BY-LAW NO. 2019-008
A BY-LAW TO AUTHORIZE
THE EXECUTION OF A TRANSFER OF EASEMEMENT
WHEREAS the Otter Valley Utility Corridor is jointly owned by the Corporation of the Town of
Tillsonburg and the Corporation of the Municipality of Bayham;
AND WHEREAS access to the property known as 10909 Plank Road crosses the Otter Valley
Corridor;
AND WHEREAS Section 8 of the Municipal Act, 2001, S.O.2001,c.25, as amended, provides
that a municipality has the capacity, rights, powers and privileges of a natural person for the
purpose of exercising its authority under this or any other Act;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous of
granting access to the property known as 10909 Plank Road by way of Transfer of Easement
over Part 1 and Part 2 of Reference Plan No. 11 R-10403 to correct a historical title defect.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and are hereby authorized to execute the Transfer of
Easement attached hereto as Schedule "A" and forming part of this by-law to transfer
Part 1 and Part 2 of Plan 11 R-10403 to Isaac Froese and Maria Froese;
2. AND THAT this by-law shall come into full force and effect upon final passing.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 17th DAY OF
JANUARY, 2019.
