BY-LAW NO. Z231-90
BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of Bayham
deems it necessary to amend its Zoning By-law No. 2387;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows:
1. THAT By-law No. 2387, as amended, is hereby further amended
by amending Section 7 - Rural Residential (RR) Zone
Regulations by adding a new subsection to Section 7 . 11 -
Exceptions (RR) Zone as follows:
"7 .11. 17
7 . 11.17 . 1 Defined Area
RR-17 as shown on Schedule 'A' to this By-law.
7. 11. 17 .2 Permitted Buildings and Structures
Existing Buildings and Structures .
7 . 11. 17 .3 Minimum Separation Distance
from the nearest main wall of a dwelling to
the nearest main wall of buildings or structures
used for livestock 112 .0 metres"
2 . THAT By-law No. 2387, as amended, is hereby further amended
by amending Schedule 'A' , Map 37 by deleting from the
Agricultural (A1) Zone and adding to the Special Rural
Residential (RR-17) Zone, those lands enclosed in heavy
solid lines and marked RR-17 on Schedule 'A' to this By-law,
which schedule is attached to and forms part of this By-law.
3 . THAT By-law No. 2387, as amended, is hereby further amended
by amending Section 5 , Agricultural (A1) Zone Regulations by
adding a new subsection to Section 5. 11 EXCEPTION - (A1)
Zone as follows:
"5 . 11. 31
5. 11.31. 1 Defined Area
A1--31 as shown on Schedule 'A' , map 37 to
this By-law.
5. 11.31.2 Permitted Buildings and Structures
Buildings and structures for the permitted
uses except those which are prohibited by
this By-law.

5. 11.31.3 Prohibited Buildings and Structures
All types of residential dwelling units .
5. 11 .31.4 Minimum Lot Area
19 .0 hectares. "
4 . THAT By-law No 2387, as amended, is hereby further amended
by amending Schedule 'A' , Map 37 by deleting from the
Agricultural (Al) Zone and adding to the Special
Agricultural (A1-31) Zone, those lands enclosed in heavy
solid lines and marked Al-31 on Schedule 'A' to this By-law,
which schedule is attached to and forms part of this By-law.
5. THIS By-law comes into force:
a) where no notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board.

NOTICE OF THE PASSING
OF A ZONING BY-LAW BY
THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
TAKE NOTICE that the Council of the Corporation of the Township
of Bayham passed By-Law No. Z231-90 on the/1th day of April, 1990
under Section 34 of THE PLANNING ACT, 1983.
AND TAKE NOTICE that any person or agency may appeal to the
Ontario Municipal Board in respect of the By-law by filing with
the Clerk of the Township of Bayham not later than the gift day of
May, 1990, a notice of appeal setting out the objection to the
By-law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-law,
describing the lands to which the By-law applies, and a Key Map
showing the location of the lands to which the By-law applies
(or, alternatively an explanation as to why a key map is not
provided) are attached. The complete By-law is available for
inspection in my office during regular office hours.

EXPLANATORY NOTE
The purpose of By-law No. Z231-90 is two-fold. Firstly, it will
change the zoning on a 0. 19 hectare (0.46 acre) parcel of land
situated on the north side of County Road No. 38, in Part Lot
136, Concession 7, in the Township of Bayham, from the
Agricultural (A1) Zone to the Special Rural Residential (RR-17)
Zone. Secondly, it will rezone a parcel of land from the
Agricultural (Al) Zone to the Special Agricultural (A1-31) Zone.
The effect of this By-law will be to permit the creation of one
rural residential lot pursuant to the process of severance and
conveyance. This By-law will also recognize the minimum lot area
deficiency on a retained parcel of land in addition to
restricting the establishment of additional dwelling units on the
property. This By-law is intended to implement the policies of
Official Plan Amendment No 71 which designates the new
residential lot as "Rural Residential" .
