BY-LAW NO. Z443-2002
BEING A BY-LAW TO AMEND BY-LAW NO. 2387
WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to
amend Zoning By-law No. 2387;
THEREFORE,the Council of the Corporation of the Municipality of Bayham enacts as follows:
1) THAT By-law No. 2387,as amended,is hereby further amended by amending Schedule"B"
Map No. 3 &4 by deleting from the site specific Hamlet Commercial Zone(HC-4)Zone and
the Hamlet Residential(HR)Zone and adding to the site-specific Hamlet Commercial Zone
(HC-5) Zone those lands outlined in heavy solid lines and marked HC-5 on Schedule`B3"
and"B4"to this By-law, which schedule is attached to and forms part of this By-law.
2) THAT By-law No. 2387,as amended,is hereby further amended by amending Schedule"B"
Map No. 3 & 4, by modifying the site specific Hamlet Commercial Zone (HC-4)Zone to
include only those lands outlined in heavy solid lines and marked HC-4 on Schedule`B3"and
"B4"to this By-law, which schedule is attached to and forms part of this By-law.
3) THAT By-law No. 2387, as amended, is hereby further amended by amending Section 9,
Hamlet Commercial Zone(HC)Zone Regulations by adding a new subsection to subsection
9.9 -EXCEPTIONS, as follows:
"9.9.5
9.9.5.1 Defined Area
HC-5 as shown on Schedule "B", Map No. 3 &4 to this By-law
9.9.5.2 Minimum Lot Area
700 m2(7535 f1.2)
9.9.5.3 Minimum Lot Frontage
16 metres(52.5 feet)
9.9.5.4 Exterior Side Yard Depth
4.5 metres(14.5 feet)
9.9.5.5 Rear Yard Depth

4) THAT By-law No. 2387, as amended, is hereby further amended by amending Section 9,
Hamlet Commercial Zone(HC)Zone Regulations by modifying subsection 9.9.4 as follows:
"9.9.4
9.9.4.1 Defined Area
HC-4 as shown on Schedule `B",Map No. 3 &4 to this By-law
9.9.4.2 Permitted Uses
A miniature golf course in addition to all other uses permitted in the Hamlet
Commercial(HC)Zone.
9.9.4.3 Minimum Side Yard Abutting the HC-5 Zone
Nil."
5) THIS By-law comes into force:
a) Where no notice of objection has been filed with the Municipal Clerk within the time
prescribed by the Planning Act and regulations pursuant thereto,upon the expiration
of the prescribed time; or
b) Where notice of objection has been filed with the Municipal Clerk within the time
prescribed by the Planning Act and regulations pursuant thereto,upon the approval of
the Ontario Municipal Board.

READ A SECOND TIME THIS 7th DAY OF MARCH 2002.
READ A THIRD TIME AND FINALLY PASSED THIS 7th DAY OF MARCH 2002.

NOTICE OF THE PASSING OF A ZONING BY-LAW BY
THE CORPORATION OF THE MUNICIPALITY OF BAYHAM
TAKE NOTICE that the Council ofthe Corporation ofthe Municipality ofBayham.passedBy--Law
No. Z443-2002 on the 7th day of March 2002 under Section 34 of THE PLANNING ACT.
AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in
respect of the By-law by filing with the Clerk of the Municipality of Bayham not later than the
4th day of April 2002, a notice of appeal setting out the objection to the By-law and the reasons in
support of the objection.
ONLY INDIVIDUALS,CORPORATIONS AND PUBLIC BODIES may appeal a zoning by-law
to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated
association or group. However, a notice of appeal may be filed in the name of an individual who is a
member of the association or group.
THE PURPOSE of the amendment is to change the zoning on a parcel ofland comprising 727.3 m2
(7828.6 ft.2), with a frontage of 16.6 metres (54.5 feet), located on the southeast corner of Plank
Road and Heritage Line,being Part of Hubbard Block, and Part of A.J.Massecar and Adam Yeager
Block and Part of Lots 1, 2 &3, South Talbot Road,Plan 205, in the Municipality of Bayham. The
subject lands are to be re-zoned from the site-specific Hamlet Commercial (HC-4) Zone and the
Hamlet Residential(HR)Zone to a site-specific Hamlet Commercial(HC-5)Zone.
THE EFFECT of this By-law will be to rezone a lot to comply with the conditions of previously
granted severance.
The complete By-law is available for inspection in the municipal office dining regular office hours.
