HomeMy WebLinkAboutZoning By-law No. Z390-1998 CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NUMBER Z390-98 BEING A BY-LAW TO AMEND BY-LAW NO. 2387 (Marion Marr) WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend Township of Bayham Zoning By-law No. 2387; THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule"A",Map No. 39 by deleting from the Special Rural Commercial(RC- 3) Zone and the Agricultural(Al) Zone and adding to the Special Rural Residential(RR-26)Zone,those lands outlined in heavy solid lines and marked RR-26 on Schedule "A"to this By-law,which schedule is attached to and forms part of this By-law. 2. THAT By-law No. 2387, as amended, is hereby further amended by amending Section 7, Rural Residential (RR)Zone Regulations by adding a new subsection to Section 7.13,EXCEPTIONS as follows: "7.13.26 7.13.26.1 Defined Area RR-26 as shown on Schedule"A",Map No. 39,to this By-law. 7.13.26.2 Minimum Lot Area 0.88 hectares (2.17 acres) 7.13.26.3 Permitted Buildings and Structures Buildings and structures for the permitted uses, including a maximum of one dwelling unit." 3. THAT this By-law comes into force: a) where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the expiration of the prescribed time; or b) where notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. EXPLANATORY NOTE The purpose of this By-law is to change the zoning on a parcel of land comprising approximately 0.9 hectares (2.2 acres) situated on the south side of Heritage Line (County Road No. 38), in Part Lot 116, S.S.T.R. in the Municipality of Bayham, from the Special Rural Commercial (RC-3) Zone and the Agricultural (Al) Zone to a Special Rural Residential (RR-26) Zone. The effect of this By-law will be to facilitate the severance of approximately 0.48 hectares (1.2 acres) for the purposes of an addition to an existing lot in accordance with the policies of Section 7.7.7 of the Official Plan. The new Special Rural Residential Zone will prohibit future severances within the new expanded lot.
