BY-LAW NO. Z145-86
BEING A BY-LAW TO AMEND BY-LAW NO. 2040
WHEREAS the Council of the Corporation of the Township of
Bayham deems it necessary to amend its Zoning By-law No. 2040;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows:
1. THAT By-law No. 2040, as amended, is hereby further
amended by amending Section 10, Rural Commercial Zone
Regulations by deleting subsection 10.10.16.3 and
replacing it with the following:
"10.10.16.3 Permitted Buildings and Structures
Buildings and structures for the
permitted uses."
2. THAT By-law No. 2040, as amended, is hereby further
amended by amending Schedule "A" Map 25 by deleting from
the Special Rural Commercial (RC-16) Zone and adding to
the Agricultural (Al) Zone and deleting from the
Agricultural (Al) Zone and adding to the Special Rural
Commercial (RC-16) Zone those lands outlined in heavy
solid lines and designated Al and RC-16 respectively on
Schedule "A" to this By-law which schedule is attached to
and forms part of this By-law.
3. THIS By-law comes into force:
a) where no notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act 1983 and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board.
READ a FIRST time this 20th day of November 1986.
READ a SECOND time this 20th day of November 1986.
READ a THIRD time and FINALLY PASSED this 20th day of November
1986.

TAKE NOTICE THAT THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF BAYHAM PASSED BY-LAW #Z145-86 ON THE 20TH. DAY OF NOVEMBER,
1986 UNDER SECTION 34 OF THE PLANNING ACT, 1983.
AND TAKE NOTICE THAT ANY PERSON OR AGENCY MAY APPEAL TO THE
ONTARIO MUNICIPAL BOARD IN RESPECT OF THE BY-LAW BY FILING WITH
THE CLERK OF THE TOWNSHIP OF BAYHAM NOT LATER THAN THE 29TH.
DAY OF DECEMBER, 1986, A NOTICE OF APPEAL SETTING OUT THE
OBJECTION TO THE BY-LAW AND THE REASONS IN SUPPORT OF THE
OBJECTION.
AN EXPLANATION OF THE PURPOSE AND EFFECT OF THE BY-LAW,
DESCRIBING THE LANDS TO WHICH THE BY-LAW APPLIES, AND A KEY MAP
SHOWING THE LOCATION OF THE LANDS TO WHICH THE BY-LAW APPLIES
(OR, ALTERNATIVELY AN EXPLANATION AS TO WHY A KEY MAP IS NOT
PROVIDED) ARE ATTACHED. THE COMPLETE BY-LAW IS AVAILABLE FOR
INSPECTION IN MY OFFICE DURING REGULAR OFFICE HOURS.

EXPLANATORY NOTE
The purpose of By-law No. Z145-86 is to change the zoning
regulations as they pertain to a site specific Rural Commercial
Zone and to correct a mapping oversight in By-law No. 2040 that
resulted in a residential lot being inadvertently zoned Special
Rural Commercial. The subject lands are located along the west
side of Highway No. 19 in part of Lot 15, Concession V and
consist of two adjacent lots. The southern-most lot, a .32
hectare site, contains an existing commercial building and is
presently zoned Agricultural (Al) . The lot to the north
contains a residential dwelling unit and is zoned for a Special
Rural Commercial Use.
The effect of this By-law will be to rezone the two properties
according to the original intent of the By-law which would
result in their being zoned according to their present use and
to permit the establishment of a single family dwelling as an
accessory use on the existing commercial site.
