BYLAW NO. Z271-92
BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of Bayham deems it
necessary to amend its Zoning By-law No. 2387;
THEREFORE, the Council of the Corporation of the Township of Bayham enacts as
follows:
1. THAT By-law No. 2387, as amended, is hereby further amended by amending
Section 7 Rural Residential (RR) Zone Regulations by adding new subsection
7.13 Exceitions (RR) Zone after subsection 7.13.2.2 as follows:
"7.13.2.3 Minimum Lot Area
1950 Square metres."
2. TIIAT By-law No. 2387, as amended, is hereby further amended by amending
Schedule 'A', Map 74, by deleting from the Future Development (PD) Zone and
adding to the Special Rural Residential (RR-2) Zone those lands enclosed in
heavy solid lines and marked RR-2 on Schedule "A" to this By-law, which
schedule is attached to and forms part of this By-law.
3. THIS By-law comes into force:
a) where no notice of objection has been filed with the Township's Clerk
within the time prescribed by the Planning Act, 1983 and regulations
pursuant thereto, upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the Township's Clerk within
the time prescribed by the Planning Act, 1983 and regulations pursuant
thereto, upon the approval of the Ontario Municipal Board.

THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
TAKE NOTICE that the Council of the Corporation of the Township of Bayham passed
By-Law No. Z271-92 on the 2lstday of May, 1992 under Section 34 of THE PLANNING
ACT, 1983.
AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal
Board in respect of the By-law by filing with the Clerk of the Township of Bayham not
later than the llthday of June, 1992, a notice of appeal setting out the objection to the
By-law and the reasons In support of the objection.
An explanation of the purpose and effect of the By-law, describing the lands to which the
By-law applies, and a Key Map showing the location of the lands to which the By-law
applies (or, alternatively an explanation as to why a key map is not provided) are
attached. The complete By-law is available for inspection in my office during regular
office hours.

EXPLANATORY NOTE
The purpose of By-law No. Z271-92 is to implement an Order of the Ontario Municipal
Board concerning three rural residential lots in Part Lot 15 on the south side of
Highway No. 19 in the Township of Bayham. The subject lots have been created in
compliance with the conditions of a decision of the Ontario Municipal Board which
prescribed the implementation of an engineered drainage scheme pursuant to the
process of site plan control.
The effect of this By-law will be to legally recognize three rural residential lots each of
which comprises approximately 0.5 acres, and each of which are subject to a site
specific building setback from the CPR.

RE: Roll No. 2-007 06&2-00710, Part Lot 15 Concession 2
In 1992 the.above properties were granted a rezoning under By-law Z271-92 to delete the
Future Development designation and add Special Rural Residential recognizing an
exception to the lot size.
At the time of rezoning it was brought to Council's attention that the Iots in question were
subject to drainage problems. As a result Council gave the above mentioned By-law third
reading and imposed a condition that building permits would not be issued until the
drainage work was completed to their satisfaction.
Therefore, in•response to your recent request for a building permit,I regret to.inform you
that until the drainage,work is completed to the satisfaction of the Township Drainage
Superintendent,that a building permit will not be issued.
If you wish to discuss this matter further please give me a call.

Please be advised that Bayham Township Council have reviewed the
above mentioned application with the Township Engineer in regards
to the drainage problems and your concerns about this matter. ,
The property owner, as is evident from past occurrences has not yet
completed the remainder of. the drain as specified by the Township
Engineer in accordance with the order issued by- the Ontario
Municipal Board.
The Township has been assured by the applicants solicitor that his
client is ready and willing to dothe necessary work as soon as the
soil conditions are appropriate. ,'
In view of the fact that the engineer has assured the Township that
the drainage problems will be addressed when the work is completed
and that the Township has sufficient financial assurance that the
necessary work will be carried out , the Council wish to advise that
they are prepared to give By-Law Z271/92 a third and final reading
at the next regularmeeting to be held Thursday, May 21, 1992 .
Council is of the opinion that no building permits are to be issued
for the proposed lots until this drainage work has been completed

Straffordville.

the Ontario Municipal Board concerning three rural residential lots
in Part Lot 15 on the south side of Highway No. 19 in the Township
of Bayham. The subject lots have been created in compliance with
the conditions of a decision of the Ontario Municipal Board which
prescribed the implementation of an engineered drainage scheme

This is further to today' s lengthy telephone attendance.
We confirm our advice to you that it has been agreed by Mr. G
Therrien and Group 133 Limited that Mr. Therrien will. convey
the proposed lots in Block K, Plan 54 , his lands to the west
of those lots and those to . the sc :1 of the Canadian Pac F: -
Railway to Group 133 Limited.
Accordingly, we ask on behalf of Group 133 Limited, for
we also act, that at tonight ' s meeting that Council
(a) direct Mr. Blazack to prepare an ar:endm.ent yo Bylaw
to permit the lot frontages and lot sizes shown on
attached copies of part of Plan ' ' -4798 :
(b) direct that a public meeting be held on :Liay 7th tc: con.Fider

the Act.
Based on our discussion with you and a later cnnversatio,1 with
Mr. Blazack, we understand that a zoning application from Group
133 Limited is not required.
Mr. Blazack has outsi21ed the efforts 1-, ing made by him and the
T7Awnship solicitor have the Board azlend its order in a timely
fc-_shion and thus av:_,1d the need for the further ar,lendment. We
appreciate those efforts but as we have some ser:.o s doubt about
