Z132-85 BEING A BY-LAW TO AMEND BY-LAW NO. 2040 WHEREAS the Council of the Corporation of the Township of Bayham deems it necessary to amend its Zoning By-law No. 2040 ; THEREFORE, the Council of the Corporation of the Township of Bayham enacts as follows: 1. THAT By- law No. 2040 , as amended, is hereby further amended by amending SECTION 6 - HAMLET RESIDENTIAL (HR) ZONE REGULATIONS by adding a new subsection to subsection 6. 10 EXCEPTIONS-HR ZONE after subsection 6 .10 .7 as follows: "6 . 10 .8 6 . 10 . 8.1 Defined Area HR-8 as shown on Schedule "A" to this By-law_ 6 .10 . 8.2 Permitted Uses Commercial Greenhouse in addition to all other uses permitted in the Hamlet Residential (HR) Zone. 6 . 10 . 8. 3 Permitted Buildings and Structures Buildings and structures for the permitted uses. 6 . 10 . 8.4 Minimum Lot Area 975 square metres . 6 .10 .8.5 Minimum Lot Frontage i) for a commercial greenhouse 16 metres ii) for a residential dwelling 14 . 5 metres 6 .10 . 8. 6 Minimum Side Yards 2 metres on each side of each building in compliance with subsection 4 .24 . " 2. THAT Schedule "C" to By-law No. 2040, as amended, is hereby further amended by deleting from the Hamlet Residential (HR) Zone and adding to the special Hamlet Residential (HR-8) Zone those lands enclosed in heavy solid lines and designated HR-8 on Schedule "A" to this By-law, which schedule is attached to and forms part of this By-law. 3 . THIS By-law comes into force ; (a) Where no notice of objection has been filed with the Township' s Clerk within the time prescribed by the Planning Act, 1983 and regulations pursuant thereto, upon the expiration of the prescribed time; or (b) where notice of objection has been filed with the Township' s Clerk within the time prescribed by the Planning Act, 1983 and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. READ a FIRST time this 1st day of August, 1985 READ a SECOND time this 1st day of August, 1985 READ a THIRD time and FINALLY PASSED this 1st day of August 1985. DATED AT THE TOWNSHIP OF BAYHAM THIS 1st DAY OFAiigust 1985, J , A, PETRIE CLERK OF THE TOWNSHIP OF BAYHAM BOX 160 STRAFFORDVILLE, ONTARIO NOJ 1YO EXPLANATORY NOTE The purpose of By-law No. Z132-85 is to change the zoning on a property consisting of approximately 0 . 1 hectare (one-quarter acre) , situated at the southwest corner of the intersection formed by County Road No. 46 and the Canadian National Railway in Lot 5, Concession IX, hamlet of Corinth, the Township of Bayham. The effect of this By-law is to permit the development of a commercial greenhouse on an existing hamlet residential property currently occupied in part, by a single-family residential dwel- ling.
