BY-LAW NO. Z275-92
BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of Bayham deems it
necessary to amend its Zoning By-law No. 2387;
THEREFORE, the Council of the Corporation of the Township of Bayham enacts as
follows:
1. THAT By-law No. 2387, as amended, is hereby further amended by amending
Schedule "A", Map 55 by deleting from the Agricultural (Al) Zone and adding to
the Rural Residential (RR) Zone, those lands enclosed in heavy solid lines and
marked RR on Schedule "A" to this By-law, which schedule is attached to and
forms part of this By-law.
2. THAT By-law No. 2387, as amended, is hereby further amended by amending
Section 5. Agricultural (Al) Zone Regulations by adding a new subsection to
Section 5.11 EXCEPTIONS - Al Zone as follows:
"5.11.39
5.11.39.1 Defined Area
A1-39 as shown on Schedule "A", Map 55 to this By-law.
5.11.39.2 Minimum Lot Area
19.00 hectares."
3. THAT By-law No. 2387, as amended, is hereby further amended by amending
Schedule "A", Map 55 by deleting from the Agricultural (Al) Zone and adding to
the Special Agricultural (A1-39) Zone, those lands enclosed in heavy solid lines
and marked A1-39 on Schedule "A" to this By-law, which schedule is attached to
and forms part of this By-law.

4. THIS By-law comes into force:
a) where no notice of objection has been filed with the Township's Clerk
within the time prescribed by the Planning Act, 1983 and regulations
pursuant thereto, upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the Township's Clerk within
the time prescribed by the Planning Act, 1983 and regulations pursuant
thereto, upon the approval of the Ontario Municipal Board.

NOTICE OF THE PASSING
OF A ZONING BY-LAW BY
THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
TAKE NOTICE that the Council of the Corporation of the Township of Bayham passed
By-Law No. Z275-92 on the 16th day of July, 1992 under Section 34 of THE
PLANNING ACT, 1983.
AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal
Board in respect of the By-law by filing with the Clerk of the Township of Bayham not
later than the 7th day of August, 1992, a notice of appeal setting out the objection to the
By-law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-law, describing the lands to which the
By-law applies, and a Key Map showing the location of the lands to which the By-law
applies (or, alternatively an explanation as to why a key map is not provided) are
attached. The complete By-law is available for inspection in my office during regular
office hours.

EXPLANATORY NOTE
The purpose of By-law No. Z275-92 is to change the zoning on a 0.61 hectare (1.51
acre) parcel of land situated on the west side of the road allowance between Lots 23
and 24, in Part Lot 23, Concession 5, in the Township of Bayham, from the Agricultural
(A1) Zone to the Rural Residential (RR) Zone.
The effect of this By-law will be to permit the creation of one rural residential
retirement lot pursuant to the process of severance and conveyance. This By-law will
also recognize the minimum lot area deficiency of the retained parcel of land.

RE: HOOGSTEEN RETIREMENT LOT
We are in receipt of your letter dated April 8 , 1992 requesting a
site visit o your client 's property by one or more Councillors in
order to determine an appropriate location for a retirement lot .
Due to the number of development inquiries and applications
received by the Township, 'it is not possible for Township Council
or staff to take a proactive role in the subdivision of land. We
can, however, advise you that, your client's previous application
for an estate residential lot which was refused by OMAF (after a
site visit) , appeared to Township Council and Staff to be in a
logical location on the farm. As you may recall , OMAF cited non-
compliance with the criteria of Section 4. 3. 2. of the Official
Plan (attached) .
Those criteria which govern the creation of retirement lots
meanwhile, are similar in that the lots to be created "shall be
situated in an area of the farm unit where the land is not engaged
in agricultural production nor deemed suitable for such
production" . To this end, you should also be aware that most farm
areas presently under woodlot are deemed suitable for agricultural

production by OMAF.
In summary, you will note from. the attached excerpts from the
Official Plan that the criteria for the creation of retirement lots
are fairly similar to, although not, as extensive as those for the
creation of rural estate lots . The main difference in these two
methods of creating non-farm lots is in the process. While the
creation of 'Estate Residential lots requires both an Official Plan
and Zoning By-Law Amendment, the severance of a retirement lot
requires only a Zoning By-Law Amendment . Zoning By-Law Amendments
may be approved locally provided they can meet the criteria for
such lots in the Official Plan.

4.3.1.3 In evaluating proposals for rural uses, the Township Council shall require
a presentation of the proposal which will include a detailed site plan
outlining building areas and locations, ingress and egress to the site,
parking facilities, existing and surrounding land uses, building location,
site characteristics, and proposed buffering, surface water drainage, and
landscaping. Servicing reports such as hydrogeological and/or
geotechnical may be required by the Ministry of the Environment or their
designated agent to demonstrate the suitability of lands to accommodate
individual wells and private sewage disposal systems. In addition, the
Township Council shall require all applicants to provide written
confirmation from the local Health Unit that the site is suitable for septic
systems and that potable water can be supplied.
4.3.1.4 General Policies Which Apply to all Rural Uses:
Lands to be designated "Rural" in the Township of Bayharn shall comply
with the following:
a) the provisions of the Agricultural Code of Practice;
b) must have existing frontage on an opened and maintained year
round, public road which is capable of sustaining vehicular traffic;
c) should not be situated in proximity to existing land uses which in
themselves have a high nuisance value or are easily capable of
promoting land use conflicts. Such uses may include, but shall not
be limited to, commercial grain drying operations; existing
aggregate resource extraction operations or lands which are
designated for aggregate resource extraction as described in this
Plan, operating of closed landfill sites or sewage lagoons; any
industrial or commercial operation that is normally associated with
substantial volumes of vehicular traffic or which creates adverse
off-site environmental effects such as air pollution, noise, odours or
generates excessive solid or liquid wastes either in volume or
toxicity;
d) buildings or structures must be appropriately setback from
municipal drains, watercourses and any associated hazard lands as
described in this Plan;
e) the soil and groundwater conditions are suitable for the operation
of a private water and subsurface sewage system as approved by
the Ministry of the Environment or their designated agent;

f) the size of any parcel of land created for such uses shall conform to
the provisions of the Township's Zoning By-law and in no cases
should any parcel be created smaller than necessary to support an
approved well and private sewage system;
g) shall not create a traffic hazard as a result of their access to a
portion of a roadway with limited sight lines due to curves, grades,
or existing roadside development including buildings and signs;
h) shall be considered only when mineral resource land are not
affected. Should mineral resource lands be affected, Township
Council shall consult with the Ministry of Natural Resources in
order to protect such lands from unwarranted development;
i) all "Rural" uses, save and except estate residential uses, shall
require justification which will address the need for the land use;
the amount of land needed; reasons for choice of location; and
consideration to other locations for the use.
j) should be regulated so that its impact will not detract from the
natural rural environment.
4.3.2 Estate Residential:
Estate Residential uses may be permitted on lands designated Rural-"R(E)"
on Schedule 'A' to this Official Plan.
In addition to the policies of Section 4.3.1.4 of this Plan the following
criteria shall apply:
a) the site is not part of a larger Bayham Township high priority
agricultural area;
b) the site is considered to have limited agricultural value due to its
size and shape;
c) the site exhibits the following locational characteristics:
• the site is part of a river system (e.g. Otter Creek) which
exhibits aesthetic features, or scenic vistas;
• the site is topographically and physically removed from
surrounding agricultural areas;

d) the site is of marginal agricultural land. The scale of available CLI
mapping may be insufficient to accurately evaluate the agricultural
capability of specific small sites. Consequently, it is essential that
the Canada Land Inventory map information be augmented by a
site visit and or more detailed soil investigation.
4.3.2.1 Severance of land for estate residential uses may be considered by
approval of the Land Division Committee providing the lands have been
designated "Rural" in the Official Plan after evaluation and written
comments are provided by Township Council. The creation of such
parcels of land for rural residential uses will require an amendment to the
Township Zoning By-law.
4.3.2.2 Estate residential uses in the "Rural" designation shall be restricted to low
density, single unit dwellings.
4.3.2.3 The keeping of livestock in a hobby farm context is permitted in
conjunction with estate residential uses in the "Rural" designation
provided the complement of livestock is small and can comply with the
regulations of the Agricultural Code of Practice.
4.3.2.4 Special Rural Estate Residential R(E)1 Area No. 1:
The "Special Rural Estate Residential R(E)1" designation applies to lands
located on Part Lot 5, Concession 3 of the Township of Bayham, which,
subject to the regulations of the Township's Zoning By-law, may be used
for the purposes of establishing a multiple (4 unit) apartment dwelling.
4.3.2.5 Subject to a legally conveyable lot(s) being created, estate residential
development is permitted on lands designated Rural - "R(E)" on Schedule
"A" and more particularly described as:
a) a parcel having an approximate size of 1.44 hectares and is situated
on the south side of Part Lot 14, Concession 4. A maximum of two
estate residential dwelling lots may be created.

b) a parcel having an approximate size of 4.48 hectares and is situated
on the south side of Part Lots 20 and 21, Concession 8. Two estate
residential dwellings lots may be created. Section 4.2.9 of this Plan
shall not apply in the future.
c) a parcel having an approximate size of 0.8 hectares and is situated
on the west side of Highway 19 in Part Lot 126, Concession
N.S.T.R. A maximum of three estate residential dwelling lots may
be created.
d) a parcel having an approximate size of 1.45 hectares and is situated
on the east side of the road allowance between Lots 20 and 21, in
Part Lot 21, Concession 4. One estate residential lot may be
created in the northerly location of the property.
e) a parcel having an approximate size of 0.79 hectares and is situated
on the west side of the road allowance between Lots 20 and 21.
(north side of County Road 45) in Part Lot 20, Concession 5. One
estate residential lot may be created.
f) a parcel having an approximate size of 0.12 hectares and is situated
approximately 210 metres south of County Road No. 45, on the
west side of Part Lot 21, Concession 4. One estate residential lot
may be created.
g) a parcel having an approximate size of 0.62 hectares and is situated
on the west side of Part Lot 114, Concession N.S.T.R. One estate
residential lot may be created.
h) a parcel having an approximate size of 2.47 hectares and is situated
on the west side of Highway No. 19 in Part Lot 15, Concession 3.
A maximum of four estate residential lots may be created (three on
the west side of Centre Street and one on the east side).
i) a parcel having an approximate size of 3.73 hectares and is situated
between Highway No. 19 to the west and the Canadian Pacific
Railway corridor to the east in the western portion of Lot 15,
Concession 2. A maximum of three estate residential lots may be
created.

retirement lot, keeping in mind, the requirements required to
create the lot.
