BY-LAW TO CONFIRM THE PROCEEDINGS OF COUNCIL A. By-Law No. 2018-075 Being a by-law to confirm all actions of Council 16. ADJOURNMENT We'd like to propose a request for soccer nets to be installed in Vienna. (at the old Ball Diamond) With the ever rising rates of obesity in children, 25% of teens are obese, also statistics show that 91% of kids ages 2-15 spend up to 13 hours/week playing video games! More outdoor equipment/activities would be ideal esp in small communities. Children in Vienna have voiced that they don't have much here, the soccer nets would provide them with outdoor/sport opportunity. With the open field behind the community center, this central location would be prime for the entire community. Given the opportunity we'd like to present this to council. Report DS-39/18 by Margaret Underhill, Deputy Clerk I Planning Coordinator re Rezoning Application — Parker Zoning By-Law Z676-2018 Garden Suite Moved by: Deputy Mayor Southwick Seconded by: Councillor Ketchabaw THAT Staff Report DS-39/18 regarding the Parker rezoning application be received for information; AND THAT pursuant to Planning Act Regulations Bill 73 Smart Growth for our Communities Act, 2015, it be pointed out that at the public participation meeting held May 2018 Council Minutes June 7, 2018 17, 2018 associated with this application, there were no written submissions and no persons made oral presentation regarding this matter and that all considerations were taken into account in Council's decision passing this resolution; AND THAT Zoning By-law Z456-2003, as amended, be further amended by changing the zoning on the lands owned by Gary and Sandra Parker from Agricultural (A1) to a combined Agricultural and Temporary (A1/T2-7) Zone to permit a garden suite in the form of a one storey mobile home unit for the care of an elderly parent for a period not to exceed ten (10) years, ending June 7, 2028; AND THAT Zoning By-law Z676-2018 be presented to Council for enactment; AND THAT Council direct staff to bring forward a by-law to enter into an agreement with Gary and Sandra Parker for the placement of a garden suite including provisions allowing for a ten (10) year term and a security deposit in the amount of three thousand ($3000) dollars for Council consideration. C-07/E09 SUBJECT: PETITION FOR DRAINAGE FROM ROAD AUTHORITY BACKGROUND: This report is to present Council the Petition filed with the Clerk, of the Municipality of Bayham, on June 6, 2018. The petition is for a drainage works for lands owned by the Municipality of Bayham and signed by Bayham's Road Operations Supervisor, Steve Adams. The area of concern as stated on the petition is for the road allowance of Vienna Line from Brown Road to Centre Street, known as Lots 11,12,13 Conc's 2 &3. Section 4(1) of the Drainage Act provides for a petition for the drainage by means of a drainage works of an area requiring drainage as described in the petition may be filed with the clerk of the local municipality in which the area is situate by: (a) The majority in number of the owners, as shown by the last revised assessment roll of lands in the area, including the owners of any roads in the area: (b) The owner or owners, as shown by the last revised assessment roll, of lands in the area representing at least 60% of the hectarage in the area; (c) Where a drainage works is required for a road or part thereof, the engineer, road superintendent or person having jurisdiction over such road or part, despite subsection 61(5); (d) Where a drainage works is required for the drainage of lands used for agricultural purposes, the Director. The Drainage Act provides that Council must give consideration to the petition and, within thirty days (Section 5.1.a) of the filing, decide whether or not it will proceed. If Council decides not to proceed then written notice of its decision must be sent to each petitioner. A petitioner may appeal to the Ontario Drainage Tribunal if Council decides not to proceed, or if Council does not act on the petition within 30 days. It may be difficult for Council to make a decision on the validity of the petition as it is based on definition of the "area requiring drainage". Initially, the petitioner(s) define this area on the petition they submit, however the area must be defined by an engineer at the "on-site meeting" to determine the validity of the petition. If the Municipality decides to proceed then written notice of its decision must be given to (Section 5.16): (a) each petitioner; (b) the Clerk of each local municipality that may be affected; (c) the Conservation Authority that may be affected; (d) the Ministry of Natural Resources; (e) The Ministry of Agriculture, Food & Rural Affairs. The Municipality must appoint an engineer within sixty days (Section 8.3) of giving notice to proceed. The choice of engineer is the decision of Council. When appointed by Council to prepare a report on the drainage work, the engineer is to file said report within six (6) months (Section 39.1) of the appointment. Following the appointment, the engineer must (Section 9.1) cause the Municipal Clerk to send a written notice, specifying the time and place of an "on-site meeting". The notice must be served seven days prior to the proposed site meeting. DISCUSSION: The road allowance along this section of Vienna Line is flat, the ditches don't drain. The road department is scheduling road improvements in a couple of years so it makes sense to get an outlet for the road allowance ditching before the road improvements take place. RECOMMENDATION 1. THAT Council of the Municipality of Bayham acknowledges the filing with the Clerk of the Petition for drainage works from the Municipality of Bayham's Road Operations Supervisor, Steve Adams. 2. THAT Report DS-45/18 regarding the petition for drainage and for drainage improvement be received; 3. As required by the Planning Act, the Notice of Public Meeting was circulated to agencies and the neighbouring properties within the 120 metres. A public meeting was held May 17, 2018 with no attendees. No written public submissions were received and staff received two verbal submissions from two neighbours in support. At the time of writing this report no additional applicant or public comments were received. PURPOSE & EFFECT The purpose of this By-law is to change the zoning regulations on the 15.8 ha (39 acres) retained lot from an Agricultural (A1) zone to a Site-specific Agricultural (A1-29) zone and on the 11.5 ha (28 acres) severed lot from Agricultural (A1) zone to an Agricultural (Al-A)zone in Zoning By-law Z456-2003. The severed lands will be merged with the abutting lands to the west as a condition of consent application E32/18. The subject lands are located on the south side of Bayham Drive, south of Talbot Line known as 14077 Bayham Drive. The effect of this By-law will be to fulfil two conditions of the consent. Firstly,to change the severed lands to a zone consistent with the merged parcel to the west and secondly to recognize the reduced lot area of the retained parcel. DS-46/18 Baldwin 2 DISCUSSION: The rezoning application reflects the revised survey measurements from the resubmitted consent application E32/18 supported by Council on June 7, 2018. Rezoning is a condition of the consent and the application meets the requirements for rezoning of the subject lands. Staff and planner support the zoning by-law amendment and recommend approval. C-07/ D13.DEPL Roll # 3401-000-006-04920/006-04900 SUBJECT: Rezoning Application — Deplancke, Zoning By-law Z678-2018 BACKGROUND: Danny Deplancke has submitted a rezoning application to rezone his property located on the south side of Eden Line, known as 56055 Eden Line as a condition of Consent Application E3/18. The lands are designated Agriculture and Natural Heritage on Municipality of Bayham Schedule 'Al' Land Use and Hazard Lands, Significant Woodlands on Schedule "A2" Constraints in the Official Plan. The retained portion is zoned Agriculture (A1) and Long Point Region Conservation Authority Regulation Limit and the lot addition severed portion is zoned Agriculture (A1) proposed to be merged with Rural Residential (RR) Zoned land known as 10342 Sandytown Road (Lansink). As required by the Planning Act, the Notice of Public Meeting was circulated to agencies and the neighbouring properties within the 120 metres. A public meeting was held June 7, 2018 with the appointed Agent signed in as attending. No written or verbal public submissions were received. At the time of writing this report no additional applicant or public comments were received. PURPOSE & EFFECT The purpose of this By-law is to change the zoning regulations on the 11 ha (27 acres) retained lot from an Agricultural (A1) zone to a site-specific Agricultural (A1-30) zone; and to change the 400 m2 (0.1 acres) of severed lands from an Agricultural (A1) zone to a Rural Residential (RR) Zone in Zoning By-law Z456-2003. The retained lands are located on the south side of Eden Line, east of Sandytown Road known as 56055 Line and the merged lands are located on the east side of Sandytown Road, south of Eden Line known as 10342 Sandytown Road. The effect of this By-law will be to fulfil two conditions of consent. Firstly, to recognize reduced lot DS-47/18 Deplancke 2 area of the retained lands and, secondly, to change the severed lands to a residential zone consistent with the rest of the parcel. DISCUSSION: The rezoning will satisfy the condition of consent to change the severed lands to the same zoning as the merged land and to recognize the reduced lot size of the retained portion. On January 19, 2017 the Council of the Corporation of the Municipality of Bayham passed the following resolution: THAT Report DS-03/17 regarding the Official Plan Review 2017 be received for information; AND THAT Council approves the Official Plan Review 2017 IBI Group work plan dated October 13, 2016 as presented. On March 23, 2017 the Council of.the Corporation of the Municipality of Bayham held a Public Open House to consider the Municipality of Bayham Five Year Official Plan Review under Section 26 of the Planning Act. On November 16, 2017 the Council of the Corporation of the Municipality of Bayham passed the following resolution: THAT the Official Plan Review— Background Report presentation by William Pol IBI Group Inc. be received for information; AND THAT staff be directed to post the Official Plan Background Report on the municipal website for review. On March 1, 2018 the Council of the Corporation of the Municipality of Bayham passed the following resolution: THAT the delegation of William Pol, Consulting Planner IBI Group Inc. regarding the Bayham 2017 —2018 Official Plan Review— Progress Report be received for information; AND THAT the Official Plan 5 Year Review draft amendments, including revisions, be accepted for circulation to the public and planning agencies. On June 21, 2018 the Council of the Corporation of the Municipality of Bayham will hold a Public Meeting to consider the Municipality of Bayham Five Year Official Plan Review under Section 26 of the Planning Act DISCUSSION: Attached hereto as Appendix 'A' are the Proposed Amendments to the Municipality of Bayham Five Year Official Plan Review conducted in accordance with Section 26 of the Planning Act. RECOMMENDATION 1. THAT Report DS-48/18 regarding the Official Plan Review be received for information; 2. Add Section 2.1.11 2.1.11 Large Scale Supplementary Farm Dwellings Supplementary farm dwellings that exceed the approval criteria in Section 2.1.10 may be permitted for temporary accommodation of seasonal farm labour through temporary dwellings, or a permanent dwelling subject to the following policies: 1. The owner shall apply for an Official Plan and Zoning By-law amendment to permit the farm dwelling subject to the following criteria: a. Consideration of all criteria and policies for supplementary farm dwellings permitted by a minor variance; b. Demonstration that alternative locations for the accommodation in existing farm dwellings on lots in the same farm operation, in temporary accommodation, in settlement areas and other similar accommodation are not feasible and not appropriate for the intended accommodation; c. Identification of the potential off-site impacts related to noise, lighting, traffic, maintenance and operation of the site on the surrounding community and the identification of appropriate mitigation measures; and d. A location in the Municipality where the site and building design shall provide appropriate accommodation for the health and safety of seasonal farm labourers. 2. Large scale supplementary farm dwellings shall be for the temporary accommodation of seasonal farm labour. The accommodation shall be located in proximity to the farm building cluster. The site and buildings shall be subject to agreements with the Municipality for the maintenance, buffering, removal of structures and improvement and limitations on the period of seasonal occupancy. The Municipality may enact licensing by-laws to ensure the health and safety of the occupants. 2. Add Section 2.1.12 2.1.12 Second Dwelling Units Agriculture Second dwelling units may be permitted in the Agriculture Resource designation where a single detached dwelling is permitted. The second dwelling unit shall fulfill all the criteria for Second Dwellings Units set out in Section 4.7.1. Replace Section 2.1.5 2.1.5 On-Farm Diversified Uses 2.1.5.1 The Municipality supports on-farm diversified uses through the establishment of agri-tourism, farm related home occupations, farm related home industries and uses that produce value added agricultural products. These operations include agriculture, horticultural or agri-business operations for the purpose of recreation, education, research and training or active involvement in farm activities, where the principle use on the property remains farming and where products used in the activity are produced on the property or related to farming. Such activities may include: farm tours; processing demonstrations; pick-your-own-produce; a hay or corn maze; petting zoo; hay rides and sleigh, buggy or carriage rides; a farm theme playground for children; wineries or research activities. f) Small scale overnight guest accommodation such as, farm vacation home, bed and breakfast or other temporary shelters to a maximum of six rooms may be permitted as temporary accommodation of guests to permitted agri-tourism operations. 4. Add Section 2.2.3.6.1 2.2.3 Development Applications 2.2.3.6.1 Where development or site alteration is proposed in any of the Natural Heritage Resources identified in this Plan or on adjacent lands, the applicant shall complete an evaluation of the existence and\or impact of any Species at Risk. The Municipality shall provide notice of the development application to the Ministry of Natural Resources and Forestry requesting information as to the potential existence of Species at Risk. No development or site alteration shall be permitted until the applicant for the development or site alteration provides the necessary documentation and mitigation measures to protect the identified Species at Risk. 5. Replace Section 2.3.2 and Section 2.3.3 with revised Section 2.3.2 2.3.2 Ground Water Protection 2.3.2.1 Ground and surface water sources occur throughout the Municipality. Groundwater sources need to be protected to promote public health and as an essential resource for settlement area and rural water supplies, agricultural production and the maintenance of natural heritage features. 2.3.2.2 The Municipality shall encourage agricultural practices that protect water resources. 2.3.2.3 The Municipality shall ensure that land use planning contributes to the protection, maintenance, and enhancement of water and related resources and aquatic systems on an integrated watershed management basis. IBI GROUP ON BEHALF OF THE MUNICIPALITY OF BAYHAM 3 2.3.2.4 The Municipality shall protect surface and groundwater quality through the use of regulatory and voluntary means of prohibiting, restricting, or influencing land uses and activities within vulnerable areas. 6. Add new Section 2.3.3 2.3.3 Sourcewater Protection Implementation 2.3.3.1 The policies of this Plan implement and complement the policies of the Source Protection Plans that apply within the Municipality. The Long Point Region Source Protection Plan contains the policies for the protection of municipal drinking water sources within the Municipality. 2.3.3.2 The identified vulnerable areas within Bayham include the Wellhead Protection Area (WHPA) surrounding the Richmond wellhead. This WHPA is identified on Schedule 'E' of this Plan. A WHPA is the area around a municipal wellhead where land use activities have the potential to affect the quality and quantity of water that flows into the well. 2.3.3.3 The WHPA identified on Schedule 'E' is a special protection area where certain land uses involving a significant drinking water threat activity may be prohibited or regulated in accordance with Section 57 or 58 of the Clean Water Act, 2006, and the Long Point Region Source Protection Plan, notwithstanding the uses permitted by the underlying land use designation. 2.3.3.4 The following policies are intended to prohibit or restrict significant drinking water threats from establishing within the WHPA in accordance with the Long Point Region Source Protection Plan to ensure that permitted uses can be established with an acceptable level of risk to groundwater quality and shall apply to the time related capture zones identified in Schedule E to this Plan, including: a) WHPA-A: 100 metre radius surrounding the well b) WHPA-B: 2 year travel time for water to enter the well c) WHPA-C: 5 year travel time for water to enter the well 2.3.3.5 Land use activities which may pose a drinking water threat to municipal water supplies include the following: a) The establishment, operation or maintenance of a system that collects, stores, transmits, treats or disposes of sewage. b) The application, storage and management of agricultural source material to land. c) The application handling and storage of commercial fertilizer to land. d) The application, handling and storage of pesticide to land. e) The application, storage and management of road salt. IBI GROUP ON BEHALF OF THE MUNICIPALITY OF BAYHAM 4 f) The use of land as livestock grazing or pasturing land, an outdoor confinement area or farm-animal yard. g) An activity that takes water from an aquifer or surface water body without returning the water to the same aquifer or surface water body. h) An activity that reduces the recharge of an aquifer. 2.3.3.6 The Municipal Risk Management Official shall determine whether a new land use or activity is, or involves, a significant drinking water threat and whether the use or activity is prohibited, or regulated through a Risk Management Plan in accordance with Long Point Region Source Protection Plan or a Prescribed Instrument. Therefore, notwithstanding the land uses permitted by the underlying land use designation in this Plan, permitted land uses that involve a significant drinking water threat within a WHPA identified in Schedule 'E' to this Plan may be either prohibited or regulated by the Long Point Region Source Protection Plan. 2.3.3.7 An application for development, redevelopment, or site alteration for any land use, except solely residential uses, within a WHPA that may involve a significant drinking water threat shall only be deemed complete under the Planning Act if the Risk Management Official has issued a Section 59 Notice in accordance with the Clean Water Act, 2006.The Risk Management Official may provide guidance to assist the Municipality in screening applications for development, redevelopment or site alteration. Add Section 4.2.5 4.2.5 Community Design The Municipality shall encourage development and redevelopment of lands, buildings, streets, and public spaces applying community design excellence, contributing to the quality of place for Bayham's residents. The following policies relate to the physical design of communities, including plans of subdivision, infill development proposals, and site plans. Through the development review process for all planning applications the Municipality shall: a) Ensure that new development is designed in keeping with the traditional character of Settlement Areas, in a manner that preserves the traditional image and enhances the sense of place in the Municipality; b) Promote efficient and cost-effective development buildings, landscapes and circulation design patterns that minimize land consumption; c) Promote the improvement of the physical character, appearance and safety of streetscapes, public spaces, and parks; d) Encourage tree retention and\or tree replacement on private and public lands; e) Encourage design that considers and integrates existing and traditional street patterns and neighbourhood structure; f) Encourage a high quality of architecture and site design for institutional uses such as schools, places of worship, libraries and other public service buildings; g) Encourage streetscaping that reflects the intended land use character of Settlement Areas and the specific land use designation; h) Encourage high quality of park and open space design. Land for parkland dedication shall be selected to facilitate its use as a central focal point for new or existing neighbourhoods; i) Encourage the provision of pedestrian, cycling and trail linkages through the development approvals process; and j) Encourage, at the Municipality's discretion, design guidelines with development applications, establishing how the policies of this Section have been considered and addressed. These guidelines shall be prepared by the applicant to address physical features including streetscaping, landscaping, setbacks, signage, garage placement, architectural treatment and related design matters. IBI GROUP ON BEHALF OF THE MUNICIPALITY OF BAYHAM 7 9. Add Section 4.7.1 4.7.1 Second Dwelling Units Up to one (1) second residential dwelling, being a self-contained unit, with kitchen and bathroom facilities, ancillary and subordinate to the primary dwelling unit, may be permitted within a single detached dwelling, semi-detached dwelling, or street row houses. Second units may include second suites, basement apartments, or accessory apartments. The second unit shall be located in a Settlement Area and on the same lot as the primary dwelling. It shall meet the following criteria: a) The exterior building or site changes to permit the second dwelling shall generally be less than 10% floor area increase, maintaining the general form and architectural character of the building. Additional on-site parking shall be required. b) Existing private and\or municipal sewage and water services shall be available to service the accessory residential dwelling unit, to the satisfaction of the Municipality and the Elgin St. Thomas Public Health as required. c) The second dwelling shall be incidental to the primary permitted residential use, is located within the primary residential building or an ancillary structure, where the gross floor area of the second dwelling is not greater than 40% of the combined total gross floor area of both the primary and second dwelling units. 10. Add Section 4.5.7.3 4.5.7.3 Council will encourage public service facilities to be co-located in the community hubs of the Villages of Port Burwell, Straffordville and Vienna to promote cost-effectiveness, facilitate service integration and access to active transportation. 11. Add Section 5.1.2.4 5.1.2 Municipal Sewage Services, Municipal Water Services and Stormwater Management 5.1.2.4 The Municipality may provide stormwater management infrastructure in the Village of Port Burwell in a manner that is viable, complies with all regulatory requirements and protects human health and the natural environment. Council shall encourage development which incorporates best management practices, including stormwater attenuation and re-use, and low impact development. IBI GROUP ON BEHALF OF THE MUNICIPALITY OF BAYHAM 8 12. Revise Section 5.1.4 5.1.4 Individual Services 5.1.4.1 The hamlets of Corinth, North Hall, Calton, and portions of Eden and Richmond are serviced by individual on-site sewage services and individual on-site water services. Any growth in these areas will be limited to infill development of a size and scale that complies with the requirements of the Zoning By-law and does not threaten the environment, human health and safety. 13. Revise Section 5.1.5 5.1.5 Partial Services (Water Only) 5.1.5.1 Portions of the Hamlet of Richmond have municipal water services and individual on-site sewage services (septic). 5.1.5.2 The Municipality will endeavour to extend municipal water services to partially serviced areas to allow for future multi-unit development and intensification opportunities. Such expansion will be done in a manner that is consistent with Section 5.1.2.3 of the Plan. However, nothing in this Plan shall be construed as a public commitment to extend municipal water services during the time framework of this Plan. 14. Add Section 6.1.11 6.1.11 Public Road Access 6.1.11.1 The Municipality is subject to significant shoreline erosion hazards and continues to lose tableland through this process along Lake Erie. Where existing opened municipal roads are in proximity to the shoreline, there is potential loss of public access when the road becomes unsafe for public use. This loss of access may remove access to private lands causing unreasonable hardship to land owners. The following policies provide an approach to address access to these private lands and to maintain public safety. 6.1.11.2 The Municipal Engineer shall monitor and assess the Lake Erie Shoreline erosion risk where the distance from the top of bank to the public right of way is 50 m or less. Where the assessment determines that the public road or public infrastructure in proximity to the top of bank is at risk of further erosion to a distance of 25 m or less, the Municipality shall close the road to public access to ensure safety and make any public infrastructure safe for public use. Council is under no obligation to address loss of public road access to private lands created by natural erosion processes along the Lake Erie Shoreline. IBI GROUP ON BEHALF OF THE MUNICIPALITY OF BAYHAM 9 6.1.11.3 Where the road is closed to public access the Municipality may undertake an assessment of the land owners affected by the road closure to determine the impact of the loss of the road for private access and the need to provide emergency services. The assessment shall include the number of properties affected and their assets; alternative methods of providing private access; the cost efficiency of the access; the desirability of replacing a public access and related land use planning matters. 6.1.11.4 Where Council deems it necessary to maintain public road access for public health and safety, Council may consider a wide range of methods to obtain and secure long term emergency access for these private lands. 6.1.11.5 Council shall notify the land owners affected by the closing of the public right of way and inform them of any assessments or report directed by Council, regarding the closing of road allowances or the creation of alternative access to their lands. 15. Add Section 6.3 6.3 Climate Change The Municipality recognizes the potential impacts of climate change on the built and natural environment. Through the following policies, the Municipality and the residents of Bayham will aim to conserve energy, reduce greenhouse gas (GHG) emissions, adapt to environmental changes and encourage the development of renewable energy sources. 6.3.1 Council may prepare and adopt a Municipal Energy Plan setting out targets to conserve energy and reduce overall energy consumption in the Municipality. Where new development or redevelopment is proposed, the Municipality will encourage the owners to use energy conservation measures in the orientation, design, construction and maintenance of the buildings or property. 6.3.2 Council may prepare and adopt a Local Action Plan setting out targets to reduce GHG emissions in the Municipality. This Plan will provide direction for the development or redevelopment of land or buildings to reduce the amount of GHG emissions. It is a policy of this Plan to consider actions related to buildings, outdoor areas and public and private transportation to support the achievement of GHG emission reduction targets. 6.3.3 Council will consider the increased risk associated with climate change related to intensity and volume of rainfall, increased intensity of weather events, fluctuation in temperature, and related weather changes when approving development applications or site alterations. Public works and infrastructure will be designed and built or rebuilt to adapt to the changing climate. 6.3.4 Council will encourage energy production technologies and form as set out in Section 5.3 Energy as an approach to reduce the GHG emissions in the Municipality. Add Section 7.1.5 7.1.5 Brownfields Redevelopment 7.1.5.1 Brownfields Objectives a) To improve the conditions of former contaminated industrial and commercial sites in the Municipality's hamlets and villages. b) To encourage the redevelopment of existing or vacant industrial and commercial lands to residential or commercial developments. c) To improve the overall attractiveness of industrial and commercial areas in terms of aesthetics and public amenities d) To prepare and implement design schemes and marketing of former industrial and commercial lands in the municipality. 7.1.5.2 Brownfields Criteria a) Areas of industrial or former industrial uses or commercial or former commercial uses in need of rehabilitation. b) A need for improvement to or extension of municipal services including water mains, sanitary sewers, storm drains, sidewalks, cycling lanes, curbs and gutters and related public infrastructure. c) A need for aesthetic improvements or beautification which may enhance the viability of the industries or commercial businesses in the area. 7.1.5.3 Brownfields Policies a) Council may by by-law adopt incentives for the redevelopment of brownfields sites. b) Incentives may include tax incentives, reduced development fees or other provisions in accordance with the Municipal Act. 17. Revise Section 8.5.1.1 8.5.1 Amendments 8.5.1.1 The Municipality may by by-law require a Pre-application Consultation meeting with an applicant prior to the submission of a complete land use planning application. The applications shall include any privately initiated planning application as provided for through the Planning Act. The purpose of the meeting is to identify the complete application requirements related to reports or background studies for land use planning matters to be addressed or considered through the land use planning application review process. IBI GROUP ON BEHALF OF THE MUNICIPALITY OF BAYHAM 11 18. Revise Section 8.5.1.2 8.5.1.2 The Municipality may require reports and background studies needed to make timely and informed decisions on all land use planning matters in accordance with the requirements of the Planning Act. Background studies may include but are not limited to: • Land use planning and design; • Environmental and natural heritage; • Natural hazards; • Transportation; • Municipal servicing and infrastructure; • Cultural heritage; and, • Other land use planning matters arising through the pre application consultation that are of public health and safety. These studies will address how the land use planning application fulfills the requirements of the Provincial Policy Statement 2014 and its updates and revisions; the County of Elgin Official Plan; the Bayham Official Plan; the policies and regulations of any public agency or body having an interest in the application. 19. Add Section 8.18, Relocate/Revise Section 4.5.8.7 8.18 Parkland Dedication In order to acquire and develop parks and open space areas, the Municipality shall require parkland dedication and cash-in-lieu of parkland in accordance with the following polices: 8.18.1 A dedication of five percent of the gross area of land proposed for development or redevelopment and/or a dedication rate of one hectare per 300 units or the equivalent cash-in-lieu, of the gross area of lands being subdivided for residential purposes. 8.18.2 A dedication of two percent of the gross area of land proposed for development or redevelopment or the equivalent cash-in-lieu, of the gross area of lands being subdivided for commercial and industrial purposes. 8.18.3 Where land in a draft plan of subdivision is to be used for any use other than residential, industrial or commercial purposes, Council may require conveyance of land for park purposes or equivalent cash-in-lieu at a rate of five percent (5%) of the gross area of the land proposed for development. IBI GROUP ON BEHALF OF THE MUNICIPALITY OF BAYHAM 12 8.18.4 The monies received from cash in lieu payments may be used to purchase park and open space areas elsewhere in the Municipality or, for any other public recreational purpose. 8.18.5 The Municipality may accept cash-in-lieu of the land dedication to be paid into a special account and used as specified in the Planning Act. Council will consider cash-in-lieu of parkland dedication under the following circumstances: a) where the required land dedication fails to provide an area of suitable shape, size or location for development as public parkland; b) where the required dedication of land would render the remainder of the site unsuitable or impractical for development; and/or, c) where it is preferable to have consolidated parkland of a substantial size servicing a wide area. 8.18.6 Where new development or redevelopment is proposed on a site, part of which has physical limitations or hazards, then such land shall not necessarily be acceptable as part of the land dedication under the Planning Act. All land dedicated to the Municipality shall be conveyed in a physical condition satisfactory to the Municipality, and shall meet minimum standards in terms of drainage, grading and general condition. 20. Add Section 8.19 8.19 Cash-in-lieu of Parking In order to acquire and develop public parking areas, The Municipality may accept cash-in-lieu of the provision of on-site parking into a special account and used as specified in the Planning Act. The monies received from cash in lieu payments shall be used to purchase public parking elsewhere in the Municipality or for any other public parking purpose. Council may consider acceptance of cash-in-lieu of vehicular parking under the following circumstances: a) Where the required provision of on-site parking is restricted or limited due to the available lot area, the shape, physical limitations of the land or the location of parking for the intended use; b) Where the required provision of on-site parking would render the remainder of the site unsuitable or impractical for development; and c) Where it is preferable and in the public interest to have consolidated publically accessible parking located elsewhere in the Municipality. The Chair gave his opening remarks and reviewed the guidelines and process to be followed for the hearing. Staff introduced Mr. Guidice and his agent, David Roe then proceeded to present the staff report. This application was received March 14, 2018 to construct a 10.9m x 3m enclosed porch and deck after construction had begun. The area requested for the construction is in the Lake Erie shoreline unstable slope and erosion hazard along Lakeshore Road and is contrary to the LPRCA shoreline policies. The structure affects the control of erosion in that it increases the potential for damage from slope instability and erosion. Therefore, staff recommended refusal. Mr. Roe stated that the porch is not physically connected to the cottage and will contain no heating or electrical wiring. He noted that the neighbouring structures were much closer to the top of bank and that Mr. Guidice made a mistake in starting the project without prior permission. Mr. Guidice mentioned that he spoke with staff in 2016 and was told that permission would not be granted for the proposed project. In order to work with the applicant, staff suggested an at-grade open deck that would not be attached to the building. Staff and the proponent responded to questions from the Board. There were no comments from other interested parties and no further questions. The Board moved into a closed session to discuss the matter further. As part of the new Conservation Authorities Act, each conservation authority's Administrative Bylaws must be in place by the end of December. Staff is participating in a working group to deal with the threat to Hemlock trees by the Hemlock Woolly Adelgid (HMA). CARRIED d) APRIL2018 FLOOD EVENTS CONDITIONS STATEMENTS There were two major flood events in April. A flood warning was issued April 3rd due to an expected significant surge on the lake leading to the highest levels seen since November 2015. The surge caused flooding and over-washing of roadways, the Port Dover pier was closed due to over-washing and there was lots of erosion damage reported. A few days later there was more erosion damage reported due to sustained south-west winds. Lake Erie water level is forecasted to remain high this summer. MOTION A-97/18 moved: W. Casier seconded: D. Please note that: The Safer Ontario Act, 2018, which creates, among other legislations, a new Police Services Act, 2018 (PSA 2018), received Royal Assent on March 8, 2018. Before the legislation becomes law, a collection of supporting regulations must be developed, so the Act can be ready for proclamation by the Lieutenant Governor. Until the PSA 2018 is proclaimed by the Lieutenant Governor, the existing PSA 1990 continues to apply. As of July 1st, 2018, Motor Vehicle Accident Reports (MVAR) to third party requestors (such as Insurance Services Bureau Canada) are to be directed to the Ministry of Transportation (MTO). The traffic reports are MTO documents that MTO is responsible to provide to third party requestors; the OPP is just assisting with completing them. As such, when the OPP created our internal collision reporting system the decision was made to return the responsibility for providing the requests to third party requestors back to MTO. As a result, the OPP Detachment administrative staff will resume fulfilling their main responsibilities of assisting officers, municipalities and civilian governance structures. This change in process will result in a reduction of the total revenue collected by the detachments on behalf of municipalities as these requests will no longer be processed by the OPP. Paper MVAR unit 4 and 5 provided basic information for the driver, which is now the "driver's " portion of the report. It can either be printed or emailed on eCRS to drivers involved in collisions at their request. Implementation of these recent projects and initiatives demonstrates once again our commitment to decreasing crime through reducing the number of calls for services and making our communities safer. Between now and the end of this year our bureau will continue develop innovative solutions designed to further streamline our operations and enhance municipal policing services offered to all OPP-policed municipalities. In fact, I believe that our ongoing efforts to continuously improve our services will be a never-ending quest. The deadline for this funding opportunity is July 26, 2018. The Community Accessibility Stream within the Enabling Accessibility Fund — Small Projects provides funding to eligible recipients for projects that improve accessibility in communities across Canada. Projects may include: • renovating, retrofitting or constructing community facilities where programs and/or services are or will be offered to people with disabilities; • retrofitting motor vehicles used as community-based transportation; and, • providing information and communications technologies for community use. DISCUSSION Capital Item FA-6 Straffordville Library Elevator is a strong, existing Capital Item, candidate for Council to consider making application for. The 2018 Capital Budget costing was $200,000. To make application to the program a Class 'A' Estimate from the Municipal Engineer would be required for the works which, given market conditions, may now be closer to $225,000. The Elgin County Library staff provided the following information to demonstrate the quality of application the Municipality may put forward considering services provided to the community: • The main floor of the Straffordville Library is 2,000 square feet, and comprises the collection, the circulation desk, accessible washrooms, and public access computers. This fills that square footage; therefore, the majority of programs, meetings, and training require the space which is available in the basement(2,000 square feet). • The basement area was improved in 2016 with the addition of some comfortable seating, a small fireplace, and historic photos of Straffordville, as well as painting one wall— to make a reading/discussion area. A children's area was also created by painting the end wall a contrasting colour, and adding some interesting wall features. As well, a large flat-screen TV was purchased to accommodate movie showings, and use by a local photography group. • However, the basement is accessible only by a flight of steep stairs—making it inaccessible for anyone in a wheelchair, and very difficult to access for someone with limited mobility. Because many of our programs occur in the basement, there are some patrons who are unable to attend those programs, or find it difficult to access the basement for the multiple uses that it accommodates. A couple of examples illustrate this: o In the spring of 2018, Straffordville Library partnered with Stonebridge Community Services of Tillsonburg to offer a course in Senior Chair Yoga. There were a dedicated group of participants, but some of them had difficulty in using the staircase to join the program. It is uncertain if there will be another program held here at this time— as the lack of accessibility was an issue. o In the fall of 2017, a class visit from Straffordville Public School came to take part in our programs celebrating Ontario Public Library Week. Because of the size of the class, and the activities involved, we used the basement for this occasion. One student was in a wheelchair— after some deliberation, it was decided to carry him down the stairs. Again, accessibility was an issue. • Apart from our programs which are held in the basement, it is also important to keep in mind the various community groups that use that space, such as the Photographers of Otter Valley, ASPIRE teachers and students, and Mennonite Community Services—Employment Services Outreach. These groups are also impacted by the lack of an elevator to access the lower level. • Below are overall statistics for 2016, 2017, and 2018 to date. Our attendance at programs increased from 2016 to 2017, and we should match or exceed those numbers for this year. Elgin County has requested the Municipality consider placement of an elevator in the facility as the facility is the second highest use library in Elgin County. The Municipality of Bayham has included this potential project in the Capital Budget. As noted above the facility offers a number of services and programs to the community. Further the above numbers do not include general library users which are in addition to the above noted statistics. Staff would propose making application for$100,000 from the Enabling Accessibility Fund — Small Projects with the remainder of the funding allocated from the Municipality within the 2019 Capital Budget from reserves and/or levy. RECOMMENDATION 1. THAT Report CAO-51/18 re Enabling Accessibility Fund —Small Projects be received for information; 2. Types of supported projects must achieve measured impact in the community. Specifically, the purpose of Ontario Trillium Fund Capital Stream is to: Enhance access to community spaces, programs, activities and services, and facilitate community members' full participation in the life of the community; ii. Promote energy efficiency and contribute to environmental outcomes by 'greening' community spaces; iii. Enhance and build community spaces that support Ontario Trillium Fund Priority Outcomes; iv. Enhance the efficiency and effectiveness of programs and make better use of technological resources. Grant amounts range from $5,000 to $150,000 with a project duration up to one (1) year. The Capital Stream deadline is August 15, 2018. DISCUSSION The Ontario Trillium Fund — Capital Stream program is historically significantly over subscribed, with projects that have strong performance metrics selected for approval. The assessment process is based on Strategy, Process, People, Infrastructure and Metrics: The project must align with one OTF Grant Result; ii. The idea, challenge or opportunity is clearly understood; iii. The activities and approach being used are appropriate for achieving the desired goals in a reasonable timeline; iv. Need for the initiative is understood; v. Competencies of the people involved aligns with the project objectives; vi. The project is appropriate, with reasonable costs. Based on the consideration of the above assessment criteria staff would respectfully recommend application under the `Active People' action area. Instead staff would respectfully recommend making an application for Capital Item PR-4 Port Burwell Shed — Pavilion Conversion Project. The proposed project includes removal of the existing structure, universal washroom, electrical, storage room and pavilion. To make application to the program a Class 'A' Estimate from the Municipal Engineer would be required for the works. The historical replacement cost utilized within the Capital Budget was $45,000 however given the cost to construct the Corinth Pavilion (2016-$20,000+HST), without demolition, electrical or a washroom the cost is expected to be significantly higher. Staff would recommend making application for $100,000 with the remaining costs, if any, allocated during the 2019 Capital Budget process. In 2017 the Municipality made application for Capital Item PR-10 East Pier Rehabilitation $150,000 including the following works: i. Concrete sidewall repairs (full depth) ii. Concrete edge repairs iii. HL3 asphalt overlay of pier deck iv. Dolphin (grouping of wood posts cabled together) removal v. Mooring bollard rehabilitation/replacement However, the Municipality was advised by the Ontario Trillium Fund that due to the subscription level of the program the Municipality would be unable to obtain the required grant metrics for said project. RECOMMENDATION 1. THAT Report CAO-52/18 re Ontario Trillium Foundation — Capital Stream be received for information; 2. AND THAT staff be directed to make application to the Ontario Trillium Fund — Capital Stream for the Port Burwell Shed — Pavilion Conversion as outlined within Report CAO 52/18. By-law No. 2018-056 -2 - A special equal rate sufficient to redeem the principal and interest on the debentures shall be levied upon the lands and roads as set forth in the attached Schedule "A"to be collected in the same manner and at the same time as other taxes are collected in each year for five (5) years after the passing of this by-law. 4. DEFINITIONS AND INTERPRETATION: The following words and expressions wherever used in this agreement shall have the meaning ascribed hereto: 1.1 "Chief Administrative Officer" and/or"CAO" means the Chief Administrative Officer/Clerk of the Municipality; 1.2 "Municipality" means the Corporation of the Municipality of Bayham 1.3 "Owners" means Gary Parker and Sandra Parker; 2 1.4 "Garden Suite" means a one-unit detached residential structure containing a bathroom and kitchen facilities that is ancillary to an existing residential structure and is designed to be portable 1.5 "Plan" means the Plans attached hereto as Attachment "A", and; 1.6 "Section", "subsection", "Paragraph" and "clause" means the specified section, subsection, paragraph or clause in this Agreement. 2. OWNERS' OBLIGATIONS 2.1 The Owners shall pay to the Municipality forthwith upon the execution of this Agreement all applicable Municipal fees for the establishment of the Garden Suite, including building permit fees. 2.2 Subject to the provisions of any By-laws enacted by the Municipality respecting the repair and maintenance of properties, the Owners shall repair and maintain the Garden Suite and the immediate site of the Garden Suite, at all times, to the satisfaction of the Municipality. 2.3 The location and structure of the Garden Suite shall be in accordance with the Building Permit issued to the Owners and the Owners agree not to make any structural changes to the Garden Suite and/or immediate site of the Garden Suite without the prior written approval of the Municipality and to enter into such amendments to this Agreement as the Municipality may require as conditions of approval of such changes. 2.4 The Owners agree that the sole occupant(s) of the Garden Suite shall be the person(s) listed below: 1. Mary Jane DeBoes, Mother/Mother-in-Law 2.5 It is hereby understood and agreed that the Municipality will have no responsibility to install any extension to municipal services or to provide for any connections to municipal services to the Garden Suite. 3. TERM AND TERMINATION 3.1 The Owners hereby agree the Temporary Use Zoning By-law Z676-2018 and this agreement to permit a Garden Suite will expire on June 7, 2028 (ten-year term). 3.2 If the Owners wish to extend the term of the Temporary Use By-law beyond the date set out at paragraph 3.1, above, they will apply to the Municipality, in writing, for an extension of the Temporary Use By-law not less than sixty (60) days before the expiration date set out at paragraph 3.1. The Owners agree to pay any and all municipal fees applicable to the application to extend the Temporary Use By-law. 3.3 If an extension of the Temporary Use By-law is granted, then this Agreement shall be deemed to continue on identical terms as set out herein, subject to any necessary modifications as to the term of the Agreement, unless and until a new Temporary 3 Use Garden Suite Agreement is reached by the parties and registered on title to the Lands or the Garden Suite is removed from the Lands and the Lands are remediated as described at paragraphs 5.1 and 5.2 of this Agreement. 3.4 This Agreement shall be terminated thirty (30) days after the earliest date of any of the following occurrences: i) When the Temporary Use By-law expires, ii) The Garden Suite is no longer occupied by the occupant(s) set out in paragraph 2.4 of this Agreement, or, iii) Upon the sale or transfer of the Lands. 4. DEPOSIT 4.1 The Owners shall supply the Municipality with a security deposit refundable upon compliance in the amount of Three Thousand Dollars ($3,000.00) for the removal of the Garden Suite and remediation of the Lands in accordance with paragraphs 5.1 and 5.2 of this Agreement. The deposit shall be in the form of a certified cheque, bank draft or cash. 4.2 The certified cheque or bank draft shall be: i) From a chartered bank ii) Expressed to be pursuant to this Agreement iii) Payable to the Municipality, and iv) Irrevocable 4.3 The deposit shall be provided at the time of signing of this Agreement and shall be retained by the Municipality until the Agreement is terminated. 5. REMOVAL OF THE GARDEN SUITE 5.1 The Owners agree to remove the Garden Suite from the Lands at their sole expense immediately upon termination of the Agreement. 5.2 The Owners agree to remove all services and facilities for the Garden Suite and to grade and landscape the site so that it is returned to pre-Garden Suite condition upon termination of the Agreement. 5.3 The Owners shall provide the Municipality with a signed Certificate of Compliance, attached hereto as Attachment "B", when the work described at paragraphs 5.1 and 5.2 of this Agreement has been completed. 5.4 Upon receipt of the Certificate of Compliance, the Municipality shall inspect the Lands and shall, if the work described at paragraphs 5.1 and 5.2 of this Agreement has not been completed to the Municipality's satisfaction: i) Perform such work as is required, ii) Once the Municipality is satisfied that the work described at paragraphs 5.1 and 5.2 of this Agreement has been completed, refund to the Owners the amount of the deposit paid pursuant to paragraph 4.1 of this Agreement less the 4 costs incurred by the Municipality in performing the work described at paragraphs 5.1 and 5.2 of this Agreement, and, iii) Once the Municipality is satisfied that the work described at paragraphs 5.1 and 5.2 of this Agreement has been completed, execute the Certificate of Compliance and provide the Owners with a copy of same; Or, if the work described at paragraphs 5.1 and 5.2 of this Agreement has been completed to the Municipality's satisfaction: i) Execute the Certificate of Compliance and provide the Owners with a copy of same, and, ii) Refund to the Owners the full amount of the deposit paid pursuant to paragraph 4.1 of this Agreement. 5.5 This Agreement cannot be transferred or assigned to subsequent owners of the Lands. 6. GENERAL 6.1 No amendment to this Agreement unless it is made in writing and executed by all parties hereto. 6.2 The Owners shall be jointly and severally liable with respect to the payment of any fee, cost or other payment due to the Municipality pursuant to this Agreement.
