BY-LAW NO. Z127-84
BEING A BY-LAW TO AMEND BY-LAW NO. 2040
WHEREAS the Council of the Corporation of the Township of
Bayham deems it necessary to amend its Zoning By-law No. 2040,
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows:
1 . THAT Schedule 'A' to By-law No. 2040, as amended, is hereby
further amended by deleting from the Agricultural (Al ) Zone
and the Rural Industrial (M2) Zone and adding to the Rural
Residential (RR) Zone those lands enclosed in heavy solid
lines and designated RR on Schedule 'A' to this By-law,
which Schedule is attached to and forms part of this
By-law.
2. THAT Schedule 'A' to By-law No. 2040, as amended, is hereby
further amended by deleting from the Rural Industrial (M2)
Zone and adding to the Agricultural (A1) Zone those lands
enclosed in heavy solid lines and designated Al on Schedule
'A' to this By-law, which Schedule is attached to and forms
part of this By-law.
3 . THAT Schedule 'A' to By-law No. 2040, as amended, is hereby
further amended by the addition of Map Part No. 53 which is
attached to and forms part of this By-law as Schedule 'A' .
4. THIS By-law comes into force:
(a) where no notice of objection has been filed with the
Township' s Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
(b) where notice of objection has been filed with the
Township' s Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board.
READ a FIRST time this 20th day of September, 1584.
READ a SECOND time this 20th day of September, 1984.
READ a THIRD time and FINALLY PASSED this 20th day of September,
1984.

AND TAKE NOTICE THAT ANY PERSON OR AGENCY MAY APPEAL TO THE
ONTARIO MUNICIPAL BOARD IN RESPECT OF THE BY-LAW BY FILING WITH
THE CLERK OF THE TOWNSHIP OF BAYHAM NOT LATER THAN THE 18th DAY
OF October , 1984, A NOTICE OF APPEAL SETTING OUT THE
OBJECTION TO THE BY-LAW AND THE REASONS IN SUPPORT OF THE
OBJECTION •
AN EXPLANATION OF THE PURPOSE AND EFFECT OF THE BY-LAW, DESCRIB-
ING THE LANDS TO WHICH THE BY-LAW APPLIES, AND A KEY MAP SHOWING
THE LOCATION OF THE LANDS TO WHICH THE BY-LAW APPLIES (OR, ALTER-
NATIVELY, AN EXPLANATION AS TO WHY A KEY MAP IS NOT PROVIDED) ARE
ATTACHED. THE COMPLETE BY-LAW IS AVAILABLE FOR INSPECTION IN MY

EXPLANATORY NOTE
i) The purpose of By-law No. Z127-84 is to change the zoning on
two adjacent properties located in Lot 8, Concession IV, in
the Township of Bayham as a condition of severance pursuant
to the settlement of an estate.
The subject lands were, at one time, in agricultural use and
under one ownership. Subsequent to a severance of
approximately one acre from the south-west corner of the
subject lands, for a rural residential farm use, the
remaining 54 acres were rezoned to permit the operation of a
trucking business. The trucking business has since ceased
to exist and a portion of those lands zoned for the trucking
business has been added to the previously severed lot, which
has become a new rural residential lot with an existing
dwelling. The remaining lands, constituting approximately
53 acres, have reverted from the trucking business to
agricultural use.
The effect of this By-law will be to recognize a lot line
adjustment between two lots modified by severance pursuant
to the settlement of an estate, and to permit the existing
uses of a rural residential dwelling and an agricultural use
on the affected properties.
ii) A key map showing the location of the lands to which By-law
No. Z127-84 applies is attached to this By-law.

STATEMENT OF CONFORMITY
TO THE EAST ELGIN OFFICIAL PLAN
(TOWNSHIP OF HAYHAN)
I, J.A. Petrie, the Clerk of the Corporation of the Township
of Bayham have reviewed By-law No. 2127-84 of the Corporation
of the Township of Bayham.
I am in the opinion that:
X The By-law is in conformity with the East Elgin
Official Plan as it applies to the Township of Bayham.
The East Elgin Official Plan does not contain
provisions that apply to land which this By-law
applies.
