NOTICE OF THE PASSING
OF A ZONING BY-LAW BY
THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
TAKE NOTICE that the Council of the Corporation of the Township of Bayham passed
By-Law No. Z266-91 on the 19th day of December, 1991 under Section 34 of THE
PLANNING ACT, 1983.
AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal
Board in respect of the By-law by filing with the Clerk of the Township of Bayham not
later than the 30tlaiay of January , 1992, a notice of appeal setting out the objection
to the By-law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-law, describing the lands to which the
By-law applies, and a Key Map showing the location of the lands to which the By-law
applies (or, alternatively an explanation as to why a key map is not provided) are
attached. The complete By-law is available for inspection in my office during regular
office hours.

EXPLANATORY NOTE
The purpose of By-law No. Z266-91 is to change the zoning on a parcel of land
comprised of approximately 1.22 hectares (3.01 acres) situated along the road allowance
between Part Lot 136 and Part Lot 137, Concession 6, in the Township of Bayham, from
the Agricultural (A1) Zone to the Estate Residential (ER) Zone.
The effect of this By-law will be to permit the creation of a rural residential lot which is
intended to be used for retirement purposes by the applicant. The lands have never
been cultivated due to poor topographic conditions.

BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of Bayham deems it
necessary to amend its,Zoning By-law No. 2387;
THEREFORE, the Council of the Corporation of the Township of Bayham enacts as
follows:
1. THAT By-law No. 2387, as amended, is hereby further amended by amending
Section 5, Agricultural (A1) Zone Regulations by adding a new subsection to
Section 5.11 EXCEPTIONS - Al Zone as follows:
"5.11.40
5.11.40.1 Defined Area
Al-40 as shown on Schedule 'A', Map 44 to this By-law.
5.11.40.2 Minimum Lot Area
10.5 hectares."
2. THAT By-law No. 2387, as amended, is hereby further amended by amending
Schedule 'A', Map 44 by deleting from the Agricultural (A1) Zone and adding to
the Special Agricultural (A1-40) Zone, those lands enclosed in heavy solid lines
and marked A1-40 on Schedule 'A' to this By-law, which schedule is attached to
and forms part of this By-law.
3. . THAT By-law No. 2387, as amended, is hereby further amended by amending
Schedule 'A', Map 44 by deleting from the Agricultural (Al) Zone and adding to
the Estate Residential (ER) Zone, those lands enclosed in heavy solid lines and
marked ER on Schedule 'A' to this By-law, which schedule is attached to and
forms part of this By-law.
4. THIS By-law comes into force:
a) where no notice of objection has been filed with the Township's Clerk
within the time prescribed by the Planning Act, 1983 and regulations
pursuant thereto, upon the expiration of the prescribed time; or

b) where notice of objection has been filed with the Township's Clerk within
the time prescribed by the Planning Act, 1983 and regulations pursuant
thereto, upon the approval of the Ontario Municipal Board.

in the Township of Bayham
• We have reviewed the above-noted applications with respect to the Official Plan
and Zoning By-law with the understanding that the Berends intend to create one
new lot for retirement purposes.
• The proposed lot is situated at the north-east corner of an existing 30 acre farm
property, part of which has been under the cultivation of cash crops.
• The lands intended to be severed for use as a retirement lot are physically
separated from the main farm operation by a tributary creek of the Little Otter
Creek system. These lands have never been cultivated due to poor soil conditions
resulting from poor drainage. Further, the subject lands are aesthetically situated
in an area bordered by mature woodlots to the east, north, and to a certain extent,
to the west. There are no buildings or structures capable of housing livestock
within applicable MDS criteria of the subject lands.
• The proposed retirement lot is intended to be approximately 3 acres in size which
essentially comprises the non-tillable and physically separated portion of the larger
farm property. This lot has also met the criteria for a certificate of approval for
private servicing from the Elgin-St. Thomas Health Unit.
• In consideration of the factors discussed above, it is our opinion that the Berend
application will meet the criteria of subsection 4.2.6 of the Official Plan for the
creation of a retirement lot, provided that Township Council is convinced the
Berends have been bona fide resident farmers for the last ten years in the
municipality, and are retiring from active working life.

The Corporation of the
Township of Bayham
o Our recommendation therefore, is to process the application for a zoning by-law
amendment only. The amendment would rezone the retirement lot from the
Agricultural (Al) Zone to the Rural Residential (RR) Zone, as well as
establishing site-specific regulations on the retained parcel to recognize the
creation of an agricultural parcel less than 20 hectares in size, and to restrict
further non-farm development and severances on the farm parcel.

We would like to comment on this zoning by-law
amendment. Our records indicate that a water course
runs along the edge of a woodlot in the northeast
corner of this property.
We have now established a "NO NET LOSS" of forest
ecosystem policy for the Aylmer Administrative
District. This policy requires us to ensure that
existing forest ecosystems are given regard when
development is proposed.
In the interest of retaining current forest cover for
both wood fibre production/aesthetics and wildlife
habitat, we ask that any future development within the
forested area be restricted or kept to a minimum.
Natural forest cover in Southwestern Ontario has been
gradually dwindling due to development pressures.
We would appreciate it if you could advise the
applicant that this agency provides a free woodlot
advisory service to help private landowners manage
woodlots for sawlog, fuelwood and/or wildlife habitat.

Our records also indicate that the proposed lot to be
severed and rezoned Estate Residential is adjacent to a
natural water course. We have classified this as a
"very sensitive" water course in terms of fisheries
habitat protection.
Any development must not adversely impact the fisheries
habitat of the water system. Protective measures
include maintaining a MINIMUM 30 meter, naturally
vegetated, buffer strip along each side of the creek
bank.
We feel that a residential unit in the vicinity of the
creek or woodlot would not be a compatible land use
with the natural resource values of the property.
Therefore, we recommend that any development be
restricted to the adjoining open land on the south side
of the existing driveway.

liayham wilt hold a public meeting for the purpose of informing the
public in respect of proposed official plan and zoning by-law
amendments to be considered in accordance with the provlsion of
The Planning Act . The Amendments to be considered are as follows :
APPLICATION
BEREND JAN VEEN : -- Concession 6 , South Part of Lot 136 to change t:he
zoning of a portion of the lands from Agricultural (Al ) to Estate
Residential . This will permit the creation of a residential lot by
severance by the Elgin County Land Division Committee
The Public Meeting will be held in the Council Chambers
at Straffordville commencing at 8: 30 P.M. on thursday
December 1.9, 991

Minutes of Council meeting held December 19, 1991 continued
a court case is in progress concerning these regulations and the
decision on this case could have far reaching effects on volunteer fire
departments .
Mr. Hugh Howey and Mr. George Palmer representing the Bayham
Community Initiatives Group are present requesting township assistance
in obtaining a suitable location to distribute clothing and food to
people in need. Mr . Howey informs council of the groups operation and
that they were required to move from the Anglican Hall in Port Burwell
and are therefore in need of a place large enough to display the new and
used clothing that they have available. The building should have a
suitable location and be heated. Mr. Howey advised that their group
relies on donations and therefore does not have a large budget to work
with. Discussion ensued as to possible locations with council advising
that they would be willing to assist if at all possible .
Mr . Cyril Demeyere of Cyril J . Demeyere Limited presents council
with a draft copy of a development agreement between Mr. Gilles Therrien
and the Township . Council reviews the agreement with Mr . Demeyere who
will present the final agreement for signing .
Discussion regarding a possible watermain along highway #19 takes
place . Mr . Demeyere suggest that an engineer 's report at an estimated
cost of $2000 . 00 be prepared and sent along with an application for
grant monies presently available. Mr. Demeyere advises that this grant
may no longer be available and therefore suggest that an application not
be delayed.
Mr. John Hendricks is present to further discuss council 's position
on his request to obtain a severance on his property at Concession 3 ,
Lot 12 for retirement purposes . Council advise that under the present
circumstance a lot severance at the present time would not be permitted .
PUBLIC MEETING
Record of public meeting held December 19 , 1991 concerning Official
Plan and Zoning Amendments .
Reeve Chute declares a public meeting as advertised to receive
comments on proposed amendments to the Township of Bayham's official
plan and zoning by-laws to be open.
The first application is that of Berend Jan Veen, Re By-Law Z266-91
Part Lot 136, Concession 6 to change the zoning of a portion of his
lands from Al to Estate Residential and Agricultural . The purpose of
this application is to create one residential lot for retirement
purposes .
Mr. and Mrs . Veen are present in support of the application. The
Clerk advises that correspondence received for the Elgin-St . Thomas
Health Unit advising they have no objection to the amendment . Also
correspondence is received from the Ministry of Natural Resources
advising that they have established a "No Net Loss" of forest ecosystem
policy . They advise that any development must not adversely impact the
fisheries habitat of the adjacent natural water course.
They request that there be a minimum 30 meter naturally vegetated
buffer strip along each side of the water course. The ministry
recommend that development be restricted to the adjoining open land .
Mr . Veen responds that his proposal would improve the property and
not be detrimental to it ,
No further comments were received on this application.

Please be advised that Bayham Township Council at their last
regular meeting further consideredyour application to rezone a portion
of your property for retirement purposes.
Your letter' of Sept. 12,. 1991 was presented and given consideration
by Council, however, they are unable to accept your application as
you do not meet the criteria required in section 4. 2.6 (a) of the
Township Official Plan.
The Township planning consultants are of the opinion that your
proposal is feasibile, however, if you wish to proceed at this time
an official plan and zone amendment will be necessary.
Your completed application forms are stillon file. Please
advise if you wish me to proceed to process your application. As
previously advised a payment of $1 ,000.00 must accompany your
application. .

data regarding residence in Bayham Township & Farm History .
I have farmed for approximately 20 years of which 7 years
are in Bayham Township and have resided in Bayham Township
for 14 years.
I hope that you can allow the requested severence based
on the status of the land, it ' s potential use as farm land
versus residential use.
With reference to our last discussion, you know I am in
ill health and need to sell our present home and build a
home based on a one floor plan.
I sincerely hope that this application can be granted at
the local level based on the many positive statements by
the Health Dept and the consulting report .

SUBJECT: Applications from Berend for
Official Plan and Zoning By-law Amendments
Part Lot 136, Concession 6
in the Township of Baybam
• We have reviewed the above-noted applications with respect to the Official Plan
and Zoning By-law with the understanding that the Berends intend to create one
new lot for retirement purposes.
• The proposed lot is situated at the north-east corner of an existing 30 acre farm
property, part of which has been under the cultivation of cash crops.
• The lands intended to be severed for use as a retirement lot are physically
separated from the main farm operation by a tributary creek of the Little Otter
Creek system. These lands have never been cultivated due to poor soil conditions
resulting from poor drainage. Further, the subject lands are aesthetically situated
in an area bordered by mature woodlots to the east, north, and to a certain extent,
to the west. There are no buildings or structures capable of housing livestock
within applicable MDS criteria of the subject lands.
• The proposed retirement lot is intended to he approximately 3 acres in size which
essentially comprises the-non-tillable and physically separated portion of the larger
farm property. This lot has also met the criteria for a certificate of approval for
private servicing from the Elgin-St, Thomas Health Unit.
• In consideration of the factors discussed above, it is our opinion that the Berend
application will meet the criteria of subsection 4.2.6 of the Official Plan for the
creation of a retirement lot, provided that Township Council is convinced the
Berends have been bona fide resident farmers for the last ten years in the
municipality, and are retiring from active working life.

MEMORANDUM
The Corporation of the
Township of Bayham
Our recommendation therefore, is to process the application for a zoning by-law
amendment only. The amendment would rezone the retirement lot from the
Agricultural (Al) Zone to the Rural Residential (RR) Zone, as well as
establishing site-specific regulations on the retained parcel to recognize the
creation of an agricultural parcel less than 20 hectares in size, and to restrict
further non-farm development and severances on the farm parcel.
