BY-LAW NO. Z142-86
BEING A BY-LAW TO AMEND BY-LAW NO. 2040
WHEREAS the Council of the Corporation of the Township of
Bayham deems it necessary to amend its Zoning By-law No . 2040;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows :
1. THAT By-law No . 2040 , as amended , is hereby further
amended by amending Section 10 . 10 Special Use Regulations -
Rural Commercial Zone by adding a new subsection as follows :
"10 . 10 . 25
10 . 10.25,1 Defined Area
RC-25 as shown on Schedule "A" to this By-law.
10 . 10 . 25 . 2 Permitted Uses
Service shop and one single family detached
dwelling unit as an accessory use .
10 . 10. 25 . 3 Permitted Buildings and Structures
Buildings and structures for the permitted
uses . "
2 . THAT Schedule "A" to By-law No . 2040 , as amended , is
hereby further amended by deleting from the Agricultural
(Al) Zone and adding to the special Rural Commercial (RC-25)
Zone those lands enclosed in heavy solid lines and
designated RC-25 on Schedule "A" to this By-law, which
schedule is attached to and forms part of this By-law and
which schedule shall be deemed to be known as Schedule "A" ,
Map 58 to By-law No . 2040.
3 . THAT Schedule "A" to By-law No. 2040 , as amended , is
hereby further amended by deleting from the Agricultural
(Al) Zone and adding to the Rural Residential (RR) Zone
those lands enclosed in heavy solid lines and designated
"RR" on- Schedule "A" to this By-law.
4 . THIS By-law comes into force :
a) where no notice of objection has been filed with the
Township ' s Clerk within the time prescribed by the
Planning Act 1983 and regulations pursuant thereto , upon
the expiration of the prescribed time; or
b) where notice of objection has been filed with the
Township ' s Clerk within the time prescribed by the
Planning Acs 1983 and regulations pursuant thereto , upon
the approval of the Ontario Municipal Board.
READ a FIRST time this 7th day of August 1986 .
READ a SECOND time this 7th day of August 1986 ,
READ a THIRD time and FINALLY PASSED this 7th day of August 1986 .

TAKE NOTICE THAT THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF BAYHAM PASSED BY-LAW #Z142-86 ON THE 7TH DAY OF AUGUST, 1986
UNDER SECTION 34 OF THE PLANNING ACT, 1983 .
AND TAKE NOTICE THAT ANY PERSON OR AGENCY MAY APPEAL TO THE
ONTARIO MUNICIPAL BOARD IN RESPECT OF THE BY-LAW BY FILING WITH
THE CLERK OF THE TOWNSHIP OF BAYHAM NOT LATER THAN THE 11TH DAY
OF SEPTEMBER, 1986 , A NOTICE OF APPEAL SETTING OUT THE OBJECTION
TO THE BY-LAW AND THE REASONS IN SUPPORT OF THE OBJECTION.
AN EXPLANATION OF THE PURPOSE AND EFFECT OF THE BY-LAW,
DESCRIBING THE LANDS TO WHICH THE BY-LAW APPLIES, AND A KEY MAP
SHOWING THE LOCATION OF THE LANDS TO WHICH THE BY-LAW APPLIES
(OR, ALTERNATIVELY AN EXPLANATION AS TO WHY A KEY MAP IS NOT
PROVIDED) ARE ATTACHED. THE COMPLETE BY-LAW IS AVAILABLE FOR
INSPECTION IN MY OFFICE DURING REGULAR OFFICE HOURS.

EXPLANATORY NOTE
The purpose of By-law Z142-86 is to change the zoning on two
adjacent parcels of land situated on the south side of the Road
Allowance between Concessions 9 and 10 in Lot 22, Concession 9
in the Township of Bayham. The subject lands comprise a total
-trea of approximately 1.6 hectares (4 acres) . The easternmost
parcel of land is occupied by an existing residence and would be
rezoned from the Agricultural (Al) Zone to the Rural Residential
(RR) Zone. A plumbing business is operated from an existing
service shop which is situated on the western portion of the
subject lands. The service shop would be rezoned from the
Agricultural (Al) Zone to the special Rural Commercial (RC-25)
Zone .
The effect of this by-law will be to recognize two existing
non-farm uses on separate lots which have been created via the
process of severance and conveyance .
