BY-LAW NO. Z140-86
A BY-LAW TO AMEND BY-LAW NO. 2040
WHEREAS the Council of the Corporation of the Township of Bayham
has deemed it necessary to amend its Zoning By-law No. 2040;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows :
1. THAT By-law No. 2040 as amended, is hereby further amended
by amending Section 2 - Definitions, by adding a new
subsection after subsection 2.120 as follows:
"2. 121 DWELLING, SEASONAL, shall mean a dwelling which
is used for intermittent residential occupancy
for the enjoyment of the surrounding natural
environment, and such dwelling shall be a single
detached dwelling that is not used for
continuous habitation or as a permanent
residence. "
2 . THAT By-law No . 2040, as amended, is hereby further amended
by amending Section 15, Open Space (OS) Regulations by
adding a new subsection 15 .5, Exceptions - 0S Zone after
subsection 15.4 as follows:
"15 .5 Exceptions - 0S Zone
The special use regulations contained in this
subsection 15.5 shall apply to the areas
defined below:
15.5 . 1
15.5.1.1 Defined Area
OS-1 as shown on Schedule "A" to this By-law.
15 .5 .1.2 Permitted Uses
A private park including two single family
detached dwellings as accessory uses and an
agricultural use notwithstanding those uses
prohibited by this by-law.
15 .5.1. 3 Prohibited Uses
The breeding, care of, or selling of
livestock.
15 .5.1.4 Permitted Buildings and Structures
Existing buildings and structures for
the permitted uses plus two seasonal
dwellings in accordance with the
regulations of section 4 .15 of this
By-law, as amended."
3. THAT Schedule "A" to By-law No. 2040, as amended, is hereby
further amended by deleting from the Agricultural (A1) Zone
and adding to the Special Open Space (OS-1) Zone those lands
enclosed in heavy solid lines and designated 0S-1 on
Schedule "A" to this By-Law which schedule is attached to
and forms part of this By-law and which schedule shall be
deemed to be known as Schedule "A" , Map 57 to By-law No.
2040 .
4 . THIS By-law comes into force:
(a) where no notice of objection has been filed with the
Township' s Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
(b) where notice of objection has been filed with the
Township' s Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board.
READ a FIRST time this 17TH day of JULY, 1986.
READ a SECOND time this 17TH day of JULY, 1986 .
READ a THIRD time and FINALLY PASSED this 17TH day of JULY,
1986 .

TAKE NOTICE THAT THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM PASSED BY-LAW #Z140-86 ON THE 17TH. DAY OF
JULY, 1986 UNDER SECTION 34 OF THE PLANNING ACT, 1983.
AND TAKE NOTICE THAT ANY PERSON OR AGENCY MAY APPEAL TO THE
ONTARIO MUNICIPAL BOARD IN RESPECT OF THE BY-LAW BY FILING WITH
THE CLERK OF THE TOWNSHIP OF BAYHAM NOT LATER THAN THE 21ST. DAY
OF AUGUST, 1986 , A NOTICE OF APPEAL SETTING OUT THE OBJECTION TO
THE BY-LAW AND THE REASONS IN SUPPORT OF THE OBJECTION.
AN EXPLANATION OF THE PURPOSE AND EFFECT OF THE BY-LAW,
DESCRIBING THE LANDS TO WHICH THE BY-LAW APPLIES, AND A KEY MAP
SHOWING THE LOCATION OF THE LANDS TO WHICH THE BY-LAW APPLIES
(OR, ALTERNATIVELY AN EXPLANATION AS TO WHY A KEY MAP IS NOT
PROVIDED) ARE ATTACHED. THE COMPLETE BY-LAW IS AVAILABLE FOR
INSPECTION IN MY OFFICE DURING REGULAR OFFICE HOURS.

EXPLANATORY NOTE
PURPOSE AND EFFECT
The purpose of By-law No. Z140-86 is to rezone a 10.1
hectare (25 acre) parcel of land located on the west side
of Beattie Side Road in part of Lot 113, Concession VI,
(S.T.R. ) in the Township of Bayham. Two single family
detached dwellings and a dining shelter exist on the site.
The effect of this by-law will be to recognize and bring
into conformity the present use of the lands a private park
and campground, and to permit the establishment of two
seasonal dwelling units on the site.
