CARRIED Number 3 Moved by: Councillor Froese Seconded by: Councillor Donnell THAT Notification of Special Event from Bayham Beachfest be received for information; AND THAT the Council of the Municipality of Bayham approves use of the Port Burwell East Beach for event to be held Friday, August 2, 2019 from 6:00 p.m. until 9:00 p.m., Saturday, August 3, 2019 from 12:00 p.m. until 9:00 p.m. and Sunday, August 4, 2019 from 12:00 p.m. until 10:00 p.m., including a Beverage Garden, subject to meeting the requirements of the Municipal Alcohol Policy, based on an attendance of 250—400 people in the Beverage Garden at any given time, being 100% Smart Serve Trained personnel, including a minimum of eight (8) Smart Serve personnel, plus two (2) extra floor monitors when allowing participants under the age of majority (19) and other volunteer or paid security personnel, as necessary to provide sufficient crowd control and public safety on site during all dates and hours for which the Beverage Garden is open and as listed on the Outdoor Special Occasion Permit Application to be provided to and approved by Council a minimum of three weeks before the event and also subject to: • All alcohol being served in disposable cups, not bottles or cans; • Providing a certificate of insurance, naming the Municipality of Bayham as an additional insured, in the minimum amount of$2 million liability, covering all events; • Obtaining the necessary approvals from Southwestern Public Health Oxford-Elgin-St. Thomas, the Ontario Provincial Police and the Bayham Fire Chief, as per the Municipal Event Notice; 7 2019 Council Minutes February 21, 2019 AND THAT all other terms and conditions of the municipal rental agreement remain in effect; AND THAT a copy of the LCBO liquor license be provided to the Municipality two weeks prior to the event; AND THAT the clean-up of the east beach area and any costs thereof, be the responsibility of the organizers; AND THAT staff provide access to East Beach washroom water and power panel; AND THAT arrangements be made with the Municipality of Bayham Roads Operations Supervisor to provide picnic tables, garbage cans / recycle barrels, pylons, barricades for the pier and staff assistance for installation of fence assembly and removal; AND THAT for the requirements noted above, quantity and location for drop off with map be provided to the Municipality one month prior to the event. CARRIED Number 4 Moved by: Deputy Weisler Seconded by: Councillor Chilcott THAT the Event Road Closure Request Form from the Bayham Beachfest Committee for the Port Burwell Santa Claus Parade be received; AND THAT the Council of the Municipality of Bayham grants permission to use municipal streets within Port Burwell for parade purposes on Saturday, December 7, 2019 subject to the organizers: • providing the municipality with proof of liability insurance coverage naming the Municipality of Bayham as an additional insured, in the minimum amount of$2,000,000.00; • obtaining the necessary approvals from the Ontario Provincial Police and the Bayham Fire Chief (as per completion of the Event Road Closure Request Form and parade route mapping) AND THAT Robinson Street from Brock Street to Wellington Street and Wellington Street from Robinson Street to Elizabeth Street be temporarily closed during the parade between 6:00 p.m. — 8:00 p.m.; AND THAT the County of Elgin be requested for permission to use Wellington Street in Port Burwell between 6:00 p.m. and 8:00 p.m. for the parade; AND THAT the Municipality of Bayham Roads Operations Supervisor be directed to provide the necessary provisions for traffic control and safety. CARRIED 8 2019 Council Minutes February 21, 2019 Number 5 Moved by: Councillor Donnell Seconded by: Deputy Weisler THAT the Event Road Closure Request Form from the Straffordville Hall Foundation regarding Straffordville Santa Claus Parade be received; AND THAT the Council of the Municipality of Bayham grants permission to use municipal streets within Straffordville for parade purposes on Saturday, December 14, 2019 subject to the organizers: • providing the municipality with proof of liability insurance coverage naming the Municipality of Bayham as an additional insured, in the minimum amount of$2,000,000.00; • obtaining the necessary approvals from the Ontario Provincial Police and the Bayham Fire Chief (as per completion of the Event Road Closure Request Form and parade route mapping) AND THAT Heritage Line from Sandytown Road to West Street, Old Chapel Street from Heritage Line to Main Street, Main Street from Old Chapel Street to West Street, West Street from Main Street to Third Street, Third Street from West Street to Plank Road, Plank Road from Third Street to Main Street be temporarily closed during the parade between 10:30 a.m. — 12:00 p.m.; AND THAT the County of Elgin be requested for permission to use Plank Road from Third Street to Main Street and Heritage Line from Sandytown Road to West Street between 10:30 a.m. and 12:00 p.m. for the parade; AND THAT the Municipality of Roads Operations Supervisor be directed to provide the necessary provisions for traffic control and safety. CARRIED Number 6 Moved by: Deputy Mayor Weisler Seconded by: Councillor Donnell THAT the Event Road Closure Request Form from the Straffordville Community Committee regarding Watermelon Fest and Watermelon Fest Parade be received; AND THAT an exemption to permit parking on the west side of Sandytown Road be granted; AND THAT Council grants permission to use municipal streets within Straffordville for parade purposes, on Saturday, August 24, 2019 subject to the organizers: • providing the municipality with proof of liability insurance to cover all events including naming the Municipality of Bayham as an additional insured, in the minimum amount of$2,000,000.00; • obtaining the necessary approvals from the Ontario Provincial Police and 9 2019 Council Minutes February 21, 2019 the Bayham Fire Chief (as per completion of the Event Road Closure Request and parade route mapping); AND THAT Old Chapel Street south from Heritage Line to Main Street and Main Street to Plank Road be closed from 10:00 a.m. - 5:00 p.m.; AND THAT Plank Road from the Straffordville School to Third Street, Main Street from Plank Road to West Street, West Street from Main Street to Third Street, Third Street from West Street to Plank Road and Heritage Line from West Street to Sandytown Road be temporarily closed during the parade from 10:00 a.m. — 11:00 a.m.; AND THAT Council requests permission from the County of Elgin to use Plank Road from the Straffordville School north to Third Street and Heritage Line from West Street to the Sandytown Road on August 24, 2019 between 10:00 a.m. and 11:00 a.m. during the parade in Straffordville; AND THAT the Municipality of Bayham Roads Operations Supervisor be directed to make the necessary arrangements for traffic control, signage and safety, installation and removal of extra garbage cans and picnic tables, staff assistance to clean cement pad (prior to event); AND THAT for the requirements noted above, quantity and location for drop off with map be provided to the Municipality one month prior to the event; AND THAT the cleanup of the park area be the responsibility of the organizers. AND THAT the Council of the Municipality of Bayham approves, subject to provision of certificate of liability insurance in the minimum amount of$2 million, naming the Municipality of Bayham as additional insured: • Use of the parking lot and cement pad for Watermelon Fest on August 23 and 24, 2019 (cleanup of park after the event responsibility of the organizers. CARRIED Number 7 Moved by: Councillor Donnell Seconded by: Councillor Froese THAT Special Event Request Form and correspondence from Bayham Historical Society regarding Vienna Edison Fest, Annual Edison Dinner and Silent Auction be received for information; AND THAT the Council of the Municipality of Bayham approves, subject to provision of certificate of liability insurance in the minimum amount of$2 million, naming the Municipality of Bayham as additional insured for each event: • Use of the Vienna Memorial Park including pavilion and food booth from 9:00 a.m. — 7:00p.m. June 1, 2019; 10 2019 Council Minutes February 21, 2019 AND THAT Council direct staff to provide access to food booth, water and utility panels at the Vienna Memorial Park; AND THAT Council direct staff to provide up to 35 picnic tables, up to 25 waste and recycle receptacles, garbage & recycle bags at Vienna Memorial Park, 12+ safety barrier cones; AND THAT for the requirements noted above, quantity and location for drop off with map be provided to the Municipality one month prior to the event; AND THAT clean-up of all areas and any costs thereof, be the responsibility of the organizers. Council had recommended a reduction to 11,000 m2 (2.71 acres). The amended application still suggests an irregular shaped parcel encompassing the dwelling, existing sheds and storage barn, septic system and well servicing the dwelling, as well as, the west side access to the larger metal barn. The amendment is a compromise to the Council recommended reconfiguration, which unbeknownst to staff/Council at the time would have restricted the west side door access to the barn. Council may refer to previous Staff Report DS-04/19 Froese presented January 17, 2019 for the Staff Report DS-14/19 Froese 2 background and recommended conditions of which are repeated in this report, minus the recommendation to reduce the lot size. BACKGROUND Consent application E14/19 was received from the Elgin County Land Division Committee submitted by Borm Agriculture Inc. proposing to sever a parcel of land 24,129.72 m2(5.96 acres) and to retain 75.7 hectares (187 acres) of land with the intent to add to the adjoining industrial land to the west owned by Borm Capital Inc. (ETBO Tool & Die). The subject lands are described as Concession 4 Part Lot 1 & 2, known municipally as 7202 Richmond Road. The subject lands are designated Agriculture, Natural Gas Reservoir and Natural Heritage on Schedule "Al" Municipality of Bayham: Land Use and Hazard Lands, Significant Woodlands on Schedule "A2" Municipality of Bayham: Constraints in the Official Plan. The lands are zoned Agriculture (Al-A) and LPRCA Regulation Limit on Schedule "A" Map No. 10 in Zoning By-law No. Z456-2003. Elgin County Land Division Committee will consider the application on March 20, 2019. DISCUSSION: The consent would add the lands to the neighbouring industrial property enabling the industrial business, ETBO Tool & Die, to pursue the expansion of their warehouse space by adding on a 2825 m2 addition on the east side of the existing building, as well as, plan for a future easterly expansion in the next 5-10 years. Please refer to the planner's memorandum dated February 28, 2019, which analyzes the application subject to the County Official Plan, Bayham Official Plan and Zoning By-law policies. Based on the review, the planners' memorandum states as their recommendation "that the Staff Report DS-15/19 Borm 2 boundary of consent be revised to include only those lands necessary for the proposed storage building, maintaining a 10 m setback from the east boundary". The memorandum goes on to say that should Council consider the application as presented and are in agreement with the benefit of the larger parcel, the recommended conditions would apply to either a reduced parcel or entire consent lands. Staff appreciate the planners' comments and analysis of the proposal and do recognize the benefit of considering the proposed 2.4 ha (5.9 acres) at this time. The additional information provided with the application in support of the larger parcel provides valid points to long term site planning (structures, landscaping mitigation and screening) and business flexibility. In anticipation of our building needs we want to expand our lot so that we can prepare for another building but we also want to be planning for a building beyond the immediate need. Planning far ahead(and having additional land beyond our immediate needs)is important because: - We are mindful of.creating long term solutions o Ample green space for employees and neighbours o Berms and trees to mitigate sound ■ We can create more effective solutions when we make long term solutions. ■ We can allow trees to mature instead of replanting new borders • Large berms are easier to create if we make long term parking and water drainage control solutions - The land approval process takes a lot of time and resources. From ETBO's perspective,we have proposed a land solution that allows us to create better environmental controls for neighbouring properties. ETBO Loading dock addition on north wall We have also proposed a new loading dock along the north wall(a building outcrop to the north). We chose this solution because it maximizes sound protection to the north by: - Minimizing truck traffic towards our north neighbours - Minimizing doorways on our north wall so our sound wall is more effective. Making this change would mean decreasing our 60m setback to the north. We do see other solutions but we think they will result in more impact to our neighbours. We have completed our review of consent application submitted by Borm Agriculture Inc. for lands located at 7202 Richmond Road, east side and south of James Line. The applicant is requesting consent to sever 2.4 ha (5.9 acres) of land and to retain 75 ha (185 acres) of land. The lands are designated Agriculture on Schedule "Al": Land Use and Hazard Lands on Schedule A2 of the Official Plan of the Municipality of Bayham. The lands are zoned Agriculture (Al-A) and LPRCA Regulation Limit on Schedule "A" Map No. 10 in Zoning By-law Z456-2003. 2. The proposal is to add severed land to the adjacent parcel, located at 7288 Richmond road, used for industrial use, for a building addition of 2825 m2(30,408 ft2)for storage use and an additional building of 3566 m2 (38,384 ft2) in the future for an undetermined but related use. The lands are currently used for agriculture. The lot frontage and depth remain unchanged with a lot frontage of 770 m (2,526 feet)and a lot depth of 781 m (2562 feet). Surrounding uses are agriculture to the east and south, industrial (7288 Richmond Road), residential and agriculture to the north and west. 3. The 7288 Richmond Road lands have been previously zoned and severed as the industrial business has expanded. Consent application E55/07 added Part 1 11R-9081 lands. The consent application was appealed, however, the appeal was withdrawn based on agreement in the rezoning appeal. The conditional rezoning was appealed to and amended by the Ontario Municipal Board (OMB) on November 30, 2009, via Zoning By- law Amendment Z654-2008. Zoning By-law Amendment Z571-2009 zoned the property to a site-specific Rural Industrial (M2-8) Zone. The change included a maximum lot coverage of 15%, minimum side yard of 60 m for the primary building (north lot line) and 30.0 m for the primary building (east lot line). Minor Variance application A-07/13 increased the lot coverage to 25% and reduced the rear yard setback to 10 m for a building addition. The County of Elgin Official Plan Section E1.2.3.1 General Criteria provides criteria for consideration of consent applications. Following are comment responses to each criteria: a) The retained lands and the severed/lot addition lands front on and are directly accessed by Richmond Road, a public road maintained on a year-round basis; b) Richmond Road is a County road and the access for the lands exist, the need for a permit is not anticipated. c) The access for each lot will be via the existing accesses along Richmond Road, a flat and straight road. The additional storage building may generate additional truck traffic, however, Richmond Road is designated as a County Collector on Schedule 'B' where private driveways are permitted and the road is generally designed for truck traffic. d) The retained lands have adequate lot area and frontage for the proposed use and zone. The severed lot area is larger than necessary for the storage building due to the second addition building being proposed but not developed at this time. Based on our previous (email correspondence) comments-that only the amount of land needed to accommodate the storage building should be severed at this time - the applicant provided a justification letter indicating the need for more business flexibility by permitting the entire severance area for future expansion. Furthermore, the applicant indicates that including all the land would allow them to accommodate/plan for screening and landscaping mitigation at this time to avoid undue reconstruction of berms/landscaping when the future building is added. e) The severed lot and lot addition lands must be zoned appropriately as a condition of consent. f) The applicant provided a letter from J.B. Wilson and Son Well Drilling Ltd. dated August 21, 2018 confirming the adequacy of the well water supply. The applicant provided a letter from Exact Septic Inc. dated August 16, 2018 confirming adequate sewage/septic system. g) The applicant will provide engineering reports addressing adequate drainage for the development lands. h) The development does not restrict further development of other parcels of land. i) The severed lands are not included in the portions of the retained lands designated as hazard lands on Bayham Official Plan Schedule A2. There are no negative impacts on significant features or functions anticipated. j) According to the letter provided by J.B. Wilson there is adequate supply of water to meet the needs of the facility. The "future" building use is unknown, water quantity will need to be confirmed at the time of development. k) The applicant will provide engineering reports addressing adequate stormwater management for the development lands. IBI GROUP MEMORANDUM 3 Municipality of Bayham—February 28,2019 I) The Municipality of Bayham Official Plan Section 8.7.2.2 indicates that a site plan agreement is necessary. Section 8.7.1 indicates that a zoning by-law amendment is necessary in order to zone the severed lands in accordance with the zone of the addition lands (M2-8). Section 8.7.2.5 indicates that lot additions are permitted in any land use designation provided the severance does not result in a new lot being created. The proposal is to add the severed lands to the adjacent parcel. Section 2.1.9 Minor Lot Adjustments indicates that areas designated "Agriculture" shall be permitted for minor lot additions provided no new conveyable lot is created. The proposed is generally consistent with the local Official Plan insomuch as there is no new lot created, however, the lands are not designated industrial. The business is an important part of the economy of Bayham and it is in the interest of the Municipality to support its' sustainability and growth. m) The proposed consent lots will conform to Section 51 (24) of the Planning Act, as amended. The proposed development is generally consistent with the County of Elgin Official Plan insomuch no new lot being created; the important business flexibility and consideration of screening and landscaping mitigation; and economic considerations. It would be preferable to limit the extent of the consent to a setback of 10 m from the proposed storage building or to locate the expanded industrial business in a designated industrial area. 5. The Municipality of Bayham Zoning By-law Schedule "A" Map No. 10 indicates that the lands are zoned Agriculture (Al-A). The retained lot area of 75 ha conforms to the minimum lot area of 40 ha. The severed lands are proposed to be added to the adjacent parcel, known as 7288 Richmond Road, which are zoned site-specific Rural Industrial (M2-8). The proposed lot area and lot frontage exceed the minimum requirements set out in the By-law for M2 lots. The previous minor variance and OMB decision included a minimum north property line side yard setback of 60.0 m whereas a 40 m setback is proposed. The reduced setback is intended to accommodate a realigned loading dock. The applicant exhibited through the application that the severance of a surplus farm dwelling qualifies through farm consolidation with the owner's dwelling located at 55870 Light Line in the same ownership and consolidated with the corporate farm operation. The planner's memorandum dated February 28, 2019 analyzes the application subject to the Elgin County Official Plan, Bayham Official Plan and Zoning By-law policies. It is noted the proposed size of the severed parcel is undersized at 0.26 ha (0.6 acre) and does not have private water service on the lot, only proposes an easement for access to an existing well. Being that the lot does not meet the minimum lot area and does not include private on-site water services, it does not meet the intent of the Elgin County Official Plan or Bayham planning policies. We have completed our review of consent application E16/19 submitted by 1841449 Ontario Inc. for lands located at 7855 Plank Road, west side, north of Calton Line. The applicant is requesting consent for severance of 0.2 ha (0.6 acres) of land; to retain 41 ha (101 acres) of land; and to create an easement, 37 m (121 feet) in length and 5 m (16 feet) in width, in order to provide the new lot with well water service. The intent of the change is to create a residential lot surplus to the consolidated farm operation. The lands are designated Agriculture and Natural Gas Reservoir on Schedule "A": Land Use and Hazard Lands on Schedule A2 in the Official Plan and are zoned Agriculture (Al-A) on Schedule "A", Map No. 8 in Zoning By-law Z456- 2003. 2. The severed lands have a lot frontage of 63.5 m (208 feet) and a lot depth of 40 m (131 feet). The lands comprise a single detached dwelling and a dwelling in disrepair to be removed. Plank Road, also known as Elgin County Road 19, is a county road maintained year-round. The dwelling is serviced with private septic services and private well water services via easement. The retained lands have a lot frontage of 951 m (3,120 feet) and a lot depth of 400 m (1,312 feet). The lands comprise a barn, metal shed and several small buildings. Surrounding uses are agriculture to the east and west and agriculture and residential to the north and south. 3. The Provincial Policy Statement 2014 (PPS) Section 2.3.4.1 Lot Creation and Lot Adjustments sets out policies for lot creation in prime agricultural areas. Lot creation is generally discouraged and may be permitted for: c) a residence surplus to a farming operation as a result of farm consolidation, provided that: 1. the new lot will be limited to a minimum size needed to accommodate the use and appropriate sewage and water services; and IBI Group is a group of firms providing professional services and is affiliated with IBI Group Architects IBI GROUP MEMORANDUM 2 Municipality of Bayham—February 27,2019 2. the planning authority ensures that new residential dwellings are prohibited on any remnant parcel of farmland created by the severance.....; The proposed lot is not of sufficient lot area to meet the minimum requirement of the Rural Residential (RR) zone or provide for water service on the lot, an easement to an existing well is proposed. The lot should be realigned to meet the minimum lot area regulation and to accommodate private water and sewer services. Zoning By-law Special Agricultural (A2)zone restricts residential development on retained farm lands. The severed lands will be changed from an agricultural use to a residential use. The applicant will be required to rezone the retained lands to Special Agriculture (A2) zone and the severed lands to Rural Residential (RR) Zone. 4. Elgin County Official Plan Section E1.2.3.1 General Criteria states that provisional consent may be granted subject to appropriate conditions of approval for the severed and/or retained lot. The proposed surplus residential farm dwelling conforms to the consent criteria. a) The proposed lot will front on a public road, Plank Road, a county road maintained year-round. b) The existing access is to an Elgin County road. c) Plank Road is straight and flat along the dwelling frontage and the access has existed for some time, therefore, a traffic hazard is not created. d) The severed lands have 63 m frontage where 50 m is the required minimum in the Rural Residential (RR) zone. The lot area of 0.2 ha is below the 0.4 ha minimum requirement of the RR zone. The front yard setback is 7.5 m (24 feet) whereas 15.0 m (49 feet) is the required minimum. Section 4.22.1 b) setback regulation from the centreline of the County road is 22 m whereas the minimum setback is 26.0 m. The retained lands frontage of 951 m is above the minimum of 150 m in the A2 zone. The lot area of 41 ha is above the minimum of 20 ha required in the A2 zone. The lot configuration needs to be revised to meet the minimum lot area regulation and a site-specific zone change will be required to recognize reduced front yard setback and county road setback. e) The conditions of consent include that the applicant rezone the retained lands to a Special Agriculture (A2) zone in order to prohibit any new residential development on the lands; and that the applicant rezone the severed lands to a site-specific Rural Residential (RR-XX) zone to allow residential use and to recognize reduced front yard setback and reduced county road setback. IBI GROUP MEMORANDUM 3 Municipality of Bayham—February 27,2019 f) The dwelling is serviced with private water and sewage services. The applicant has provided an assessment of the water service from Dave Oatman Pump and Pressure Systems, dated October 19th, 2018, confirming the well is producing enough water for household use, the pump is working well and in good condition. Water test results were provided from Public Health Ontario, dated January 12, 2019, confirming the water is safe as a drinking water source. An evaluation form was also received from Norfolk County, dated March 2016, indicating that the sewage system is working properly. The applicant should consider a realigned lot configuration to include the existing well or to construct a new well. g) Based on a desktop review of recent Google aerial and Streetview imagery there is a drainage ditch over 150 m south of the severed lands, however, there are no new structures or physical site changes which are affecting drainage patterns associated with the proposed consent. h) The retained lands would not be restricted and are not designated for development. The lands are designated for agricultural use and have adequate frontage on Plank Road. i) Bayham Official Plan Schedule Al and A2 do not indicate that there are any significant features associated with the subject lands. j) The proposed use does not increase the amount of water being sourced from local groundwater. The applicant has provided recent Public Health Ontario positive drinking water quality test. k) Bayham Official Plan Schedule A2 indicates that there are hazard lands within the retained lands, in the form of a creek/drainage system south and west of the severed lot, however, no negative impacts associated with the severed lot are anticipated. I) A review of Official Plan policies follows in a separate section. m) The proposed surplus farm dwelling lot will conform to Section 51 (24) of the Planning Act, as amended. The consent generally consistent with the County of Elgin Official Plan for surplus farm dwellings, however, the lot does not meet the minimum lot area and does not include private water services on site. Alternative lot configurations would meet the intent of the Elgin Official Plan. 5. The Municipality of Bayham Official Plan Section 2.1.7 Farm Consolidation and Surplus Farm Dwellings sets out policies for surplus farm dwelling consents. Section 2.1.7.1 indicates that farm consolidations may result in the identification of existing farm dwellings that are rendered surplus to the consolidated farm operation and that consent to sever may be permitted within the "Agriculture"designation in accordance with the following criteria response: IBI GROUP MEMORANDUM 4 Municipality of Bayham—February 27,2019 There is a farm building cluster adjacent to the proposed lot including a metal shop and barn which are accessed by a separate private lane access. The remainder of the immediate area is farm fields. A land use conflict is not created with the agricultural operation or other existing land uses in the immediate area. Policy 2.1.7.1 states that: Where a farm parcel with more than one existing dwelling is being consolidated into a farm operation, only one dwelling may be severed from that farm parcel, and no more than one severance of a surplus dwelling shall be allowed from an original farm parcel regardless of changes in boundary or ownership. Based on a review of the original parcel configuration in the area the subject lands do not appear to be the original farm parcel and two residential parcels have been severed since the current lot configuration was created. There was a house built and parcel created sometime around 1964 known as 7683 Plank Road in the southeast corner and there was a farm retirement lot known as 8105 Plank Road created in the north east corner in 2004. Notwithstanding the above, it is unknown what the reason was for the 7683 Plank Road parcel and dwelling and the severance. The 8105 Plank Road farm retirement lot was created in the north east corner in 2004. At the time farm retirement lots were permitted by policies in the Official Plan which have been removed. Therefore, although the policy could be interpreted to prohibit further severance of the original farm parcel, where the original farm parcel has been altered; the lot 7683 Plank Road lot was created prior to the policies for surplus dwellings; and a lot created for farm retirement in accordance with the policies at the time, the proposed surplus farm dwelling is considered acceptable. Further severances for residential purposes are to be prohibited by rezoning the retained lands to a Special Agricultural (A2) Zone. Municipal tax records confirm that the applicant is the owner of the subject lands and a dwelling is owned by the same within the Municipality. Section 2.1.7.2 includes the following criteria response for consideration of the surplus farm dwelling lands: a) The proposed lot configuration is smaller than the minimum lot area in the rural residential zone and water service is not accommodated on site. b) In Section 19 of the application form the applicant has indicated that there is a barn not used for or capable of being used for livestock within 750 m. c) The severed lands should be changed to a Rural Residential zone. Section 2.1.7.3 includes criteria response for consideration for the surplus dwelling lands: IBI GROUP MEMORANDUM 5 Municipality of Bayham—February 27,2019 a) There is a dwelling in a state of disrepair to be removed as a condition of consent. b) No accessory building are proposed. Section 2.1.7.4 includes criteria response for consideration for the retained lands: a) The retained lands meet all the regulations required in the A2 zone. b) The applicant must rezone the retained lands to a Special Agricultural (A2) zone to prohibit the placement, development, or establishment of any additional type or form of residential dwelling. The proposed consent is generally consistent with the Municipality of Bayham Official Plan policies for surplus farm dwelling, however, the lot configuration is not large enough to conform to the regulations of the zone and water service is not adequately provided. 6. The subject lands are located in the Agricultural (A1)zone in By-law Z456-2003. The proposed retained lot setbacks, lot area and frontage meet the minimum requirements for the Special Agriculture (A2) zone. The severed lands require a rezoning to a site-specific Rural Residential (RR-XX) allow for residential use, and to recognize reduced front yard setback and reduced county road setback. 7. Based on the above review of consent application E16/19 we do not recommend the surplus farm dwelling severance of 0.2 ha and an easement for well water service. The applicant has two options in order to revise the lot configuration: a) Realign the lot to conform to the minimum lot area of 0.4 ha by extending the severed lot south and/or west; constructing a new private lane north of the severed lot for farm building access; and constructing a new well. b) Realign the lot to conform to the minimum lot area of 0.4 ha by including the lands with the well. 8. Should the applicant wish to revise the lot configuration to meet the 0.4 ha lot area minimum and accommodate a well on the lot, the following are conditions of consent: a. That the applicant rezone the retained lands to a Special Agriculture (A2) zone. b. That the applicant rezone the severed lands to a site-specific Rural Residential (RR-XX) zone to permit residential use, and to recognize reduced front yard depth and reduced county road centreline setback for the existing dwelling. c. The applicant exhibited through the application that the severance of a surplus farm dwelling qualifies through farm consolidation with the owner's dwelling located at 55870 Light Line in the same ownership and consolidated with the corporate farm operation. The sketch doesn't show the existing mobile home located on the north side of the metal clad barn, remaining on the retained lands for the purpose of an approved supplementary farm dwelling - Minor Variance A-03/16 and Agreement granted and approved in 2016. The applicant/Owner will have to confirm the supplementary farm dwelling and the retained barn have approved county road access. The planner's memorandum dated February 28, 2019 analyzes the application subject to the Elgin County Official Plan, Bayham planning policies. We have completed our review of consent application E17/19 submitted by 1841449 Ontario Inc. for lands located at 6978 Plank Road, east side, north of Light Line. The applicant is requesting consent for severance of 0.39 ha (0.96 acres) of land; and to retain 48 ha (118 acres) of land. The intent of the change is to create a residential lot surplus to the consolidated farm operation. The lands are designated Agriculture and Natural Gas Reservoir on Schedule "A": Land Use and Hazard Lands on Schedule A2 in the Official Plan and are zoned Agriculture (Al-A) and LPRCA Regulation Limit on Schedule "A", Map No. 11 in Zoning By-law Z456-2003. 2. The severed lands have a lot frontage of 45 m (148 feet) and a lot depth of 86 m (283 feet). The lands comprise a single detached dwelling, a frame barn, a detached garage and small shed. Plank Road, also known as Elgin County Road 19, is a County Road maintained year-round. The dwelling is serviced with private septic services and water services. The retained lands have a lot frontage of 489 m (1,604 feet), additional frontage along Light Line of 145 m (475 feet) and a lot depth of 755 m (2,477 feet). The lands comprise dwelling, known as 55870 Light Line, a barn setback 3 m from the proposed north property line and a supplementary farm dwelling in the form of a mobile home. The supplementary farm dwelling is located 55 m north easterly from the severed dwelling; is setback approximately 28 m from the north property line; is used for eight (8)farm labourers during the growing season; and was approved by Minor Variance (MV) application A-03/16. The MV approved two trailers with a maximum of sixteen (16) workers, however, only one trailer was placed on the lands. The retained barn is located between the surplus dwelling and supplementary dwelling. Surrounding uses are agriculture to the north and east and agriculture and residential to the south and west. There are seven (7) dwellings within 200 m along Plank Road. The Provincial Policy Statement 2014 (PPS) Section 2.3.4.1 Lot Creation and Lot Adjustments sets out policies for lot creation in prime agricultural areas. Lot creation is generally discouraged, however, may be permitted for: c) a residence surplus to a farming operation as a result of farm consolidation, provided that: 1. the new lot will be limited to a minimum size needed to accommodate the use and appropriate sewage and water services; and 2. the planning authority ensures that new residential dwellings are prohibited on any remnant parcel of farmland created by the severance.....; The proposed lot area is 0.39 ha where 0.4 ha is the required minimum. The applicant should resize the lot to 0.4 ha lot area. The resized lot can accommodate the use and has existing water and sewer services. Zoning By-law Special Agricultural (A2) zone restricts residential development on retained farm lands for surplus dwelling severances. The applicant will be required to rezone the retained lands to A2 and the severed lands to Rural Residential (RR). 4. Elgin County Official Plan Section E1.2.3.1 General Criteria states that provisional consent may be granted subject to appropriate conditions of approval for the severed and/or retained lot. The proposed surplus residential farm dwelling conforms to the consent criteria. a) The proposed lot will front on a public road, Plank Road, a county road maintained year-round. b) The existing access is to an Elgin County road. c) Plank Road is straight and flat along the dwelling frontage and the access has existed for some time, therefore, a traffic hazard is not created. d) The severed lands have 45 m frontage where 50 m is the required minimum in the Rural Residential (RR) zone. The reduced frontage is a result of the location of the retained barn and is considered minor in nature. The lot area of 0.39 ha is below the 0.4 ha minimum requirement of the RR zone and there is surplus land available to the east to resize the lot to meet the minimum. The front yard setback is 17 m (55 feet) where 15.0 m (49 feet) is the required minimum. The retained lands frontage of 489 m is above the minimum of 150 m in the A2 zone. The lot area of 48 ha is above the minimum of 20 ha required in the A2 zone. A zone change will be required for the severed lot to allow residential use; to recognize the reduced lot frontage; and to prohibit the keeping of livestock. IBI GROUP MEMORANDUM 3 Municipality of Bayham—February 25,2019 e) The conditions of consent include the applicant rezoning the retained lands to a Special Agriculture (A2) zone in order to prohibit any new residential development on the lands; and the applicant rezoning the severed lands to a site-specific Rural Residential (RR-XX) zone to allow for residential use; to recognize reduced lot frontage; and to prohibit the keeping of livestock. f) The dwelling is serviced with private water and sewage services. The applicant has provided an assessment of the water service from Dave Oatman Pump and Pressure Systems, dated October 19th, 2018, confirming the well is producing enough water for household use, the pump is working well and in good condition, however, also indicated is that the casing height should be brought up to code. Water test results were received from Public Health Ontario, dated January 12, 2019, confirming the water is safe as a drinking water source. A letter from Gilles Therrien Septic Tank Pumping and Backhoe Services indicates that a new septic system was installed on October 24, 2018. g) No new structures or physical site changes are associated with the proposed consent, therefore, negative impacts to the drainage patterns in the area are not anticipated. h) The retained lands would not be restricted and are not designated for development. The lands are designated for agricultural use and have adequate frontage on Plank Road. i) Bayham Official Plan Schedules do not identify any significant features in close proximity to the new lot, therefore, no negative impacts are anticipated. j) The proposed use does not increase the amount of water being sourced from local groundwater. The applicant has provided recent Public Health Ontario positive drinking water test. k) Bayham Official Plan Schedule A2 indicates that there are hazard lands within the retained lands, in the form of a creek system south and east of the severed lot, however, no negative impacts associated with the severed lot are anticipated. I) A review of Official Plan policies follows in a separate section. m) The proposed surplus farm dwelling lot will conform to Section 51 (24) of the Planning Act, as amended. The consent is generally consistent with the County of Elgin Official Plan policies for surplus farm dwellings, however, the lot does not meet the minimum lot area and there is surplus available land to the east to resize the lot to meet the minimum lot area. IBI GROUP MEMORANDUM 4 Municipality of Bayham—February 25,2019 5. The Municipality of Bayham Official Plan Section 2.1.7 Farm Consolidation and Surplus Farm Dwellings sets out policies for surplus farm dwelling consents. Section 2.1.7.1 indicates that farm consolidations may result in the identification of existing farm dwellings that are rendered surplus to the consolidated farm operation and that consent to sever may be permitted within the "Agriculture" designation in accordance with the following criteria response: The creation of a residential parcel does not create a land use conflict with the agricultural operations or other existing land uses in the immediate area of the subject lands. Policy 2.1.7.1 states that: Where a farm parcel with more than one existing dwelling is being consolidated into a farm operation, only one dwelling may be severed from that farm parcel, and no more than one severance of a surplus dwelling shall be allowed from an original farm parcel regardless of changes in boundary or ownership. Based on a review of the original parcel configuration in the area the subject lands are not the original farm parcel and two residential parcels have been severed since the current lot configuration was created. There was a house built and parcel created in 1998 known as 55846 Light Line and there was a house built in 1963 and lot surveyed in 1985 on the parcel known as 7028 Plank Road. Notwithstanding the above, the 55846 Light Line parcel was created in 1998 and was a vacant retirement lot, not a surplus farm dwelling. Furthermore, it is unknown what the reason was for the 7028 Plank Road parcel. The information available suggests that the dwelling and parcel were not likely as a result of surplus dwelling severance. The parcels were created prior to Official Plan policies currently in effect. Therefore, although the policy could be interpreted to prohibit further severance of the original farm parcel, where a lot was created prior to the policies for surplus dwellings and there was a vacant lot created for retirement in accordance with the policies at the time, the proposed surplus farm dwelling is considered acceptable. Further severances for residential purposes are to be prohibited by rezoning the retained lands to a Special Agricultural (A2) Zone. Municipal tax records confirm that the applicant is the owner of the subject lands and a dwelling is owned by the same within the Municipality. Section 2.1.7.2 includes the following criteria response for consideration of the surplus farm dwelling lands: a) The proposed lot area is less than the minimum lot area for the Rural Residential (RR) zone. Water and sewer services are accommodated on site. IBI GROUP MEMORANDUM 5 Municipality of Bayham—February 25,2019 b) In Section 19 of the application form the applicant has indicated that there is a barn not used for or capable of being used for livestock within 750 m. c) The applicant shall rezone the severed lands to Rural Residential zone. Section 2.1.7.3 includes criteria response for consideration for the surplus dwelling lands: a) The existing frame barn meets the zoning by-law regulations for setbacks in accordance with the Rural Residential Zone. b) The barn is not used for livestock and the site-specific rezoning will prohibit the keeping of livestock. Section 2.1.7.4 includes criteria response for consideration for the retained lands: a) The retained lands have a lot area of 48 ha where 20 ha (49 acres) is the required minimum in the A2 zone. The lot frontage of the retained lands is 489 m where the minimum lot frontage in the A2 zone is 150 m (492 feet). Therefore the lands conform to the minimum regulations for the A2 zone. b) The applicant must rezone the retained lands to a Special Agricultural (A2) zone to prohibit the placement, development, or establishment of any additional type or form of residential dwelling. The proposed consent is generally consistent with the Municipality of Bayham Official Plan policies for surplus farm dwelling, however, the lot area is not large enough to conform to the regulations of the zone. 6. The subject lands are located in the Agricultural (A1) zone in By-law Z456-2003. The proposed retained lot setbacks, lot area and frontage meet the minimum requirements for the Special Agriculture (A2) zone. The severed lands require a rezoning to a site-specific Rural Residential (RR-XX)zone to allow for residential use; recognize the reduced lot frontage and prohibit the keeping of livestock. 7. Based on the above review of consent application E17/19 we do not recommend the surplus farm dwelling severance of 0.39 ha. The applicant should revise the lot configuration to conform to the minimum lot area of 0.4 ha by extending the easterly lot line further east. 8. Should the applicant wish to revise the lot configuration to meet the 0.4 ha lot area minimum, the following are conditions of consent: a. That the applicant rezone the retained lands to a Special Agriculture(A2)zone in order to prohibit future residential development on the lands. b. The Act also imposes other obligations on Enbridge Gas related to emissions from the operation of its natural gas distribution system starting January 1, 2019. Port Burwell Historical Society February 19, 2019 Re: Request to hold yard sale at Port Burwell Marine Museum Dear Mayor Ketchabaw and Council, I am writing on behalf of the Port Burwell Historical Society to request Council's permission to hold a yard sale on the grounds of the Port Burwell Marine Museum on Saturday, May 18, 2019. The purpose of the yard sale is to raise funds for the work of the Society, which largely consists of procuring artifacts for the museum and coordinating Canada Day celebrations for the community. Our major current project is restoration of the Wheelhouse. It is also our hope that this event will contribute to community spirit, and that it might even become an annual event. By holding this event on the museum's seasonal opening weekend,we hope to draw local residents into their museum so that they can experience that there is something new for them to see there every year. As well as yard sale items, we will also have a table specifically selling items from the Historical Society's museum shop. The yard sale would be held specifically on the grass area in front of the museum. Nothing would be placed on the parking lot. The sale would take place from approximately 8 a.m.to 2 p.m. on Saturday, May 18, 2019. Some setup would occur on the afternoon and evening of Friday, May 17, 2019. Section 2 - Procedure 2.1 Operationally dust suppressant will be applied once annually to gravel roads at available times when moisture is present to maximize the dust suppression agent bond, and to create a seal on the surface of the gravel road. 2.2 Dust suppressant will be applied at the direction and discretion of the Road Operations Supervisor, or designate, within the approved budget envelope. MAYOR CLERK THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2019-020 A BY-LAW TO AUTHORIZE THE EXECUTION OF AN AGREEMENT BETWEEN THE CORPORATION OF THE MUNICIPALITY OF BAYHAM AND MEU CONSULTING TO PROVIDE SERVICES FOR THE ENFORCEMENT OF BY-LAWS AND PROVINCIAL OFFENCES WHEREAS pursuant to Section 9 of the Municipal Act, 2001, S.O.2001, as amended, a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS pursuant to Section 5.3 of the Municipal Act, 2001, S.O. 2001,c25, the powers of every Council shall be exercised by by-law; AND WHEREAS it is deemed expedient that the Corporation of the Municipality of Bayham enter into an agreement with MEU Consulting to provide services for the enforcement of by- laws and provincial offences; AND WHEREAS such agreement is required to set out the terms and conditions of the provision of such service; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk be and are hereby authorized, on behalf of the Corporation of the Municipality of Bayham, to enter into and execute under its corporate seal, an agreement with MEU Consulting to provide services for the enforcement of by-laws and provincial offences; 2. AND THAT a copy of said agreement shall remain attached to and form part of this by- law, marked as Schedule `A'; 3. AND THAT this by-law shall come into full force and effect upon final passing. MAYOR CLERK THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2019-021 BEING A BY-LAW TO AMEND BY-LAW NO. 2017-021 BEING A BY-LAW FOR THE PROVISION OF RECYCLING AND WASTE COLLECTION AND TO PROHIBIT THE DEPOSITING OF REFUSE OR DEBRIS ON LANDS WITHIN THE MUNICIPALITY OF BAYHAM WITHOUT THE CONSENT OF THE PROPERTY OWNER OR OCCUPANT OF THE LAND WHEREAS the Council of the Municipality of Bayham on the 2nd day of March, 2017 enacted By-Law No. 2017-021, being a by-law for the provision of recycling and waste collection and to prohibit the depositing of refuse or debris on lands within the Municipality of Bayham without the consent of the property owner or occupant of the land; AND WHEREAS the Council of the Municipality of Bayham deems it necessary to amend By- law No. 2017-021; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: THAT definition 1.5 `Place of Business' be deleted in its entirety; THAT definition `Commercial Unit' be inserted as follows: `Commercial Unit' shall mean an operational, occupied and duly zoned place of business assessed for commercial property taxes on the Assessment Roll; THAT Section 1 — Definitions be renumbered; THAT Schedule `A' to By-law 2017-021 be deleted in its entirety and replaced with Schedule `A' affixed hereto and forming part of this by-law; THAT in all other respects, By-law No. 2017-021 is hereby confirmed and remains unchanged; AND THAT this by-law shall come into full force and effect upon final passing. READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 7th DAY OF MARCH, 2019 MAYOR CLERK By-law No. 2017-021 Schedule "A" 1. The Municipality shall provide: a) Each Residential Unit with 52 "Bayham Garbage Tags" annually at no charge to the owner. Tags will only be valid in the year for which they were issued. Additional tags may be purchased from the municipality at a cost of$2.00 per tag. b) Each Commercial Unit with 86 "Bayham Garbage Tags" annually at no charge to the owner. Tags will only be valid in the year for which they were issued. Additional tags may be purchased from the municipality at a cost of $2.00 per tag. c) Each Farming Business with 16 "Bayham Garbage Tags" annually at no charge to the Farming Business upon the Farming Business providing the Municipality with a valid Farming Business Registration Number. For the sake of clarity the following provisions shall be applicable to the distribution of Bag Tags. a) Vacant parcels of land and/or vacant Commercial Units not operating as a duly zoned place of business shall not be provided Bag Tags. b) It is the responsibility of an Owner to transfer remaining Bag Tags to a new Owner in the event of a property sale. THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2019-022 A BY-LAW TO CONFIRM ALL ACTIONS OF THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM FOR THE REGULAR MEETING HELD MARCH 7, 2019 WHEREAS under Section 5 (1) of the Municipal Act, 2001 S.O. 2001, Chapter 25, the powers of a municipal corporation are to be exercised by the Council of the municipality; AND WHEREAS under Section 5 (3) of the Municipal Act, 2001, the powers of Council are to be exercised by by-law; AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it advisable that the proceedings of the meeting be confirmed and adopted by by-law. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the actions of the Council of the Corporation of the Municipality of Bayham in respect of each recommendation and each motion and resolution passed and other action by the Council at the regular meeting held March 7, 2019 is hereby adopted and confirmed as if all proceedings were expressly embodied in this by- law. 2. THAT the Mayor and Clerk of the Corporation of the Municipality of Bayham are hereby authorized and directed to do all things necessary to give effect to the action of the Council including executing all documents and affixing the Corporate Seal.
