BY-LAW NO. Z228-90
BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of Bayham
deems it necessary to amend its Zoning By-law No. 2387;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows:
1. That By-law No.2387, as amended, is hereby further amended
by adding a new Section immediately after Section 18, Mobile
Home Park (MH) Zone Regulations as follows:
"Section 19 - Hazard Land (HL) Zone Regulations
19 . 1 Permitted Uses
No land shall be used and no buildings or
structures shall be erected, used, or altered in
the Hazard Land (HL) Zone except for the following
purposes:
agricultural uses
conservation area
forestry use
private park
public park
public utility and transmission facilities and
works
recreational uses
flood and erosion control facilities and works .
19.2 Permitted Buildings and Structures
Buildings and structures for the permitted uses
which have been approved by the Conservation
Authority.
19 .3 Prohibited Buildings and Structures
All habitable buildings and structures
19 .4 Exceptions - Hazard Land (HL) Zone
19 .4 . 1
19 .4 . 1. 1 Defined Area
HL-1 as shown on Schedule `A' Map 81 to this By-
law.
19 .4 . 1 . 2 Extent of the Special Hazard Land (HL-1) Zone
All lands below the 195.0 metre elevation are
within the Special Hazard Land (HL-1) Zone.
19 .4 .2
19 .4 .2 . 1 Defined Area
HL-2 as shown on Schedule 'A' , Map 66 to this By-
law.
19 .4 .2 .2 Extent of the Special Hazard Land (HL-2) Zone
All lands below the 213.5 metre elevation are
within the Special Hazard Land (HL-2) Zone.
19 .4.3
19 .4 .3. 1 Defined Area
HL-3 as shown on Schedule 'A' , Map 50 to this By-
law.
19.4.3.2 Extent of the Special Hazard Land (HL-3) Zone
All lands below the 206.0 metre elevation are
within the Special Hazard Land (HL-3) Zone. "
2 . THAT By-law No. 2387, as amended, is hereby further amended
by amending Schedule 'A' , Map 81 be deleting from the Rural
Residential (RR) Zone and adding to the Special Hazard Land
(HL-1) Zone, those lands enclosed in heavy solid lines and
marked HL-1 on Schedule 'A' Map 81 this By-law, which
schedule is attached to and forms part of this By-law.
3. THAT By-law No. 2387 , as amended, is hereby further amended
by amending Schedule 'A' , Map 66 by deleting from the Rural
Residential (RR) Zone and adding to the Special Hazard Land
(HL-2) Zone, those lands enclosed in heavy solid lines and
marked HL-2 on Schedule 'A' Map 66 to this By-law, which
schedule is attached to and forms part of this By-law.
4. THAT By-law No. 2387, as amended, is hereby further amended
by amending Schedule 'A' , Map 50 by deleting from the
Special Rural Residential (RR-8 and RR-9) Zones and adding
to the Special Hazard Land (HL-3) Zone, those lands enclosed
in heavy solid lines and marked HL-3 on Schedule `A' Map 50
to this By-law, which schedule is attached to and forms part
of this By-law.
5. THAT By-law No. 2387, as amended is hereby further amended
by deleting Subsection 7 . 11.8 in its entirety and replacing
it with the following:
"7 . 11.8

RR-8 as shown on Schedule 'A' , Map 50 to this
By-law.
7 . 11. 8.2 Permitted Uses
One single family detached dwelling unit in
addition to all other permitted uses in the
Rural Residential (RR) Zone.
7 . 11 .8.3 Permitted Buildings and Structures
Buildings and Structures for the permitted
uses .
7 . 11.8 .4 Minimum Lot Frontage
61 .0 metres .
7 . 11.8.5 Minimum Dwelling Unit Floor Area
148.0 square metres. "
6. THAT By-law No. 2387 as amended is hereby further amended by
deleting Subsection 7 . 11.9 in its entirety and replacing it
with the following:

7 . THIS By-law comes into force:
a) where no notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board.

NOTICE OF THE PASSING
OF A ZONING BY-LAW BY
THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
TAKE NOTICE that the Council of the Corporation of the Township
of Bayham passed By-Law No. Z228-90 on the / th day of April, 1990
under Section 34 of THE PLANNING ACT, 1983.
AND TAKE NOTICE that any person or agency may appeal to the
Ontario Municipal Board in respect of the By-law by filing with
the Clerk of the Township of Bayham not later than the YfA day of
May, 1990, a notice of appeal setting out the objection to the
By-law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-law,
describing the lands to which the By-law applies, and a Key Map
showing the location of the lands to which the By-law applies
(or, alternatively an explanation as to why a key map is not
provided) are attached. The complete By-law is available for
inspection in my office during regular office hours .

EXPLANATORY NOTE
The purpose of By-law No. Z228-90 is two-fold. Firstly, it will
expand the Township of Bayham's Comprehensive Zoning By-law No.
2387 by adding a new zone namely, Hazard Land (HL) Zone
regulations to the document. Secondly, it will rezone three
parcels of land to the newly created Hazard Land (HL) Zone.
The zoning amendments are required in order that the zoning on
each parcel of land conform to the existing Hazard Lands
designation. All three parcels were the subject of earlier
Official Plan Amendments which received approval subject to
Minister's Modifications. The modifications removed portions of
land intended to be redesignated through the Official Plan
amendment process thereby leaving certain areas in the Hazard
Lands designation.
The location of the three parcels as indicated on the key map are
as follows:
1. Part Lot 14, Concession 1
2 . Part Lot 11, Concession 3
3. Part Lot 2, Concession 5
