BY-LAW NO. Z270-92
BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of Bayham deems it
necessary to amend its Zoning By-law No. 2387;
THEREFORE, the Council of the Corporation of the Township of Bayham enacts as
follows:
1. THAT By-lw No. 2387, as amended, is hereby further amended by amending
Section 12, Rural IndustrialjM2) Zone Regulations by adding a new subsection
to Section 12.10 EXCEPTION - (M2) Zone as follows:
"12.10.10
12.10.10.1 Defined Area
M2-10 as shown on Schedule `B', Map No. 4 to this By-law.
12.10.10.2 Permitted Uses
Public garage excluding an automobile service station;
Automobile sales establishment restricted to the storage
and/or display of a maximum of ten (10) vehicles at any one
time;
Machine shop;
Service shop;
Tool and die making;
Welding shop;
One single detached dwelling as an accessory use;
Accessory buildings and structures in accordance with the
regulations of the Zoning By-law.
12.10.10.3 Prohibited Uses
All uses in the Rural Industrial (M2) Zone except as
otherwise provided for in subsection 12.10.10.2 of this By-
law.
12.10.10.4 Special Area Restrictions
Notwithstanding any other regulations in this By-law, only
that area clearly marked: "Area Permitted For Storage And
Display of 10 Motor Vehicles" on Schedule "B", Map No. 5 to
this By-law, which schedule is attached to and forms part of
this By-law, may be used for the storage and display of
motor vehicles offered for sale in the M2-10 Zone."

2. THAT By-law No. 2387, as amended, is hereby further amended by amending
Schedule "B", Map No. 4, by deleting from the Rural Industrial (M2) Zone and
adding to the Special Rural Industrial (M2-10) Zone, those lands enclosed in
heavy solid lines and marked M2-10 on Schedule "A" to this By-law which
schedule is attached to and forms part of this By-law.
3. THIS By-law comes into force:
a) where no notice of objection has been filed with the Township's Clerk
within the time prescribed by the Planning Act, 1983 and regulations
pursuant thereto, upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the Township's Clerk within
the time prescribed by the Planning Act, 1983 and regulations pursuant
thereto, upon the approval of the Ontario Municipal Board.

TAKE NOTICE that the Council of the Corporation of the Township of Bayham passed
By-Law No. Z270-92 on the 7th day of May, 1992 under Section 34 of THE PLANNING
ACT, 1983.
AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal
Board in respect of the By-law by filing with the Clerk of the Township of Bayham not
later than the 3rd day of June, 1992, a notice of appeal setting out the objection to the
By-law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-law, describing the lands to which the
By-law applies, and a Key Map showing the location of the lands to which the By-law
applies (or, alternatively an explanation as to why a key map is not provided) are
attached. The complete By-law is available for inspection in my office during regular
office hours.

EXPLANATORY NOTE
The purpose of By-law No. Z270-92 is to change the zoning on a 0.4 hectare (1 acre)
parcel of land on the south side of Talbot Road East (Highway 19) in Lot 126,
Concession VI, hamlet of Straffordville, Township of Bayham, from the Rural Industrial
(M2) Zone and the Hamlet Residential (HR) Zone to the Special Rural Industrial (M2-
10) Zone.
The effect of this By-law will be to permit the establishment of an automobile sales
establishment and a public garage in addition to the existing residential use on the
subject lands.

SUBJECT: Planning Advisory
The purpose of this memorandum is to provide comments on two applications for
Zoning By-law amendments from Robert Cain and Michael McQuiggan.
Comments on applications from Hughes and Reiser for Estate Residential
developments, and a report on licensing fees and arrangements for mobile
vendors in other local municipalities will be forwarded within the next week.
1) Robert Cain
• The applicant proposes to establish a small scale used car lot in connection with
a public garage in Lot 126, Concession VI, on the south side of County Road No.
38, east of Highway No. 19 in the hamlet of Straffordville.
The subject lands are presently occupied by 'n existing single detached dwelling
zoned Hamlet Residential (HR), and a former welding shop and a storage
building which are currently zoned Rural Industrial (M2).
• In consideration of the arrangement of existing buildings, and the area proposed
for storage and display of automobiles as shown on the applicant's sketch plan, it
is my recommendation to rezone the entire property, including the dweliiv.,
two shops to a Special Rural Industrial (M2-10) Zone.
• Notwithstanding the existing Hamlet Residential zoning on part of the property
and the applicant's request for Hamlet Commercial zoning for his business, the
Special Rural Industrial (M240) Zone is recommended for the following reasons
and conditions:
1) Maintainine, the split zoning on the property will require an
excessive- number of specialized yr. i regulations that would be
difficult to enforce, particularly with the dwelling situated in the
midst of the proposed business uses. As such, the dwelling should
be listed among the permitted accessory uses on the site.

ii) The nature of the existing buildings and their historical
performance characteristics are more amenab'e for conversion back
to industrial uses if the proposed automotive use were to change or
relocate in the future.
iii) A "public garage" is c permitted use in both the Hamlet Commercial.
and the Rura Industrial Zones, however, virtually all other
permitted uses in either zoite will be excluded from the site specific
rezoning in order TO assure some degree of future land use
compatibility.
iv) The extension or redefinition of an existing zone on the property
(i.e.: M2) would be eas er o defend at the OMB, if necessary, than
would rezoning- to a completely different zor a (Lao HC).
v) The recor,.tmended zoning amendment would inclade a restricted
area on the property for the storage and offering for sale of motor
vehicles - to a maximum of 10 vehicles at anyone time Which
should afford some flexibility for the applicant.
Michael Mcouiggan
The applicant has requested a Zoning Bylaw Amendment to permii the
severance and conveyance of a 35 acre agricultural r�arcel fiorn a much larger
agricultural holding of approximately 185 acres. The subject lands are situated
in Part Lot 8, Concession V in the Tcaanalip of Payham, at the intersection of the
Fifth Concession Road, and. the Travel1et.i Road through Lots 7 and 8.
• Both the severed and. retained lands are intended to remain in agricultural use.
The. rationale for the significantly undersized agricultt.t: l lot is its physical
separation by a natural creek and gully from the larger faam holding.
Although them are some practical reasons for the proposed >tiverance and the Al
- special. rezo_nfrig, 't is my recommendation that the application for rezoning be
refused because of the ex..ent of the proposed deviation rom the minimum 50
acre lot size in the :kgricultural (Al) Zone. As such, the proposed rezoning
wourl_d not conform w'.zh subsections 4.2.5 a), d e) and g), with the emphasis
on the deviation from 4.2.5 g).

• As an alternative to the applicant's existing proposal, it is suggested that he may
wish to reconsider the size of the lot proposed for severance. if the application
for severance is amended to request conveyance of a 50 acre lot, then a Zoning
By-law Amendment would not be required.
