Z220-90 BEING A BY-LAW TO AMEND BY-LAW NO. 2387 WHEREAS the Council of the Corporation of the Township of Bayham deems it necessary to amend its Zoning By-law No. 2387; THEREFORE, the Council of the Corporation of the Township of Bayham enacts as follows: 1. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule 'E' , by deleting from the Special Hamlet Residential (HR-10) Zone and adding to the Hamlet Residential (HR) Zone, those lands enclosed in heavy solid lines and marked HR on Schedule 'A' to this By-law, which schedule is attached to and forms part of this By-law. 2 . THAT By-law No. 2387, as amended, is hereby further amended by deleting section 2 . 112 in its entirety and replacing it with the following: "2 . 112 SERVICE SHOP, shall mean any building or part thereof where appliances, equipment, instruments, and machinery are sold, serviced, or repaired and includes building trades establishments but excludes any manufacturing, processing, or wholesaling. " 3 . THAT By-law No. 2387, as amended, is hereby further amended by deleting section 6 . 12 .9 in its entirety and replacing it with the following: "6 . 12 .9 6 . 12 . 9 . 1 DEFINED AREA HR-10 as shown on Schedule 'E' to this By-law 6 . 12 .9 .2 PERMITTED USES - service shop - inside storage - pumphouse for a communal well system - all uses permitted in the Hamlet Residential (HR) Zone 6 . 12 . 9 . 3 PERMITTED BUILDINGS &STRUCTURES Buildings & Structures for the Permitted Uses. 6 . 12 .9 .4 MINIUM LOT AREA 2625.0 m2 6 . 12 .9 .5 MINIUM LOT FRONTAGE 79.50 m2 -2- 4 . THIS By-law comes into force: a) where no notice of objection has been filed with the Township's Clerk within the time prescribed by the Planning Act, 1983 and regulations pursuant thereto, upon the expiration of the prescribed time; or b) where notice of objection has been filed with the Township's Clerk within the time prescribed by the Planning Act, 1983 and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. REEVE CLERK FORM 1 PLANNING ACT, 1983 NOTICE OF THE PASSING OF A ZONING BY-LAW BY THE CORPORATION OF THE TOWNSHIP OF BAYHAM TAKE NOTICE that the Council of the Corporation of the Township of Bayham passed By-Law No. Z220-90 on the 4th day of January, 1990 under Section 34 of THE PLANNING ACT, 1983. AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing with the Clerk of the Township of Bayham not later than the 30th day of January, 1990, a notice of appeal setting out the objection to the By-law and the reasons in support of the objection. An explanation of the purpose and effect of the By-law, describing the lands to which the By-law applies, and a Key Map showing the location of the lands to which the By-law applies (or, alternatively an explanation as to why a key map is not provided) are attached. Petrie Clerk Township of Bayham Box 160 STRAFFORDVILLE, Ontario NOJ 1Y0 EXPLANATORY NOTE The purpose of By-law No. 220-90 is three-fold. Firstly, it will change the zoning on a 0 . 34 hectare (0. 85 acre) parcel of land situated on the west side of Mill Street in the hamlet of Richmond on Parts 2 and 3 of Registered Plan No. 11R-3653, Township of Bayham from the Special Hamlet Residential (HR-10) Zone to the Hamlet Residential (HR) Zone. Secondly, it will revise the provisions of the Special Hamlet Residential (HR-10) Zone which applies to Part 1 of the above-noted Registered Plan by expanding the permitted uses. Thirdly, it will expand the Service Shop definition in order to improve the level of interpretation. The effect of this By-law will be to recognize existing hamlet residential use on Part 2 and 3 of Registered Plan 11R-3653 which has occurred as a result of an earlier severance which divided the original Special Hamlet Residential (HR-10) block into three seperate lots. The revised Special Residential (HR-10) Zone provisions will recognize additional permitted uses on the lands in order to facilitate a pipe organ service and storage business . The Service Shop definition has been expanded to include the selling, servicing or repairing of equipment and instruments . It is the applicant's intent to enlarge the existing storage structure on Part 1 of Registered Plan 11R-3653 by approximately 93 m2 to accommodate the pipe organ service and storage business.
