BY-LAW NO. Z183-89
BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of
Bayham deems it necessary to amend its Zoning By-law No . 2387;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows :
1. THAT By-law No. 2387 , as amended , is hereby further
amended by amending Section 7 , Rural Residential (RR) Zone
Regulations by adding a new subsection to Section 7. 11 ,
Exceptions - RR Zone as follows :
"7 .11.5
7. 11.5.1 Defined Area
RR-5 as shown on Schedule ' A' , Map 19 to this
By-law.
7. 11. 5.2 Permitted Uses
greenhouse, as an accessory use in addition to
all other permitted uses in the Rural
Residential Zone.
7 .11.5.3 Permitted Buildings and Structures
Existing buildings and structures for the
permitted uses. "
2. THAT By-law No . 2387 , as amended , is hereby further
amended by amending Schedule ' A' , Map 19 by. deleting from
the Agricultural (Al) Zone and adding to the Special Rural
Residential (RR-5) Zone, those lands enclosed in heavy
solid lines and marked RR-5 on Schedule 'A' to this
By-law, which schedule is attached to and forms part of
this By-law.
3. THAT By-law No . 2387, as amended, is hereby further
amended by amending Section 5, Agricultural (Al) Zone
Regulations by adding a new subsection to Section 5.11
EXCEPTIONS - Al Zone as follows :
"5.11.16
5.11.16.1 Defined Area
A1-16 as shown on Schedule 'A' , Map 19 to this
By-law.
5. 11. 16.2 Minimum Lot Area
19 .75 hectares ."
4. THAT By-law No. 2387 , as amended , is hereby further
amended by amending Schedule ' A' , Map 19 by deleting from
the Agricultural (Al) Zone and adding to the Special
Agricultural (A1-16) Zone, those lands enclosed in heavy
solid lines and marked A1-16 on Schedule ' A' to this
By-law, which schedule is attached to and forms part of
this By-law.

5. THIS By-law comes into force :
a) where no notice of objection has been filed with the
Township' s Clerk within the time prescribed by the
Planning Act 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the
Township' s Clerk within the time prescribed by the
Planning Act 1983 and regulations pursuant thereto ,
upon the approval of the Ontario Municipal Board .
READ a FIRST time this 16th day of March, 1989 .
READ a SECOND time this 16th day of March, 1989 .
READ a THIRD time and FINALLY PASSED this 16th day of March,
1989.

NOTICE OF THE PASSING
OF A ZONING BY-LAW BY
THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
TAKE NOTICE that the Council of the Corporation of the Township
of Bayham passed By-Law No . ZI83-89 on the 16th day of March,
1989 under Section 34 of THE PLANNING ACT, 1983 .
AND TAKE NOTICE that any person or agency may appeal to the
Ontario Municipal Board in respect of the By-Law by filing with
the Clerk of the Township of Bayham not later than the 20th day
of April , 1989 , a notice of appeal setting out the objection to
the By-Law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-Law,
describing the lands to which the By-Law applies, and a key map
showing the location of the lands to which the By-Law applies
(or , alternatively an explanation as to why a key map is not
provided) are attached . The complete By-Law is available for
inspection in my office during regular office hours.

EXPLANATORY NOTE
The purpose of By-law No . Z183-89 is two-fold. Firstly, it
will change the zoning on a recently severed 0. 45 hectare (1.1
acres) parcel of land situated on the west side of Side Road
No . 16 in Part of Lot 16, Concession 8, in the Township of
Bayham, from the Agricultural (Al) Zone to the Special Rural
Residential (RR-5) Zone. Secondly, it will rezone the retained
parcel of land from the Agricultural (Al) Zone to the Special
Agricultural (A1-16) Zone to recognize a minimum lot area
deficiency.
The effect of this By-law will be to permit the creation of one
rural residential lot which presently contains a house, garage
and a greenhouse pursuant to the process of severance and
conveyance. This By-law will also recognize the minimum lot
area deficiency of the retained parcel of land . The Special
Rural Residential (RR-5) Zone is also necessary in order to
recognize an existing greenhouse which is located on the
subject lands as being a permitted accessory structure. This
By-law is intended to implement the policies of Official Plan
Amendment No. 38 which designates the recently severed lands as
"Rural Residential" .
