as attached providing a complete analysis of the proposal. DS-74/19 Best Line Farms 2 The County planner provided preliminary comments including the County would have no objections to the proposed OPA provided a justification report is included to support the change. The County is of the opinion the PPS does not place a limit on surplus residences, however, the future severance must be as a result of farm consolidation. Staff confirmed with the Applicant's Agent that there have been no recent land acquisitions. Staff provides further reference to PPS Section 4.9 which states: the policies of this Provincial Policy Statement represent minimum standards. This Provincial Policy Statement does not prevent planning authorities and decision-makers from going beyond the minimum standards established in specific policies, unless doing so would conflict with any policy of this Provincial Policy Statement. This means that local municipalities are permitted to be more restrictive than the PPS and Bayham policies can restrict surplus residences to only one from an original farm parcel. Staff and planner recommend maintaining the OP policies in place and do not recommend approval of By-law 2019-095 adopting Official Plan Amendment No. 25 requesting a site-specific Official Plan Amendment to permit a second surplus dwelling lot for the reasons as outlined in the staff proposed draft recommendation. Staff appreciates that Council may determine the application meets the criteria and is consistent with land use planning policies and therefore, By-law 2019-095 adopting the Official Plan Amendment No. 25 is attached and a second recommendation is provided for Council's information. The proposed amendment,will request that Section 2.1,7.1 paragraph 3 be deleted as it applies to the subject lands.This policy limits the number of surplus dwelling severances permitted to only one.The applicant has severed one surplus dwelling from the farm and seeks to sever a second surplus dwelling. The subject lands are located at 54728 Best Line and, in the Bayham Official Plan,are designated Agriculture.These lands are zoned "A 1" in the Bayham Zoning By-Law Z456-2003. This report includes a review of the Provincial Policy Statement 2014, Elgin County Official Plan, Municipality of Bayham Official Plan and Bayham Zoning By-Law Z456-2003, as amended. 2.0 Site description and neighbouring land uses The subject lands are located on the north side of Best Line east of Corinth.The lands have a frontage of 369m and an area of 27.6ha.The lands grow asparagus and corn.The farm has a dwelling,garage and two implement sheds.The applicant severed a surplus dwelling from this farm in 2012. 3.0 Development Proposal The applicant proposes to sever the existing dwelling and garage as a surplus farm dwelling.This house is no longer required by the farm operation.The proposed lot containing a dwelling and a garage will have a frontage of 73m a depth of 73m and 67m and an area of 5162.5m2 (1.3ac).The retained farm parcel will have a frontage of 338m and an area 26.5ha (65.69ac). However, in order to comply with the policies of the Bayham Official Plan it will first be necessary to amend the Official Plan to permit a second surplus dwelling to be severed. 4.0 Policy Review 4.1 Provincial Policy Statement(2014) The Provincial Policy Statement guides land uses planning for the entire province and the policies are to be read in their entirety. Decisions regarding land use planning matters are to be consistent with the Provincial Policy Statement.The following is a review of pertinent polices for this development proposal. Page 7 IGS Clad 9 Planning Justification Report - Best Line Farms June 6, 2019 Should the proposed severance be approved it will be necessary as a condition of the severance of the proposed residential lot be rezoned Rural Residential (RR) and the retained lands be subject to a restriction that no new residential dwelling may be permitted on retained parcel. 5.0 Review Summary It is my professional planning opinion that the proposed official plan amendment to removed the restriction which permits only one surplus dwelling to be severed from a farm parcel is consistent with the policies of the PPS.While the municipality is within its jurisdiction to require additional criteria which must be met when considering the severance of a surplus farm dwelling i.e. dwelling must be at least 10 years old,applicant must own another dwelling within Bayham.With regard to the limitation on the number of surplus dwelling which may be severed, it does not,in my opinion,serve a purpose to limit the number of such severances as the dwellings do exist and will remain to be surplus to the needs of the farm operation.These dwellings are often rented to non-farm tenants or neglected and fall into disrepair. In my opinion, it is desirable to have the surplus dwelling severed and sold to an owner who will invest in the property and ensure the property is well maintained. It is for these reasons, I respectfully request that Council support this application on a site specific basis for an official plan amendment. The change is to the designation of 27.6 ha (68 acres) of land to permit two residential dwelling lots surplus to the consolidated farm operation. The subject lands are designated as"Agriculture"on Schedule"A" Land Use and"Hazard Lands"on Schedule "B" Constraints of the Official Plan of the Municipality of Bayham and are zoned Special Agricultural (A2) on Schedule"A" Map No. 2 in Zoning By-law Z456-2003. The subject lands are characterized as an irregularly shaped farm parcel bounded by a railway line to the north and comprises a residential dwelling, shed and barn. The lot frontage is 369 metres(1,210 feet)and the lot depth is 813 metres(2,667 feet). There is a ditch located diagonally crossing the field, more than 110 metres (360 feet)from the dwelling designated as hazard lands which are not affected by the proposed development. The residential property located at 54704 Best Line was created by way of consent E13/11 based on surplus farm dwelling severance and was severed from the original farm parcel. Subsequent Consent and Zoning By-law Amendment applications are proposed to facilitate the creation of a second surplus dwelling parcel. The parcel would comprise the existing dwelling, shed and private sewer and water services; with a lot area of 5162 m2 (1.3 acres), lot frontage and lot depth of 73 m (239 feet). Overview of Proposed Amendment The Provincial Policy Statement 2014 (PPS) sets out a maximum number of surplus dwellings. The policy states"a dwelling"which means one dwelling. In 2012 a surplus dwelling was severed from the subject lands. The Bayham Official Plan (OP) interprets farm consolidation in the PPS as recent acquisition of lands by the farm operation where the dwelling on the new lands is not needed or alternatively if a dwelling on previously acquired lands is surplus as a result of a dwelling on the new lands. The intent of PPS and Bayham OP lot creation and settlement area policies is to direct residential growth and lot creation to settlement areas for efficient delivery of services and to protect agricultural resources for the long-term. The agricultural land is protected by maintaining adequate lot areas with for viable agricultural operations on original farm parcels for the long-term and by discouraging residential uses which create land use conflicts with agricultural uses. The minor variance approval was based on the farm operation having 35-40 seasonal labours, some of which needing accommodation because there was not enough housing in the area or local labour to accommodate their needs. The applicant has now stated that they do not use the dwelling for seasonal farm labour because of labour being provided by persons with alternative accommodation in the area. The dwelling has the potential to serve future accommodation needs of the farm operation as agricultural practices can change quickly, for instance, this farm operations labour needs changed within two years. The subject dwelling should be kept by the farm operation in order to avoid undue lot creation to protect agricultural resources consistent with the applicable planning policies. IBI GROUP MEMORANDUM 3 Municipality of Bayham—October 30,2019 The following paragraphs constitute the relevant land use planning review and conclusion: 1. The Provincial Policy Statement 2014 (PPS) Section 2.3.4 sets out policies for lot creation in prime agricultural areas. Lot creation in prime agricultural areas is discouraged and may only be permitted for several reasons, including dwellings made surplus as a result of farm consolidation. Section 2.3.4 c) states that lot creation may only be permitted for: c. a residence surplus to a farming operation as a result of farm consolidation, provided that: 1. the new lot will be limited to a minimum size needed to accommodate the use and appropriate sewage and water services; and 2. the planning authority ensures that new residential dwellings are prohibited on any remnant parcel of farmland created by the severance... In 2012 the applicant severed a surplus farm dwelling from the lands, located at 54704 Best Line. The PPS policy states"a residence surplus to the farm operation" and a residence has been severed, therefore, a second severance is prohibited. The severed parcel has adequate lot area, however, the lands have been zoned to Special Agriculture specifically to prohibit new residential uses which is what is proposed. Section 2.3 Agriculture states that"prime agricultural areas shall be protected for long-term use for agriculture"and Section 2.3.4.1 states that lot creation in prime agricultural areas is discouraged. The subject lands generally consist of Class 3 CLI soils which are a prime agricultural soil type protected for long-term agricultural use. Section 2.3.3 Permitted Uses does not include residential. Based on previous surplus dwelling severance and discouraged lot creation to protect agricultural resources for long-term agricultural use the proposed consent is not consistent with the PPS. 2. Elgin County Official Plan (Elgin OP) Section E1.2.3 New Lots By Consent states that "Under no circumstances shall consents be granted for approval that are contrary to the policies of this Plan or the local Official Plan." The second surplus dwelling, no land acquisition and lot creation in rural areas is contrary to Bayham Official Plan. Section E1.2.3.4 Lot Creation on Lands in the Agricultural Area indicates that the intent of the Plan is to maintain and protect agricultural resources, direct the majority of new residential growth to settlement areas and that new lots may be permitted if the local Official Plan supports their creation. Subsection b) states that"a new residential use is prohibited" on retained farm parcels. The land use as a dwelling lot is a new residential use on a retained farm parcel. The severance is not consistent with the Elgin OP. 3. The Official Plan of the Municipality of Bayham Section 2.1.7 Farm Consolidation and Surplus Farm Dwellings states: "In accordance with the Provincial Policy Statement 2014, farm consolidation shall mean the acquisition of additional farm parcels to be operated as one farm operation. Farm consolidation may result in the identification of existing farm dwellings that are rendered surplus to the consolidated farm operation. Consents to sever and convey existing farm dwellings which were built and occupied a minimum of ten (10) years prior to the date of consent application, and which are surplus to a consolidated farm operation, may be permitted within the"Agriculture" designation in accordance with the following criteria: IBI GROUP MEMORANDUM 4 Municipality of Bayham—October 30,2019 In the opinion of Municipal Council, a land use conflict shall not be created with agricultural operations or other existing land uses in the immediate area of the subject lands; Where a farm parcel with more than one existing dwelling is being consolidated into a farm operation, only one dwelling may be severed from that farm parcel, and no more than one severance of a surplus dwelling shall be allowed from an original farm parcel regardless of changes in boundary or ownership; A minimum of one existing dwelling within the Municipality of Bayham must be retained by the proponent farm operation, or a registered owner of the proponent farm operation." There is no land acquisition justifying a severance and a second surplus farm dwelling is prohibited. The policy is in place to limit lot creation and residential uses in rural areas in order to protect agricultural resources for long-term use for agriculture. The dwelling is over ten years old, built in 1994, and the farm operation includes a principle dwelling at 54466 Best Line. The severed lands would be used for residential purposes under new ownership. The retained lands would comprise two barns with approximate floor area of 560 m2 (6,028 ft2). The nearest barn is 32 m (105 feet) from the dwelling. There is a grain handling facility, part of the farm operation, across Best Line within 215 m (705 feet). The proximity of the agricultural buildings may create minor land use conflict in the form of undue odour, dust or noise during the planting and harvest season. A second surplus farm dwelling is prohibited and there is no land acquisition, therefore, the proposed amendment is not consistent with the Official Plan. 4. The subject lands are zoned Special Agricultural (A2) on Schedule "A" Map No. 2 in the Municipality of Bayham Zoning By-law. The purpose of the A2 zone is to prohibit new dwellings as a result of a severance of a surplus farm dwelling. Section 6.2 Permitted Uses indicates that no land shall be used and no buildings or structures shall be erected, used or altered in the A2 zone except for Agricultural uses and Accessory Use. The A2 zone is utilized consistent to the PPS and Bayham Official Plan policies which limit lot creation in the rural areas to protect the agricultural resources of the Municipality. Permitted uses are agricultural uses and accessory uses, therefore, the proposed residential use is not in conformity to the Zoning By-law. 5. Based on our review of this application we do not recommend approval of the requested site- specific Official Plan Amendment to permit a second surplus dwelling lot. 6. BASIS OF THE AMENDMENT The subject lands are characterized as cultivated field with a ditch/creek crossing the site diagonally east to west, comprising a dwelling, shed and two barns. The purpose of the amendment is to permit, specific to the site, the creation of a second residential parcel, with an existing dwelling in existence for more than ten (10) years and the farm operation having a principle residence within the Municipality, surplus to the needs of the farm operation from the original farm parcel. There was a previous residential lot severance from the original farm parcel for an existing dwelling surplus to the needs of the farm operation, known as 54704 Best Line. The policies of the Bayham Official Plan Section 2.1.7 do not permit a second lot to be created, however, the Provincial Policy Statement (2014) (PPS) does not place a limit on surplus residences. In addition, the Bayham Official Plan indicates that the intent of PPS surplus farm dwelling polices that farm consolidation means the acquisition of new farm lands by the farm operation, however, the PPS does not include a definition for farm consolidation nor specifically requires a recent acquisition. The farm operation acquired the subject lands sometime before 2012 and no other lands were added recently. Changes to the type of crop being grown have changed the accommodation and labour needs of the farm operation. 4. DETAILS OF THE AMENDMENT a) Section 2.1.7 of the Official Plan of the Municipality of Bayham is hereby amended by adding the following sub-section: 2.1.7.6 Notwithstanding Section 2.1.7.1 c), the dwelling located in Part S%, Lot 9, Concession 10, and known municipally as 54728 Best Line, may be severed as a surplus farm dwelling, whereas the lot created represents the second surplus farm dwelling severance from the original farm parcel known municipally as 54744 Best Line. We also know that each municipality is unique, and one size does not fit all. This approach is reflected in a number of announcements that we have made recently, which are summarized below. Regional Government Review After careful consideration of the feedback we heard through the course of the Regional Government Review that was launched in January 2019, and in consultation with my Cabinet colleagues, our government is committed to partnering with municipalities without pursuing a top-down approach. We will work collaboratively and in partnership, and we will not impose any changes on municipalities. Renewal of funding programs to identify efficiencies The government has announced $143 million in funding for municipalities across the province to help lower costs and deliver important services to residents over the long term. The new programs include: Audit and Accountability Fund o We will extend funding for 39 large urban municipalities, by providing up to $6 million annually for three years beginning in fiscal year 2020-21. More information on the application process will follow in the coming months. Municipal Modernization Program o Building on Ontario's previous investment to modernize municipal service delivery, 405 small and rural municipalities will have access to an application- based program, which will provide up to $125 million until 2022-23. The first round of funding under this program will be available in the current provincial fiscal year to support service delivery reviews, similar to the types of reviews eligible under the Audit and Accountability Fund. Details on eligibility and application process for this year's funding are coming soon. ...12 2 Municipal Fiscal Year The government is committed to consulting with the municipal sector in 2020 on the alignment of the municipal fiscal year with the Province's. We believe municipalities will be able to provide valuable input regarding how the current budget cycles affect funding allocations for their programs — and if aligning the municipal and provincial budget cycles could enhance public transparency and improve program and service delivery. Voters' List Our government is also proposing to work with Ontario's Chief Electoral Officer to eliminate duplication by combining the provincial and municipal voters' lists and giving Elections Ontario the responsibility of managing one voters' list. Ontario Municipal Partnership Fund In addition, I would like to highlight that the Minister of Finance recently sent out letters to all Heads of Council regarding the 2020 Ontario Municipal Partnership Fund (OMPF) allocations. This is the earliest that OMPF allocations have ever been announced. As indicated in that letter, the government is maintaining the current structure of the OMPF for 2020. The delegation included the site map attached hereto as Appendix 'A'. DISCUSSION As per the direction of Council, staff have reviewed the proposal and provide the following implementation considerations for Council consideration: ADMINISTRATION • The Municipal Insurer would need to be contacted to add a use and service to the Municipal Insurance Policy which would include a premium increase. CAPITAL CONSIDERATIONS • Callidus Engineering provided technical expertise to outline electrical service considerations. • The provided site map required amendments to comply with Electrical Safety Authority (ESA) and Ontario Electric Safety Code (OESC) requirements. A modified site map is attached hereto as Appendix `B'. o Option 1: Incoming service is to run underground off Sandytown Road, to a utility owned pad mounted 75kVA transformer that will feed the 400A distribution circuit breaker panel which will then feed the different electrical posts throughout the site. o Option 2: Incoming service is to run underground off Sandytown Road to a utility owned 50 kVA transformer closer to the rear ball diamond, and daisy chained to feed a second 30kVA transformer located near the pavilion/play area. A fused disconnect, meter base and distribution panel is required for each transformer if this option is selected. • The preliminary estimated capital cost to construct and implement the electrical system is $240,000-$360,000 depending on the option selected. The system would have ongoing utility expenses to be accounted for in the Operating Budget. o The subsurface electrical service would have a limiting impact on the public use of the Straffordville Community Centre grounds. • The current electrical site servicing is insufficient for the proposed use. • Temporary above ground electrical system designs are not accepted by the ESA or OESC Section 72. DEVELOPMENT SERVICES • The subject lands are used for community park and institutional (Municipal Office) uses. The park/open space is used for recreational activities, such as youth sports and events, and active and passive recreation. This is the only community park in Straffordville. • Official Plan Section 4.5.8 Open Space includes policies on Open Space use. The primary use shall be for community parks, conservation areas, fairgrounds, etc. and secondary uses include buildings, structures and parking areas for accessory or complementary use to the primary uses. o The primary use of the subject lands is community park and there are existing accessory/complimentary uses— baseball diamond, structures (utility building and pavilion) and parking. • Section 4.5.8.6 policy states, "the Municipality will ensure that adequate, safe neighbourhood parks are provided to serve the areas in the residential designation." FIRE DEPARTMENT • An access plan and routes would need to be established for emergency services. MUNICIPAL LAW ENFORCEMENT • A number of regulatory by-laws would require consideration of alteration including: o Public Parks & Recreation Area By-law o Fire (Burning) By-law o Municipal Alcohol Policy o Noise By-law o Rates & Fees By-law (Rental Contract) PUBLIC WORKS&OPERATIONS • The Straffordville Community Centre grounds is susceptible to rutting from vehicles. o How does the Municipality intend to maintain the Straffordville Community Centre grounds for the public use of the same? PARKS & RECREATION • The Municipality currently has reoccurring league use of the Straffordville Community Centre grounds on Monday, Thursday and Friday along with rentals of the specific diamonds and pavilions throughout the week. o How does this proposal work in conjunction with the public use of the Straffordville Community Centre grounds? • The Municipality would require an employee or contractor to supervise the area and use. WATER/WASTEWATER • Wastewater dump station would require significant capital investment and amendment of the Municipality of Bayham Wastewater Environmental Compliance Approval (ECA) o The Municipality currently has a septage receiving station and rates for the same at the Wastewater Treatment Plant. o A wastewater dump station installed in Straffordville would require appropriate protections, as it is a waste transfer station. o A wastewater pump truck station would require appropriate protections, as it is a waste transfer station. • The Straffordville Community Centre does not have available on site potable water. • The Straffordville Community Centre does not have sufficient non-potable water on site. Although some of the considerations may seem over-burdensome when considered in the context of a Tri-County Travellers use, the Bayham Campground in theory would be utilized by a variety of users. Tri-County Travellers have outlined a number of benefits of the proposed Bayham Campground Use. The Straffordville Community Centre grounds present a number of considerations for Council. The difference between the Straffordville Community Centre location and the other locations noted by the Tri-County Travellers is the lack of open fairground type lands in Straffordville. The Straffordville Community Centre lands are very much multi-use, multi- purpose. RECOMMENDATION 1. THAT Report CAO-61/19 re Bayham Campground Proposal be received for information. The Investing in Canada Plan is commonly known as Infrastructure Phase 2. Under Infrastructure Phase 1, Infrastructure Ontario approved more than 2,000 projects worth more than $1.6 billion in Ontario. This includes the Clean Water Wastewater Fund (CWWF) Port Burwell Storm Sewer Phase 1A project completed in 2017. The stated goals of the Investing in Canada Infrastructure Program (ICIP) includes: • Faster commute and travel time for more people, and easier movement of goods for businesses • Cleaner air and water • Reduced greenhouse gas emissions • Smarter and more efficient cities • Sustainable water management • Enhanced public parks, recreational facilities and other spaces that make communities great places to live • Better transportation and digital infrastructure for people living in remote communities • Increased energy security and reduced reliance on diesel in the North The Canada Infrastructure Program has four (4)funding streams: Public Green Community Culture Rural & Northern Transit Infrastructure & Recreation Community Federal $8.3 billion $2.8 billion $407 million $250 million Provincial I $6.8 billion I $2.3 billion I $335 million I $206 million DISCUSSION INVESTING IN CANADA INFRASTRUCTURE PROGRAM (ICIP)—GREEN INFRASTRUCTURE STREAM On October 25, 2019, the Province of Ontario Minister of Infrastructure launched the Investing in Canada Infrastructure Program (ICIP) — Green Infrastructure Stream. The ICIP Green Infrastructure Stream objective is to address critical health and safety issues associated with water, wastewater and stormwater infrastructure. Project eligibility will be assessed using an outcomes-based approach. Eligible projects must meet one of the following federally determined project outcomes : • Increase capacity to treat and/or manage wastewater and stormwater • Increase access to potable water ICIP Green Infrastructure Stream applications are due by January 22, 2020. The ICIP Green Infrastructure Stream funding allocation model is as follows: Investing in Canada Infrastructure Program (ICIP) Green Infrastructure Stream Funding Share Federal Provincial Municipal 40% (Max.) 33.33% (Max.) 26.67% (Min.) ICIP Green Infrastructure Stream applications must also satisfy the following requirements: CRITERIA 1 —INITIAL TECHNICAL REVIEW • Ontario will conduct a scope, eligibility and technical review of all applications. Projects must meet eligibility requirements and must be technically viable, and achievable in the project timeline noted. CRITERIA 2 -CRITICALITY OF HEALTH AND/OR SAFETY RISK • Critical health and safety aspects of a project will be evaluated based on technical assessment criteria used for each project type relative to industry standards. • Projects with multiple components will be assessed based on their primary project type o Drinking Water Projects Human health and/or safety issues related to water systems will be assessed within the framework of the standards, policies and requirements of the Ministry of the Environment, Conservation and Parks. Aspects that may potentially pose a threat to public health and/or safety, and their critical and imminent levels will be assessed. Project assessment criteria include those related to provincial standards, policies, and the health and safety condition of drinking water assets. o Wastewater and Stormwater Projects Human health and/or safety issues (including continuity of service) related to wastewater and stormwater systems will be assessed within the framework of the standards, policies and requirements of the Ministry of the Environment, Conservation and Parks. Aspects that may pose a threat to public health and/or safety and/or environmental protection will be assessed, along with their relative scale, severity and likelihood, will be assessed. Project assessment criteria include those related to containment of pollutants/sewage, wastewater system failures, and the meeting of specific MECP standards. CRITERIA 3 -FUNDING NEED • Projects will be assessed according to their relative funding need, including the cost of the proposed project per person served by the organization's water/wastewater services, as well as median household income and weighted property assessment per household. Following assessment of the ICIP — Green Infrastructure Stream guidelines and application and the Municipality of Bayham Capital Budget staff have identified the Port Burwell Storm Sewer Phase 1 C/D (Brock St., Erieus St. — south end to Wellington St.) project for Council consideration and direction. ONTARIO COMMUNITY INFRASTRUCTURE FUND-TOP-UP PROGRAM On September 7, 2017, the Council of the Corporation of the Municipality of Bayham passed the following resolution: THAT Report CAO-61/17 re Infrastructure Grant Applications be received for information; AND THAT staff be directed to make application to the Federation of Canadian Municipalities (FCM) — Municipalities for Climate Innovation Program (MCIP)for Substage 1A of the Port Burwell Storm Sewer System works; AND THAT staff be directed to make application to the Ontario Community Infrastructure Fund — Top-Up Program for Substage 1C and Substage 1D of the Port Burwell Storm Sewer System works; On March 14, 2019, the Province of Ontario Minister of Infrastructure announced the 2018 and 2019 OCIF Top-Up Application Grant Program was canceled. The OCIF Top-Up Program was $100,000 million annually. In the correspondence from the Minister of Infrastructure, the following statement was made concerning applications under the 2018 OCIF Top-up Program: Projects that were submitted to the 2018 top-up application intake were reviewed and evaluated based on the criteria outlined in the program guidelines. While no funding will be provided through the 2018 OCIF application intake, it is our intent to nominate a number of road and bridge projects— that would have been successful under the program— for federal funding under the Rural and Northern stream on an accelerated basis. The Municipality of Bayham Port Burwell Storm Sewer Phase 1 C/D was not nominated for the Investing in Canada Infrastructure Program (ICIP) — Rural & Northern stream, as stormwater projects were not eligible under the Rural & Northern Stream. Council provided staff direction to write the Minister of Infrastructure and advocate for the Municipality of Bayham Port Burwell Storm Sewer Phase 1 C/D, submitted under the 2018 OCIF Top-up Program, to be nominated by the Province for the Investing in Canada Infrastructure Program (ICIP) — Green Infrastructure Stream. The Province has chosen not to nominate 2018 OCIF Top-Up projects for the ICIP — Green Infrastructure Stream. On October 1, 2019, the Council of the Corporation of the Municipality of Bayham passed the following resolution: THAT Report TR-13/19 re 2020-2029 Capital Budget- Draft be received for information; AND THAT Council approve in principle the 2020-2029 Capital Budget. Specifically,the work is to evaluate the risk management services offered by each proponent and the accompanying risk financing options provided through insurance coverage. The analysis compared each Proponent's response to assess how their proposed services,types of insurance coverage, and quoted premiums compare with one another. While the total annual premium is important,so too is the availability of qualified broker personnel and assigned employees who have familiarity with the needs and operating culture of local municipalities. All three proponents met these criteria. This report finds that two proponents, Frank Cowan Company and JLT score very closely overall in terms of experience,expertise and breadth of services and coverage. However,the premium offered by Marsh/JLT is lower that Cowan by$34,879 (23%).This difference results in Marsh/JLT being the preferred proponent. Scope of Work The scope of the work was to review and advise on the draft Request For Proposal document. Once the responses were received, a review of the services, insurance offered and premiums would be completed and a draft report be supplied for approval. Following acceptance, references would be checked for the two closest-ranking respondents. Upon completion of the final proposals ratings the report would be finalized and submitted for approval. Numerical rating of each proponent was completed using the formula described in the RFP. The work included development and completion of a spreadsheet to compare coverage,services and fees proposed by each Proponent. Every reasonable effort has been made to ensure accuracy and validity in this report. Should inadvertent errors or omissions be found appropriate adjustments will be made promptly, if requested within thirty(30) days,at no additional cost to Bayham. The scope of work does not include: • Identification and analysis of exposures; • Review and evaluation of historical claims information; • Insurance advice or coverage recommendations; • Review of Bayham's internal processes,controls and resources or contracted services allotted to risk and insurance management. Proposals Received Three proposals were received from the following firms: • BFL Canada • Frank Cowan Company • Marsh/JLT Canada All three Proponents have extensive risk management and insurance representative experience.All proposals included both insurance coverage and risk management services. Services varied by 2 Cunnart Associates November,2019 Proponent and include, but were not limited to, insurance procurement, property inspections and appraisals, risk management and insurance training for municipal employees and claims handling/ oversight. Overall,the services offered were substantially similar. Note:The proposals were not reviewed for receipt by the due date or that the form of proposal met the Bayham's requirements. Project Length The project was required to be completed within the required time frame.Time did not permit a detailed review of current or optional insurance or risk management proposals submitted by the Proponents. Differences Considered Ultimately,the number of types of services and coverages available result in some proponents being a better'fit' in some areas, but less so in others.The key is to select the proponent that provides the best overall combination of professional, responsive service and insurance coverage for the most likely categories of losses. Some key differences in the two proposals were noted for comparison clarity. Proposal Scoring The table below sets out the final scoring for the two leading Proposals.The Proponent awarded the contract will hold overall accountability for providing quality insurance and risk management services. The insurance and risk management services offered by the proponents were similar but not identical. Only Frank Cowan Company offered a price guarantee for two years on most insurance policies. Chief Building Official (CBO) Knifton has highlighted this fact in the quarterly building department reports. As part of the Municipality of Bayham Official Plan Review the municipality updated its developable lot inventory, being the amount of privately owned developable lands within hamlet areas. DISCUSSION Lower-tier municipalities within Elgin County have previously utilized the Elgin County Economic Development Department to communicate information to the development community concerning the availability of privately owned developable lands. The Eglin County Economic Development Department has been able to provide information to: • The St. Thomas Elgin Homebuilders Association • London St. Thomas Association of Realtors (LSTAR) • Conferences & Trade Shows As a member of the South Central Ontario Region Economic Development Corporation (SCOR) the Municipality of Bayham has access to another information dispersal mechanism. Staff, with the assistance of IBI, have compiled a database of information on privately owned developable lands with accompanying mapping. The database clearly outlines information about the subject lands and the main requirements to develop the subject lands. The mapping compliments the database. Engineer Report No.218291, dated November 1, 2019 and attached hereto, is hereby adopted and the drainage works as therein indicated and set forth are hereby authorized and shall be completed in accordance therewith. 2.1 The Corporation of the Municipality of Bayham may borrow, on the credit of the Corporation, the amount of$83,000.00 being the amount necessary for the drainage works or other tendered and awarded amount by Council. 2.2 The Corporation may arrange for the issue of debentures on its behalf for the amount borrowed less the total amount of, (a) grants received under Section #85 of the Act; (b) commuted payments made in respect of lands and roads assessed within the municipality; (c) monies paid under Subsection #61(3) of the Act; and monies assessed in and payable by another municipality, and such debentures shall be made payable within five (5) years from the date of the debenture and shall bear interest at the rate established by the Ontario Ministry of Agriculture, Food and Rural Affairs pursuant to the Tile Drainage Act as of the date of passing of this By-law. By-law No. 2019-093 A special equal rate sufficient to redeem the principal and interest on the debentures shall be levied upon the lands and roads as set forth in the attached Schedule "A" to be collected in the same manner and at the same time as other taxes are collected in each year for five (5) years after the passing of this by-law. 4. For paying the amount of$0 being the amount assessed upon the lands and roads belonging to or controlled by the municipality, a special rate sufficient to pay the amount assessed plus interest thereon shall be levied upon the whole rateable property in the Municipality of Bayham in each year for five (5) years after the passing of this Provisional By-law to be collected in the same manner and at the same time as other taxes are collected. 5. All assessments of $500.00 or less are payable in the first year in which the assessment is imposed. 6. PURPOSE The purpose of the Official Plan amendment is to change the land use designation for 27.6 ha (68 acres) of land to permit the creation of a second residential lot surplus to the farm operation from the original farm parcel in the Official Plan of the Municipality of Bayham. 2. LOCATION The area affected by this amendment is a farm parcel in an agricultural area, bounded by a railway line to the north, located on the north side of Best Line, west of Somers Road and known municipally as 54728 and 54744 Best Line. 3. BASIS OF THE AMENDMENT The subject lands are characterized as cultivated field with a ditch/creek crossing the site diagonally east to west, comprising a dwelling, shed and two barns. The purpose of the amendment is to permit, specific to the site, the creation of a second residential parcel, with an existing dwelling in existence for more than ten (10) years and the farm operation having a principle residence within the Municipality, surplus to the needs of the farm operation from the original farm parcel. There was a previous residential lot severance from the original farm parcel for an existing dwelling surplus to the needs of the farm operation, known as 54704 Best Line. The policies of the Bayham Official Plan Section 2.1.7 do not permit a second lot to be created, however, the Provincial Policy Statement (2014) (PPS) does not place a limit on surplus residences. In addition, the Bayham Official Plan indicates that the intent of PPS surplus farm dwelling polices that farm consolidation means the acquisition of new farm lands by the farm operation, however, the PPS does not include a definition for farm consolidation nor specifically requires a recent acquisition. The farm operation acquired the subject lands sometime before 2012 and no other lands were added recently. Changes to the type of crop being grown have changed the accommodation and labour needs of the farm operation. 4. DETAILS OF THE AMENDMENT a) Section 2.1.7 of the Official Plan of the Municipality of Bayham is hereby amended by adding the following sub-section: 2.1.7.6 Notwithstanding Section 2.1.7.1 c), the dwelling located in Part S%, Lot 9, Concession 10, and known municipally as 54728 Best Line, may be severed as a surplus farm dwelling, whereas the lot created represents the second surplus farm dwelling severance from the original farm parcel known municipally as 54744 Best Line. The lands subject to this Amendment and designated "Agriculture" may be used, developed and zoned in accordance with surplus farm dwelling policies of Section 2.1.7 of the Official Plan, as amended.
