Application A-04/18, Abe and Charlotte Wall COMMITTEE MEMBERS PRESENT: STAFF PRESENT: CAOICLERK SECRETARY/TREASURER SIGNED IN ATTENDEES: None CALL TO ORDER PAUL ENS TOM SOUTHWICK RANDY BREYER WAYNE CASIER ED KETCHABAW PAUL SHIPWAY MARGARET UNDERHILL Secretary/Treasurer M. Underhill called the meeting to order at 8:00 p.m. and asked for those in attendance for this meeting to sign in at the podium. 2. APPOINTMENT OF CHAIRMAN Moved by: P. Ens Seconded by: W. Casier THAT Tom Southwick be appointed Chairman of the Committee of Adjustment for consideration of Minor Variance Application A-04/18 submitted by Abe and Charlotte Wall. CARRIED 3. DISCLOSURES OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF No disclosures of pecuniary interest were declared. 4. APPLICATIONS A. Minor Variance Application A-04/18, Abe and Charlotte Wall Request to grant relief from the Zoning By-law regulations Section 24.6 for front yard depth of 10.6 m (35 feet) whereas 15.0 m (49 feet) is the required minimum; Section 24.8 for rear yard depth of 0.6 m (2 feet) whereas 4.0 m (13 feet) is the required minimum; Section 4.22.1 b) for setback from the centre line of the right-of-way of a County road of 20.0 m (65 feet) 2018 Committee of Adjustment Minutes May 17, 2018 whereas 26.0 m (85 feet) is the required minimum; and Section 4.32.2 parking required for a nursing home of six (6) spaces whereas ten (10) spaces are required. The variance is needed to permit a rest home in the Institutional (1) Zone in an existing building located on the east side of Plank Road and north side of First Street known as 9344 Plank Road. 5. STAFF PRESENTATION A. Staff Report DS -34/18 by Margaret Underhill, Secretary/Treasurer Committee of Adjustment re Committee of Adjustment — Minor Variance — A-04/18, Wall, A & C Secretary/Treasurer M. Underhill presented Report DS -34/18 and advised one public submission was received in support of the application. 6. PRESENTATIONS BY APPLICANT/AGENT 7. PUBLIC SUBMISSIONS One piece of written correspondence was received in support of the application 8. COMMITTEE QUESTIONS AND DISCUSSION P. Ens inquired if additional parking may be a concern of the potential purchaser. M. Underhill replied additional parking may be investigated by the purchaser through expansion of the existing parking on the south side and/or a lease agreement with the Municipality and if so, would be considered under site plan. 9. DECISION OF COMMITTEE (Motions) Moved by: P Ens Seconded by: E. Ketchabaw THAT the Committee of Adjustment Secretary -Treasurer's report DS -34/18 regarding the Wall minor variance be received; AND THAT the Committee of Adjustment considered all written and oral submissions received on this application, the effect of which helped the committee to make an informed decision; AND WHEREAS the Committee agrees that the proposed variances meet Section 45.1(1) of the Planning Act and the variances are considered minor; THEREFORE application A-04/18 submitted by Abe and Charlotte Wall, pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law Z456-2003: 0 Section 24.6 Minimum Front Yard Depth of 10.6 m (35 feet) whereas 15.0 m (49 2018 Committee of Adjustment Minutes May 17, 2018 feet) is the required minimum Section 24.8 Minimum Rear Yard Depth of 0.6 m (2 feet) whereas 4.0 m (13 feet) is the required minimum Section 4.22 Minimum Setback from Arterial Roads (Streets) Subsection 4.22.1 b) County Road: Setback from centre line of the right-of-way of a County Road of 20.0 m (65 feet) whereas 26.0 m (85 feet) is the required minimum, and; Section 4.32.2 Parking required for a Rest Home of six (6) spaces whereas ten (10) spaces are required To permit a change of use in the Institutional (1) Zone for an existing building from a municipal office to a rest home for seniors with 16-20 beds and common kitchen, dining and recreation facilities. CARRIED 10. ADJOURNMENT Moved by: W. Casier Seconded by: R. Breyer THAT the Committee of Adjustment hearing for consideration of Minor Variance Application A- 04/18 be adjourned at 8:12 p.m. AND THAT in accordance with the regulations of the Planning Act, Notices of Decision be circulated by the Secretary/Treasurer accordingly.
