BY-LAW NO. Z177-89
BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of
Bayham deems it necessary to amend its Zoning By-law No . 2387;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows :
1. THAT By-law No . 2387 , as amended , is hereby further
amended by amending Schedule "A" , Map 81 by deleting from
the Agricultural (Al) Zone and adding to the Rural
Residential (RR) Zone, those lands enclosed in heavy solid
lines and marked RR on Schedule "A" to this By-law, which
schedule is attached to and forms part of this By-law.
2. THAT By-law No. 2387 , as amended, is hereby further
amended by amending Section 2, DEFINITIONS by adding a new
subsection as follows :
"2 . 139 APIARY, shall mean a place in which a number
of beehives are kept, a bee farm."
3. THAT By-law No. 2387 , as amended , is hereby further
amended by amending Section 5, Agricultural (Al) Zone
Regulations by adding a new subsection to Section 5. 11
Exceptions - Al Zone as follows :
"5.11. 13
5.11 .13 .1 Defined Area
Al-13 as shown on Schedule 'A' , Map 81 to this
By-law.
5. 11. 13 .2 Permitted Uses
Apiary
5 . 11. 13.3 Prohibited Uses
The keeping or raising of livestock as defined
in subsection 2. 60 of the By-law.
5.11. 13.4 Permitted Buildings and Structures
Buildings and structures for the permitted
uses;
Accessory buildings and structures for the
permitted uses .
5 . 11.13 .5 Minimum Lot Area
8 .50 hectares."
4. THAT By-law No . 2387, as amended, is hereby further
amended by amending Schedule "A" , Map 81 by deleting from
the Agricultural (Al) Zone and adding to the Special
Agricultural (A1-13) Zone, those lands enclosed in heavy
solid lines and marked Al-13 on Schedule "A" to this
By-law, which schedule is attached to and forms part of
this By-law.

5. THIS By-law comes into force :
a) where no notice of objection has been filed with the
Township ' s Clerk within the time prescribed by the
Planning Act 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the
Township' s Clerk within the time prescribed by the
Planning Act 19R1 and regulations pursuant thereto ,
upon the approval of the Ontario Municipal Board .
READ a FIRST time this 2nd day of March, 1989 .
READ a SECOND time this 2nd day of March, 1989 .
READ a THIRD time and FINALLY PASSED this 2nd day of March,
1989 .

NOTICE OF THE PASSING
OF A ZONING BY—LAW BY
THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
TAKE NOTICE that the Council of the Corporation of the Township
of Bayham passed By-Law No . Z177-89 on the 2nd day of March,
1989 under Section 34 of THE PLANNING ACT, 1983 .
AND TAKE NOTICE that any person or agency may appeal to the
Ontario Municipal Board in respect of the By-Law by filing with
the Clerk of the Township of Bayham not later than the 6th day
of April , 1989 , a notice of appeal setting out the objection to
the By-Law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-Law,
describing the lands to which the By-Law applies , and a key map
showing the location of the lands to which the By-Law applies
(or , alternatively an explanation as to why a key map is not
provided) are attached . The complete By-Law is available for
inspection in my office during regular office hours.

EXPLANATORY NOTE
The purpose of By-law No. Z177-89 is two-fold . First it is
proposed to change the zoning on a 0 . 66 hectare ( 1 . 64 acre)
parcel of land which is intended to be retained as a result of
a recent severance which was approved by the County of Elgin
Land Division Committee . The subject lands are located on the
south side of the road allowance in the north half of Part of
Lot 14 , Concession 1, in the Township of Bayham. It is
proposed to rezone the subject lands from the Agricultural (Al)
Zone to the Rural Residential (RR) Zone.
Secondly, it is proposed to rezone the severed parcel of land
from the Agricultural (Al) Zone to the Special Agriculture
(A1-13) Zone to recognize an apiary as a permitted use on the
subject lands as well as to recognize a deficiency in the
minimum lot area requirements .
The effect of this By-law will be to recognize the rural
residential nature of the retained lot and to permit an apiary
on the recently severed parcel of land . This By-law is
intended to implement the policies of Official Plan Amendment
No . 32 which designates the retained parcel of land as "Rural
Residential" .
