C-07/ D09.19 Orchard Roll # 3401-000-005-14900 /005-14100 SUBJECT: Consent Application E1/19 Orchard Crest Farms Ltd. BACKGROUND: Consent application E1/19 was received from the Elgin County Land Division Committee on January 7, 2019 submitted by Orchard Crest Farms Ltd. proposing to sever a 1.46 ha (3.6 acre) parcel and retain 13.59 ha (33.6 acres) known municipally as 55957 Green Line for the purpose of severing a surplus farm dwelling. The subject lands are designated "Agriculture", on Schedule "Al" Land Use of the Official Plan and zoned Agriculture (Al) on Schedule "A" Map No. 2 in the Zoning By-law No. Z456-2003. At the request of municipal staff to realign the westerly lot line to include the access over the rail line for the southerly lands in order to avoid creating an inaccessible parcel, the Owner amended the application to propose the severance of a 1.3 ha (3.3 acre), retaining 14.7 ha (36.3 acre) whereby retaining the access. The revised sketch was received on January 11, 2019 with new acreages for both the severed and retained parcels. The application reflects these revisions. Elgin County Land Division Committee will consider the application on February 6, 2019. DISCUSSION: The proposal suggests creating a parcel encompassing the dwelling and garage, septic system and well servicing the dwelling. The applicant exhibited through the application that the severance of a surplus farm dwelling qualifies through farm consolidation with the owner's agricultural farm parcel dwelling located at 12165 Elliott Road in the same ownership and consolidated with the corporate farm operation. The planner's memorandum dated January 14, 2019 analyzes the application subject to the Official Plan and Zoning By-law policies. The application meets the criteria for the creation of the surplus farm dwelling parcel subject to the recommended conditions. Further to this Staff Report DS-01/19 Orchard Crest 2 regarding the severed parcel, the garage is in disrepair and staff recommend it be removed to improve the parcel's esthetics. The application indicates the larger barn on the retained parcel will be removed and staff support this as it would remove potential for land use conflict relating to the keeping of livestock. We have completed our review of consent application E01/19 submitted by Orchard Crest Farms Ltd. for lands located at 55957 Green Line, south side, west of Elliot Road. The applicant is requesting consent for severance of 1.3 ha (3.3 acres) of land; and to retain 13 ha (33 acres) of land. The intent of the change is to create a residential lot surplus to the consolidated farm operation. The lands are designated Agriculture on Schedule "A": Land Use in the Official Plan and are zoned Agriculture (A1) on Schedule "A", Map No. 2 in Zoning By-law Z456-2003. 2. The severed lands have a lot frontage of 116 m (380 feet) and a lot depth of 143 m (469 feet). The lands comprise a single detached dwelling and garage. Green Line is a local road maintained year-round. The dwelling is serviced with private water and septic services. Surrounding uses are agriculture. The retained lands have a lot frontage of 502 m (1,647 feet) and a lot depth of 410 m (1,345 feet). The lands comprise a barn. 3. The Provincial Policy Statement 2014 (PPS) Section 2.3.4.1 Lot Creation and Lot Adjustments sets out policies for lot creation in prime agricultural areas. Lot creation is generally discouraged and may be permitted for: c) a residence surplus to a farming operation as a result of farm consolidation, provided that: 1. the new lot will be limited to a minimum size needed to accommodate the use and appropriate sewage and water services; and 2. the planning authority ensures that new residential dwellings are prohibited on any remnant parcel of farmland created by the severance.....; The applicant must provide confirmation of ownership of the company owning the subject lands and the lands at 12165 Elliott Road, to qualify as a surplus farm dwelling. Zoning By-law Special Agricultural (A2) zone restricts residential development on retained farm lands for surplus dwelling severances. The applicant will be required to rezone the retained lands to A2 and the severed lands to Rural Residential (RR). 4. Elgin County Official Plan Section E1.2.3.1 General Criteria states that provisional consent may be granted subject to appropriate conditions of approval for the severed and/or retained lot. The proposed surplus residential farm dwelling conforms to the consent criteria. a) The proposed lot will not front on a public road, Green Line, which is maintained year-round. b) The proposed access is to a local road. c) Green Line is straight and flat at the location and the access has existed for some time, therefore, residential traffic will not create a traffic hazard. d) The severed lands have 116 m frontage where 50 m is the required minimum in the Rural Residential (RR) zone. The lot area of 1.4 ha is above the minimum requirement of the RR zone. The retained lands frontage of 502 m is above the minimum of 150 m in the RR zone. The lot area of 13 ha is below the minimum of 20 ha required in the Al zone, however, the reduced area situation is existing. The zone change will recognize the reduced lot area. e) The conditions of consent include the applicant rezoning the retained lands to a site-specific Special Agriculture (A2-XX) zone in order to prohibit any new residential development on the lands and to recognize the reduced lot area; and the applicant rezoning the severed lands to a Rural Residential (RR)zone to recognize residential use. f) The dwelling is serviced with private water and sewage services. The applicant has provided an assessment of the water service from Dave Oatman Pumps Well Inspection, dated November 19th, 2018, confirming the good working order of the existing well/pump; water test results from Public Health Ontario confirming the water is safe as a drinking water source; and a letter from Gilles Therrien Septic Tank Pumping indicating the septic system appears to be in good working order. IBI GROUP MEMORANDUM 3 Municipality of Bayham—January 14,2019 g) Based on the information provided by the applicant; a desktop review of recent Google Streetview imagery; and no new structures or physical site changes, there are no anticipated drainage pattern impacts. h) The retained lands would not be restricted. The lands are designated for agricultural use and have adequate frontage on Green line. The initial sketch showed an access to a landlocked farm field accessed over the rail line being severed with the residential lot. The applicant revised the clot configuration to retain the access. i) Official Plan Schedule Al and A2 do not indicate any significant features or natural heritage processes, therefore, no negative impacts are anticipated. j) The proposed use does not increase the amount of water being sourced from local groundwater. The applicant has provided recent Public Health Ontario positive drinking water test. k) No natural hazard processes have been identified on Official Plan Schedule A2 and there are no site works being proposed, therefore, no adverse effects on natural hazard processes are created. I) A review of Official Plan policies follows in a separate section. m) The proposed surplus farm dwelling lot will conform to Section 51 (24) of the Planning Act, as amended. The consent is consistent with the County of Elgin Official Plan. 5. The Municipality of Bayham Official Plan Section 2.1.7 Farm Consolidation and Surplus Farm Dwellings sets out policies for surplus farm dwelling consents. Section 2.1.7.1 indicates that farm consolidations may result in the identification of existing farm dwellings that are rendered surplus to the consolidated farm operation and that consent to sever may be permitted within the "Agriculture" designation in accordance with the following criteria: There is no anticipated conflict from the proposed residential lot with agricultural operations or other existing land uses in the immediate area of the subject lands; Based on a review of property boundary mapping there is no evidence of a prior severance of surplus dwellings from the subject lands. The retained lands will be rezoned to an A2 zoning, prohibiting future dwellings from being developed. The applicant has indicated that the farm at 12165 Elliott Road is the principle residence of the farm operation and is located within the Municipality. The applicant must provide proof of ownership to qualify as a surplus farm dwelling. Section 2.1.7.3 includes the following criteria for consideration, the surplus dwelling lands may: a) The existing garage is in a state of disrepair and is to be removed as a condition of consent. b) The applicant has indicated that the barn on the retained lands is to be removed, avoiding land use conflict relating to the keeping of livestock. Section 2.1.7.4 indicates that the retained lands shall: a) The retained lands have a lot area of 13 ha where 20 ha (49 acres) is the required minimum in the Al and A2 zone. The reduced lot area will be recognized in the rezoning. The lot frontage of the retained lands is 502 m where the minimum lot frontage in the Al/A2 zone is 150 m (492 feet). b) The applicant must rezone the retained lands to a Special Agricultural (A2) zone to prohibit the placement, development, or establishment of any additional type or form of residential dwelling. The Municipality of Bayham Official Plan indicates that no land use conflict should be created and that the created lot should be limited to a size adequate to accommodate water and sewage services. The proposed consent is generally consistent with the Official Plan. 6. The subject lands are located in the Agricultural (A1) zone in By-law Z456-2003. The proposed severed lot setbacks, lot area and frontage meet the minimum requirements for the rural residential zone. The retained lands would require a rezoning to Special Agriculture (A2-XX) to recognize reduced lot area and the severed lands would require rezoning to a Rural Residential (RR) zone. 7. Based on the above review of consent application E01/19 we have no objection to the surplus farm dwelling severance of 1.3 ha and to retain 13 ha, subject to the following: a. C-07 / D09.19 Schafer Roll # 3401-000-004-10000 SUBJECT: Consent Application E2-5/19 Schafer, Barnard, Vansevenant BACKGROUND: Four consent applications E2-5/19 were received on January 7, 2019 from the Elgin County Land Division Committee submitted by Mathew Schafer, Christine Barnard and Kathy Schafer- Vansevenant proposing to sever four lots with 24.47 metres frontage and equal depths at 57.65 metres. The owner would retain 29.79 hectares. The subject land is within the boundary of the Village of Straffordville. Lands are designated "Residential" on Schedule `B' Straffordville: Land Use and Constraints in the Official Plan. Lands are zoned Village Residential (R1) Zone in Zoning By-law No. Z456-2003. In the immediate area of the proposed lots, the lands are designated and zoned appropriate for future residential development. Elgin County Land Division Committee will consider the applications on February 6, 2019. DISCUSSION: In the past, Council has supported multiple lot developments by consent. Careful consideration must be made to the overall development and potential servicing and surface water management and drainage. The four lots proposed are considered to be infilling in an established residential area. The lots are serviced with sanitary sewer stubs to the lot lines. An additional requirement for servicing is the installation of individual wells and the provision of acceptable water quality and quantity testing results meeting provincial standards for residential use. As well, our standard conditions to require an engineer design storm water management, drainage/grading plan, civic numbering signage, survey, cash in lieu payment for the creation of building lots and the planning report fee. The lots front on County Road 38 (Heritage Line) and will likely be subject to the County requiring a municipal drain connection. In the absence of requiring a municipal drain, the Staff Report DS-07/19 Schafer 2 County may agree to all four lots having mutual drain agreements. Future development of the retained interior lands would be by registered Plan of Subdivision to ensure the lands are developed utilizing the best planning principles and design criteria. There's been no indication of further development of the interior lands at this time. Staff and municipal planner recommend the support of the consent applications for the creation of four building lots fronting on Heritage Line in the village of Straffordville. ATTACHMENTS 1. We have completed our review of four consent applications submitted by Matthew Schafer, Christine Barnard and Kathy Schafer-Vansevenant for lands located at 56486 Heritage Line, north side and east of Garner Road. The applicant is requesting consent to create four new lots of approximately 1,400 m2 (0.3 acres) and to retain 29 ha (73 acres) of land. The lands are designated Residential on Schedule"B" Straffordville: Land Use and Constraints of the Official Plan of the Municipality of Bayham. The lands are zoned Village Residential R1 on Schedule "F" Straffordville in Zoning By-law Z456-2003. 2. The existing lands are used for agricultural purposes. There are no existing buildings or dwellings. The proposal is to create four new residential lots along Heritage Line with a lot frontage of 24 m (78 feet) and lot depth of 57 m (187 feet). Lot areas are: Part A 1,402 m2; Part B 1,396 m2; Part C 1,390 m2; and Part D 1,383 m2. There were ten previous lots created by consent, the most recent in 2007 creating one lot abutting the proposed Part D to the east. The other nine lots were created prior to that. 3. The subject lands are located in the Village of Staffordville to which "settlement area" policies apply. The proposed consents are consistent with Section 1.1.3 Settlement Areas of the Provincial Policy Statement 2014 as the settlement area is the focus of the proposed growth and development, and the vitality and regeneration of the Village is promoted by allowing for the expansion of the built up area for residential purposes. 4. The criteria for conditional approval of new lots by consent are outlined in Section E1.2.3.1 —General Criteria of the County Official Plan. The lots are consistent with the minimum lot area of 900 m2 and minimum lot frontage of 20 m. In the future the western boundary of Part A may develop into a local road should further development occur to the north. A dwelling or buildings constructed on Part A should meet the minimum regulations for corner lots. e) The lands are zoned R1 in keeping with the proposed use as single detached dwellings are permitted in the R1 zone. f) The owner will provide connections to the municipal sewage system and private water services upon construction. They have provided confirmation of sufficient water quantity and quality for the farm building cluster on the retained lands. The applicant will provide confirmation of sufficient water quantity and quality for each of the new lots. g) The applicant will enter into Mutual Drain Agreements with the retained lands for each lot. h) A road access location for future connection to Garner Road appears to be available with retaining 23 m of frontage west of the proposed lots. Future subdivision of land can connect to Heritage line at this location. The development of the retained lands is therefore maintained. i) There are no significant natural heritage features associated with the subject lands. j) As a condition of consent the owner will provide confirmation of sufficient water quantity and quality for each of the lots and showing that the development will not have a negative impact on the surrounding area. k) The applicant will provide engineering reports addressing adequate stormwater management for the development lands. I) Section 8.7.3 of the Bayham Official Plan states that consents may only be granted that conform to the policies of the Official Plan. The severed lands are designated "Residential" in the Bayham Official Plan. Permitted uses on lands within this designation include residential uses, primarily in the form of low to medium density residential uses. Further analysis of Official Plan policies is included in a below section. m) The proposed consent lots will conform to Section 51 (24) of the Planning Act, as amended. The proposed consent is consistent with the County of Elgin Official Plan. IBI GROUP MEMORANDUM 3 Municipality of Bayham—January 14,2019 5. Official Plan Section 4.5.2.8 sets out the criteria for proposals for new single unit dwellings in designated "Residential" areas. Consideration of the criteria of the Section follows: a) The proposed lots meet the Village Residential (R1)zone regulations for lot frontage, depth and size as set out in the Zoning By-law. b) The development of the subject lands should include retention of the existing natural features to the greatest extent possible. c) Consideration should be made regarding the inclusion of the innovative design being utilized in the design of the site layout and dwelling. d) According to Section 4.5.8.7 the Municipality shall require a dedication of 5%, or cash- in-lieu, of the subject lands in accordance with the Planning Act. The Municipality accepts cash-in-lieu of parkland to use throughout the Municipality where there is a need. e) The lots are similar in size to the adjacent single family lots and the surrounding lands are designated "Residential"on Schedule`B' Straffordville: Land Use and Constraints in the Official Plan. f) Each lot has an existing connection stubs to the sanitary sewer system in Straffordville. Adequate private water services are required. g) Mutual drain agreements for drainage in the area is to be determined by the County. h) Heritage Line is straight and flat along this stretch of development and driveways are the predominant access for surrounding dwellings, no traffic hazards are anticipated. i) The proposal is to create four lots whereas Section 50 and 51 of the Planning Act are generally in regards to plans of subdivision with 5 or more lots. The proposed consents are consistent with the Municipality of Bayham Official Plan. 6. The existing Village Residential (R1) zone allows single detached dwellings. The proposed lot area and lot frontage exceed the minimum set out in the By-law. The shape and configuration of the lots is regular and will allow for the appropriate siting of single detached dwellings. The proposed lot layout provides adequate lot area and lot frontage to meet the regulations and is in conformity with the Zoning By-law. 7. Based on the above review of the applications we have no objection to Council approval of four lots as proposed, subject to the following conditions: 1. The applicant provide engineer design storm water management, drainage and grading plans. 2. That the applicant enter into Mutual Drain Agreement(s) if required by the County. 3. The installation of private wells with test results showing water quality and quantity for residential use that meets provincial standards. 4. The applicant provide a survey of the lands. 5.
