BY-LAW NO. Z135-86
BEING A BY-LAW TO AMEND BY-LAW NO. 2040
WHEREAS the Council of the Corporation of the Township of Bayham
deems it necessary to amend its Zoning By-law No. 2040;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows :
1. THAT By-law No. 2040, as amended, is hereby further amended
by amending Section 6, Hamlet Residential (HR) Zone
Regulations by adding a new subsection 6 . 10 . 10 after
subsection 6 .10.9 as follows:
"6. 10.10
6.10. 10. 1 Defined Area
HR-10 as shown on Schedule "A" to this By-law.
6.10. 10. 2 Permitted Uses
public garage
- pumphouse for a communal well system
- all uses permitted in the Hamlet Residential
(HR) Zone
6.10 . 10.3 Permitted Buildings and Structures
Existing buildings and structures for the
permitted uses."
2. THAT Schedule "E" to By-law No. 2040, as amended, is hereby
further amended by deleting from the Agricultural (Al) Zone
and the Future Development (FD) Zone, and adding to the
special Hamlet Residential (HR-10) Zone those lands outlined
in heavy solid lines and designated HR-10 on Schedule "A" to
this By-law, which schedule is attached to and forms part of
this By-law.
3 . THIS By-law comes into force:
(a) where no notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
(b) where notice of objection has been filed with the
Township' s Clerk within the time prescribed by the
Planning Act 1983 and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board.
READ a FIRST time this 15th day of May, 1986
READ a SECOND time this 15th day of May, 1986.
READ a THIRD time and FINALLY PASSED this 15th day of May, 1986 .

TAKE NOTICE THAT THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF BAYHAM PASSED BY-LAW NO . 1135-86 ON THE 15TH DAY OF MAY, 1986
UNDER SECTION 34 OF THE PLANNING ACT, 1983.
AND TAKE NOTICE THAT ANY PERSON OR AGENCY MAY APPEAL TO THE
ONTARIO MUNICIPAL BOARD IN RESPECT OF THE BY-LAW BY FILING WITH
THE CLERK OF THE TOWNSHIP OF BAYHAM NOT LATER THAN THE 19TH DAY OF
JUNE , 1986, A NOTICE OF APPEAL SETTING OUT THE OBJECTION TO THE
BY-LAW AND THE REASONS IN SUPPORT OF THE OBJECTION .
AN EXPLANATION OF THE PURPOSE AND EFFECT OF THE BY-LAW, DESCRIB-
ING THE LANDS TO WHICH THE BY-LAW APPLIES, AND A KEY MAP SHOWING
THE LOCATION OF THE LANDS TO WHICH THE BY-LAW APPLIES (OR, ALTER-
NATIVELY, AN EXPLANATION AS TO WHY A KEY MAP IS NOT PROVIDED) ARE
ATTACHED . THE COMPLETE BY-LAW IS AVAILABLE FOR INSPECTION IN MY
OFFICE DURING REGULAR OFFICE HOURS .

EXPLANATORY NOTE
The purpose of By-law No. 2135-86 is to change the zoning on a
parcel of land located on the west side of County Road No . 43
(Mill Street) in the hamlet of Richmond, Township of Bayham,
from the Agricultural (Al) Zone and the Future Development (FD)
Zone, to the special Hamlet Residential (HR--1O) Zone. The
subject lands are comprised of approximately 0.6 hectares (1. 5
acres) and are presently occupied by an existing dwelling, a
barn used as a garage for the repair and storage of motor
vehicles, and a pumphouse for a communal well system.
The effect of this by-law will be to recognize the existing uses
of the subject lands on a new lot which has been separated from
the adjacent farm operation through the process of severance and
conveyance.
