HomeMy WebLinkAboutMay 21, 2015 - Council THE CORPORATION OF THE MUNICIPALITY OF BAYHAM COUNCIL MEETING MINUTES Thursday, May 21, 2015 MUNICIPAL OFFICE STRAFFORDVILLE, ONTARIO 7:00 p.m. 6:30 p.m. Committee of Adjustment Council recessed at 8:16 p.m. for a short break and reconvened at 8:22 p.m. The regular meeting of the Council of the Municipality of Bayham was held on Thursday, May 21, 2015 in the Council Chambers. Present were Mayor Paul Ens, Deputy Mayor Tom Southwick, Councillors Randy Breyer, Wayne Casier and Ed Ketchabaw, CAO Paul Shipway and Clerk Lynda Millard. Planning Coordinator 1 Deputy Clerk Margaret Underhill, Fire Chief 1 By-Law Enforcement Officer Randy White, and Treasurer Lorne James were in attendance to present their respective reports. 1. REPORTS TO COUNCIL (a) Report FR-05/15 by Randy White, Fire Chief/By-law Officer re Medical Tiered Response Agreement Moved by: Deputy Mayor Southwick Seconded by: Councillor Breyer THAT Report FR-05/15 be received for information; AND THAT the proposed Dispatch Priority Card Index(DPCI), attached hereto as Appendix 'A', be submitted as the new tiered response criteria for Bayham Fire & Emergency Services; AND THAT the agreement be amended with the inclusion of a provision for events that would allow CACC to tier Bayham in extenuating circumstances; AND THAT a review of medical responses in Bayham be undertaken with MEMSEO in six months to ensure the criteria is appropriate. CARRIED (b) Report FR-06/15 by Randy White, Fire Chief/By-law Officer re Vessel Based Water Rescue Moved by: Deputy Mayor Southwick Seconded by: Councillor Casier THAT Report FR-06/15 be received for information; AND THAT the existing equipment utilized for vessel based water rescue remain in service along with the requisite training; AND THAT the vessel based rescue service capability be re-evaluated at the time a capital expenditure to replace the current equipment would be required. REPORTS TO COUNCIL (a) Report D5-32115 by Margaret Underhill, Deputy Clerk/Planning Coordinator re Official Plan Amendment No. 16 - CIP Policies and Circulation Policies The Planning Co-ordinator circulated an amended copy of By-law 2015-059 reflecting minor changes to Bayham Official Plan Amendment Number 16, through comments provided by the Ministry of Municipal Affairs and Housing, received since the Public Meeting held on May 7h. Moved by: Deputy Mayor Southwick Seconded by: Councillor Casier THAT Report DS-32115, as verbally amended to reflect the changes to the Official Plan Amendment No. 16, be received for information; AND THAT By-law 2015-059, as amended, being an adopting By-law for Official Plan Amendment No. 16 be presented for enactment; AND THAT adopted Official Plan Amendment No. 16 be forwarded to the County of Elgin for approval. CARRIED (b) Report 05033/15 by Margaret Underhill, Deputy Clerk/Planning Coordinator re Rezoning Application - New Hope Baptist Church The Planning Co-ordinator advised that no public comments or concerns have been received since the Public Meeting May 7t" Moved by: Councillor Ketchabaw Seconded by: Councillor Casier Page 3 of 8 Council Minutes May 21,2015 THAT Report DS-33/15 be received for information; AND THAT Zoning By-law Z456-2003, as amended, be further amended by changing the zoning on the subject lands known as 57272 Talbot Line, owned by New Hope Baptist Church, from the site-specific Highway Commercial (HWC-2) Zone to Institutional (I); AND THAT Zoning By-law Z638-2015 be presented to Council for enactment. CARRIED (c) Report DS-34/15 by Margaret Underhill, Deputy Clerk/Planning Coordinator re Rezoning Application —Bergen The Planning Co-ordinator advised that no public comments or concerns have been received since the Public Meeting held May 7th Moved by: Councillor Breyer Seconded by: Councillor Casier THAT Report DS-34115 be received for information; AND THAT Zoning By-law Z456-2003, as amended, be further amended by changing the zoning on the subject lands owned by Peter and Anne Bergen, from the Hamlet Residential (HR)Zone to site-specific Hamlet Residential (HR-8); AND THAT Zoning By-law Z637-2015 be presented to Council for enactment. CARRIED 1.2 REQUIRING ACTION (a) Jeff King re Police Service Moved by: Councillor Casier Seconded by: Deputy Mayor Southwick THAT correspondence from Jeff King re Police Services be received for information; AND THAT staff be directed to send correspondence to Mr. King thanking him for the offer, however it is not something the Municipality will pursue at this time. CARRIED 2. REPORTS TO COUNCIL (a) Report TR-05/15 by Lorne James, Treasurer re 2015 Budget and Levy Moved by: Councillor Ketchabaw Seconded by: Deputy Mayor Southwick THAT Report TR-08115 be received for information; AND THAT staff be directed to bring forward a by-law for Council consideration to establish a levy for the year 2015 and adopt tax rates be drafted by the Treasurer. CARRIED (b) Report CAO-26/15 re Peters Court Developer Deposit Moved by: Councillor Casier Seconded by: Deputy Mayor Southwick THAT Report CAO-26/15 re Peters Court— Developer Deposit be received for information; AND THAT staff be directed to bring forward a by-law for Council consideration to assume and dedicate as part of the public highway Peters Court on Plan 11M-187; AND THAT staff be directed to return all remaining security to the Developer held pursuant to Agreement No. 0492. CARRIED Page 5 of 8 Council Minutes May 21,2015 (c) Report CAO-27/15 by Paul Shipway, CAO re Municipal Property Surplus - Edison Museum Moved by: Councillor Breyer Seconded by: Councillor Ketchabaw THAT Report CAO-27115 re Municipal Property Surplus—Edison Museum be received for information; AND THAT the Council of the Corporation of the Municipality of Bayham declare 14 Snow Street, being Plan 54 Lot 8-9, Vacant Lot, being Plan 54 Lot 7 and the unopened road allowance between Lot 7 and 8 surplus to the needs of the Municipality for the purpose of sale via a realtor; AND THAT the Municipality provide until June 26, 2015 at 4:30 PM for written public comment on the same. AND THAT staff be directed to circulate the RFP utilizing the Zoning By-law exception and report back to Council. CARRIED (d) Report CAO-28115 by Paul Shipway, CAO re Wind Interpretive Centre Moved by: Councillor Casier Seconded by: Councillor Ketchabaw THAT Report CAO-28115 re Wind Interpretive Centre be received for information; AND THAT Council direct staff to surplus the Wind Interpretive Centre Structure; AND THAT if not awarded through the RFP process the same be removed and scrapped by staff; AND THAT Capstone proceed as per Report CAO-28115. BY-LAWS (a) By-Law Z637-2015 Being a By-law to further amend By-law Z456-2003 (Bergen) (b) By-Law Z638-2015 Being a By-law to further amend By-law Z456-2003 (New Hope Baptist Church) (c) By-Law 2015-057 Being a By-law to assume and establish lands in the Municipality of Bayham as part of the open public highway system (Peters Court) (d) By-Law 2015-058 Being a By-law to authorize the execution of a development agreement between Wm. Dan &Carolyn Murray and the Municipality of Bayham (e) By-Law 2015-059 Being a By-law to adopt Official Plan Amendment No.16 Moved by: Councillor Ketchabaw Seconded by: Deputy Mayor Southwick Page 6 of 8 Council Minutes May 21,2015 THAT By-laws Z637-2015, Z638-2015, 2015-057, 2015-058 and 2015-059 be read a first, second and third time and finally passed. CARRIED 13. UNFINISHED BUSINESS 14. OTHER BUSINESS (a) A verbal update on No Smoking on Public Lands Legislation was made. (b) There was verbal discussion regarding a possible Canada 150 Infrastructure Fund grant submission. (c) In Camera Moved by: Councillor Casier Seconded by: Deputy Mayor Southwick THAT Council do now rise to enter into an "In Camera" Session of Committee of the Whole at 8:22 p.m. to discuss: ® litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board. CARRIED (e) By-Law 2015-061 Being a By-law to authorize the execution of an agreement between The Municipality of Bayham and RBC Moved by: Councillor Ketchabaw Seconded by: Councillor Casier THAT By-law 2015-061 be read a first, second and third time and finally passed. BY-LAW TO CONFIRM THE PROCEEDINGS OF COUNCIL (a) By-Law 2015-060 Being a By-law to confirm all actions of Council Moved by: Councillor Casier Seconded by: Councillor Breyer THAT confirming By-law 2015-060 be read a first, second and third time and finally passed.
