EXPLANATORY NOTE
The purpose of By-law No. Z252-90 is to change the zoning on a
2.02 hectare (5.0 acre) parcel of land situated on the north side
of County Road No. 38, in Part Lot 131, Concession N.S.T.R. ,in
the Township of Bayham, from the Agricultural (A1) Zone to the
Special Agricultural (A1-38) Zone.
The effect of this By-law will be to permit a lot to be created
containing one surplus dwelling unit and two sheds, pursuant to
the process of severance and conveyance. The Special
Agricultural (A1-38) Zone will regulate the type of activity
permitted on the newly created lot as well as recognize a minimum
lot area deficiency.

BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of Bayham
deems it necessary to amend its Zoning By-law No. 2387 ;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows:
1. THAT By-law No. 2387, as amended, is hereby further amended
by amending Section 5L Agricultural (Al) Zone Regulations by
adding a new subsection to Section 5. 11 EXCEPTIONS - Al Zone
as follows:
"5. 11.38
5 . 11.38 . 1 Defined Area
Al-38 as shown on Schedule `A` , Map 36 to
this By-law.
5 . 11. 38.2 Permitted Uses
All uses permitted in the Agricultural (Al)
Zone unless specifically prohibited.
5 . 11.38.3 Prohibited Uses
landing strip
riding stable
supplementary housing to a farm operation.
5. 11. 38 .4 Minimum Lot Area
2 .0 hectares.
5. 11. 38 .5 Minimum Lot Frontage
100.0 metres.
5. 11. 38.6 Minimum Side Yard Width
for buildings and structures used or intended
to be used for the raising of livestock 30.0
metres .
5 . 11 . 38 . 7 Supplementary Regulations for Livestock
The number of animal units permitted to be
raised or kept in the Special Agricultural
(A1-38) Zone shall be in accordance with the
Agricultural Code of Practise and comply to
the minimum distance separation formula.
2 . THAT By-law No. 2387, as amended, is hereby further amended
by amending Schedule 'A' , Map 36 by deleting from the
Agricultural (Al) Zone and adding to the Special
Agricultural (A1-38) Zone, those lands enclosed in heavy
solid lines and marked Al-38 on Schedule 'A' to this By-law,
which schedule is attached to and forms part of this By-law.
3. THIS By-law comes into force:
a) where no notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board.

MEMORANDUM

Proposed Official. Plan and Zoning
By-law Amendments
We have been approached directly by Mr. Dennis to provide a
preliminary planning evaluation of a proposal to create a rural
residential lot. It is our opinion that the proposed lot could
be created based on the surplus farm dwelling policies of the
Official Plan of the Township of Bayham. As such, we feel this
proposal could be supported by Council.
Due to an existing tree row on the north and east side of the
property, the applicant prefers to sever a 5 acre parcel of land
which surrounds the surplus farm dwelling and structures .
Regardless of the size of parcel proposed for the newly created
lot, the subject lands should be placed into a Rural Residential
designation in the Official Plan which accurately represents the
intended use of the lands . The property should also be rezoned
into a special Rural Residential Zone which recognizes the types
of structures and size of the newly created lot. The special
zoning would further prohibit the lands from baing subdivided for
additional rural residential lots.
Mr. Dennis' letter is enclosed for your information which is self
explanatory. If you require additional information pertaining to
this issue, please do not hesitate to contact the undersigned.

Dear Paul :
I have enclosed an illustration of the said mentioned property as per our
telephone conversation.
This property is an old homestead with the buildings being pre 1900. The
size is approximately 5 acres in total surrounded by hand planted red pine
and some white birch. I could sever only the house and approximately one
acre of land , however I feel that in reality this would be a disservice to
the Township of E-ayh:arm. With a little work , this parcel of land would
make a nice home for a family.
This property is located on the south west corner of the farm. The only
way for this extra land to fit into the rest of the farm would be to
bulldoze out the fences and the red pine trees surrounding this property.
Also, as :f. understand , the barns would have to be torn dawn or but .l dozed
and burned as well .
I h.sve riven this situation a lot of thought and to me it makes more sense
to leave this sect:i.on of property a small homestead by itself . If this
property were to be classed as Special Agricultural. , this would prevent
the new owner from severing an additional lot on the highway. As I
understand i t , if this property were changed to Rural Residential , then
the new owner could apply for severance of another lot.
The way I see this property Paul , is that there could potentially be only
two lots severed on the hi ehway , the existing house and erre acre of land ,
and then another lot directly to the east of this house -and one acre lot.
If I decided to co this route then most of the barns and sheds would have
to be torn down and the zoning changed.
I understand that there are not too many properties around t4ayham Township
with this potential . With this property severed from the rest of the
farm, the Appearance of the farm is not altered. This is a piece of
property by itself and I think that it would enhance the esthetic value of

This property has its own well and even in the worst drought , there has
always been plenty of water in this area.
With this property situated only 8 miles from Ti l l sonburg on a good
highway , the new owners can easily commute to work in Till sonburg , Aylmer ,
or even St. Thomas. This area is mainly tobacco and cash crop country and
this section of agriculture seems to be sliding downhill . Therefore this
area needs working class people to keep this region from getting any
poorer.
