Further to your conversation (08 . 10 . 90) with Tim Bower , of this
office , we can now advise you that the LPRCA would have no
objection to the proposed severance . Of concern to this
Authority would be the location of the residence and associated
regrading in relation to the watercourse and ravine. Staff from
this office are of this opinion that there is adequate area on
the severed lot to regrade and construct without impacting the
watercourse . Additional comments will be provided once the
application for severance is circulated .

contour shown on Schedule "A" - Map 17 to this
By-law.
8. 12. 1. 3 SETBACK FROM BREAK OF SLOPE
7.62 metres minimum for all buildings and
structures on lots 3 , 4, 5, 6 and 7 as shown on
Schedule "A" - Map 17 to this By-law. The break of
slope is defined as the 243.8 metre contour line
for lots 3 , 4 and 5, as shown on Schedule "A" - Map

the Clerk of the Township of Bayham not later than the 11th day
of December, 1990, a notice of appeal setting out the objection
to the By-law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-law,
describing the lands to which the By-law applies, and a Key Map

EXPLANATORY NOTE
The purpose of By-law No. Z249-90 is two fold. Firstly, it will
change the zoning on a 0.25 hectare (0. 61 acre) parcel of land
situated on the west side of Part Lot 21, Concession 4,
approximately 210.0 metres south of County Road No. 45, in the
Township of Bayham, from the Agricultural (Al) Zone to the
Special Rural Residential (RR-18) Zone and the Hazard Land (HL)
Zone. Secondly, it will rezone a parcel of land from the (Al)
Zone to the Special (A1-37) Zone.
The effect of this By-law will be to permit the creation of a
rural residential lot pursuant to the process of severance and
conveyance. The proposed lot is situated in an area which is
comprised of a wooded plateau adjacent to the Otter Creek and its
associated valley walls. It is the Long Point Region
Conservation Authority's opinion that development can occur on
the subject lands above the 212 . 5 metre contour elevation without
impacting on the bank of the Otter Creek. Although the proposed
rural residential lot will extend below the 212 .5 metre contour
elevation, only the portion of the lot above this elevation is to
be rezoned to the Special Rural Residential (RR-18) Zone. All
lands below this elevation forming part of the proposed
residential lot will be rezoned Hazard Lands in order to reflect
the potential hazardous conditions of this area.
This By-law will also recognize the minimum lot area deficiency
on the land intended to be retained. This By-law is intended to
implement the policies of Official Plan Amendment No. 84 which
designates the buildable portion of the residential lot as "Rural
Residential" .

BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Township of Bayham
deems it necessary to amend its Zoning By-law No. 2387;
THEREFORE, the Council of the Corporation of the Township of
Bayham enacts as follows :
1. THAT By-law No. 2387, as amended, is hereby further amended
by amending Section 7 , Rural Residential (RR) Zone
Regulations by adding a new subsection to Section 7 . 11
Exception (RR) Zone as follows :
"7. 11. 18
7 . 11. 18. 1 Defined Area
RR-18 as shown on Schedule 'A' , Map 62 to
this By-law.
7 . 11. 18.2 Minimum Lot Frontage
36 .0 metres .
7. 11. 18.3 Rear Yard Setback from the 212.5 Metre
Contour Elevation.
0.0 metres
7 . 11. 18 .4 Building, Structures and Grading Regulations
No buildings or structures shall be
constructed or regrading of land occur below
the 212 .5 metre contour elevation. "
2 . THAT By-law No. 2387, as amended, is hereby further amended
by amending Section 5, Agricultural (Al) Zone Regulations by
adding a new subsection to Section 5. 11 Exception (A1) Zone
as follows:
"5. 11.37
5. 11. 37 .1 Defined Area
A1-37 as shown on Schedule 'A' , Map 62 to
this By-law.
5. 11. 37 ..2 Minimum Lot Area
9 .0 hectares . "
3. THAT By-law No. 2387, as amended, is hereby further amended
by amending Schedule `A' , Map 62, by deleting from the
Agricultural (Al) Zone and adding to the Special Rural
Residential (RR-18) Zone, Hazard Land (HL) Zone and the
Special Agricultural (A1-37) Zone, those lands enclosed in
heavy solid lines and marked RR-18, HL and A1-37

respectively on Schedule 'A' to this By-law, which schedule
is attached to and forms part of this By-law.
4 . THIS By-law comes into force:
a) where no notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the
Township's Clerk within the time prescribed by the
Planning Act, 1983 and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board.
READ A FIRST TIME THIS 15TH DAY OF NOVEMBER, 1990.
