BY-LAW NO. Z149-87
BEING A BY-LAW TO AMEND BY-LAW NO. 2040
WHEREAS the Council of the Corporation of the Township of
Bayham deems it necessary to amend its Zoning By-law No. 2040;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows :
1 . THAT By-law No. 2040, as amended , is hereby further
amended by amending Schedule 'A' - Map Part 3, by deleting
from the Agricultural (A1) Zone and adding to the Special
Rural Residential (RR-4) Zone those lands enclosed in
heavy solid lines and designated RR-4 on Schedule "A" to
this By-law, which schedule is attached to and forms part
of this By-law.
2. THAT By-law No. 2040, as amended, is hereby further
amended by adding the following subsections to subsection
7. 11 , Exceptions - RR Zone:
"7 . 11.4
7. 11. 4. 1 Defined Area
RR-4 as shown on Schedule "A" - Map Part 3
7. 11. 4. 2 Minimum Separation Distance for Dwelling
from Existing Livestock Barn
123 metres
7. 11. 4. 3 Minimum Side Yard for Dwelling
61 metres measured along Highway No . 3 from the
southwesternmost point of the lot.
7. 11. 4. 4 Permitted Buildings and Structures
Buildings and structures for the permitted uses

in `accordance with the regulations of this
By-law.
Accessory buildings and structures. "
2. THIS By-law comes into force:
a) where no notice of objection has been filed with the
Township' s Clerk within the time prescribed by the
Planning Act 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the
Township' s Clerk within the time prescribed by the
Planning Act 1983 and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board .
READ a FIRST time this 19th day of February, 1987.
READ a SECOND time this 19th day of February, 1987.
READ a THIRD time and FINALLY PASSED this 19th day of February,
1987.

TAKE NOTICE THAT THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF BAYHAM PASSED BY-LAW #Z149-87 ON THE 19TH. DAY OF FEBRUARY
1987 UNDER SECTION 34 OF THE PLANNING ACT, 1983.
AND TAKE NOTICE THAT ANY PERSON OR AGENCY MAY APPEAL TO THE
ONTARIO MUNICIPAL BOARD IN RESPECT OF THE BY-LAW BY FILING WITH
THE CLERK OF THE TOWNSHIP OF BAYHAM NOT LATER THAN THE 26TH
DAY OF MARCH, 1987, A NOTICE OF APPEAL SETTING OUT THE
OBJECTION TO THE BY-LAW AND THE REASONS IN SUPPORT OF THE
OBJECTION.
AN EXPLANATION OF THE PURPOSE AND EFFECT OF THE BY-LAW,
DESCRIBING THE LANDS TO WHICH THE BY-LAW APPLIES, AND A KEY MAP
SHOWING THE LOCATION OF THE LANDS TO WHICH THE BY-LAW APPLIES
(OR, ALTERNATIVELY AN EXPLANATION AS TO WHY A KEY MAP IS NOT
PROVIDED) ARE ATTACHED. THE COMPLETE BY-LAW IS AVAILABLE FOR
INSPECTION IN MY OFFICE DURING REGULAR OFFICE HOURS.

EXPLANATORY NOTE
The purpose of By-law No. 2149-87 is to change the zoning on a
parcel of land from the Agricultural (Al) Zone to the Special
Rural Residential (RR-4) Zone. The subject lands are comprised
of approximately 1. 1 hectares (2. 79 acres) and are located on
the south side of Highway No. 3, in Part Lot 18, Concession 10,
in the Township of Bayham. A wooded gully and ravine system
physically separates the subject lands from surrounding pro-
perty. Existing land uses in the area include a mixture of
agricultural , rural residential and rural commercial uses,
however, the subject lands are vacant.
The effect of this By-law will be to recognize the creation of
a rural residential building lot pursuant to the process of
severance and conveyance and to permit the establishment of a
single family detached dwelling thereon. This By-law is
intended to implement the policies of Official Plan Amendment
No. 8 , which designates the subject lands as "Rural
Residential".
