BY-LAW NO. z167-88
BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of
Bayham deems it necessary to amend its Zoning By-law No . 2387;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows:
1 . THAT By-law No . 2387, as amended , is hereby further
amended by amending Section 2, DEFINITIONS by adding the
following subsection after Subsection 2. 136 :
"2. 137 DWELLING SEASONAL SUPPLEMENTARY, shall mean a
building or structure but not including a
mobile home which is used or intended to be
used for accommodating seasonal temporary farm
labour , but not used or intended to be used as
a primary residence, a permanent dwelling or
for the use of continuous habitation.
2 . THAT By-law No. 2387, as amended , is hereby further
amended by amending Section 7, Rural Residential (RR) Zone
regulations by adding after subsection 7. 10, Minimum
Distance Separation Distance a new subsection 7. 11
Exceptions - RR Zone:

RR-1 as shown on Schedule "A" , Map 60 to this
By-law.
7 .11 . 1. 2 Permitted Uses
- one seasonal supplementary dwelling
-- the commercial production of earthworms as
an accessory use within the permitted
dwelling .

8500 square metres
7. 11.1.4 Minimum Lot Frontage
85.0 metres
7 .11 .1.5 Minimum Floor Area
55.0 square metres
7. 11.1.6 Minimum Lot Depth

3 . THAT Schedule "A" , Map No. 60 to By-law 2387 , as amended ,
is hereby further amended by deleting from the Agricul-
tural (A1) Zone and adding to the Special Rural
Residential (RR-1) Zone those lands enclosed in heavy
solid lines and designated RR-1 on Schedule "A" to this
By-law, which Schedule is attached to and forms part of
this By-law.
4 . THIS By-law comes into force:
a) where no notice of objection has been filed with the
Township' s Clerk within the time prescribed by the
Planning Act 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the
Township' s Clerk within the time prescribed by the
Planning Act 1983 and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board .
READ a FIRST time this 7th day of July, 1988.
READ a SECOND time this 7th day of July, 1988.
READ a THIRD time and FINALLY PASSED this 7th day of July,
1988.

NOTICE OF THE PASSING
OF A ZONING BY-LAW BY
THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
TAKE NOTICE that the Council of the Corporation of the Township
of Bayham passed By-Law No. Z167-88 on the 7th day of July,
1988 under Section 34 of THE PLANNING ACT, 1983 .
AND TAKE NOTICE that any person or agency may appeal to the
Ontario Municipal Board in respect of the By-Law by filing with
the Clerk of the Township of Bayham not later than the 11th day
of August, 1988 , a notice of appeal setting out the objection
to the By-Law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-Law,
describing the lands to which the By-Law applies, and a key map
showing the location of the landa to which the By- Law applies
(or , alternatively an explanation as to why a key map is not
provided) are attached. The complete By--Law is available for
inspection in my office during regular office hours.

EXPLANATORY NOTE
The purpose of By-law No . Z167-88 is to rezone a .85 hectare
(2 . 1 acre) parcel of land located in part of Lot 13 , Concession
4 just north of the Village of Vienna from the Agricultural
(A1) Zone to the Special Rural Residential (RR--1) Zone. The
subject lands are a newly created lot as a result of a recent
decision by the Elgin County Land Division Committee.
The effect of this By-law will be to permit the construction of
a seasonal supplementary dwelling which is intended to
accommodate temporary farm workers during the summer . It is
also proposed that a portion of the dwelling will be utilized
for the commercial production of earthworms.
Any development of the subject property will be regulated by
the policies of Section 4.12.1 of the Township of Bayham Zoning
By-law No . 2387 , as amended and subject to written approval by
the Long Point: Region Conservation Authority. This By-law is
intended to implement the policies of Official Plan Amendment
No . 22 which designates the subject lands as "Rural Non Farm
Area 7" .
