BY-LAW NO. Z385-98

BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary
to amend its Zoning By-law No. 2387;
THEREFORE,the Council of the Corporation of the Municipality of Bayham enacts as
follows:
1. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule
"A",Map No. 74,by deleting from the Agricultural(A1)Zone and adding to the Special
Rural Industrial(M2-12)Zone, those lands outlined in heavy solid lines and marked
M2-12 on Schedule "A"to this By-law,which schedule is attached to and forms part of
this By-law.
2. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule
"A", Map No. 74 by deleting from the Future Development(FD)Zone and adding to the
Special rural Industrial(M2-12)Zone,those lands outlined in heavy solid lines and
marked M2-12 on Schedule"A"to this by-law,which schedule is attached to and forms
part of this By-law.
3. THAT By-law No. 2387, as amended, is hereby further amended by amending Section
12, Rural Industrial(M2)Zone Regulations by adding a new subsection to Section 12.10,
EXCEPTIONS, as follows:
"12.10.12
12.10.12.1 Defined Area
M2-12 as shown on Schedule "A", Map No. 74,to this by-law.
12.10.12.2 Permitted Uses
Gas processing plant
Accessory uses
12.10.12.3 Maximum Height for Buildings and Structures
12 metres for all buildings
92 metres (302 feet)for a flare tower."
4. THAT By-law No. 2387, as amended, is hereby further amended by amending section 2,
Definitions by adding a new subsection as follows:
"2.53 GAS PROCESSING PLANT, shall mean a facility including buildings
and structures used for the processing and refinement of natural gas from
off-shore wells in Lake Erie, for sale and distribution to a public or private
utility company."

5. THAT this By-law comes into force:
a) where no notice of objection has been filed with the Municipal Clerk
within the time prescribed by the Planning Act and regulations pursuant
thereto, upon the expiration of the prescribed time, or
b) where notice of objection has been filed with the Municipal Clerk within
the time prescribed by the Planning Act and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board.

EXPLANATORY NOTE
The purpose of this By-law is to change the zoning on a property comprising approximately 13.7
hectares (33.8 acres) situated on the south side of Highway No. 19 in Part Lot 15, concession 2,
in the Municipality of Bayham, from the Agricultural (Al)Zone and the Future Development
(FD Zone to the Special Rural Industrial(M2-12)Zone.
The effect of this By-law will be to permit the establishment of a natural gas processing plant on
the subject lands.

BY-LAW NO. 98-90
BEING A BY-LAW TO PROHIBIT AND REGULATE
THE KEEPING OF EXOTIC ANIMALS
IN THE MUNICIPALITY OF BAYHAM
WHEREAS Section 210 of the Municipal Act. R.S.O., 1990 M.45,provides that by-laws may
be passed by councils of local municipalities for prohibiting or regulating the keeping of animals
or any class thereof;
THEREFORE BE IT RESOLVED THAT THE COUNCIL OF THE CORPORATION OF
THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS:
Part 1 —DEFINITIONS
1. "Exotic Animal" shall mean a wild or non domesticated animal whether or not kept in
captivity and includes but is not limited to: bear, wolf, lion, bobcat, cougar, crocodile,
venomous snake, constricting snake, venomous lizard,venomous spider, or tiger.
The term Exotic Animal does not include cats, dogs, deer, elk, bison, rodents, horses,
cows, mules,donkeys,ponies, sheep, goats, swine, chicken, geese,turkey, duck,emu,
ostrich, homing pigeon, powder pigeon,tumbler pigeon, turtle, chinchilla,non venomous
snake, non venomous lizard, non venomous spider, cardinal, finch, budgie,bulbul,
canary,tanagers, amazons,cockatoos,conures,macaws,parakeets,cockatiels,loorikeets,
touracos, toucans, oriels, mynahs, magpies,barbets, arcaris, pied hornbells and cock-of-
the-rocks;
"Keep"shall mean own,possess or harbour;
"Animal Control Officer" shall mean a person appointed by the Council whose duties
include the administration and enforcement of the Exotic Animal By-law.
PART II—PROHIBITED REGULATIONS
2. No person shall within the Municipality of Bayham keep an exotic animal.
PART III—ENFORCEMENT
3. This By-law may be enforced by the By-law Enforcement Officer upon receipt of
a written and signed complaint of alleged violation of this By-law from a citizen
or ratepayer of the Municipality of Bayham directly affected by the alleged
violation.
PART IV—FINE
4. Any person who contravenes any provision of this By-law is guilty of an offence and
upon conviction liable to pay any penalty provided by the Provincial Offences Act.
5. The Court in which a conviction has been entered and any court of competent jurisdiction
thereafter may make an order prohibiting the continuation or repetition of the offence by
the person convicted and such order shall be in addition to any other penalty imposed on
the person convicted.
