BY-LAW NO. Z218-89
BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of Bayham
deems it necessary to amend its Zoning By-law No. 2387;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows:
1. THAT By-law No. 2387, as amended, is hereby further amended
by amending Section 2, Definitions, by adding the following
new subsection immediately after subsection 2 . 141 :
"2 . 142 MOBILE HOME SITE, shall mean an area of land
within a mobile home park that is intend to be
occupied by one mobile home and which may be owned
by the occupant of the mobile home or by the owner
of the mobile home park. "
2 . THAT By-law No. 2387 , as amended, is hereby further amended
by adding a new Section immediately after Section 17 ,
Highway Commercial (HWC) Zone Regulations as follows:
"Section 18 - MOBILE HOME PARK MH ZONE REGULATI•NS
18. 1 PERMITTED USES
No land shall be used and no buildings or
structures shall be erected, used, or altered in
the Mobile Home Park (MH) Zone except for the
following purposes :
mobile home park
one mobile home on one mobile home site
private garage or carport as an accessory use
18.2 MINIMUM LOT AREA
a) Mobile Home Park 4 .0 hectares
b) Mobile Home Site
where a public or communal 1200. 0 m2
water supply is not available
where a public or communal 464 . 0 m2
water supply is available
18 .3 MINIMUM LOT FRONTAGE FOR A MOBILE HOME SITE
without a public or communal 30 . 0 metres
water supply
with a public or communal 19 .0 metres
water supply

18 .4 MAXIMUM COVERAGE 35 percent

3 . THAT Schedule 'A' , Map 14 to By-law 2387 , as amended, is
hereby further amended by deleting from the Special
Agricultural (A1-1) Zone and the Agricultural (A1) Zone and
adding to the Mobile Home Park (MH) Zone, those lands
enclosed in heavy solid lines and marked MH on Schedule 'A'
to this By-law, which schedule is attached to and forms part
of this By-law.

4. THAT By-law No. 2387, as amended, is hereby further amended
by amending Schedule 'A' , Map 14 by deleting from the
Agricultural (A1) Zone and adding to the Open Space (OS)
Zone, those lands enclosed in heavy solid lines and marked
OS on Schedule 'A' to this By-law, which schedule is
attached to and forms part of this By-law.
5 . THIS By-law comes into force:
a) where no notice of objection has been filed with tha
Township's Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board.

NOTICE OF THE PASSING
OF A ZONING BY-LAW BY
THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
TAKE NOTICE that the Council of the Corporation of the Township
of Bayham passed By-Law No. Z218-89 on the 7th day of December,
1989 under Section 34 of THE PLANNING ACT, 1983.
AND TAKE NOTICE that any person or agency may appeal to the
Ontario Municipal Board in respect of the By-law by filing with
the Clerk of the Township of Bayham not later than the 11th day
of January, 1990, a notice of appeal setting out the objection to
the By-law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-law,
describing the lands to which the By-law applies, and a Key Map
showing the location of the lands to which the By-law applies
(or, alternatively an explanation as to why a key map is not
provided) are attached. The complete By-law is available for
inspection in my office during regular office hours.

EXPLANATORY NOTE
The purpose of By-law No. Z218-89 is two-fold. Firstly, it will
change the zoning on a 22 .83 hectare (56 .41 acre) parcel of land
located on Part Lots 23 and 24, Concession 9, in the Township of
Bayham, from the Agricultural (Al) Zone and Special Agricultural
(Al-1) Zone to the Mobile Home Park (MH) Zone. Secondly, it will
change the zoning on a 0.65 hectare ( 1.59 acre) strip of land
which forms the northern boundary of the same parcel of land from
the Agricultural (Al) Zone to the Open Space (OS) Zone.
The subject lands intended to be rezoned to the Open Space (OS)
Zone are comprised of a small tributary and associated wooded
gully. The lands below the defined top-of-bank which are
proposed to be zoned Open Space have been deemed to be hazardous
and thus development will be regulated subject to the Hazard Land
policies of the Official Plan of the Township of Bayham. The
lands intended to be rezoned to the Mobile Home Park (MH) Zone
are comprised of the wooded portion and agricultural area of the
plateau lands. An existing mobile home park is located in the
extreme southeast corner of the subject lands.
The effect of this By-law will be to permit an expansion of the
Mobile Home Park. This By-law is intended to implement the
policies of Official Plan Amendment No. 64 which designates the
parcel of land as "Rural Non-Farm Area No. 13" .
