Application submitted by the Municipality of Bayham The purpose of the public meeting to ensure the Zoning By-law of the Municipality of Bayham is up-to-date and is consistent with the Official Plan in accordance with Section 26 (9) of the Planning Act. The review process includes a review, consolidation and update of the Zoning By-law. Generally, the amendment will address recent updates to the Official Plan, revisions to map schedules based on updated parcel mapping, as well as other housekeeping items which will affect regulations in the Municipality. No key map is provided as the proposed amendment applies to the entire Municipality. ADJOURNMENT Moved by: Councillor Chilcott Seconded by: Councillor Donnell THAT the updated Zoning By-law be considered at a future meeting of the Council of the Corporation of the Municipality of Bayham; AND THAT pursuant to the Planning Act requirements, the Public Meeting for Zoning By-Law Review Municipality of Bayham is now complete at 7:48 p.m. CARRIED MAYOR CLERK WHEREAS on September 11, 2018 the Elgin County Council considered a report from Michael Plant, Director of Engineering Services and Steve Evans, Manager of Planning re Land Severances— Unsolicited Conveyance of Lands; AND WHEREAS on September 11, 2018 the County of Elgin established a policy that the County of Elgin not accept unsolicited lands to accommodate Land Division Consent applications that have otherwise not been previously requested or required by the County; AND WHEREAS the Municipality of Bayham has subsequently been approached by Land Division applicants requesting reconsideration of the September 11, 2018 County of Elgin Policy to facilitate lot addition activities; AND WHEREAS lot addition, the process of a landowner selling or transferring and merging a part of land to an abutting parcel resulting in an increase in size to the abutting landowners lot, is a form of rural economic development and conforms to the Elgin County and Bayham Official Plans. AND WHEREAS the Planning Act, R.S.O. 1990, c. P.13 also provides a mechanism for planning approval authorities to grant approval for subsequent conveyances of the same parcel, which is normally exercised for lot additions, since the suitability of the lot to be conveyed as a standalone parcel (not to be added to an abutting lot) would not have been reviewed; AND WHEREAS the County of Oxford, and Norfolk County both accept and retain 1' X 1' conveyances on County Roads to facilitate lot additions to promote development with the administrative costs of the transaction funded by the applicant; AND WHEREAS the acceptance of 1' X1' conveyances to facilitate lot additions is the most cost effective and least burdensome process to grant lot additions, to both the Municipality and the applicant; NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Municipality of Bayham respectfully request Elgin County Council to reconsider its policy of September 11, 2018 re Land Severances — Unsolicited Conveyance of Lands to facilitate rural economic development. The owner would retain 29.79 hectares. The subject land is within the boundary of the Village of Straffordville. Lands are designated "Residential" on Schedule 'B' Straffordville: Land Use and Constraints in the Official Plan. Lands are zoned Village Residential (R1) Zone in Zoning By-law No. Z456-2003. In the immediate area of the proposed lots, the lands are designated and zoned appropriate for future residential development. Council supported the consents January 17, 2019 through Staff Report DS-07/19 and Elgin County Land Division Committee granted them on February 6, 2019. After approval the landowner decided to reconfigure the lots. This resulted in new applications E66-69/19 with the new dimensions. The previous applications are withdrawn. The Elgin County Land Division Committee will consider the new applications on October 16, 2019. DISCUSSION: The new applications present an increase in frontage on E66/19 (Lot A) by 3.469 metres and all lots are shortened by 8.53 metres from the original proposal. All lots are serviced with sanitary stubs to the lot lines for mandatory connection to the municipal system. Staff and municipal planner recommend the support of the new consent applications for the creation of four building lots fronting on Heritage Line in the village of Straffordville with the same conditions as the previous applications. The Agent has requested the applications be included on the October 16, 2019 Land Division Committee Agenda and therefore staff reports are before Council for consideration at this time. Consent application E57/18 was received from the Elgin County Land Division Committee submitted by Chad Underhill Farms Limited proposing to sever an irregular shaped parcel of land 1.132 ha(2.79 acres) and to retain +/- 75 ha (185.3 acres) of land with the intent to add to the adjoining agricultural land to the north owned by Douglas Dennis. Staff Report DS-60/19 Chad Underhill Farms 2 DISCUSSION: The planner's memorandum dated September 11, 2018 analyzes the application subject to the Elgin County Official Plan, Bayham Official Plan and Zoning By-law policies. The intent is to add the lands to the neighbouring property owned by Douglas Dennis identified as Roll # 3401- 000-002-03300. The application meets the criteria for the boundary adjustment policies subject to the recommended conditions. We have completed our review of consent application submitted by Chad Underhill Farms Limited for lands located at Part Lots 6, 7 and 8, Concession 3, east of Woodworth Road, north of Vienna Line and south of the end of Dennis Road. The applicants are requesting consent for severance of 1.1 ha (2.8 acres) of land and to retain 75 ha (185 acres) of land. The purpose of the severance is a lot addition to the adjacent farm parcel to the north. The lands are designated Agricultural, Natural Heritage and Natural Gas Reservoir on Schedule "A": Land Use in the Official Plan and are within the Hazard Lands and Significant Woodlands overlay on Schedule A2 Municipality of Bayham: Constraints. The lands are zoned Agriculture (A1) and LPRCA Regulation Limit on Schedule "A", Map No. 10 in Zoning By-law Z456-2003. 2. The severed lands comprise a wooded area, to the north and south is wooded, to the east and west are agricultural fields. The retained lands are irregular in shape having a lot frontage of 707 m (2,320 feet) and irregular lot depth. There are no existing or proposed buildings, structures or site alterations. The severed lands are to be merged as lot addition to the parcel to the north as part of a legal settlement agreement between abutting landowners. Consent application E58/18 is being considered concurrently for a 9.75 m (32 feet) wide easement and a frontage of 12.9 m (42 feet) on the municipal road allowance. The applicant is seeking an easement for farm field access in exchange for the severed lands. 3. Elgin County Official Plan Section E1.2.3.2 Boundary Adjustments indicates that a consent may be permitted for the purpose of modifying lot boundaries, provided no new lot is created. The proposed lot addition does not result in the creation of a new lot and therefore is consistent with the policies of the County Official Plan. The Municipality of Bayham Official Plan Section 2.1.9 Minor Lot Adjustments indicates that minor boundary adjustments to convey land shall be permitted if no new conveyable lot is created. The intent of the application is to add the severed lands to the adjacent parcel and to continue agricultural use with no new lot created. Based on no new lot being created the consent is consistent with the Official Plan. 5. The subject lands are located in the Agricultural (A1) zone in By-law Z456-2003. C-07/ D09.DENN Roll # 3401-000-002-03300 SUBJECT: CONSENT APPLICATION E58/18 DENNIS BACKGROUND Original Staff Report DS-57/18 was presented to Council on September 20, 2018 and Council passed the following resolution: "THAT Staff Report DS-56/18 regarding Consent Application E57/18 submitted by Chad Underhill Farms Ltd. and Staff Report DS-57/18 regarding Consent Application E58/18 submitted by Douglas Dennis be deferred until further notification from the applicant or agent as per the agent's written request." The Agent has requested the application be included on the October 16, 2019 Land Division Committee Agenda and therefore is before Council for consideration at this time. The Elgin County Land Division Committee circulated a consent application submitted by Douglas Dennis proposing to create an easement over lands legally described as Concession 3 Part of Lots 6, 7 & 8, east side Woodworth Road. The proposal is to create an easement with a frontage of 12.9 metres by an irregular depth, area 0.478 ha, proposed to provide driveway access for the agricultural parcel owned by Chad Underhill Farms Limited in Concession 3 Part Lot 7. The owners are retaining approximately 23 +/- ha proposed to remain in agricultural use. The subject lands are currently designated Agriculture, Natural Gas Reservoir and Natural Heritage on Schedule 'Al' Land Use and Hazard Lands and Significant Woodlands on Schedule `A2' Constraints in the Official Plan and zoned Agricultural and Long Point Region Conservation Authority Regulation Limit in the Zoning By- Staff Report DS-61/19 Dennis 2 law No. Z456-2003. DISCUSSION The easement is proposed by landowner Mr. Dennis to provide formal access to Chad Underhill Farms Ltd. lands. Mr. Underhill is presently using the unopened portion of Dennis Road (north of the creek), the bridge and Dennis' lands to access his agricultural lands. Both parties would like to formalize the easement of access through a consent application. Mr. Dennis will retain ownership and share the easement with the neighbour. No new lots are being created. The request for easement in its current state cannot be supported as it requests an easement to an unopened road allowance (municipally owned) both northerly across the bridge to Dennis Road and southwesterly to Woodworth Road. This easement may only be considered if the landowner Chad Underhill, owner of the lands on the north side of the bridge, agrees to the process of the Municipal Sale and Disposition of Land By-law to stop up, close and convey and purchase this road allowance, including the bridge "as is where is" condition and lands south of the bridge to the easement as a means to connect to the requested easement across Mr. Dennis' lands. As expressed through his appointed Agent, Mr. Underhill has agreed to proceed with the Municipal Sale and Disposition of Land By-law for the Dennis Road allowance, bridge and connecting land to the easement. All costs for this transaction would be the responsibility of Mr. Underhill. On August 26, 2019 the Municipality of Bayham issued Notice concerning the proposed closure and conveyance of a highway in the Municipality of Bayham. A copy of the Notice is attached hereto as Appendix '4'. The notice was received for information at the September 5, 2019 regular meeting of Council. Four (4) comments were received from Mr. Doug Dennis during the notice period and are attached hereto as Appendix '5'. In response to the comments submitted by Mr. Doug Dennis staff would provide the following information for Council consideration: • By-law No. 2015-021, the Municipality of Bayham Sale & Disposition of Land By-law establishes a policy with respect to the sale and disposition of land by the Municipality. The request from Mr. Underhill to facilitate the easement with Mr. Dennis is in conformity with By-law No. 2015-021. • Unopened road allowances do not permit public use. For a person to utilize an unopened road allowance an agreement is required. The use of an unopened road allowance without permission from the Municipality is trespass. Neither Dennis Road nor Woodworth Road provide access to the public to the Otter River. • The Dennis Road Bridge, formerly known as the Wilson Bridge, is abandoned and closed to the public. The structure should not be utilized by the public. Staff are supportive of the proposed closure and conveyance of the subject lands, including the bridge, in accordance with By-law No. 2015-021. Staff Report DS-61/19 Dennis 3 The planner's memorandum dated September 12, 2018 analyzes the application subject to the Elgin County Official Plan, Bayham Official Plan and Zoning By-law policies. Bayham Official Plan Section 8.7.2.5 supports consents for easements in any land use designation provided it complies with all other policies and regulations of the Official Plan and Zoning By-law. Both staff and the planner are of the opinion that the land between the bridge and the easement should be included in the stop up, close and convey process to provide the private land ownership connectivity to the easement. We have completed our review of consent application submitted by Douglas Dennis for lands located at Part Lots 6, 7, 8 and 9, Concession 3, east of Woodworth Road, north of Vienna Line and south of the end of Dennis Road. The applicant is requesting consent for easement of 0.5 ha (1.2 acres) of land for access to farm lands. The lands are designated Agricultural, Natural Heritage and Natural Gas Reservoir on Schedule "A": Land Use in the Official Plan and are within the Hazard Lands and Significant Woodlands overlay on Schedule A2 Municipality of Bayham: Constraints. The lands are zoned Agriculture (A1) and LPRCA Regulation Limit on Schedule "A", Map No. 10 in Zoning By-law Z456-2003. 2. The proposed easement is irregular in shape with a width of 9.75 m (32 feet) and a frontage of 12.9 m (42 feet) on a municipal road allowance. The retained lands have a lot frontage of 304 m (997 feet) and have an irregular depth. There are no existing or proposed buildings or structures. Surrounding uses are agriculture. 3. The easement lands follow an existing roadway/trail accessed from the end of Dennis Road, via a bridge across Big Otter Creek (Creek) and up the south valley wall of the Creek. The route is used in order to access farm fields at the south end of the proposed easement because it is the most direct route to the fields. Those fields have adequate frontage for access along Woodworth Road, however, an alternative route around the Creek is approximately 10 km (6 miles) in distance — along Dennis Road to Calton Line, County Road 43, Vienna Line and Woodworth Road. 4. The bridge is within a portion of closed municipal road allowance and has not been maintained by the Municipality since the road allowance was closed. Dennis Road ends on the north side of the Creek and there is a closed municipal road allowance from the end of Dennis Road to the end of Woodworth Road.The proposed easement ends at the closed road allowance. IBI Group is a group of firms providing professional services and is affiliated with IBI Group Architects IBI GROUP MEMORANDUM 2 Municipality of Bayham—September 11,2018 The route has been used by Chad Underhill Farms, the landowner requesting the easement, for access to the fields for many years, however, a recent title search by the applicant found that there was no easement registered on title. The applicant and Chad Underhill Farms have agreed to exchange easement access for a lot addition in a legal settlement. Consent application E57/18 is under consideration concurrently and proposes a lot addition of 1.1 ha (2.8 acres) of land and to retain 75 ha (185 acres) of land. 5. Through the review process it became evident that the end of the proposed easement accessed a closed road allowance. It is determined that in order for Chad Underhill Farms to use the easement they would need access over the closed road allowance lands. The Municipality proposed to the applicant and Chad Underhill Farms to stop up, close and convey the portion of the Dennis Road road allowance from north of the driveway to Chad Underhill Farms property, located at 7135 Dennis Road, to the proposed easement. The result of the stop up, close and convey would allow Chad Underhill Farms to directly access the easement on private lands. From a bridge maintenance perspective having ownership south of the bridge would be preferable for maintenance purposes. We recommend that a condition of consent require Dennis Road be stopped up, closed and conveyed into private ownership and merged on title. The Municipality would require the acquisition of a portion of Chad Underhill Farms lands at the end of Dennis Road to construct a public turnaround. For what reason?? The township spent a lot of money on that road taking out the steep banks leading to the bridge and making an excellent road and turnaround which is heavily gravelled. The public should have access to the Big Otter to walk the bank and fish, to put kayaks or canoes in or out, or just go for a drive to enjoy the scenery. The Otter river is crown land and a navigational waterway for all to enjoy and should be accessible to encourage tourism and enjoyment of nature.No one should have the right to close a given road especially when it would cut off water access. The only reason I've heard is to keep the "riff raff'out. I also own two pieces of property on that side of the river and may need access to that road to take some timber out in the future. I have nothing against the Underhills - in fact they farm my property and we have a good relationship. But I see no reason why this proposal should be granted for one's own personal gain. In it I've given Chad Undehill permission for an easement across my property.Now I see that Paul Riley of the IBI group who is the consulting planner for Bayham has proposed that in order to do this the Dennis side road should be closed at Chad Underhills driveway. I do not agree with this even though the Aylmer paper stated that both Chad and I did.That road is named after my family and the township spent a lot of money on it. I absolutely do not want access to the Otter cut off to the public. Hopefully there's another solution because I will not agree to this. It's not part of the original deal. My guests hike my 12 miles of trails and sometimes cross the Dennis bridge from my walnut farm and walk the Dennis sideroad out to hwy 45 and back. I also take people on guided tours on my side by side or they travel by atvs and snowmobiles down the Dennis side road,to highway 45. If Chad gets ownership of that portion of the road then he can put a gate at the bridge and lock it up. This is what he has talked about doing, and thus,I and my guests won't be able to access the Dennis side road. My ecotourism brings in many guests who have now discovered Bayham township and spend money in the area. Doing this would discourage tourism. This whole thing began because there are 2.8 acres which I always thought I owned and maintained, but apparently are on Chads deed. I applied for adverse ownership and after many discussion between both of our lawyers, Chad offered to add the property to my deed IF I allowed him a right of way across my property. We've both been working toward this end but now the planner has thrown in the idea of closing the road in order to do it. I am so against this that I want to know if I can rescind my agreement to allow a right of way across my property in order to keep the road open. To my knowledge, there are five different owners on the Dennis side road, and is it proper to deny them the right to have access to the river? I can understand the closing of the Woodworth side road, because no one lives on it, and it is not maintained year round. When you think of it when the snow plow or grader does the Dennis side road,really how much more of an effort is it to go a little further to the bridge where the township made an excellent turn around. As you already are aware of, Chad and I had a boundary dispute, and for ten years considered the old fence was the boundary between my property and Chads property. when I bought the property the real estate agent and a former Owner K. Please describe the nature of the problem as you see it? In response to the Province's request for consultation, the Township has a significant issue with Joint and Several Liability (JSL) and the impact it has on the municipality. a. No Requirement of Proof JSL is a tool that is used by the legal industry without any discretion to the point that this municipality feels that its use is negligent and in fact unethical. Most law suits that municipalities see are frivolous and vexations as lawyers cast their nets wide and attempt to use shotgun justice for their clients that are more than often the sole cause of a claim. A statement of claim does not require any proof that there is fault. A plaintiff only has to state who they think is involved and a significant amount of court time is spent determining who should be a party to the legal claim. b. No Consequence for Being Wrongly Identified in a Statement of Claim To add to this, there is no consequence that lawyers and their clients face for submitting a claim against a municipality when it is clear that a municipality is not involved. Municipalities incur significant administrative costs in managing these claims and the municipalities and their insurers pay significant costs to go through a lengthy process to prove that a claim was made in error (intentionally) only to find that a judge sees no reason to compensate a municipality for cost for incorrectly being named in a lawsuit by a plaintiff. Municipalities are seen as having deep pockets by the legal industry as well as the judicial system that makes decisions on these claims. Proof of innocence is often furnished to the plaintiff and lawyer by a municipality immediately upon notification of a pending legal action of statement of claim. This information is ignored by the plaintiff's lawyer. A plaintiff and their lawyer should have to reimburse a municipality for Phone: 705-728-4784 Administration Fax: 705-728-2759 2 all administrative and legal costs when the municipality is cleared of liability. Judges rarely compensate municipalities for being wrongly named in a legal action. A recent example from 2019 occurred when a statement of claim was made against the Township of Springwater for an accident on a County Road (not the jurisdiction of Springwater). After legal and administrative costs totaling more than $5,000, Springwater was dismissed from the claim. Unfortunately no costs were assigned to the plaintiff for wrongly naming Springwater in the statement of claim. The current system is broken and Springwater tax payers are left paying the bill. 2. What are the problems that you need addressed to benefit your community? a. Ethical Standard of Due Diligence Required Before Submitting a Legal Action Lawyer's representing plaintiff's should be required to submit documentation that provides significant research into why a claim is being made and a municipality is being named in a law suit. The claim should clearly prove authority and responsibility. The current practice of naming every party under the sun in a legal claim is negligent and unethical. b. Frivolous and Vexatious Suits are Costing Taxpayers The Township of Springwater is seeing a significant waste of administrative time and cost in managing legal claims against the municipality that are predominantly frivolous and vexatious due to JSL. Over the last seven years, the municipality has had 55 claims made against the municipality. These claims range from trips/falls resulting in broken eyeglasses to cases that unfortunately involve loss of life. The Township has no problem dealing with claims that the municipality is responsible for; however the Township does have a problem dealing with claims it does not have any responsibility for. Of the 55 claims against the municipality; 42 of these claims are frivolous and vexatious. Claims that the municipality has no responsibility for. Over the past 7 years, Springwater has paid more than $100,000 on these frivolous and vexatious claims as they work themselves through the legal process. Many of these files are still open. This does not include additional costs paid by Springwater's insurance company that are beyond the municipality's deductible. c. Negligent Legal Actions (Beyond Frivolous and Vexatious) The Township of Springwater is currently named in 4 legal actions and an additional legal action (recently abandoned) for claims that occurred in another municipality (no where near Springwater). The Township is currently named in 3 claims that occurred in the Township of Clearview west of Stayner and one claim in the Township of Brock that have nothing to do with the Township. Springwater was named in a claim that occurred 3 in Wasaga Beach that was abandoned recently. All of these claims cost the Springwater taxpayer in administrative and legal costs as they work their way through the process. d. Triage System for Claims Before a claim makes it to a court date, the file should be triaged. It is at this stage that negligent of frivolous and vexatious claims will be filtered or thrown out. This process will trigger the reimbursement of costs to municipalities by unethical law firms. a Law Society of Ontario Charges Lawyers that use JSL in an unethical way should be charged by the Law Society of Ontario. If a lawyer names a municipality in a legal action that should not be named, these lawyers should be suspended and potentially lose their license to practice law. There is a significant commonality when comparing frivolous and vexatious claims and the law firms/lawyers that submit them. The current code of ethics of the Law Society of Ontario should be updated by the Province to reprimand lawyers and law firms that negligently use JSL. The Province of Ontario should be involved in creating a new Code of Ethics for Ontario's legal industry. 3. Is it increased premiums? Rising deductibles? A recent survey by CAO's in Simcoe County shows that insurance premiums are going up between 10% at the lowest to 59% being the highest in 2019. The Township of Springwater experienced a 10.8% increase in its 2019 insurance renewal. The area that typically sees an annual increase is related to the Municipal General Liability and Excess Liability lines of the business. The municipality was advised by its insurance broker that "over the past several years, insurance companies' appetite for Municipal Insurance has remained fairly stable. Insurance rates across all lines have seen only modest increases intended to simply keep pace with inflation and the rising cost of claims. Larger rate increases have been reserved for those accounts experiencing adverse claims development; either in frequency or severity (or both). However, starting in June 2018, the insurance market as a whole has shown clear signs of "hardening". Insurance companies for all sectors are putting stricter rules in place regarding the amount and breadth of coverage they will provide, and to which clients. Since the overall insurance supply is being reduced, the demand for insurer capacity is increasing, and as such, prices are elevating." Staff and its insurance broker have looked at increasing our deductibles in an effort to reduce the overall premium; however this has led to minimal reductions in the overall annual premium to the Township. 4. Being unfairly named in lawsuits? As detailed above, Springwater continues to be unfairly named in legal actions. Issues here range from a complete absence of research by legal firms on causality to the municipality being named in legal action in completely separate jurisdictions (other municipalities). 5. Feeling you cannot offer certain services because of liability risks? More recently, with the advice of the Township's insurance broker, the Township has changed the way in which it delivers some of its recreational programs/services, especially as it relates to children's programs/activities. For example, the Township in partnership with its Community Recreation Associations will host a number of community based events throughout the year, which includes children's activities. In order to allow inflatable Bouncy castles at community events, the Township now requires the service provider to indemnify the Township and to also provide staff to monitor the safety of participants while in the inflatable Bouncy castle. Southwestern Ontario needs a Transportation plan that includes transport of goods and people. This plan should connect with the GTHA and beyond and be "solutions designed” for this region. We do not have the population density that would require the more complex and robust systems of urban neighbours. Our region does cover a large geography comprised of smaller cities, towns and villages that require transportation for residents to access education, receive medical care, employment and recreation. We have a strong tourism sector that also relies on active transporta- tion. Our residents often commute from town to town within the region that have little to no means of connected community transportation options. Our agricultural and manufacturing businesses also rely on the shortline rail assets in our region to move goods. These businesses support a number of jobs across the region. The economic impact that shortline rail has on our ability to attract and retain these businesses is not insignificant. SCOR EDC and its municipal partners have been seeking ways to encourage the continued and increased use of rail systems but investments in the rail infrastructure will need to be made in order make this happen. This will need to be concerted effort between the federal, provincial, municipal and private stakeholders. Regional municipalities have invested in community and active transportation, SCOR partners continue to seek cost effective ways to connect to larger urban centres and to provide transportation to support businesses whose employees need transportation for work. All of this requires planning and collaboration with senior levels of government and the private sector. We are committed to creating a transportation network for the region that meets our needs to move people and goods in a cost effective manner but we need your help. We have had the op- portunity to meet with senior staff within your Ministry in the past but these meetings have been sporadic and inconsistent. Your Ministry has been open in consulting with us and our partners regarding the Local Food Act and how to best support local food procurement for the broader public sector institutions. We have worked with other partners such as MealSource, Whitecrest Mushrooms, VG Meats and others who have helped us understand barriers in accessing the public sector market for small and midsized producers in our region. Our sincere hope is that through our discussions with you we were able to impart our concern regarding a province wide public procurement plan when it comes to sourcing local food. As we mentioned we strongly believe that this would undo many years of relationship building and value chain development for local producers and purchasers. We further discussed the need for succession planning tools for aging farmers in Ontario. We work collaboratively with organizations such as the Ontario Federation of Agriculture (OFA) to support farmers in Ontario. The need to foster transitions for farmers seeking to retire and to assist those interested in entering and or purchasing a farming operation continue to be important to SCOR EDC and its partner communities. Municipal governments and rural ratepayers are confronted with increasing pressures to find solutions to pay the costs of vital municipal services. Municipal governments struggle to afford to pay the cost of expected municipal services and infrastructure needs that are maintained by a relatively smaller population. Municipalities need transparent consistent support from the upper levels of government in order to adequately manage community assets. The stability and predictability of OMPF allocations help municipalities finance long-term challenges like tackling the infrastructure gap. Rural municipalities work diligently to adapt to rapid change by moving to citizen-centred services, regional cooperation agreements, lean management, and the adoption of digital technology while shifting financial resources to the infrastructure deficit. As noted by the Association of Municipalities of Ontario (AMO), for every dollar of provincial upload value, mu- nicipalities have invested $1.67 back into infrastructure. Past underinvestment, aging assets, extreme weather events, all contribute to the gap between actual and needed investment in Ontario's infrastructure. Many of our bridges, dams and municipal /agricultural drainage systems are investments from the 1970's. Investments in upgrading are much needed across the region. SCOR and the rest of rural Ontario need greater access to affordable energy, improved roads and bridges as well as agricultural infrastructure such as drainage. Broadband coverage gaps in Ontario's rural regions result in lost productivity and repress business and community innovation. Investment in advanced network technology is imperative to support our businesses and communities. We strongly encourage your Ministry to reconsider the reconsider the proposed increases to class sizes and further to develop and adopt a rural school strategy. This could present a dire circumstances to our rural schools that we feel will harm students, their families and the economic viability of our smaller communities. The training and education of current and future workers will determine whether or not our local businesses can be successful, and is a major issue identified by surveys of businesses in the region. Coordination between schools and school boards, post-secondary institutions, other employment stakeholders and industry about current, available resources to them and how the current education system works are inval- uable, we ask that your Ministry work with other Ministries such as MTCU and Labour to bridge these gaps. Through supporting initiatives such as the Manufacturing Day mentioned above which is a great example of coordination of education, government and business your Ministry would be creating a continuum for learning that would offer students new prospects, demonstrate to families the change in certain jobs that may have a stigma for them and give business the opportunity to market their business and preferred skill sets to students at a younger age. Visitors to the region gain a knowledge and understanding of what the communities and residents value and what the opportunities are within various commu- nities. Tourism and our regional branding are often the marketing catalyst for other economic opportunities A strong tourism industry is a significant component to business and resident attraction. Creating and supporting a rich cultural and experience for investors is key in painting an overall picture for their success in our communities and the region as a whole. Being in a region where employees are excited to build their future and to relocate to be is often a contributing factor in successful investment attraction. The role tourism plays in our region is vital not only from an economic standpoint but through its social impact, environmental impacts and community capacity building. Environmental aspects of sustainability are equally important as visitors seek experiences that spark their sense of adventure and contribute to being good global citizens. One of the stronger trends tourism operators are seeing are those related to environmental stewardship. While the federal government has invested in Destination Canada to support the long haul market focusing on places such as Dallas and other larger markets that currently have point to point air service, we would ask your Ministry to consider an investment in the near border market including Pennsylvania, Ohio, Michigan and New York. These markets continue to see stable tourism vis- its that result in increased spending from high-yield travellers who are seeking vacations with ex- periential travel components, including natural vistas, world-class cuisine, cultural and historic adventures, hunting and fishing. These are assets we have in abundance in our region Many of the tourism attractions and destinations struggle to attract and retain workforce as many of the positions are seasonal in nature or entry level positions. The industry continues to seek ways to incorporate tech solutions for some of their labour force needs but we need a consistent well supported strategy including marketing for these positions. Regional Transportation Mayor Preston noted that plans are underway at the City of St.Thomas for an improved transit system. Mayor Preston also shared his conceptual plans for regional transportation which would include a bus service from St.Thomas to London as well as St.Thomas to Port Stanley. Mayor Martyn requested that consideration be given to a bus stop at the County's new Provincial Offences Administration building. Discussions have occurred with the Minister of Transportation and the City intends to request provincial support for a two (2) year pilot project. Mayor Preston noted that a regional transportation service would provide residents of the City and County with more job opportunities and he reinforced the importance of inter-municipal support. Mayor Preston clarified that the City intends to request full provincial funding for the pilot project. Mayor Jones said he is looking forward to more discussion. 3. Economic Development(St.Thomas Municipal Airport) Airport Mayor Preston noted that the St.Thomas Municipal Airport is a fully functional municipal airport with many possibilities,including partnerships between airports,industries, and municipalities. The Mayor shared his vision for a joint industrial hub between neighbouring municipalities that would benefit everyone. Deputy Mayor Monteith (Southwold) asked Mayor Preston to share what the City's interest in Southwold's industrial land is. Mayor Preston stressed the importance of working together to eliminate barriers in order to benefit both the County and municipalities to create more jobs and attract more residents. Joint Economic Development and Tourism Corporation For the purposes of discussion,Warden McPhail asked if there is interest in forming a joint City- County Economic Development and Tourism strategy. There was general consensus that a committee with representatives from the City and County,with staff and Council membership,be established to research,discuss and report on any findings to the broader network. 4. Provincial Funding Changes a. Social Services, Employment, Childcare Elizabeth Sebestyen, Director of Social Services, provided a brief background of the Social Services Department and provided an overview of anticipated changes to programs and funding as a result of recent provincial announcements. b. Conservation Authorities Mayor Martyn shared her concerns with respect to funding changes impacting Conservation Authorities (CA). Mayor Jones noted that some programs are revenue generating and suggested that all Councils have an open mind when CAs request funding to support discretionary programs. Councillor Chapman (Aylmer) asked if it is possible to lobby the government not to cancel non-mandated programs as they do not provide funding for the services anyways. Councillor Peters asked if the four conservation authorities are effectively communicating with each other to determine whether four conservation authorities are needed. Mayor Martyn clarified that they are communicating and all CAs work closely together for all education programs. Mayor Purcell noted that the recent letter from the Government did not say that programs must be cut, rather to start examining because they will not be funded in the future. Warden McPhail said that deputations will likely be coming to Councils explaining the Conservation Authorities'shortfall and seeking assistance; if a conservation authority is cut funding,the ability to levy should not be left in place. Councillor Fehr asked if a joint project was possible for shorelines to address high water levels. Mayor Jones stated that the costs are too high for a regional/municipal solution. c. Health Units/Ontario Health Teams Councillor Peters noted that the new Ontario Health Team structure is similar to a school board structure-"ELMO" (Elgin-London-Middlesex-Oxford). The Ministry has classified the Elgin-St. Thomas OHT application as "in development", meaning more information must be received prior to being selected to complete a "full application". Councillor Stevenson (St.Thomas) expressed concerns regarding the scope of the potential Ontario Health Team as the LHIN was too large. It was also suggested that partners contribute 0.1% of Long-Term Care budgets to support the application development. Mayor Preston remarked that once we are contributing, it will be difficult to get out. d. Tourism and Culture Councillor Peters would like to see the City supporting and working with Elgin County Museum, Archives and Libraries. There was general consensus that a committee be established to discuss potential opportunities. Councillor Peters asked for the County and City administration to examine changes since the 1997 restructuring, noting that the municipalities may be forced to amalgamate in the future. 5. Affordable Housing Mayor Preston informed local Councils that an announcement should be coming soon regarding a shelter in St.Thomas.The housing situation needs to be looked at from top to bottom; many conversations are being had with builders regarding market rent units in the City and across Elgin. Mayor French noted that the Town of Aylmer hopes to have a shelter in operation by December (citizen-led initiative). Mayor Martyn commended Dutton/Dunwich for the two housing units for Seniors in the municipality; Central Elgin is working on getting policies in place for something similar. 6. Phragmites Warden McPhail noted that the County is developing a strategy to deal with Phragmites. Councillor Rowe (West Elgin) thanked the County for developing the strategy as many municipalities have been working on it independently. Councillor Rowe encouraged the County and the City to lobby for a provincial strategy.Warden McPhail clarified that this process has already started. The City of St.Thomas is in year six (6) of their Phragmites program. Central Elgin also has a successful program. 7. Green Lane Landfill and Waste Management Planning The Township of Southwold has an agreement with Green Lane as the "host"municipality (expires February 28, 2029 -guaranteed space until then),with Dutton,Southwold, Central Elgin,West Elgin, Malahide and St.Thomas dumping at the landfill. Mayor Jones noted that an expansion has not been applied for yet; once applied for, it will take approximately ten (10)years for the expansion to occur. READ a FIRST, SECOND AND THIRD time this 3rd day of October, 2019 MAYOR CLERK THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2019-083 A BY-LAW TO CONFIRM ALL ACTIONS OF THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM FOR THE REGULAR MEETING HELD OCTOBER 3, 2019 WHEREAS under Section 5 (1) of the Municipal Act, 2001 S.O. 2001, Chapter 25, the powers of a municipal corporation are to be exercised by the Council of the municipality; AND WHEREAS under Section 5 (3) of the Municipal Act, 2001, the powers of Council are to be exercised by by-law; AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it advisable that the proceedings of the meeting be confirmed and adopted by by-law. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the actions of the Council of the Corporation of the Municipality of Bayham in respect of each recommendation and each motion and resolution passed and other action by the Council at the regular meeting held October 3, 2019 is hereby adopted and confirmed as if all proceedings were expressly embodied in this by- law. 2. THAT the Mayor and Clerk of the Corporation of the Municipality of Bayham are hereby authorized and directed to do all things necessary to give effect to the action of the Council including executing all documents and affixing the Corporate Seal.
