NOTICE OF THE PASSING
OF A ZONING BY-LAW BY
THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
TAKE NOTICE that the Council of the Corporation of the Township of Bayham passed
By-Law No. Z278-92 on the 5th day of November, 1992. under Section 34 of THE
PLANNING ACT, 1983.
AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal
Board in respect of the By-law by filing with the Clerk of the Township of Bayham not
later than the 9tti day of December, 1992, a notice of appeal setting out the
objection to the By-law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-law, describing the lands to which the
By-law applies, and a Key Map showing the location of the lands to which the By-law
applies (or, alternatively an explanation as to why a key map is not provided) are
attached. The complete By-law is available for inspection in my office during regular
office hours.

SUBJECT: Application for Official Plan and Zoning By-law Amendment -
Mr. John Progett, Part Lot 15, Concession 4
Further to receipt o t e alcove-noted application and subsequent to discussion with
Township Staff we offer the following comments:
Mr. Progett is the owner of a 25,627 ftp (.23 hectare) vacant lot located on the
south side of County Road No. 45 just west of the Highway No. 19 intersection.
• The land is designated. "Agriculture" in the Official Plan and zoned "RC-4" in the
Zoning By-law. The RC-4 zone which applies to the subject property also applies
to a commercial operation situated immediately east of the subject lands on the
corner of County Road No. 45 and Highway No. 19.
• The subject lands were severed from the commercial operation, however, the RC-
4 zoning was not changed.
• Mr. Frogett has applied to change the designation and the zoning on the subject
lands to permit the establishment of a residential unit on the vacant property
comprising the west side of the RC-4 Zone, in consideration of the size and use
of the subject lands and the developed pattern of land use in the surrounding
area it is feasible to consider the site for residential development.
• Section 4.2.8 of the Official Plan pertains to Existing Lots in the Agriculture
designation and states this. following:
"4.2.8 Existing Lots:
One non-farm residential unit may be considered on existing lots of record
in areas designated "Agriculture", provided the following criteria are met:
the lot was in existence as of the adoption of this Official Plan
Amendment (April 18th, 1991);

▪ the lot complies with the Minimum Distance Separation formula of
the Agricultural Code of Practice; and
• the lot is suitable to support en individual well and private sewage
disposal system which is approved by the Ministry of the
Environment or their designated agent."
• In consideration of the above-noted criteria we contacted the Regional
Assessment Office and learned that the lot was created prior to April 18, 1991.
The remaining criteria are yet to be resolved.
• Our recommendation to Council is that the applicant seek approval from the
Ministry of the Environment for the establishment of a private well and septic
system on the site. Pending that approval and a determination that no livestock
existing the immediate area, Council could then consider passing a zoning
amendment which would permit a new dwelling on the existing slightly
undersized lot.
• As there is no need for an Official Plan amendment, we also recommend that the
applicant be reimbursed for that portion of his application fee.

a public meeting on Thursday, November. 5th, 1992 at 8:00 p.m_ in the Township Council
Chambers in Straffordville, to consider a proposed Zoning 13y-law Amendment under
Section 34 of the PLANNING ACT, 1983.
The purpose of the Amendment is to change the zoning on a 0.2:3 hectare (half acre) parcel
of land situated in Lot 15, Concession 4 in the Township of.Aayham as shown on the key
map below.
The subject lands are presently in a special Rural Commercial (RC-4) Zone which applies
to the existing retail use situated immediately to the east of the subject lends. The subject
lands form a separate vacant lot within the RC-4 Zone.
The effect of the proposed Zoning 13y-law Amendment will be to permit the establishment
of a single detached residence in a site specific Rural Residential Zone.
ANY PERSON may attend the public meeting and/or make a written or verbal representa-
tion in support of or in opposition to the proposed amendment.
