BY-LAW NUMBER Z395-98
BEING A BY-LAW TO AMEND BY-LAW
NO. 2387 (Mary A. Pilkey)
WHEREAS the Council of the Corporation of the Municipality of Bayham deems it
necessary to amend Township of Bayham Zoning By-law No. 2387;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE
MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS:
1. THAT By-law No. 2387, as amended, is hereby further amended by amending
Schedule "A", Map No. 51 by deleting from the Rural Residential (RR) Zone and
adding to the Special Rural Industrial(M2-13)Zone,those lands outlined in
heavy solid lines and marked M2-13 on Schedule"A"to this By-law, which
schedule is attached to and forms part of this By-law.
2. THAT By-law No. 2387, as amended, is hereby further amended by amending
Section 12, Rural Industrial(M2)Zone Regulations by adding a new subsection
to Section 12.10, EXCEPTIONS as follows:
"12.10.13
12.10.13.1 Defined Area
M2-13 as shown on Schedule"A",Map No. 51 to this By-law.
12.10.13.2 Permitted Uses
A sawmill operation
An accessory office use
One dwelling unit as an accessory use.
12.10.13.3 Minimum Rear Yard Depth
6 metres (20 feet) for the existing sawmill building.
12.10.13.4 Permitted Buildings and Structures
Buildings and structures for the permitted uses.
Accessory buildings and structures for the permitted uses.
12.10.13.5 Existing Accessory Buildings and Structures
Notwithstanding subsections 4.2.2 and 4.2.4, existing accessory
buildings and structures shall be:
a) permitted closer to the side lot line and front lot line than
the minimum distance required by this By-law for the main
building on the lot.
b) permitted closer to the street than the main building is to
that street."

3. THIS By-law comes into force:
a) where no notice of objection has been filed with the Municipal Clerk
within the time prescribed by the Planning Act and regulations pursuant
thereto, upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the Municipal Clerk within
the time prescribed by the Planning Act and regulations pursuant thereto,
upon the approval of the Ontario Municipal Board.

EXPLANATORY NOTE
(Mary A. Pilkey)
The purpose of this By-law is to change the zoning on a parcel of land comprising
approximately 1 hectare(2.5 acres) situated on the south side of Jackson Line, east of
Gregson Line, in Part Lot 8, Concession 5, in the Municipality of Bayham from the
Rural Residential (RR)Zone to the Special Rural Industrial(M2-13)Zone.
The effect of this By-law will be to recognize an existing sawmill operation which is an
existing non-conforming industrial use on the subject lands. This By-law will bring this
one exiting industrial use into conformity with the Zoning By-law.

Section 34(2) of the Planning Act,R.S.O. 1990, Chapter P.13
I, Maureen Beatty, Co-ordinator of Planning and Community Services hereby certify on behalf
of the Clerk,that the notice for By-law No. Z395-98 of the Corporation of the Municipality of
Bayham passed by the Council of the Corporation on the 2nd day of July, 1998 was given in the
manner and form and to the persons prescribed by regulations made by the Lieutenant Governor-
in-Council under Section 34(18) of the Planning Act.
I also certify that the 20 day objection period expired on the 27th day of July, 1998 and to this
date,no notice of objection has been filed by any person in the office of the Clerk.
