Chapter 1 , Section 52, as it affects the following property:
LOT 117&118, CONCESSION NORTH TALBOT ROAD, TOWNSHIP OF BAYHAM
of a severance of a portion of the above-mentioned premises as shown on a sketch attached to
the application of a parcel of land with a frontage of 121.92m along Maple Grove Road and a
depth of 1130m. The owners are retaining 40.48 hectares.

Conditions: This decision will expire unless a deed is presented for stamping by:
MAY 28, 1992 . Providing that the requirements of the Township of Bayhan are
met ($1000.00 cash in lieu of parkland dedication for two-newly created parcels of land) and
written notice be received from sane confirming the conditions prior to stamping the deed. THIS
CONSENT was granted as per amended application-SEVERED PORTION frontage increased by 33.58m to a
frontage of 155.5m, Severed portion depth (east lot line)decreased by 330m to a depth of 800m
(west lot line) increased by 91.44m to a depth of 914.44m, Severed portion Area now 20.64 hectares.

EXPLANATORY NOTE
The purpose of By-law No. Z251-90 is to change the zoning on a
0.62 hectare ( 1.54 acre) parcel of land situated on the east side
of the road allowance between Lot 113 and 114 on the west side of
Part Lot 114, N.S.T.R. (Concession 7) , south of the Big Otter
Creek, in the Township of Bayham, from the Agricultural (Al) Zone
to the Rural Residential (RR) Zone.
The effect of this By-law will be to permit the creation of a
rural residential lot suitable for the construction of a single
dwelling unit pursuant to the process of severance and
conveyance. Any development on the subject lands will be
regulated by the policies of Section 4. 12 of the Township of
Bayham Zoning By-law No. 2387 , as amended and subject to written
approval by the Long Point Region Conservation Authority. This
By-law is intended to implement the policies of Official Plan
Amendment No. 86 which designates the subject lands as "Rural
Residential" .

BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of Bayham
deems it necessary to amend its Zoning By-law No. 2387;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows:
1. THAT By-law No. 2387, as amended, is hereby further amended
by amending Schedule 'A' , Map 31, by deleting from the
Agricultural (A1) Zone and adding to the Rural Residential
(RR) Zone, those lands enclosed in heavy solid lines and
marked RR on Schedule 'A' to this By-law, which schedule is
attached to and forms part of this By-law.
3 . THIS By-law comes into force:
a) where no notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board.

SUBJECT: Proposed Zoning By-law

We have reviewed the subject matter and have no objections to its
approval .
Our concerns pertain to the Big Otter Creek waterway that passes
by the property. Kindly advise the landowner that any proposals
that may entail the dredging, diversion, damming or placing of
structures in the waterway will require a formal Work Permit from
this agency. This is in accordance to Section 13a(1) of the
Public Lands Act, R.S.O. 1980, as amended. Application from the
local conservation authority may also be required.
In addition, this section of Big Otter Creek waterway has been
deemed a navigable waterway and for the administrative purposes of
this agency, the waterbed of same is claimed as Crown lands.

This checklist is intended to act as a guide in order to assist
in determining the appropriateness of creating rural non-farm
residential lots . If a proposal does not entirely conform to
this checklist , the Township Planners should be contacted prior
to the formal submission of an application for consent to the
Elgin County Land Division Committee. For a more detailed
reference to the policies affecting rural non-farm residential
development, the Official Plan and Zoning By-law for the
Township of Bayham should be consulted .
