NOTICE OF THE PASSING
OF'A ZONING BY-LAW BY
THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
TAKE NOTICE that the Council of the Corporation of the Township of Bayham passed
By-Law No. Z256-91 on the 22nd day of August, 1991 under Section 34 of THE
PLANNING ACT, 1983.
AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal
Board in respect of the By-law by filing with the Clerk of the Township of Bayham not
later than the 18th day of September, 1991, a notice of appeal setting out the objection
to the By-law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-law, describing the lands to which the
By-law applies, and a Key Map showing the location of the lands to which the By-law
applies (or, alternatively an explanation as to why a key map is not provided) are
attached. The complete By-law is available for inspection in my office during regular
office hours.

EXPLANATORY NOTE
The purpose of By-law No. Z256-91 is to effect a series of technical changes and
revisions to the Township's Comprehensive Zoning By-law No. 2387. These changes are
intended to revise the Estate Residential (ER) and Rural Residential (RR) zone
regulations. The new zone regulations have been created to implement approved
Policies which were incorporated into the Official Plan of the Township of Bayham.
Farm related residential lots (i.e.: farm retirement, surplus, supplementary farm help, or
infilling) that are created without the necessity of processing an Official Plan Amendment
will be zoned "Rural Residential" (RR). The creation of new non farm related
residential lots will continue to require an Amendment to the Official Plan of the
Township of Bayham and will be zoned "Estate Residential" (ER). The new zone
provisions will regulate the lot size, setbacks and permitted uses in each zone.
The effect of this By-law will be to facilitate an improved level of interpretation and
implementation of the Township's Zoning By-law and to bring it into conformity with the
Official Plan of the Township of Bayham, as amended.
A key map is not attached because this By-law will apply to all lands zoned Estate
Residential (ER) or Rural Residential (RR) within the Township of Bayham.

BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of Bayham deems it
necessary to amend its Zoning By-law No. 2387;
THEREFORE, the Council of the Corporation of the Township of Bayham enacts as
follows:
1) That By-law No. 2387, as amended is hereby further amended by deleting Section
7 Rural Residential (RR) Zone Regulations in their entirety and replacing them
with the following:
"Section 7 Rural Residential (RR) Zone Regulations
7.1 PERMITTED USES
No land shall be used and no buildings or structures shall be erected, used
or altered in the Rural Residential (RR) Zone except for the following
purposes:
residential uses
home occupation
home occupation agricultural
private garage or carport
accessory uses.
7.2 PERMITTED BUILDINGS AND STRUCTURES
residential dwelling units
private garage or carport
accessory buildings or structures.
7.3 MINIMUM LOT AREA 0.4 hectares
7.4 MINIMUM LOT FRONTAGE 50.0 metres
7.5 MAXIMUM LOT COVERAGE 20 per cent
7.6 MAXIMUM BUILDING HEIGHT 10.5 metres

No accessory buildings or structures shall be located within 3 metres of a
side or rear lot line.
7.11.1 Re ulations for ivestock Buildings and Structure=s
The keeping of livestock in a hobby farm context is permitted in the Rural
Residential (RR) Zone providing the complement of livestock is small and
can comply with the regulations of the Agricultural Code of Practice, A
certificate of compliance must be obtained from the Ontario Ministry of
Agriculture and Food prior to the keeping of livestock on lands zoned
Rural Residential (RR).

Permitted buildings and structures for accessory uses shall include
greenhouses, and notwithstanding Subsections 4.2.3, 4.2.4, and 4.2.6 of By-
law No. 2387, as amended, such accessory buildings and structures may be
located in the front yard and closer to the front lot line than the main
building provided that a minimum setback of thirty-five (35.0) metres is
maintained from the front lot line for such accessory buildings and
structures and that all accessory buildings and structures shall not exceed
seventeen and one half (17.5%) percent coverage of the total lot area.

The keeping of livestock in a hobby farm context is permitted in the Estate
Residential (ER) Zone providing the complement of livestock is small and
can comply with the regulations of the Agricultural Code of Practice. A
certificate of compliance must by obtained from the Ontario Ministry of
Agriculture and Food prior to the keeping of livestock on lands zoned
Estate Residential (ER).
8.12 MINIMUM SEPARATION DISTANCE

8.13 EXCEPTIONS

8.13.1.2 LOCATION OF BUILDINGS AND OTHER STRUCTURES
No building or private sewage disposal system shall be permitted in the
area south of the 243.8 metre contour shown on Schedule "A" - Map 17 to
this By-law.
8.13.1.3 SETBACK FROM BREAK OF SLOPE
7.62 metres minimum for all buildings and structures on lots 3, 4, 5, 6 and 7
as shown on Schedule "A" - Map 17 to this By-law. The break of slope is
defined as the 243.8 metre contour line for lots 3, 4 and 5, as shown on
Schedule "A" - Map 17, and the 242.3 metre contour line for lots 6 and 7,
as shown on Schedule "A" - Map 17.
8.13.1.4 Regulation for Accessory Buildings
Maximum floor area 32.6 m2
No more than one (1) accessory building or structure shall be permitted on
one lot in lands within the Special Estate Residential (ER-1) Zone.
8.13.1.5 PROHIBITED USES
The keeping or raising of livestock in accordance with Section 8.11 to this
By-law is prohibited."
3. THIS By-law comes into force:
a) where no notice of objection has been filed with the Township's Clerk
within the time prescribed by the Planning Act, 1983 and regulations
pursuant thereto, upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the Township's Clerk within
the time prescribed by the Planning Act, 1983 and regulations pursuant
thereto, upon the approval of the Ontario Municipal Board.

TOWNSHIP OF BAYHAM
TAKE NOTICE that the Council of the Corporation of the Township of Bayham will
hold public meetings on Thursday, July 18th, 1991 at 8:30 p.m., at the Township Office in
Straffordville to consider proposed Comprehensive Zoning.By-law Amendments pursuant
to Section 34 of the Planning Act, 1983.
The purpose of the proposed amendments are as follows:
1) implement Official Plan amendment No. 87 which had the effect of revising the
Rural Policy section of the Official Plan. This zoning by-law will zone all non
farm related residential lots that have been approved by OPA #87 "Estate
Residential" in the Comprehensive Zoning By-law of the Township of Bayham.
2) revise the zone provisions for lands zoned "Rural Residential" and "Estate
Residential" throughout the Township of Bayham.
ANY PERSONS may attend the public meeting and/or make a written or verbal
representation in support of or in opposition to the proposed amendments.
ADDITIONAL INFORMATION relating to the proposed Zoning By-law Amendment is
available for inspection between 9:00 a.m. and 4:30 p.m. at the Township Municipal
Office on Highway 19 in Straffordville.

8.11 Regulations for Livestock Buildings and Structures
The keeping of livestock in a hobby farm context is permitted in the Estate
Residential (ER) Zone providing the complement of livestock is small and
can comply with the regulations of the Agricultural Code of Practice. A
certificate of compliance must by obtained from the Ontario Ministry of
Agriculture and Food prior to the keeping of livestock on lands zoned
Estate Residential (ER).

The Council of the Corporation of the Township of Bayham hereby resolves
THAT, pursuant to Section 34 (16) of the Planning Act, further notice and public
meeting concerning By-law No. Z256-91 will not be required.
