A. Ontario Trillium Fund — Port Burwell Pavilion
Mr. Peter Fleming, Ontario Trillium Foundation, Grant Review Team provided comments
regarding the Ontario Trillium Foundation grant which assisted with the construction of the
new Port Burwell Pavilion then presented the Ontario Trillium Foundation plaque to the
Municipality. Comments from MPP Jeff Yurek were read by the CAOICIerk. Mayor
Ketchabaw and Deputy Mayor Weisler made statements of appreciation.
B. Mayor Ketchabaw advised the Armistice Day Service will be held at Memorial Park in
Vienna November 10, 2019 at 11:00 a.m. The Armistice Day Parade will be held in Port
Burwell November 10, 2019 at 1:30 followed by a service at the Cenotaph.

1. Application be amended to reduce the parcel size to include the stucco garage
and dwelling only, whereby meeting the intent of the Provincial Policy Statement
and the Official Plan lot creation policies limiting lot size to no larger than
necessary to support private sanitary sewage treatment and disposal systems
and a potable water supply
2. Rezoning to Remove the Holding (h2) Zone Provision on the severed parcel

THAT Staff Report DS-67/19 regarding the Zoning By-law Amendment for John Fehr be
received for information;
AND THAT pursuant to Planning Act Regulations Bill 73 Smart Growth for our
Communities Act, 2015, it be pointed out that at the first public participation meeting
associated with this application held November 1, 2018, no verbal and one written
submission was received; at the second public participation meeting held December 20,
2019, no verbal and one written submission was received; and at the third public
participation meeting held October 3, 2019, no verbal and no written submissions were
received and that all considerations regarding this matter were taken into account in
Council's decision passing this resolution;
AND THAT Zoning By-law Z456-2003, as amended, be further amended by changing the

1. The proposal to sever the 1.92 ha parcel be deferred as it does not meet the
intent of the PPS 2014, Elgin County Official Plan and Municipality of Bayham
Official Plan and is considered to be premature at this time to sever the land
zoned with a Holding Provision that requires a Plan of Subdivision.

Mayor Ketchabaw called the public meeting to order at 7:30 p.m. and asked those in
attendance for this Planning Public Meeting regarding a Zoning By-Law Amendment
application by Antonia Van Leeuwen and Best Line Farms Ltd. to place their name and contact
information on the sign-in sheet provided at the podium.
2. DISCLOSURES OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF
No disclosures of pecuniary interest were declared.
3. CHAIRMAN'S REMARKS ON THE PURPOSE OF THE MEETING
The Chairman stated the purpose and effect of the proposed amendment.
4. PURPOSE AND EFFECT OF THE PROPOSED AMENDMENT
A. Application submitted by Antonia Van Leeuwen and Best Line Farms Ltd.
The purpose of the public meeting is to consider an application to allow for a site-
specific Official Plan policy on a 27.6 ha (68 acre) parcel of land to permit the
severance of a second surplus farm dwelling in the Official Plan of the Municipality of
Bayham. The subject lands are located on the north side of Best Line, east of Somers
Road known as 54728 and 54744 Best Line.
The effect of the by-law will be to create two surplus farm dwellings from one original farm
parcel.

5. PUBLIC PARTICIPATION
Dave Roe, agent for the applicant provided background information referencing the Provincial
Policy Statement and Municipality of Bayham Official Plan regarding surplus dwelling policies.
In response to questions from Council, Deputy ClerklPlanning Coordinator M. Underhill advised
the Provincial Policy Statement requires restrictive A2 zoning on the retained lands. She also
advised that Council previously supported an Official Plan Amendment for one surplus dwelling
for a landowner not owning an additional residence in the Municipality of Bayham and that the
Best Line application is a different amendment requesting a second dwelling be severed from
the same parcel.

Pursuant to Chapter D17, Section 41 of the Drainage Act the purpose of the public meeting
is to consider the proposed reconstruction, incorporation and extension of parts of the
Chalk Municipal Drain as outlined in the Chalk Drain Engineer's Report#218290 dated
September 17, 2019 as prepared by Spriet Associates

Engineer John Spriet provided an overview of the design of the drain.

Mr. Albert Assel questioned the reason for the location of the drain being on the north side of
the road. John Spriet explained this is to keep consistency with the existing drain.

THAT in accordance with Sections 44 to 46 of the Drainage Act, Council of the Corporation of
the Municipality of Bayham hereby adopts Spriet Associates report#218290 dated September
17, 2019, referred to as the "Chalk Drain" report;
AND THAT Provisional By-law No. 2019-085 be given first and second reading;
AND THAT the Clerk be directed to distribute copies of the Provisional By-law and Notice of
the time and place of the first sitting of the Court of Revision to the affected parties pursuant to
Section 46 (2) of the Drainage Act;
AND THAT a date of November 7, 2019 at 8:00 p.m. be set for the first sitting of the Court of
Revision.

attendance for the Public Meeting regarding the Vienna Line Drain to place their name and

6. PUBLIC PARTICIPATION
Mr. Brad Valko inquired about lot grading /drainage plans in regard to the newer homes on
Centre Street. Mr. Valko also questioned the limits of the watershed and topography within the
watershed.
Mr. Dave Racz questioned the depth and location of the drain as well as the benefit to his land.
Mr. Racz commented regarding the impact to his agricultural land and questioned alternative
design considerations.
Mr. Dylan McCormick commented that water ponds on the property and the ditch floods at the
corner of Vienna line and Centre Street.
Drainage Superintendent, B. Knifton and Engineer John Spriet provided comment regarding
drainage plans for the Centre Street homes and the reasoning and background behind the
design of the drain.
7. CORRESPONDENCE
One piece of correspondence was received which was included with the Staff Report.
8. DISPOSITION

THAT in accordance with Sections 44 to 46 of the Drainage Act, Council of the Corporation of
the Municipality of Bayham hereby adopts Spriet Associates report#218145 dated September

AND THAT Provisional By-law No. 2019-086 be given first and second reading;
AND THAT the Clerk be directed to distribute copies of the Provisional By-law and Notice of
the time and place of the first sitting of the Court of Revision to the affected parties pursuant to
Section 46 (2) of the Drainage Act;
AND THAT a date of November 7, 2019 at 8:00 p.m. be set for the first sitting of the Court of
Revision."

Law No. Z693-2019 on the 17th day of October 2019 under Section 34 of THE PLANNING ACT.

THE PURPOSE of this By-law is to change the zoning regulations for a 10,460 m2 (2.5 acres)
parcel of land from a Hamlet Residential (HR) Zone to a site-specific Hamlet Residential (HR-9)
to permit the operation of a water extraction and delivery business accessory to the primary
residential use; to permit the construction of an oversized accessory building with a floor area of
111.5 m2 (1,200 ft2) where 75 m2 (807 ft2) is the permitted maximum for accessory use; and to

accessory building. The subject lands are located at 54303 Eden Line, south side, east of
Culloden Road, in the hamlet of North Hall.
THE EFFECT of this By-law will allow the operation of a water extraction and delivery business,
subject to a valid Permit To Take Water from the Ministry of the Environment, Conservation and
Parks and to permit an oversized accessory building to accommodate the use.
ONLY INDIVIDUALS, CORPORATIONS AND PUBLIC BODIES may appeal a by-law to the
Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated
association or group. However, a notice of appeal may be filed in the name of an individual who
is a member of the association or the group on its behalf.

Dear Head of Council:
We are writing to announce the release of the 2020 Ontario Municipal Partnership
Fund (OMPF) allocations.
As communicated by the Premier at the Association of Municipalities of Ontario (AMO)
conference, the government is maintaining the current structure of the OMPF for 2020.
This means the program is the same as it was in 2019, while allowing for annual data
updates and related adjustments.
We have been listening to municipalities and have heard that you need information
early to allow time to plan for your budgets. That is why we are announcing allocations
now— the earliest that OMPF allocations have ever been announced.
Consistent with prior years, Transitional Assistance will ensure that the 2020 funding
guarantee for municipalities in northern Ontario will be at least 90 per cent of their
2019 OMPF allocation and for municipalities in southern Ontario will be at least
85 per cent of their 2019 OMPF allocation.
Northern and rural municipalities with the most challenging fiscal circumstances will
continue to have their guarantee enhanced up to 100 per cent of the prior year's
allocation.
As in prior years, Transitional Assistance continues to adjust in 2020 as fewer
municipalities require this funding. Consequently, the 2020 OMPF will provide a total
of $500 million to 389 municipalities across the province.
The Ministry of Finance's Provincial-Local Finance Division will be providing your
municipal Treasurers and Clerk-Treasurers with further details on the 2020 OMPF.

I am writing to inform you about the upcoming introduction of the new Ontario Electricity
Rebate (OER) on November 1, 2019. The Ontario government has made several
regulatory changes as part of the transition away from Global Adjustment (GA)
Refinancing under the previous government's Fair Hydro Plan to the new, more
transparent on-bill rebate. These changes include amendments to Ontario Regulation
363/16 made under the Ontario Rebate for Electricity Consumers Act, 2016.
The transition to the OER is a key part of the government's commitment to strengthen
transparency, accountability and fiscal responsibility in the electricity sector and respond
to the recommendations of the Auditor General of Ontario.
The OER will replace the 8% rebate and the reduction previously provided through
Regulated Price Plan (RPP) rates, as well as the GA reduction that was provided to
consumers not participating in the RPP. As a result, the Electricity line on bills will rise,
the OER will provide an increased percentage rebate, and the average residential bill will
increase in line with inflation.
Consumers that were previously eligible for the 8% rebate will be eligible for the OER
including low-volume consumers such as households and small businesses, as well as
farms, certain long-term care homes, and certain larger multi-unit complexes that are
primarily residential (i.e. where at least 50% of the units are "qualifying units" as defined),
such as apartment buildings and condominiums (see section 1.1 (1) 5 of O. Reg. 363/16
as amended).

Under the new rules, certain larger multi-unit complexes that are not primarily residential
(as contemplated above), and certain types of multi-unit complexes (see section 1.1 (2)
of O. Reg. 363/16 as amended), are not eligible for the OER. This includes, but is not
limited to:
• hotels, motels or motor hotels, resorts, lodges, tourist camps, cottages or cabin
establishments, inns, campgrounds, trailer parks, tourist homes, bed and breakfast
vacation establishments or vacation homes;
• hospitals (as defined under O. Reg. 363/16, as amended);
• living accommodations occupied by a person for penal or correctional purposes,
or premises that are subject to the Ministry of Correctional Services Act or the
Child, Youth and Family Services Act, 2017;
• short-term living accommodations provided as emergency shelter;
• universities, colleges of applied arts and technology or other entities that provide
post-secondary education; and
• premises that are identified by a NAICS code commencing with digits 21, 22, 23,
31, 32 or 33.
However, consumers that were receiving the 8% rebate on October 22, 2019 but are not
eligible for the OER will nevertheless receive the OER until October 31, 2020 if they meet
the new notice requirements set out in section 1.3 of O. Reg. 363/16 (as amended) before
February 1, 2020. If they don't meet those notice requirements, they will receive the OER
until January 31, 2020 (see section 1.2 (2) of O. Reg. 363/16 as amended).
Additional new notice requirements are also being introduced for certain larger multi-unit
complexes that are eligible under the new rules (see section 1.3 of O. Reg. 363/16 as
amended). These notices are due to Local Distribution Companies (LDCs) before
February 1, 2020 (see section 1.1 (4) of O. Reg. 363/16 as amended).
Consumers with inquiries regarding their eligibility or notice requirements should be
directed to their LDC.

Authority (LPRCA) approved our new 2019 — 2023 Strategic Plan.
The Strategic Plan is a result of consultation with our Board of Directors, staff, municipal
partners, and the public who are equally committed to protecting the Long Point Watershed.
These meaningful contributions will set forth the tone for the next five years and provide
lasting benefits for current and future generations.
As we move forward over the next five years this plan will provide both a blueprint and
roadmap to build on and enhance all facets of our organization. It guides us, yet provides
enough flexibility to meet the changing environment. The goal of this plan is to have a

Long Point Region Conservation Authority (LPRCA) is a special purpose environmental body
that works in partnership with the provincial and federal governments, our eight member
municipalities and the community to protect, restore and manage the natural resources and
features in the Long Point Region Watershed.
LPRCA is one of 36 Conservation Authorities in Ontario and was formed in 1971 as a result
of the amalgamation of the Big Creek Region (1948-1970) and Otter Creek Conservation
Authorities (1954-1970). We provide quality of life and value-added services to residents
through our programs including watershed management, erosion control and mitigation, flood
forecasting and warning, recreation, water quality and quantity monitoring, plan input and
review, environmental education and stewardship. As a leader in environmentally-sustainable
practices and responsible stewardship, we look forward to strong continued collaborations to
achieve the objectives of our Strategic Plan.

WATERSH :•
The Long Point Region Watershed is home to approximately 98,000 people and covers an area
of 2,782 square kilometres. Our Watershed encompasses the entire Municipality of Bayham
and the Town of Tillsonburg; most of Norfolk County; and portions of Haldimand County, the
County of Brant, the Township of Norwich, and the Townships of Malahide and South-West
Oxford.
The Long Point watershed is situated on the north shore of Lake Erie and is part of the Lake
Erie Water Basin. The watershed is made up of six main sub-watersheds areas: Big Otter
Creek, South Otter/Clear Creek, Big Creek, Dedrick/Young/Hay Creek, Lynn River/Black Creek,
and Nanticoke/Sandusk/Stoney Creek. The Watershed is drained by more than 30 creeks and
tributaries with 225 kilometres of Lake Erie shoreline. LPRCA owns over 11,000 acres of land
that includes 13 water-control structures and five conservation areas with campgrounds.
The Long Point Region Watershed falls within the Deciduous Forest Region of Canada also
known as the Carolinian Forest Zone. There are significant pockets that include species such
as the Tulip Tree, Black Gum, Sassafras, Flowering Dogwood and Cucumber Tree. These tree
species are rare in Canada and occur naturally only in southern parts of Ontario, north of
Lake Erie. There are 85 species at risk found in the Long Point Region watershed, including 14
reptiles and amphibians, 30 birds and insects, 14 fish and mollusks, 23 plants and mosses, and
4 mammals.
Our watershed is diverse. It contains varied natural landscapes, ecosystems and natural areas,
which supports a rich biodiversity that provides the foundation for a healthy watershed. LPRCA
works with our municipal partners, stakeholders, as well as an actively engaged community
who contribute to support the development of a thriving, resilient, and economically
sustainable watershed.

LPRCA fulfills its mandate under the Conservation Authorities
Act to protect people and property from flooding and other
natural hazards, and to conserve natural resources for
economic, social and environmental benefits. This direction
ensures our communities are protected and remain resilient.

Flood Hazard Mapping and Risk Assessment
Long Point Region Conservation Authority (LPRCA) has ..
initiated a project to update and create new flood hazard Project Study Areas Wtmapping focused on flood-vulnerable communities within
its watershed. Accurate floodplain mapping is required to
support land use planning and permitting decisions, flood- 4Z
related emergency response and mitigation planning in at- / W 1

will be available to answer questions relating to the project.
The scope of this project is limited to updating the hazard mapping using current technology and
resources. Updates to policies and plans are not included in the scope of this project. Public consultation
requirements for any resulting amendments to the regulated area of Ontario Regulation 178/06 made
under the Conservation Authorities Act will be met by the PICs.
Project comments and input provided at a PIC will be maintained on file for use during the study and may
be included in study documentation.

The Manager of Planning presented the report outlining the Provincial
Government's proposed policy changes to the Provincial Policy Statement in order

Housing Supply and Mix, B)Protecting the Environment and Public Safety, C)
Reducing Barriers and Costs, D)Supporting Rural, Northern and Indigenous
Communities, and E)Supporting Certainty and Economic Growth.

Government of Canada's top-up funding received by the County be designated in
the County's 2020 capital budget to fund the King George VI Lift Bridge
Rehabilitation Project.

designated in the County's 2020 Capital Budget to fund the King George VI Lift

maintained while Bill 88, Planning Amendment Act, 2019 is under consideration;
and that staff prepare a follow-up report which includes legal opinion as to
potential repercussions on repealing the County's current policy not to accept
unsolicited lands to accommodate Land Division Consent applications, as well as
a legal opinion and report which considers an exemption for Notice of Application

optional 75%tax reduction in the Small-Scale On-Farm Business Sub-Class
introduced by the province be included in the 2020 budget deliberations.The
intent of this provincial initiative is to provide sustainable property tax treatment to

WHEREAS public health care consistently ranks as the top priority in public opinion
polls, and;
WHEREAS Public Health provides vital health promotion and prevention services based
on the unique demographic and economic, social, and cultural needs of our
communities; and;
WHEREAS the evidence from hospital amalgamation in Ontario and across Canada is
that they have cost billions of dollars and have not yielded the promised administrative
savings but have taken money away from frontline care, and;
WHEREAS there is no evidence to support the proposed closure of 25 out of 35 local
Public Health Units, the closure of 12 of 22 local ambulance dispatch centres, and the
closure of 49 out of 59 local ambulance services, and;
WHEREAS there is a deep consensus among virtually all stakeholders that increasing
acuity in our long-term care homes requires additional staff and resources, not
cancellation of the two special funds and real dollar cuts to per diem funding of our long-
term care homes, and;
WHEREAS our local hospitals have been downsized for an entire generation and
cannot meet population needs while sustaining real dollar cuts to hospital global
budgets.
THEREFORE BE IT RESOLVED:
That The Corporation of the Town of Kingsville calls upon the Ontario government to
halt the closures of, mergers of, and cuts to our local health care services including
Public Health Units, land ambulance services, hospitals and long-term care homes and
the Town of Kingsville forward this resolution to all municipalities in the Province of
Ontario."

Re: Notice of Passing Resolution in regards to Transforming and Modernizing the delivery of Ontario
Building Code Services.
On September 24th, 2019,the Ministry of Municipal Affairs and Housing launched consultation on
Transforming and Modernizing the Delivery of Ontario's Building Code Services.The reality is that the
ministry is looking for a way to remove this service delivery function from government even though they
have dramatically reduced the level of support provided to the building sector over the past 15 years.
This is happening at a time when the Building Code has increased in volume, complexity, and
harmonizing with the National Code. In addition, a large number of experienced building officials have
left the workforce.There has been a fear that the reduction of these services has put public well-being
at risk. This is why other agencies and associations from the sector have already stepped in to fill these
voids.
The Ministry is now proposing that a Delegated Administrative Authority(DAA) be created to administer
an undefined number of functions, which may include building sector service delivery, consumer
protection, and the protection of public safety.This at a time when they have been very critical of
other administrative authorities for stepping outside their mandate or being"broken". Moreover,
creating another level of red tape and agency bureaucracy.
They are also intending other methods building code enforcement that would remove a municipality's
authority to administer and enforce construction regulation within their communities but does not
eliminate any of the associated responsibility or liability.
This DAA is being advertised as adopting a fee-for-service revenue model however approximately 90%of
the funds required to operate this agency would come from a provincial tax applied to the building
permit fees municipalities collect.

justification to municipalities that the creation of a new Delegated Administrative Authority is necessary
prior to any legislative changes to the Building Code Act, with regard to building service delivery, are
introduced in the Legislature.

August 16, 2019 of a need for conservation authorities to re-focus their operations
related to core mandates as currently defined in the Conservation Authorities Act,

August 16, 2019 that Conservation Authorities should not proceed with any
increases to fees or levies;

Provincial effort to require its municipal levy only apply to core mandated programs
and services;

of the watershed under the jurisdiction of the Nottawasaga Valley Conservation
Authority and is compelled to remit non-negotiable levy funding to the Authority on
an annual basis;
And Whereas the Township of Springwater cannot exercise line-item scrutiny of
Nottawasaga Valley Conservation Authority's budget and operations nor does the
Authority itself provide detailed substantiation of the same to its member
municipalities like the Township of Springwater;
And Whereas the Township of Springwater must account for all taxpayer funds it
expends within its operations and that it forwards to local agencies and boards;
Therefore Be It Resolved That the Township of Springwater requests that the
Nottawasaga Valley Conservation Authority provide prior to passage of its 2020
budget the following:
(1) Its interpretation and understanding of its mandated operations as found in the
current Conservation Authorities Act, 1990, R.S.O. 1990, c.C.27 and its prescribed
regulations;
(2) The costs of each as determined under (1);
(3) Detailed definitions and determinations of what can be characterized as non-
mandatory programming and service(s);
(4) The costs of each as determined under (3);
(5) Detailed definitions and determinations of fee-for-service activities of the
Nottawasaga Valley Conservation Authority, the revenues they generate as the

Whereas The government of Ontario is consulting on proposed changes to the
Provincial Policy Statement (PPS) to support the government's Housing Supply Action
Plan and other land use planning related priorities. This consultation period closes on
October 21, 2019;
And Whereas The Provincial Policy Statement is a consolidated statement of the
government's policies on land use planning and is issued under section 3 of the
Planning Act. The PPS applies province-wide and sets out the provincial policy direction
for, among other things: The efficient use and management of land and infrastructure;
Protecting public safety, the environment, and important resources including farmland;
And Whereas Municipalities are the primary implementers of the PPS through policies
in their local official plans, zoning by-laws and other planning related decisions;
And Whereas The proposed draft policies would enhance agricultural protections to
support critical food production and the agricultural sector as a significant economic
driver;
And Whereas The proposed draft policies would direct large ground-mounted solar
facilities away from prime agricultural and specialty crop areas, except for on-farm
diversified uses;
And Whereas The Municipality of West Elgin is primarily an agriculture-based
economy, and large grid-connected industrial wind turbine projects could also remove
large portions of prime agricultural land from use, and are therefore not an appropriate
use of prime agricultural land;
Therefore West Elgin Council supports the above policy statement with regard to large

Municipality of Bayham Winter Control Operations
The Municipality of Bayham is making every effort to ensure that winter control operations are met
effectively and economically through approved policies and procedures. The Municipality of Bayham
Winter Operations Plan sets out a policy and procedural framework for ensuring that the Corporation of
the Municipality of Bayham continuously improves on the effective delivery of winter maintenance
services and the management of road salt used in winter maintenance operations, as outlined in
Environment Canada's Code of Practice for the Environmental Management of Road Salts.
PRIORITIES
The Municipality's winter control procedures are in place to meet or exceed the Minimum Maintenance
Standards as set out in the Municipal Act. As such, some roads are given a higher priority. Not all
roads will be maintained in the winter to the same degree. The degree of winter maintenance will vary
in accordance with the role the road/street plays in the transportation network and its classification
according to the Minimum Maintenance Standards.
SIDEWALK MAINTENANCE
Only select sidewalks are maintained for winter operations. The Municipality does not perform snow
removal around community mailboxes; please contact Canada Post for snow removal in this area.
WINTER PARKING RESTRICTIONS
As per the Municipality of Bayham Traffic By-law, parking is not permitted on any municipal streets from
3:OOam-5:OOam. This ensures the Municipality can completely clear streets of snow and that
emergency vehicles can get down the street.
DRIVEWAY ENTRANCES
As we all anticipate having streets cleared free of snow accumulation, no one looks forward to the pile
of snow that's left at the end of the driveway. Plows push the snow along the roadway, and some of
the accumulated snow travels along the blade. As the plow moves past a driveway, the snow falls to
one side leaving what is called a windrow. It is up to the home owner to clear the snow left behind the
plow. Piling snow to the right side of the driveway can help reduce the amount of snow pushed back
into the driveway. Standing in the driveway and looking at the street determines the right side.
MAILBOXES & SOD DAMAGE
The Municipality will replace broken mail boxes only if the snow removal equipment makes physical
contact with the mailbox. Landowners are responsible to ensure that mailboxes are securely attached
to their post. Heavy snow will knock down a mailbox if it is not properly secured.
Plowing snow presents many challenges. It is difficult to tell exactly where the edge of the
road/sidewalk is and when the ground is not frozen some sod damage may occur. Generally the
Municipality does not conduct repairs to sod within the municipal right-of-way.

I am seeking your permission to park my transport truck on the property formerly part of the train tracks beside
my home at 57161 Eden Line. As requested,here is a letter outlining my purpose for asking for this opportunity.
I am an Owner/Operator, driving a transport truck to move products around Canada and the USA.
Unfortunately, I do not have room in my own driveway for my truck. It would be very convenient if I could have
your permission to park my transport on the above-noted property when I am home. The majority of the time,my
truck would be parked at this location on weekends and evenings (over night).

BEING A BY-LAW TO REPEAL BY-LAW NO. 2019-053
A BY-LAW TO AUTHORIZE THE EXECUTION OF AN AGREEMENT BETWEEN THE
MUNICIPALITY OF BAYHAM AND QUAENET CANADA INC.
WHEREAS the Council of the Corporation of the Municipality of Bayham on the 6th day of
June, 2019 enacted By-Law No. 2019-053, being a by-law to authorize the execution of an
Agreement between the Municipality of Bayham and Quaenet Canada Inc. for the placement
of a Communication Tower at the property known as 8354 Plank Road, Municipality of
Bayham;
AND WHEREAS the Council of the Municipality of Bayham deems it necessary to repeal By-
Law No. 2019-053;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM ENACTS AS FOLLOWS:
1. THAT By-Law No. 2019-053 be repealed in its entirety.
2. AND THAT this by-law shall come into force and take effect upon final passing.

A BY-LAW TO CONFIRM ALL ACTIONS OF
THE COUNCIL OF THE CORPORATION OF
THE MUNICIPALITY OF BAYHAM FOR THE
REGULAR MEETING HELD NOVEMBER 7, 2019
WHEREAS under Section 5 (1) of the Municipal Act, 2001 S.O. 2001, Chapter 25, the
powers of a municipal corporation are to be exercised by the Council of the municipality;
AND WHEREAS under Section 5 (3) of the Municipal Act, 2001, the powers of Council
are to be exercised by by-law;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it
advisable that the proceedings of the meeting be confirmed and adopted by by-law.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM ENACTS AS FOLLOWS:
1. THAT the actions of the Council of the Corporation of the Municipality of Bayham
in respect of each recommendation and each motion and resolution passed and
other action by the Council at the regular meeting held November 7, 2019 is
hereby adopted and confirmed as if all proceedings were expressly embodied in
this by-law.
2. THAT the Mayor and Clerk of the Corporation of the Municipality of Bayham are
hereby authorized and directed to do all things necessary to give effect to the
action of the Council including executing all documents and affixing the
Corporate Seal.
