The subject lands are situated within the hamlet designation of Richmond, in the Official Plan of the Township of Bayham. The effect of this By-law will be to recognize lands suitable for hamlet residential development within Richmond and permit the creation of five (5) hamlet residential lots pursuant to the process of severance and conveyance. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule 'E' , by deleting from the Future Development (FD) Zone and adding to the Hamlet Residential (HR) Zone, those lands enclosed in heavy solid lines and marked HR on Schedule 'A' to this By-law, which schedule is attached to and forms part of this By-law. 2 . The Hearing is to be held on Wednesday October 21, 1992 at 10:00 a.m. in the Township of Bayham Council Chambers. • By-law Z247-90 was passed by Council on September 6, 1990, and if approved by the OMB, the by-law would permit the creation by severance of five residential lots on the west side of Mill Street in the hamlet of Richmond. • Further to our discussions with the Township Solicitor and the Agent for the Applicants, we have determined that the objections remaining before the OMB are related to demands for certain guarantees by neighbours around the subject lands. Specifically, a person across the street wants a written guarantee that his water supply will not be negatively affected, and, a person to the west wants a written guarantee that he will not be negatively affected by increased storm water run off. • Although the Ministry of the Environment (M.O.E.) had originally objected to By-law Z247-90 on the grounds of a questionable water supply, they have since withdrawn their formal objection upon demonstration by the applicants of intent to connect to the Richmond Communal Water System. In a letter to the Township dated January 21, 1991, however, the M.O.E. clearly indicates that the withdrawal of their objection is due only to their lack of jurisdiction over communal water systems, and the inapplicability of their nitrate guidelines to development proposals consisting of less than six lots. London Page.../2 August 20, 1992 Memorandum • Although the Agent for the Applicants is attempting to resolve the outstanding objections from the neighbours so as to avoid the OMB Hearing, the Township should begin to consider its role at the Hearing should it proceed. Basically, there are two options: i) The Township may withdraw support for the By-law at the Hearing unless or until the Applicants can demonstrate to the satisfaction of the M.O.E. that water and sewage services will not cause or contribute to problems in the hamlet; u) The Township may take a passive role of support at the Hearing in as much as the proposed zoning conforms to the Hamlet Designation in the Official Plan. 410. 1 - CUMMING COCKBURN LIMITED Gary Blazak, M.A. Consulting Planner to the Township of Bayham GB:rem Notwithstanding our Ministry's decision to withdraw our appeal, the Ministry of the Environment offers for Bayham Township's consideration the following advice in the event that it may ultimately be responsibile for providing a municipal supply should individual wells become inadequate. 1. Bayham Township should require a pump test(s) to be undertaken by the proponent to substantiate that there is sufficient water available to service all five properties from a single well or individual wells on each lot depending upon the proponent's intentions. 2. Bayham Township should require the proponent to undertake some testing of the water from the intended water bearing zone for physical, bacteriological and general chemistry parameters. Without the prior provision of this information, the Township could be seen as approving residential development on the subject property without anyknowledge as to the potability of the water for future residents. 3. To date our Ministry has not received any indication from the proponent as to the proposed lot areas, existing nitrate levels, or the number and location of downgradient shallow well users. Without the provision of this information, our Ministry has been unable to assess the potential impact of additional nitrate generated from septic tank systems yet to be installed within the subject property on existing downgradient shallow well water users. - The Ministry of the Environment does not apply the nitrate guideline to development proposals less than six dwellings. The reason for this stems from the fact that our Ministry presently has no regulatory approval authority for doing so. This is not to say that elevated nitrate levels would not be encountered on development proposals of five or less dwellings. It is my understanding that elevated nitrate levels have been a problem in the Richmond area in the past, and it would therefore be appropriate for the Township to address the nitrate issue prior to deciding on approval of the zoning amendment. 4. The proponent has not provided documentation indicating that the subject property is suitable or can be made suitable for sewage disposal. As the Health Unit is our Ministry's agent for Part 7 of the Environmental Protection Act, a letter outlining their opinion of the suitability of the site for private sewage servicing should be sought by the proponent and provided to Bayham Township prior to any consideration of approval of the zonin1 by-Eaw. I W J C r aim i ^C. rN Lib w __ Plaet.7- r.,a Ad e r y F MEMORANDUM146- {` 2001 TO: Township of Bayham DATE: October 3, 1991 FROM: Gary Blazak SUBJECT: Application from Roloson for Official Plan and Zoning By-law Amendments Part Lot 24, Concession 3 in the Township of Bayham • We have reviewed the above-noted applications with the understanding that the applicant intends to split an existing rural residential lot with one residence in order to create one new lot for estate residential purposes. ▪ The subject lands comprise 0.8 hectares (2 acres) and are situated at the northwest corner of Part Lot 24, Concession 3 in an area which is presently occupied by a number of farm buildings associated with existing tobacco farm operations. • We have difficulty supporting the Roloson applications because the proposal does not comply with the intent of subsections 4.2.9; 4.2.10; and 4.3.1.4 of the Official Plan, as recently amended, regarding infilling, minor lot adjustments and the policies for the Rural designation. • It is our recommendation to refuse the Roloson applications for Official Plan and Zoning By-law Amendments on the grounds that they do not comply with the policies of the Official Plan and as such, they would be virtually impossible to defend before the Ontario Municipal Board. The creation of a single lot for residential purposes may be considered by Council providing the following criteria axe met: • the lands to be severed for non-farm residential purposes is bounded on both sides by existing non-farm residential dwellings which are located on the same side of the road where the buildings are no further than 100 metres apart; • the lands to be severed must not be within the applicable separation distance of a livestock operation as defined in the Agricultural Code of Practice; • the land to be severed must be suitable to support an individual well and private sewage disposal system which is approved by the Ministry of the Environment or their designated agent; • the lot to be severed must be situated on land not engaged in agricultural production and deemed unsuitable for such production. 4.2.10 Minor lot adjustments: Consents to sever and convey land in areas designated "Agriculture" shall be permitted for minor lot adjustments, minor lot additions, minor boundary changes, easements and rights of way, technical severance or correction of title, provided no new conveyable lot(s) are created and where applicable, the consent decision shall stipulate that Subsection 3 of Section 49 of the Planning Act, 1983, be applied to any subsequent conveyance of the severed parcel. 8 4.3 RURAL 4.3.1 The "Rural" designation applies to lands outside the hamlet areas which may be used for non-farm activities and where no identifiable adverse impacts on agriculture will occur. Such areas are subject to a site specific amendment to the Township's Official Plan and the regulations of the Township's Zoning By-law. 4.3.1.1 The following uses-in the "Rural" designation will'be further identified by a sub-classification indicating a specific use. The uses and their sub- classifications will he shown on Schedule 'A' to the Official Plan and are as - follows: • Estate Residential R(E) • Mobile Home Parks R(MH) • Seasonal Travel Trailer Parks R(T) • Campgrounds R(CG) • Recreational R(R) • Public Institutional R(I) • Commercial R(C) • Industrial R(M) 4.3.1.2 The Township shall regulate all development in the areas designated "Rural" so that the environment is maintained and potential land use conflicts are not created. 4.3.1.3 In evaluating proposals for rural uses, the Township Council shall require a _ presentation of the proposal which will include a detailed site plan outlining building areas and locations, ingress and egress'to the site, parking facilities, existing and surrounding land uses, building location, site characteristics, and proposed buffering, surface water drainage, and landscaping. Servicing reports such as hydrogeological and/or geotechnical may be required by the Ministry of the Environment or their designated agent to demonstrate the suitability of lands to accommodate individual wells and private sewage disposal systems. In addition, the Township Council shall require all applicants to provide written confirmation from the local Health Unit that the site is suitable for septic systems and that potable water can be supplied. 9 4.3.1.4 General policies which apply to all rural uses: Lands to be designated "Rural" in the Township of Bayham shall comply with the following: a) • the provisions of the Agricultural Code of Practice; b) must have existing frontage on an opened and maintained year round, public road which is capable of sustaining vehicular traffic; c) should not lie situated in proximity to existing land uses which in themselves have a high nuisance value or are easily capable of promoting land use conflicts. Such uses may include, but shall not be limited to, commercial grain drying operations; existing aggregate resource extraction operations or lands which are designated for aggregate resource extraction as described in this Plan, operating of closed landfill sites or sewage lagoons; any industrial or commercial operation that is normally associated with substantial volumes of vehicular traffic or which creates adverse off-site environmental effects such as air pollution, noise, odours or generates excessive solid or liquid wastes either in volume or toxicity; d)- buildings or structures must be appropriately setback from municipal drains, watercourses and any associated hazard lands as described in this Plan; • e) the soil and groundwater conditions are suitable for the operation of a private water and subsurface sewage system as approved by the Ministry of the Environment or their designated agent; f) the size of any parcel of land created for such uses shall conform to the provisions of the Township's Zoning By-law and in no cases should any parcel be created smaller than necessary to support an approved well and private sewage system; g) shall not create a traffic hazard as a result of their access to a portion of a roadway with limited sight lines due to curves, grades, or existing roadside development including buildings and signs; h) shall be considered only when mineral resource land are not affected. Should mineral resource lands be affected, Township Council shall consult with the Ministry of Natural Resources in order to protect such lands from unwarranted development; 10 i) all "Rural" uses, save and except estate residential uses, shall require justification which will address the need for the land use; the amount of land needed; reasons for choice of location; and consideration to other locations for the use. j) should be regulated so that its impact will not detract from the natural rural environment. 4.3.2 Estate residential: Estate Residential uses may be permitted on lands designated Rural"R(E)" on Schedule 'A' to this Official Plan. ; In addition to the policies of Section 43.1.4 of this Plan the following criteria shall apply: a) the site is not part of a larger Bayham Township high priority agricultural area; b) the site is considered to have limited agricultural value due to its size and shape; c) the site exhibits the following locational characteristics: • the site is part of a river system (e.g. Otter Creek) which exhibits aesthetic features, or scenic vistas; • the site is topographically and physically removed from surrounding agricultural areas; d) the site is of marginal agricultural land. the scale of available CLI mapping may be insufficient to accurately evaluate the agricultural capability of specific small sites. I am requesting a proper plan of drainage and watershed to ensure that no new water will be added to the existing storm sewers and/or directed toward my property. Roth of the aboved mentioned articles affect my property beoause the drainage is directed and disposed of through my property. Through the past years of drainage in the existing storm sewers. as they are now, it has caused considerable erosion with no compensation for lost property. Violet Petrie of your office on October 1, 1990, I was advised that your office does not have a fax machine . I expressed my concern to her that our Ministry had some concern over the passage of this By-law and I was not certain that our letter could reach your office prior to the deadline by regular mail service . Ms . Petrie advised me that provided I faxed our letter to ( 519 ) 892--7922 Sandham Cartage in Tillsonburg on October 2, 1990 that our appeal would be picked up by someone of your office and the deadline thereby met . The original letter to follow by regular mail . You verified Ms . Petrie 's statement to me in our telephone conversation of October 2, 1990 . It is my understanding that the purpose of By-law No. Z247-90 is to change the zoning on a 0 . 75 hoctare ( 1 . 85 acre ) strip of land fronting on County Road No . 43 (Mill Street) , in Part Lot 111, N . S .T .R. in the Township of Bayham, from the Future Development (FO ) Zone to the Hamlet Residential (HR) Zone . The subject lands are situated within the hamlet designation of Richmond, in the Official Plan of the Township of Bayham. The effect of this By-law will be to recognize lands suitable for hamlet residential development within Richmond and permit the creation of five ( 5 ) hamlet residential lots pursuant to the process of severance and conveyance . The above referenced Notice Of The Passing Of A Zoning By-law does not not specify the methods of servicing intended . 09. 14 92 16:30 FAX 519 842 5001 G.L.T.C, TBURG 1 ,006 Our Ministry requires the provision of more information on the adequacy of servicing before we would consider any endorsement of this particular amendment . Regional Files indicate that the local shallow aquifer in the Richmond area consists of fine to medium grained sands . Because high permeability is a characteristic of formations of this composition, sapid infiltration of septic effluents and the attendant risk far well interference _and 'arid coetamination . is of concern . Also, with the lack of servicing information provid "d; our Ministry is not able to comment on whether our reasonable use criteria would be met . It is my understanding that the Hamlet of Richmond is presently serviced by a communal water works, consisting of a spring fed well . This well has been noted in the past ( 1983 ) to have elevated nitrate levels . I am not aware of any recent sampling results on chemical or bacteriological parameters for this communal well supply system. In addition, our Ministry is not currently aware of the extent of uncommited reserve capacity availabe from this source . In view of the hydrological sensitivity of the Richmond area, a hydrological assessment will need to be undertaken by the proponent . This assessment shall address the availability, quantity, quality and security of the proposed water supply and should also include soil percolation tests to determine the suitability of the local soils for on-site sewage disposal . Our Ministry Is unable to endorse the passage of this zoning amendment in the absense of detailed information on servicing . The Village of Richmond Comnunity Water System ccmmitted itself ( subject to member approval ) to accept applications to tie in these lots to the Community System, subject to the normal payments for capital charges, hook-up, etc . 2. Substantial discussion took place with respect to storm drainage and an outlet problem on the property of Mr. Lewis Acre. It appeared that the matter might be resolved through a municipal drain. The parties will discuss the matter with the Township Drainage Commissioner and if there seems to be general agreement, they will proceed either by petition or possibly by municipal initiative. 3. The only other concern that surfaced was over possible contamination of the Comnunity Water System' s source of supply and well site, through the construction of these five new houses. It seemed unlikely that this would occur considering the location of the houses relative to the existing well site and the nature of developnent in between; however the developer ' s representative, Mr. Davis, acknowledged that the concern is legitimate and that the question would have to be addressed by an engineer or other proper person. In the circumstances there should probably be a development agreement entered into, as suggested in Mr. Hinde ' s Cumming Cockburn Limited, Page 2, August 23, 1991. previous letter. Your assistance in this regard would be appreciated. It would appear that the severances have lapsed and as a result the agreement could be a ccndition of the new severance approvals. Consequently, site plan control is not appropriate in this instance, but rather, the Cox development could be subject to a development agreement which is negotiated between the applicant and the Township. As a condition of severance and conveyance, the Township of Bayham could request the Elgin St. Thomas Land Division Committee to impose a condition requiring the applicant to enter into a development agreement. I did not object to the bylaw; therefore , I don ' t know why we are being required to pay a deposit of $150 . I would have thought that that would have come from the two objectors. In any event, we are sending you the $150 to simply have the matter move along , but I would ask that you appreciate that this is done without prejudice. We are not appealing the bylaw; we merely wish the matter resolved , and it appears as though the only way it can be resolved is for the objections to go to the Ontario Municipal Board. The second paragraph in your letter indicates that Council is advising that they will be requesting that the Ontario Municipal Board ensure the concerns of the Ministry of the Environment are met . We agree with that ; in fact , that was part of the consideration of the bylaw being approved . I see no need to have the bylaw repealed and reapproved in a different form. In response to the Ontario Ministry of Environment's letter dated January 21, 1991, regarding the above noted zoning by-law amendment we offer the following comments. Mr. Cox proposes to create five residential lots within the hamlet of Richmond pursuant to the process of severance and conveyance. Although the Ministry of Environment has withdrawn their appeal, they have raised a number of concerns regarding the proper functioning of septic systems and the availability of acceptable drinking water on the subject lands. The subject lands were originally zoned "Future Development" in the Comprehensive Zoning By-law of the Township of Bayham. This zoning would have the affect of restricting any development on the subject lands until certain concerns and/or conditions imposed by Council could be addressed. Section 4.3.2.3 of the Official Plan states: Development shall be on private water and septic tanks approved by the Ministry of the Environment or their delegated authority and shall be limited to a type and density that does not precipitate the need for communal water or sewage works. Based on the above, this type of development can proceed providing the applicant is able to satisfy the Ministry of the Environment and the Health Unit. I trust the Health Unit was circulated the zoning by-law amendment and that they have not objected to same. If this is the case, the fourth condition of the Ministry's January 21st 1991 letter has been partially addressed. If the severances have not been granted by the Elgin St. Thomas Land Division Committee the Township could insist that as a condition of approval the four EMI conditions at the Land Division Committee stage would be appropriate based on the following policies of the Official Plan. 4.3.3.6 Consents will generally be discouraged and will only be granted when it is clearly not necessary in the public interest that a plan of subdivision be registered. If a plan of subdivision is not deemed necessary, regard shall be had to other policies in the Official Plan and to the following criteria when considering an application for consent in the hamlet areas: a) Consents should be granted only in areas where the undue extension of any major service would not be required. Any services required in a consent should be satisfactory to the Ministry of the Environment or their delegated authority. d) The size of any parcel of land created by such a consent should be appropriate for the use proposed considering the public services available and the soil conditions and in no case should any parcel be created which does not conform to the provisions of the Township Zoning By-law. If the severances have been granted, the only option available to the Township is to request that these conditions be addressed if the applicant is successful at the Ontario Municipal Board Hearing. The hearing is necessary as a result of the neighbours appealing the zoning by-law admendment. If the Township intends to request that these conditions be imposed by the Ontario Municipal Board the applicant should be advised prior to the hearing so that they may be dealt with according. That letter indicated that our Ministry is unable to endorse the passage of this zoning bylaw in the absense of detailed information on servicing. I am also addressing in this letter the matters outlined in Mr. J.E. Davis Holdings Limited's letters of October 17, 1990 and November 2, 1990 to myself with respect to our Ministry's appeal. By copy of this letter, Mr. Davis will be made aware of our Ministry's present position and suggested requirements. (Copies of Mr. Davis' letters are attached) First of all, my letter of October 2 , 1990 was an appeal by the Ministry of the Environment, and should not be construed as an individual appeal by myself. I can only assume from Mr. Davis' letter of October 17, 1990 that he did not see a copy of my October 2, 1990 letter that had Ministry letterhead on the top page. I verbally indicated in a previous telephone conversation with Mr. Davis that if he can satisfy our Ministry's concerns as outlined in my letter of October 2, 1990 to Bayham Twp, our Ministry is prepared to withdrawl our appeal of the above noted zoning bylaw. Mr. Davis has since forwarded for our Ministry's review a July 12, 1988 report prepared by Atkinson Davies Inc. Consulting Engineers for Spriet Associates London Limited Consulting Engineers titled "Report On Soil Investigation for Proposed Subdivision, Part of Lots 19 and 20, Registered Plan 22, and Part of Lots 110 and 111 south of the Talbot Road in the Township of Bayham" . Mr. Davis also included with this wi^•,1K'se:Ylxl e�p{a.,:iikL�MN.lY4R'w'�C'ds . . , 2 package copies of three water well records submitted to the Ministry of the Environment in 1987 and 1989 pertaining to these lands. The above noted report and well records have since been reviewed by our Ministry. Of the three submitted water well records, two were reported dry and one suggests that a sufficient groundwater quantity can be obtained from the confined water bearing zone(s) to supply an individual well at that well location through careful drilling and utilizing the cable tool drilling technique. Large diameter shallow wells and sandpoints are not acceptable. The information provided to our Ministry to date does not as yet convince us that there is sufficient water available throughout the whole subject property to support the five proposed lots. Mr. Davis's letter of November 2, 1990 indicates that his client does not intend to utilize the existing communal water supply system that the Village of Richmond utilizes. However, Mr. Davis's letter does not indicate whether his client proposes to develop the five lots on individual wells on each lot, or one well to serve all five lots. Following my previous telephone conversation with Mr. Davis, mentioned earlier in this letter, our Ministry has since decided that because our Ministry's regulatory a prQ al authority does not apply to a privately-owned water works supplying water for five or fewer private residences, our Ministry will not proceed as far as an OMB Hearing with respect to this zoning by-law. Hence, please consider this letter as our Ministry's formal withdrawl of our appeal of the proposed zoning bylaw. The reasoning for our withdrawl is based solely on the regulatory reasoning noted above and not on the acceptability of the water supply. Notwithstanding our Ministry's decision to withdrawl our appeal, the Ministry of the Environment offers for Bayham Township's consideration the following advice in the event that it may ultimately be responsibile for providing a municipal supply should individual wells become inadequate. 1. Bayham Township should require a pump test(s) to be undertaken by the proponent to substantiate that there is sufficient water available to service all five properties from a single well or individual wells on each lot depending upon the proponent's intentions. . . . 3 2 Bayham Township should require the proponent to undertake some testing of the water from the intended water bearing zone for physical, bacteriological and general chemistry parameters. Without the prior provision of this information, the Township could be seen as approving residential development on the subject property without any knowledge as to the potability of the water for future residents. 3. To date our Ministry has not received any indication from the proponent as to the proposed lot areas, existing nitrate levels, or the number and location of downgradient shallow well users. Without the provision of this information, our Ministry has been unable to assess the potential impact of additional nitrate generated from septic tank systems yet to be installed within the subject property on existing downgradient shallow well water users. The Ministry of the Environment does not apply the nitrate guideline to development proposals less than six dwellings. The reason for this stems from the fact that our Ministry presently has no regulatory approval authority for doing so. This is not to say that elevated nitrate levels would not be encountered on development proposals of five or less dwellings. It is my understanding that elevated nitrate levels have been a problem in the Richmond area in the past, and it would therefore be appropriate for the Township to address the nitrate issue prior to deciding on approval of the zoning amendment. 4. The proponent has not provided documentation indicating that the subject property is suitable or can be made suitable for sewage disposal. As the Health Unit is our Ministry's agent for Part 7 of the Environmental Protection Act, a letter outlining their opinion of the suitability of the site for private sewage servicing should be sought by the proponent and provided to Bayham Township prior to any consideration of approval of the 4.1 . . .4 zoning bylaw. Violet Petrie of your office on October 1, 1990, I was advised that your office does not have a fax machine . I expressed my concern to her that our Ministry had some concern over the passage of this By-law and I was not certain that our letter could reach your office prior to the deadline by regular mail service . Ms . Petrie advised me that provided I faxed our letter to ( 519 ) 842-7422 Sandham Cartage in Tillsonburg on October 2, 1990 that our appeal would be picked up by someone of your office and the deadline thereby met . The original letter to follow by regular mail . You verified Ms . Petrie 's statement to me in our telephone conversation of October 2, 1990 . It is my understanding that the purpose of By-law No. Z247-90 is to change the zoning on a 0 . 75 hectare ( 1 . 85 acre ) strip of land fronting on County Road No . 43 (Mill Street) , in Part Lot 111, N.S .T.R. in the Township of Bayham, from the Future Development (FD) Zone to the Hamlet Residential (HR) Zone . The subject lands are situated within the hamlet designation of Richmond, in the Official Plan of the Township of Bayham. The effect of this By-law will be to recognize lands suitable for hamlet residential development within Richmond and permit the creation of five ( 5) hamlet residential lots pursuant to the process of severance and conveyance . The above referenced Notice Of The Passing Of A Zoning By-law does not not specify the methods of servicing intended . Our Ministry requires the provision of more information on the adequacy of servicing before we would consider any endorsement of this particular amendment . Regional Files indicate that the local shallow aquifer in the Richmond area consists of fine to medium grained sands . Because high permeability is a characteristic of formations of this composition, rapid infiltration of septic effluents and the attendant risk for well interference and and contamination is of concern . Also, with the lack of servicing information provided, our Ministry is not able to comment on whether our reasonable use criteria would be met . It is my understanding that the Hamlet of Richmond is presently serviced by a communal water works, consisting of a spring fed well . This well has been noted in the past ( 1983 ) to have elevated nitrate levels . I am not aware of any recent sampling results on chemical or bacteriological parameters for this communal well supply system. In addition, our Ministry is not currently aware of the extent of uncommited reserve capacity availabe from this source . In view of the hydrological sensitivity of the Richmond area, a hydrological assessment will need to be undertaken by the proponent. This assessment shall address the availability, quantity, quality and security of the proposed water supply and should also include soil percolation tests to determine the suitability of the local soils for on-site sewage disposal . Our Ministry is unable to endorse the passage of this zoning amendment in the absence of detailed information on servicing. WHEREAS Section 68 of the Planning Act, 1983 enable the Council of the Township of •Bayham to prescribe a tariff of fees for the processing of applications made in respect of planning matters; AND WHEREAS Section 68 of the Planning Act restricts the tariff to meet only the anticipated cost to the Township for the processing of each type of application provided for in the tariff; NOW THEREFORE, the Council of the Township of Bayham enacts as follows: 1. THAT the tariff prescribed in this By-law shall apply to cover the anticipated costs incurred by the Township of Bayham in processing the following applications made in respect of the Planning Act. 1983. i) an 'amendment' to the Township of Bayham Official Plan in accordance with Section 17 of the Planning Act, 1983. ii) an 'amendment' to the Township of Bayham Zoning By-law in accordance with Section 34, Section 35, Section 36, or Section 38 of the Planning Act, 1983. iii) a 'site plan and/or site plan agreement' in accordance with Section 40 of the Planning Act, 1983. iv) a `minor variance' to the Township of Bayham Zoning By-law in accordance with Section 44 of the Planning Act, 1983. v) a 'plan of subdivision' in accordance with Section 50 of the Planning Act, 1983. vi) a 'development agreement' in accordance with Section 49 and Section 52 of the Planning Act, 1983. 2. THAT the tariff shall apply to the following municipal functions in the processing of an application listed in Section 1. i) preliminary review of the subject application (including the preparation of written reports and maps, site visits, and meetings) by the Township of Bayham Planning or Engineering Consultant and/or Solicitor where in the opinion of Council this is deemed necessary or desirable; ii) public meetings as required under the Planning Act; iii) special meetings of Council where deemed necessary or desirable either by Council, or where requested by the applicant, in respect of the subject application. 2 iv) preparation of any required amendments or agreements in respect of the subject application by the Township of Bayham Planning or Engineering Consultant, Solicitor or Clerk; v) incidental expenses incurred in the processing of the subject application such as mailing costs, printing charges, and publication charges; 3. The tariff of fees In processing applications in accordance with this By-law shall be a combination of fixed fees and fees based on a time consumed basis in accordance with the following: I) Official Plan Amendment $ 500.00 ii) Zoning By-law Amendment $ 500.00 iii) Minor Variance $ 150.00 iv) Site Plan and/or Site Plan Agreements $1,000.00 v) Plan of Subdivision $3,000.00 vi) Development Agreement $1,000.00 4. Notwithstanding the foregoing, Council or the Committee of Adjustment may reduce the amount of, or waive the requirement for the payment of the fee in respect of an application where Council or the Committee is satisfied that it would be unreasonable to require payment in accordance with the tariff. 5. Prior to commencing with the processing of any application listed under Section 1 of this By-law, the Township of Bayham shall require payment in full of the tariff of fee as specified in Section 3 of this By-law. Any additional costs exceeding the tariff of fee as specified in Section 3 of this By-law which is incurred by the Township of Bayham to complete the municipal functions in processing the application as listed In Section 2 of this By-law will be paid in full by the applicant. Violet Petrie of your office on October 1, 1990, I was advised that your office does not have a fax machine . I expressed my concern to her that our Ministry had some concern over the passage of this By-law and I was not certain that our letter could reach your office prior to the deadline by regular mail service. Ms. Petrie advised me that provided I faxed our letter to (519 ) 842-7422 Sandham Cartage in Tillsonburg on October 2, 1990 that our appeal would be picked up by someone of your office and the deadline thereby met . It is my understanding that the purpose of By-law No . 7247-90 is to change the zoning on a 0 .75 hectare (1. 85 acre) strip of land fronting on County Road No. 43 (Mill Street) , In Part Lot 111, N.S.T.R. in the Township of Bayham, from the Future Development (FD) Zone to the Hamlet Residential (HR) Zone . The subject lands are situated within the hamlet designation of Richmond, in the Official Plan of the Township of Bayham. The effect of this By-law will be to recognize lands suitable for hamlet residential development within Richmond and permit the creation of five ( 5) hamlet residential lots pursuant to the process of severance and conveyance. Regional Files, indicate that the local shallow aquifer in the Richmond area consists of fine to medium grained sands . Because high permeability is a characteristic of formations of this composition, rapid infiltration of septic effluents and the attendant risk for well interference and and contamination is of concern. Also, with the lack of servicing information provided, our Ministry is not able to comment on whether our reasonable use criteria would be met. It is my understanding that the Hamlet of Richmond is presently serviced by a communal water works, consisting of a spring fed well . This well has been noted in the past (1983) to have elevated nitrate levels . I am not aware of any recent sampling results on chemical or bacteriological parameters for this communal well supply system- In addition, our Ministry is not currently aware of the extent of uncommited reserve capacity availabe from this source . In view of the hydrological sensitivity of the Richmond areas a hydrological assessment will need to be undertaken by the proponent. This assessment shall address the availability, quantity, quality and security of the proposed water supply and should also include soil percolation tests to determine the suitability of the local soils for on-site sewage disposal . Our Ministry is unable to endorse the passage of this zoning amendment in the absense o, = bided information on servicing.
