The purpose of dust suppression is twofold: 1) Maintain the integrity of the granular infrastructure by preventing the loss of gravel fines. 2) Reduce dust impacts. The two factors that determine dust suppressant capabilities are the composition and the concentration of brine material. Composition is important because some salts are highly hygroscopic (calcium chloride and magnesium chloride) and others, such as sodium chloride, are not. The most frequently utilized dust suppressant options: CALCIUM CHLORIDE Calcium chloride (CaCl2) is a hygroscopic salt that draws moisture from the air to form a solution in road gravel that attempts to keep road surfaces constantly damp. The moisture helps to bind particles together to create a hard and compact road surface. MAGNESIUM CHLORIDE Magnesium chloride (MgCl2) is a hygroscopic salt. Liquid magnesium chloride and liquid calcium chloride exhibit similar water attraction properties. WELL HEAD BRINES Well Head Brine Solutions, also referred to as mineral well or oil well brines are sometimes applied to unpaved roads. While the hygroscopic performance of defined concentrations of pure calcium chloride and magnesium chloride are well known, the moisture attraction and resulting dust control effectiveness of other brine solutions is less certain. The lower concentrations of hygroscopic material typically found in well head brines means far more material can be required to achieve dust control, increasing transportation and application expense. Well Head Brine Solutions require Ministry of the Environment approval for carriers applying waste as a dust suppressant under Section 2 of O. Regulation 347 and Section 27 of the Environmental Protection Act(EPA). Under Section 5(2) of O. Regulation 347, sites receiving dust suppressants are exempt from approval requirements, provided that the site and wastes are identified in the carrier's Environmental Compliance Approval. DISCUSSION The dry nature of 2018 has created an influx of service requests and general concerns pertaining to Municipality of Bayham dust suppression level of service and the general lack of dust suppression. As a result staff present the following information for assessment and make a recommendation for a 2019 Level of Service pertaining to dust suppression activities. The Municipality of Bayham has historically budgeted $0.00 for dust suppression materials and has historically utilized Well Head Brine Solutions for dust suppressant. In 2018 a shortage of Well Head Brine Solutions existed which significantly impacted dust suppression activities. Lack of Well Head Brine Solution coupled with Ministry of the Environment requirements and the effectiveness of Well Head Brine Solutions has necessitated the consideration of alternate dust suppression activities. Generally, staff would recommend that in 2019 the Municipality of Bayham utilize calcium chloride dust suppressant supplied through a third party vendor identified through a competitive procurement process. Staff would recommend a 20% calcium chloride solution applied at a rate of 4 flake ton. The Municipality has approximately 68 kilometres of gravel roads. Costing for the annual one time application would be approximately $47,000 ($40,000 plus an additional $7,000 to be stored at the Public Works Yard to be applied as needed as determined by the Road Operations Supervisor based on infrastructure integrity requirements). Operationally dust suppressant would be applied once annually to gravel roads at available times when moisture is present to maximize the dust suppression agent bond, and to create a seal on the surface of the gravel road. From a Capital Budget perspective staff would carry additional funds on projects that include granular base applications or gravel upgrades. RECOMMENDATION 1. THAT Staff Report PS-04/18 re Gravel Road Dust Suppression be received for information; 2. C-07/ D9.18 Grewal Roll # 3401-000-004-09030 SUBJECT: Consent Application E63-66/18 Grewal BACKGROUND: Four consent applications were received from the Elgin County Land Division Committee submitted by Nariender Grewal proposing to sever four lots, Lots 1-3 each with 27.4 metres of lot frontage, Lot 4 with 47.5 metres lot frontage and equal depths at 55 metres. The owner would retain 5.83 hectares. The subject land is within the boundary of the Village of Straffordville. Lands are designated "Residential" on Schedule `B' Straffordville: Land Use and Constraints in the Official Plan. Lands are zoned Village Residential — Holding 2 [R1(h2)]) in Zoning By-law No. Z456-2003. In the immediate area of the proposed lots, the lands are designated and zoned appropriate for future residential development. Elgin County Land Division Committee will consider the application on September 5, 2018. DISCUSSION: In the past, Council has supported multiple lot developments by consent, however, experience has shown that multiple lot development by consent may lead to municipal servicing, drainage and surface water management concerns that ideally are mitigated through an orderly development by plan of subdivision. The municipal planners, as you will read in the attached planner's memorandum dated August 8, 2018, recommend Council not support the consent applications. They recommend a Plan of Subdivision in order to ensure the orderly and coordinated development of not only these lands but those in the immediate vicinity (east side Sandytown Rd). They suggest conducting a Secondary planning exercise with adjacent land owners to determine a coordinated overall development to address items such as drainage, surface water management, street layout and land intensification. Staff Report DS-52/18 Grewal 2 Staff acknowledge the opinion and recommendations of the municipal planners but would suggest that this specific property be considered for the current four consents that complete the west side development stretch to Stewart Road and recommend that all future development of the retained interior lands on the west side of Sandytown Road be through a registered Plan of Subdivision to ensure the lands are developed utilizing the best planning principles and design criteria. Grewal - Sandytown Road -Applications for Consent E63/18; E64/18; E65/18; E66/18 - Concession NTR Part Lot 123, Municipality of Bayham 1. We have completed our review of four consent applications submitted by Nariender S. Grewal for lands located at Concession NTR Part Lot 123, on Sandytown Road,west side and north of Heritage Line. The applicant is requesting consent to create three new lots of 1,505 m2 (0.3 acres) and one new lot of 2,898 m2 (0.7 acres) and to retain 5.8 ha (14 acres) of land. The lands are designated Residential on Schedule"B" Straffordville: Land Use and Constraints of the Official Plan of the Municipality of Bayham. The lands are zoned holding Village Residential R1(h2) on Schedule "F" Straffordville in Zoning By-law Z456-2003. 2. The existing lands are used for agricultural purposes. There are no existing buildings or dwellings. This proposal is to create four new lots along Sandytown Road, each of the three interior lots Parts A-C with a lot frontage of 27.4 m (90 feet), lot depth of 50.1 m (164 feet) and lot area of 1,505 m2; and Part D (abutting Stewart Road) having lot frontage of 47.5 m (156 feet), lot depth of 55.1 m, and lot area of 2,898 m2. The retained lands will have a lot frontage of 151 m (495 feet); lot depth of 410 m (1,345 feet) and lot area of 5.8 ha. There were eight previous consents created, four in 2006 and four in 2010 along Sandytown Road. At the time of consent application in 2010 the applicant submitted a conceptual plan illustrating the proposed lot layout of the subject lands. 3. The subject lands are located in the Village of Staffordville to which "settlement area" policies apply. The proposed consents are consistent with Section 1.1.3 Settlement Areas of the Provincial Policy Statement 2014 as the settlement area is the focus of the proposed growth and development, and the vitality and regeneration of the Village is promoted by allowing for the expansion of the built up area for residential purposes. However, with respect to policies on sewage, water and stormwater servicing and in order to be consistent with these policies it is appropriate to have an orderly disposition of services and roads through a plan of subdivision. The consent applications are not consistent with the Provincial Policy Statement 2014 due to the lack of a plan of subdivision for the lands. IBI Group is a group of firms providing professional services and is affiliated with IBI Group Architects IBI GROUP MEMORANDUM 2 Municipality of Bayham—August 8,2018 4. The criteria for conditional approval of new lots by consent are outlined in Section E1.2.3.1 —General Criteria of the County Official Plan. The Elgin County Land Division Committee must be satisfied that the proposed lots meet the following criteria: a) fronts on and will be directly accessed by a public road that is maintained on a year- round basis; The proposed lots will be directly accessed via Sandytown Road, or in the case of Part D either Sandytown Road or Stewart Road, opened public road(s) maintained year-round. b) does not have direct access to a Provincial Highway or County Road, unless the Province or the County permits a request for access; Sandytown Road and Stewart Road are municipal roads. c) will not cause a traffic hazard; Based on a desktop review of recent Google Streetview imagery there are no anticipated traffic hazards associated with the sightlines along Sandytown Road and the driveways will be in keeping with the existing residential nature of the road. Stewart Road is of insufficient width, at 12.2 m (40 feet), to accommodate increased traffic for municipal servicing of roads and municipal services of the subject lands, therefore, a road widening to 20.1 m (66 feet) is necessary. A 3.9 m (12.8 feet) portion of the lands fronting on Stewart Road shall be transferred to the Municipality for road widening purposes. d) has adequate size and frontage for the proposed use in accordance with the local municipal Zoning By-law; The proposed lots have adequate size to meet all the frontage and setback regulations of the Zoning By-law. A zoning by-law amendment is needed to remove the Holding Provision. The holding provision requires the applicant to enter into a subdivision agreement with the Municipality to address financial and servicing impacts of the new development to the Municipality. e) notwithstanding d) above, where a zoning by-law amendment or minor variance is required, approval of such amendment or variance shall be included as a condition of the approval of the consent; The applicant will be required to remove the holding provisions on the lands by entering into a subdivision agreement with the Municipality. f) can be serviced with an appropriate water supply and means of sewage disposal, provided there is confirmation of sufficient reserve sewage system capacity and reserve water system capacity within municipal sewage services and municipal water services; The owner will provide connections to the sewage system and will provide confirmation of sufficient water quantity and quality for each of the lots. g) will not have a negative impact on the drainage patterns in the area; The applicant will provide engineering reports in the subdivision agreement to demonstrate the lotting pattern will not have a negative impact on the drainage patterns in the area. IBI GROUP MEMORANDUM 3 Municipality of Bayham—August 8,2018 h) will not restrict the development of the retained lands or other parcels of land, particularly as it relates to the provision of access, if they are designated for development by this Plan; A road access location from Sandytown Road was maintained during the previous consents for future road access approximately 170 m (feet)south of Part A on Sandytown Road. Road connections to and from the undeveloped lands to the west are not considered in the conceptual plan and they should be determined prior to further lot creation. The retained Sandytown Road access is unable to connect easterly due to lot creation on the other side of Sandytown Road. There is an existing registered plan of subdivision #205 existing for the easterly lands and existing street pattern and lotting pattern that need to be reviewed comprehensively with the subject lands. It is recommended that at a minimum a conceptual plan that works for the entire area on either side of Sandytown Road be determined prior to the granting of consent and that a comprehensive plan of subdivision be approved for the subject lands that compliments surrounding street and lotting patterns. A road access connection to Stewart Road is to be maintained along Stewart Road for future rounding out of development. i) will not have a negative impact on the significant features and functions of any natural heritage feature; in this regard, lots should be restricted in size in order to conserve other lands in larger blocks for natural heritage purposes; There are no significant natural heritage features associated with the subject lands. j) will not have a negative impact on the quality and quantity of groundwater available for other uses in the area; As a condition of consent the owner will provide confirmation of sufficient water quantity and quality for each of the lots and will not have a negative impact on the surrounding area. k) will not have an adverse effect on natural hazard processes such as flooding and erosion; The applicant will provide engineering reports addressing adequate stormwater management for the development lands. 1) conform with the local Official Plan; and, Section 8.7.3 of the Bayham Official Plan states that consents may only be granted that conform to the policies of the Official Plan. The severed lands are designated "Residential" in the Bayham Official Plan. Permitted uses on lands within this designation include residential uses, primarily in the form of low to medium density residential uses. The conceptual plan layout is not consistent with the target residential development density in villages of 20 uph. The conceptual plan shows six lots along Sandytown Road on the same lands for the four proposed lots,four lots with less frontage along Sandytown Road and two lots on the corner fronting on Stewart Road. The Official Plan targets a density of 20 units per hectare(uph)for areas designated Residential within Straffordville. The conceptual plan illustrates development at a density of 6.3 uph, based on the four proposed and remaining 37 internal lots. This is not in conformity with the Plan. IBI GROUP MEMORANDUM 4 Municipality of Bayham—August 8,2018 Section 4.2.2 of the Plan states that it is the intent of the Plan to encourage residential development in existing settlement areas by locating new residential development adjacent to existing built-up areas in a compact and contiguous fashion. Section 4.5.2 supports the redevelopment and residential intensification of lands in the Residential designation where such lands are being underutilized. The infilling of four single family lots along Sandytown Road in a settlement area is consistent with Official Plan policies for residential use. However,we do not support the layout of the retained lands as shown. Any future development of the lands should be in keeping with the goals and objectives of the Official Plan to target higher densities for residential areas in villages. m) will conform to Section 51 (24) of the Planning Act, as amended. Section 51 (24) of the Planning Act sets out criteria for considering draft plans of subdivision with regard to the health, safety, convenience, accessibility for persons with disabilities and welfare of the present and future inhabitants, among other matters, as follows: (a) the effect of development of the proposed subdivision on matters of provincial interest as referred to in section 2; A review of the matters of provincial interest outlined in Section 2 of the Planning Act corroborated the need for a plan of subdivision in order to ensure such things as: (f) adequate provision of sewage and water services (h) the orderly development of safe and healthy communities (j) The adequate provision of a full range of housing, including affordable housing (I) the protection of the financial well-being of the municipality (p) the appropriate location of growth and development. (b) whether the proposed subdivision is premature or in the public interest; Based on the conceptual plan for the subject lands and the uncoordinated nature of a plan for the entirety of undeveloped lands in the area the proposed lots are premature and may not be in the long-term public interest due to uncertainty of servicing, roadway locations and lotting patterns.We recommend conducting a secondary planning exercise with adjacent land owners to determine future layout of development and in particular the location of roadways. (c) whether the plan conforms to the official plan and adjacent plans of subdivision, if any; The plan is not in conformity with density targets for the settlement area. There remains uncertainty with how servicing and access for the lands in the area will be developed in a coordinated manner. The conceptual plan does not conform to the Official Plan and requires further deliberation with the adjacent lands. IBI GROUP MEMORANDUM 5 Municipality of Bayham—August 8,2018 (d) the suitability of the land for the purposes for which it is to be subdivided; The purpose is suitable for residential development in a residential designation in the Official Plan. (d.1) if any affordable housing units are being proposed, the suitability of the proposed units for affordable housing; No affordable housing is proposed. Development of the lands shall incorporate affordable housing in accordance with Section 4.2.2.3 of the Official Plan. (e) the number, width, location and proposed grades and elevations of highways, and the adequacy of them, and the highways linking the highways in the proposed subdivision with the established highway system in the vicinity and the adequacy of them; Based on a desktop review of recent streetview and aerial imagery, Sandytown Road is flat to rolling and is considered adequate for the proposed purpose. The subject lands are in close proximity to Heritage Line or County Road 38.The location of access to and from the subject lands and adjacent lands remains uncertain. Revision to the conceptual plan and it's coordination with adjacent lands in the area needs to be considered and a plan of subdivision should be established prior to further consent, with particular focus on establishing appropriate street and lotting patterns. (f) the dimensions and shapes of the proposed lots; The lot dimension and shape are appropriate for single family residential development. (g) the restrictions or proposed restrictions, if any, on the land proposed to be subdivided or the buildings and structures proposed to be erected on it and the restrictions, if any, on adjoining land; The Zoning By-law holding provisions require that a subdivision agreement be entered into with the Municipality to determine, among other matters, the financial and servicing impacts of the development to the Municipality. (h) conservation of natural resources and flood control; The applicant will provide engineering reports addressing adequate stormwater management for the development lands. There no significant natural resource features in proximity to the subject lands. (i) the adequacy of utilities and municipal services; The owner will provide connections to the sewage system and will provide confirmation of sufficient water quantity and quality for each of the lots. (j) the adequacy of school sites; There is a public school within Straffordville to accommodate future students. (k) the area of land, if any, within the proposed subdivision that, exclusive of highways, is to be conveyed or dedicated for public purposes; According to Section 4.5.8.7 of the Official Plan the Municipality shall require a dedication of 5%, or cash-in-lieu, of the subject lands in accordance with the Planning Act. The Municipality collects cash-in-lieu of parkland to use throughout the Municipality where there is a need. IBI GROUP MEMORANDUM 6 Municipality of Bayham—August 8,2018 (I) the extent to which the plan's design optimizes the available supply, means of supplying, efficient use and conservation of energy,' and The design and orientation of the buildings should seek to maximize energy efficiency, including such matters as daylighting, renewable energy system capability, etc. 5. Official Plan Section 4.5.2.8 sets out the criteria for proposals for new single unit dwellings in designated "Residential" areas. Consideration of the criteria of the Section follows: a) Lot frontage, depth and size: The lot frontage, lot depth, and lot size of any lots proposed to be used or created for residential purposes shall be appropriate to the development being proposed and consistent, wherever desirable and feasible, to adjacent and surrounding lots. In no case shall lots be created or dwelling units constructed which do not conform to the provisions of the Zoning By-law unless the By-law is otherwise amended or a variance granted. The proposed lots meet the Village Residential (R1) zone regulations for lot frontage, depth and size as set out in the Zoning By-law. b) Natural features: Natural site features including vegetation, tree cover, and topography shall be protected, enhanced, and incorporated into the design of the proposed development to the greatest extent possible. The development of the subject lands should include retention of the existing natural features to the greatest extent possible. c) Design: Innovative housing design and site layout including energy-saving measures will be encouraged. To achieve energy savings, particular regard shall be had to building form and size, density, lot and building orientation, and on-site landscaping. Consideration should be made regarding the inclusion of the innovative design being utilized in the design of the site layout and dwelling. d) Open space: Open space including parkland shall be provided in accordance with the policies of Section 4.5.8. According to Section 4.5.8.7 the Municipality shall require a dedication of 5%, or cash-in- lieu, of the subject lands in accordance with the Planning Act. The Municipality accepts cash-in-lieu of parkland to use throughout the Municipality where there is a need. e) Adjacent and surrounding land use: The proposed development shall be compatible with existing (or proposed) neighbouring land uses. Where necessary or desirable, the proposed development shall be adequately screened from adjacent land uses by the provision of landscaping and/or buffering. The lots are similar in size to the adjacent single family lots and the surrounding lands are designated "Residential" on Schedule `B' Straffordville: Land Use and Constraints in the Official Plan, however, uncertainty remains as to the compatibility of the conceptual plan for the subject lands and future development on adjacent lands, particularly in regard to access and servicing. IBI GROUP MEMORANDUM 7 Municipality of Bayham—August 8,2018 f) Facilities and services: Existing or proposed municipal services (including potable water supply, sanitary sewage treatment and disposal, solid waste disposal, storm and surface drainage, roads, sidewalks, and street lighting)shall be adequate to serve the proposed development. If these services or facilities are deemed inadequate, the Municipality may require that an agreement be entered into with the developer as to the design and cost apportionment of any public works required to bring these services or facilities up to the appropriate standard. The Municipality requires that a subdivision agreement be entered into with the Municipality prior to development of the lands to ensure adequate services are maintained on existing built up lands and be provided for on the proposed development. g) Storm drainage: Adequate provision for stormwater management/drainage and surface runoff subject to the requirements of the Municipality, and the statutory approval authority having jurisdiction, shall be provided. Where in the opinion of the Municipality it is deemed necessary or desirable, the Municipality may require the submission of a grading plan and/or stormwater management plan to ensure surface water runoff does not adversely affect neighbouring properties or receiving watercourses. Drainage in the area is to be addressed with appropriate engineering design plans through a subdivision agreement. h) Vehicular access: Vehicular access shall be available or made available from a public highway or public street of reasonable construction and maintenance to permit year round access and shall be subject to the approval of the authority(ies) having jurisdiction. In no case shall access be permitted where traffic hazards could result due to poor sight lines or proximity to a traffic intersection. In new residential subdivisions, the use of a curvilinear street pattern, cul-de-sacs, and other similar design features to minimize through traffic movements shall be encouraged. The intersection at Sandytown Road and Stewart Road is flat to rolling and straight, no traffic hazards are anticipated. i) The Planning Act:In the case of a residential subdivision, all matters contained within Section 50 and 51 of the Planning Act as amended or revised from time to time shall be complied with. The proposal is to create four lots whereas Section 50 and 51 of the Planning Act are generally in regards to plans of subdivision. The matters contained in Section 50 and 51 should be addressed with an application for these consents in accordance with the Planning Act. IBI GROUP MEMORANDUM 8 Municipality of Bayham—August 8,2018 6. The existing Village Residential (R1) zone allows single detached dwellings. The proposed lot area and lot frontage exceed the minimum set out in the By-law. The shape and configuration of the lots is regular and will allow for the appropriate siting of single detached dwellings. The holding symbol "h2" requires the owner enter into a subdivision agreement with the Municipality to address financial and servicing impacts of the new development to the Municipality prior to the removal of the holding symbol, primarily related to the extension of municipal sewage services to the new lots. It is recommended that a comprehensive plan for the remaining undeveloped lands in the area be determined and that a plan of subdivision be approved prior to any further development.The proposed lot layout provides adequate lot area and lot frontage to meet the regulations and is in conformity with of the Zoning By-law. 7. Based on the above review of the applications, Official Plan and Zoning By-law, we recommend refusal of the four consent applications and we further recommend a draft plan of subdivision application to support the orderly and coordinated development of municipal services and the minimization of potential impact between the proposed lots and on abutting properties. 8. Should the Land Division Committee determine that the proposed consents are appropriate, as there may be a need to balance the long-term interests of the Municipality with the short-term desire to attract residential development to Straffordville, we recommend the following conditions: 1) The approval of a Zoning By-law Amendment to remove holding provision "h2" by entering into a subdivision agreement with the Municipality. 2) That the applicant enter into a Subdivision Agreement to address the following items: 1. The applicant provide engineering design servicing plans for the extension of the sanitary sewer extension, to be approved by the Ministry of the Environment, Conservation and Parks. 2. The applicant provide engineer design storm water management, drainage and grading plans. 3. That the applicant enter into Mutual Drain Agreements with the retained lands for each lot. 4. The installation of private wells with test results showing water quality and quantity for residential use that meets provincial standards. 5. The applicant provide a survey of the lands. 6. That the applicant provide a 3.9 m portion of lands along Stewart Road for road widening purposes. 7. As required by Municipal staff: a. Howick cemeteries have anywhere from 10-20 burials/year and sold 12 plots in 2017. All Howick Cemetery Boards have money in a Care and Maintenance Fund which can only be used to purchase land. Interest earned from these accounts, approximately $2 - $84/month, can be used to cover operating expenses. At its meeting held July 17, 2018, the Council of the Township of Howick passed the following resolution: Moved by Councillor Harding; Seconded by Councillor Scott: Whereas; Ontario Regulation 30/11 states the Capital portion of the Care and Maintenance Trust Fund cannot be accessed, the only exception is to purchase land adjacent to the cemetery to increase the capacity of the cemetery; And whereas; none of the Howick Township Cemetery Boards have a need to purchase land to increase capacity at this time or in the near future; And whereas, only the interest generated from the Care and Maintenance Trust Fund can be used for the care and maintenance of the lots, markers and grounds of the cemetery; And whereas, Howick Township Cemetery Boards have minimal funds to cover the cost of minimal maintenance in their cemeteries; And whereas; major maintenance projects such as road repair and tree maintenance/removal could be arranged if the Cemetery Boards could borrow/loan funds from the Care and Maintenance Trust Fund; Therefore, be it resolved that Council petition the Bereavement Authority of Ontario to amend Ontario Regulation 30/11 to allow borrowing of funds from the Care and Maintenance Trust Fund for capital improvements and purchases when other municipal cemetery funds are exhausted. Harm reduction is: • A viable, common-sense, empirically validated, compassionate approach (Understanding Addiction,Ron Shore, January 2009) • A range of non-judgemental strategies and approaches to provide and enhance knowledge, skills, resources and support for individuals,families and communities to become safer and healthier. (British Columbia Centre for Disease Control,2004) • Measures taken to address drug problems that are open to outcomes other than abstinence or cessation (Canadian Centre of Substance Abuse,2007) Harm Reduction is about ACCEPTING people for who they are and where they are at in life. We understand that individuals who engage in high risk drug use/misuse are also likely to engage in high risk sexual activities. Southwestern Public Health operates a Needle Exchange Program (NEP) from its building at 1230 Talbot Street, St.Thomas and satellite programs also operate from Central Community Health Centre and West Elgin Community Health Centre.The NEP is part of Ontario's harm reduction program and is offered by Public Health to provide sterile, single use equipment to help clients who use substances prevent the spread of bloodborne infections like HIV, Hepatitis C and B. Sharps containers are also distributed to encourage safe disposal of used sharps and supplies. From 2016 to 2017, we saw a 47% increase in sharps (needles) distributed through our NEPs.An evidence-based harm reduction strategy includes sharps containers and bins throughout a community to eliminate "rogue" sharps found discarded in our communities. Our services are free and confidential. Included in the supplies distributed are naloxone kits. Naloxone is a medication that can temporarily reverse the effects of an overdose related to an opioid such as fentanyl, heroin and morphine.Take home naloxone kits and training are provided free of charge and without a prescription to people at risk of an opioid emergency and their family and friends. In an effort to better serve our rural communities, we have secured funding from Green Lane Community Trust Fund to launch a mobile outreach service across Elgin County. Services offered would include distribution of supplies for safer drug use, including injection and inhalation, and safer sex supplies including condoms and dental dams. We would offer needle return services and naloxone training as well from the mobile unit, which will be staffed with a sexual health public health nurse and a health promoter from our harm reduction program. I have attached the PROPROSED routes and locations and am reaching out to you to seek confirmation that the vehicle can park at these respective locations and deliver service. We will be launching a marketing campaign as well that will include this information for clients and community agencies. We would like to operationalize this program in October 2018. I would ask that you bring this forward to your respective councils/leaders for review and a confirmation that we may use these respective locations. Agreement No. 0507 between the Municipality of Bayham and Marion Faith Rogers for Civil Marriage Officiant Services expires on December 31, 2018. On July 12, 2018 staff sent correspondence to Ms. Rogers to propose renewal of the current Civil Marriage Officiant Services Contract for a further three (3) year period with all terms and conditions to remain the same. Municipality of Bayham Civil Marriage Officiant Services operate on a full cost recovery model when offered. DISCUSSION On July 18, 2018 Ms. Rogers advised `there is a strong possibility that regretfully I may not be available to celebrate civil weddings in Bayham between Oct. 20, 2018 and May 1, 2020'. Ms. Rogers also made recommendation for consideration to appoint another individual. The municipal organization AMCTO offers corporate training for Officiant Services as authorized under Ontario Regulation 285/04. AMCTO will next offer the training program in the fall of 2018, after the municipal election, at AMCTO headquarters in Mississauga. Estimated costs associated with training, travel and accommodations is $1,000/person. Staff require Council direction if the Municipality will continue to offer Civil Marriage Officiant Services and if so, the process for selection of said persons to send for training in the absence of Ms. Rogers. THAT Schedule "C" to By-law No. 2018-045 is hereby repealed and replaced with Schedule "C" affixed hereto and forming part of this by-law; 2. THAT the Mayor and Clerk be and are hereby authorized to execute the Agreement attached hereto as Schedule "A" and forming part of this by-law between the Municipality of Bayham and Farm Credit Canada to provide funding for the Bayham Community Hub project; 2. AND THAT this by-law shall come into full force and effect upon final passing. READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 16th DAY OF AUGUST 2018. MAYOR CLERK THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2018-082 A BY-LAW TO CONFIRM ALL ACTIONS OF THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM FOR THE REGULAR MEETING HELD AUGUST 16, 2018 WHEREAS under Section 5 (1) of the Municipal Act, 2001 S.O. 2001, Chapter 25, the powers of a municipal corporation are to be exercised by the Council of the municipality; AND WHEREAS under Section 5 (3) of the Municipal Act, 2001, the powers of Council are to be exercised by by-law; AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it advisable that the proceedings of the meeting be confirmed and adopted by by-law. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the actions of the Council of the Corporation of the Municipality of Bayham in respect of each recommendation and each motion and resolution passed and other action by the Council at the regular meeting held August 16, 2018 is hereby adopted and confirmed as if all proceedings were expressly embodied in this by- law. 2. THAT the Mayor and Clerk of the Corporation of the Municipality of Bayham are hereby authorized and directed to do all things necessary to give effect to the action of the Council including executing all documents and affixing the Corporate Seal.
