Therefore the Council of the v I `U5 o[ Po�� �N
hereby enacts as follows:
1. The Head and the Treasurer are hereby authorized on behalf of the Municipality to
borrow from time to time by way of promissory note from CANADIAN IMPERIAL BANK
• OF COMMERCE a sum or sums not exceeding in the aggregate $
to meet until the taxes are collected the current expenditures of the Municipality
for the year, including the amounts required for the purposes mentioned in subsection
(1) of Section 332 of the Municipal Act, and to give on behalf of the Municipality
to the Bank a promissory note or notes sealed with the Corporate Seal and signed by
the Head and Treasurer for the moneys so borrowed, with interest at such rate
as may be agreed upon from time to time with the Bank.
2. All sums borrowed pursuant to the authority of this by-law, as well as all other sums
borrowed in this year and in previous years from the said Bank for any or all of the
purposes mentioned in the said Section 332, shall, with interest thereon, be a charge
upon the whole of the revenues of the Municipality for the current year and for all
preceding years as and when such revenues are received.
3. The Treasurer is hereby authorized and directed to apply in payment of all sums
borrowed as aforesaid, together with interest thereon, all of the moneys hereafter
collected or received either on account or realized in respect of taxes levied for the
current year and preceding years or from any other source which may lawfully be
applied for such purpose.

BY-LAW NUMBER 92-02
Being a by-law to execute a lease between the
Corporation of the Village of Port Burwell and
345990 Ontario Limited.
Whereas the Corporation of the Village of Port Burwell is desirous
of leasing vacant land known as part 7, 8. 9, on plan 11R990 from
:345990 Ontario Limited.
Whereas the attached lease marked appendix A-1 forms part of this
by-law.
The Reeve and Clerk are authorized to sign the lease as shown on
appendix A-1.
The Treasurer is authorized to pay over the required lease payments
on or before October 1 of each year.
This by-law comes into full force and effect on date of passing.

THE Lessee covenants that he is the sole owner of all goods and chattels that are to be
brought upon the premises, and that they are free from any mortgage, lien or other
charge.
PROVIDED that the Lessee may remove his fixtures if all rent due hereunder has been
paid.

PROVIDED that, in the event of the destruction or partial destruction of the said
premises, the Lessor may declare the term hereby granted to be forthwith terminated,
and In such event rent shall be payable up to the time of such destruction or partial
destruction.
PROVIDED also that during the last two months of the said term any stralteer or
strangers may inspect the said premises, on tiny day except Sunday, on producing a
written order to that effect signed by the Lessor.
PROVIDED that the Lessor may place upon the said premises at any time during the said
term a notice that the said premises are for sale, and within two months prior to the ter-
mination of the said term may place a notice on the said premises that they are to be let,
and the Lessee agrees that he will not remove such notices, or permit them to be removed.

said premises, or which may cause any increased or additional premium to be payable
for any such insurance.
THE Lessee shall not allow any ashes. refuse, garbnge or other loose or objectionable
material to accumulate in or about the building, ynrds or passages of the snid premises,
and will at all times keep the said premises in clean and whnlesome condition, rend-, 1 11,

THE Lessee covenants that he will keep the sidewalks in front and at the sides of the said
premises free of snow and ice; and that the Lessee shall not, during the said term, injure
or remove any shade trees, shrubbery, hedges or other tree or plant which may be in, upon
or about the said premises, and that he will keep in good condition the boulevard and
other sodded spaces abort the said premises.
PROVISO for re-entry by the said Lessor on non-payment of rent or non-performance of
covenants.
PROVIDED also that in the case of a seizure or forfeiture of the said term for any of the
causes herein set forth, the Lessor shall have the same right of re-entry as is given under
the next preceding proviso.
PROVIDED that notwithstanding anything herein contained the Lessor's right of re-
entry hereunder for non-payment of rent or non-performance of covenants shall become
exercisable immediately upon default being made.
THE said Lessor covenants with the said Lessee for quiet enjoyment.
IN consideration of the foregoing and of the leasing and letting by the Lessor to the
Lessee of the premises hereby demised for the term hereby granted (and it is upon that
express understanding that this indenture is entered into), the Lessee hereby covenants
and agrees with the Lessor that notwithstanding anything in Section 30 of Chapter 212
of the Revised Statutes of Ontario 1980, or in any other section of the said Act, or in any
other Act now in force or which may hereafter be passed, none of the goods or chattels of
the Lessee on the said premises at any time during the continuance of the acid term shall
be exempt from levy by distress for rent in arrear by the Lessee as provided for by any Act
above referred to, and that upon any claim being made for such exemption by the Lessee,
or on distress being made by the Lessor, this covennnt and agreement mny be pleaded as
an estoppel against the Lessee in any action brought to test the right to the levying upon
any such goods as are named as exempted in any Act above referred to, the Lessee waiving,
as he hereby does, all and every benefit that could or might have accrued to him under
and by virtue of any such Act but for the above covenant.
AND it is hereby agreed between the parties hereto that should the Lessee remain in
possession of the said premises after the determination of the term hereby granted,
without other special agreement, it shall be as a monthly tenant only, at a rental of
E 100.00 per month, payable in advance on the f 1 r 5 t day of every
month, and subject in other respects to the terms of this lease.

Schedule "A" attached hereto forms part of this lease.
IT 1S agreed between the parties hereto that every covenant, proviso and agreement
herein contained shall enure to the benefit of and be binding upon the parties hereto, and
their heirs, executors, administrators, successors and assigns, and that all covenants
herein contained shall be construed as being joint and several, and that when the context
so requires or permits the singular number shall be read as If the plural were expressed,
and the masculine gender as if the feminine or neuter, as the case may be, were expressed.

1. INSURANCE
The Lessee shall take out and maintain, with
respect to the premises and the Lessees use thereof,
insurance policies of all risk, earthquake, flood
and public liability coverages up to such limits
as the Lessor may from time to time reasonably determine
and will provide certified copies of such policies
to the Lessor.
2. INDEMNIFICATION BY LESSEE
The Lessee shall indemnify and save harmless
the Lessor from any and all liabilities, damages,
costs, claims, suits or actions growing out of:
(a) any breach, violation or non-performance
of any covenant, condition or agreement in this
lease set forth and contained on the part of
the Lessees to be fulfilled, kept, observed
and performed, and
(b) any damage to property howsoever occasioned
by the use and occupation of the Demised Premises
and Complex or of the buildings, structures,
improvements, fixtures, equipment, machinery
and facilities comprised therein and any injury
to any person or persons, including death resulting
at any time therefrom, occurring in or about
the Demised Premises and Complex or any building,
structure, improvement, fixture, equipment,
machinery or facility comprised therein and
arising from or occasioned by any cause whatsoever,

and such indemnification in respect of any such
breach, violation or non-performance, damage to
property, injury or death occurring during the Term
shall survive the termination of this Lease, anything
in this Lease to the contrary notwithstanding.
If the Lessor shall be made party to any litigation
commecned by or against the Lessees, then, unless
in such litigation or otherwise it shall be established
that the Lessor was solely at fault, the Lessees
shall protect, indemnify and hold the Lessor harmless
and shall pay all costs, expenses, and reasonable
legal fees incurred or paid by the Lessor in connection
with such litigation. The Lessees shall also pay
all costs :xpenses and legal fees (on a solicitor
and his client basis) that may be incurred or paid
by the Lessor in enforcing the terms, covenants
and conditions in this Lease.
3. TERMINATION
This Lease may be terminated prior to the expiry
of the terms by either party by the giving of Thirty
(30) days written notice, effective on the date
delivered, at the following addresses:

A By -Law of the Corporation of the Village of Port
Burwell to amend zoning By -Law 91-03 which
regulates the use of land and the character, location
and use of buildings and structures in the Village of
Port Burwell
WHEREAS The Council of the Corporation of the Village of Port Burwell deems it advisable to
amend By-law 91-03 in accordance with the provisions of Section 34 of the Planning Act, 1983:
NOW THEREFORE The Council of the Corporation of the Village of Port Burwell enacts as
follows:
SECTION 1
Application
1.1 Section 2.1 of this By -Law shall apply to those lands shown on Schedule "A" attached hereto.
Schedule "A" forms part of this by-law.
SECTION 2
Amendment
2.1 By -Law 91-03 is hereby amended by as shown on Schedule "A" attached hereto to rezone
affected property from Mobde Home Residential (R4) to a Residential Zone (R2).

A By -Law of the Corporation of the Village of Port Burwell to amend Zoning
• By -Law 91-03 which regulates the use of land and the character, location
and uae of buildings and structures in the Village of Port Burwell.
WHEREAS The Council of the Village of Port Burwell deems it advisable to
amend By -Lain 91-03 in accordance with the provisions of Section 34 of the
Planning Act, 1981
NOW THEREFORE the Council of the Corporation of the Village of Port Burwe!!

Being a By-law to amend by-law 88-20 a subdivision
agreement with Anthony and Grace Lama.
WHEREAS the Planning Act. 1983 allows municipalities to enter into
subdivision agreements:
WHEREAS Anthony and Grace Lama have re -zoned a portion of the "Grace
Court" (property on the east side of Elizabeth south of Wellington for use of
permanent mobile homes and modular homes) from R-4 Mobile Homes
Residential to R-2 Single Family Residential: By-law 88-20 is hereby
amended to include the following:
(1) Subdivision Agreement Section 3 Maintenance and Repairs New Clause
3.5
An appropriate notice be placed on title for each lot zoned R-2 fronting onto
Grace Court, to inform potential purchasers that owners of each lot are
responsible for road and water/sewer maintenance on a pro -rated basis.
Grace Court is a private street.

Being a by-law to set renumeration
of the Reeve and Council and to
provide for the paying of expenses
WHEREAS; The Municipal Act, R.S.O. 1980, Section 238 permits Council to
pass a by-law for paying of renumeration to a member of Council and such
renumeration may be determined in any manner that Council considers
advisable.
AND WHEREAS; Section 239 of the said Act permits council to pass a by-
law to set maximum amounts or rates that may be paid in respect of
expenses.

NOTWITHSTANDING; the foregoing, if attendance by the Reeve or a councillor at
a meeting requires time off work, renumeration shall be on the basis of a full
meeting regardless of the actual time spent in attendance at the meeting.
PRIOR; approval by Council to attend meetings other than regular Council and
special meetings is recommended. Prior approval may not be possible do to the
scheduling of regular Council meetings. The Reeve or Councillor will attend the
meeting and report to the Treasurer their attendance. The Treasurer will keep a
record of all these meetings and at the beginning of each month will submit to
the Reeve and Councillors a list of all meetings that are attended, subject matter
and who attended. This will also include meetings the Administrator/ Clerk/
Treasurer attended.
AND FURTHERMORE; to be paid for a regular or special meeting the Reeve and
Council must be in attendance at the meeting. A "special meeting" is defined as a
meeting of Council other than a regular meeting, called pursuant to section 57,
subsection 2 of the Municipal Act.
AND FURTHERMORE; Council pay will be quarterly.
AND FURTHERMORE; expenses incurred by a member of Council while attending
such conferances, courses, conventions or other functions as are approved by
resolution of Council shall be reimbursed in amountsand at such times as Council
may by resolution determine.
AND FURTHERMORE; automobile expenses incurred by members of Council,
officers and servants of the municipality as a result of their acting either within
or outside the municipality as members of Council, Officers or Servants shall be
repaid at the rate of $0.31 per km travelled.
AND FURTHERMORE; be it enacted that while on the municipality's business, that
a meal allowance be provided to be no more than $35.00 for each 24 hour period
providing that the time on business has been more than 12 hours. A proper
• invoice must be provided to the Treasurer.

THE FIRE DEPARTMENT TO CARRY OUT RESCUES
WHEREAS 'Ibe Municipal Act provides that the Council may
establish regulations for a fire department.

AMENDMENT NO. 3 TO THE OFFICIAL PLAN FOR THE CORPORATION OF THE
VILLAGE OF PORT BURWELL
PART A - THE PREAMBLE
1) PURPOSE:
The purpose of this amendment is:
a) to change the land use designation of certain lands, as shown on Schedule "A"
attached, from "Commercial" (C) and "Residential" (R) to "Multi -Family
Residential (RMF)"; and
b) to change the maximum density allowed for townhouse projects in the "RMF„
designation from 30 units per hectare to up to 35 units per/hectare.
• 2) LOCATION:
This amendment consists of two parts, as follows:
Part A: The lands affected by this redesignation front onto the east side of County
Road # 42 at the north edge of the Village, as shown on Schedule "A" attached.
Part B: Policy 3.3.4 of the Official Plan for the Village of Port Burwell will be
amended to permit townhouse development at 35 units/hectare.
3) BASIS
The lands affected by this amendment are currently designated "Commercial" and
"Residential" on Schedule "A" of the Village of Port Burwell Official Plan. At the
time the Official Plan was prepared, the landowner was proposing a draft plan of
subdivision that included three Commercial Blocks and lots for single detached
dwellings. The Village Council supported that proposal as the site has excellent
visibility and accessibility from County Road # 42, very important to the viability of
commercial properties.
At that time, the extent of the potential for new commercial growth in the downtown
• and on the proposed marina lands at the Village's "east beach" had not been fully
considered.

A developer for the marina had not been selected and the Village's Tourism and Recreation
Study had not been completed. In addition, Village Council wanted to ensure that there
would be an ample supply and wide variety of commercial sites available in the Village to
potential merchants.
The recent development proposal for the east beach area and completion of the Tourism
and Recreation Study have shown the most appropriate location and greatest potential for
retail growth in the Village is in the downtown area. Development of commercial facilities
at the "gateways" or entry points to the Village may not be a viable short term development
option and may only serve to divert attention from the development and redevelopment
potential in the downtown.
While some commercial development potential may still exist along County Road # 42 and
Chatham Street, this potential is considered long term and dependent upon residential and
• seasonal residential development in that area. In addition, Council supports promotion of
commercial growth in the downtown area.
Recognizing these changing conditions, the landowner requested that Council consider a
land use designation change to permit medium density development instead of Commercial
uses. To date, the landowner has proposed a change to an earlier draft plan approved
subdivision to permit row townhouses along a public street. To better reflect the draft plan
proposal, a portion of the area designated "Residential" must also be redesignated to "Multi -
Family Residential". As this proposal would be compatible with the single detached housing
already proposed for this subdivision, Council feels that a change to the Official Plan to
accommodate townhouses is appropriate.
PART B - THE AMENDMENT
All of this part of the document entitled Part B - The Amendment, consisting of the
following text and attached map designated Schedule "A" (Land Use Plan) constitutes
Amendment No. 3 to the Official Plan for the Village of Port Burwell.
The Official Plan is amended as follows:
Part A: The area indicated on the attached Schedule "A" of the Official Plan is
hereby redesignated from "Commercial" and "Residential" to "Multi -Family
• Residential".

Part B: Section 3.3 (Multi - Family Residential) is hereby amended by deleting
Section 3.3.4 and replacing it with the following:
3.3.4 - In the Multi -Family Residential designation, apartments are permitted to a
maximum net density of 75 units per hectare. All other permitted uses may be
developed to a maximum net density of 35 units per hectare.
All multi -family uses shall be serviced with municipal water and sewer services.
IMPLEMENTATION AND ADMINISTRATION
The implementation and administration of this Amendment shall be in accordance with the
respective policies of the Village of Port Burwell Official Plan.

commercial growth in the downtown area.
Recognizing these changing conditions, the landowner requested that Council consider a
land use designation change to permit medium density development instead of Commercial
uses. To date, the landowner has proposed a change to an earlier draft plan approved
subdivision to permit row townhouses along a public street. To better reflect the draft plan
proposal a portion of the area designated "Residential" must also be redesignated to "Multi -
Family Residential". As this proposal would be compatible with the single detached housing
already proposed for this subdivision, Council feels that a change to the Official Plan to
accommodate townhouses is appropriate.
PART B - THE AMENDMENT
All of this part of the document entitled Part B - The Amendment, consisting of the
following text and attached map designated Schedule "A" (Land Use Plan) constitutes
Amendment No. 3 to the Official Plan for the Village of Port Burwell.
The Official Plan is amended as follows:
Part A: The area indicated on the attached Schedule "A" of the Official Plan is
hereby redesignated from "Commercial" and "Residential" to "Multi -Family
Residential".
Part B: Section 3.3 (Multi - Family Residential) is hereby amended by deleting
Section 3.3.4 and replacing it with the following:
3.3.4 - In the Multi -Family Residential designation, apartments are permitted to a
maximum net density of 75 units per hectare. All other permitted uses may be
developed to a maximum net density of 35 units per hectare.
All multi -family uses shall be serviced with municipal water and sewer services.
IMPLEMENTATION AND ADMINISTRATION
The implementation and administration of this Amendment shall be in accordance with the
respective policies of the Village of Port Burwell Official Plan.

BY-LAW 92-14
Being a by-law to authorize
the sale of land.
WHEREAS under Section 316 of the Municipal Act, being Chapter 302:
The Council of the Corporation of the Village of Port Burwell enacts as
follows;
Whereas the four abutting landowners have been offered the opportunity to
purchase the road allowance and two owners have declined the road
allowance shall be sold to the two interested parties.
All and singular that part of George Street, an unopened road allowance, in
the Village of Port Burwell, (See Schedule A) be sold to the following:
Parts 1 and 5 to Leonard Bastien and Gwendolyn Bastien
• Parts 2, 3 and 4 to Judy Thorton and Scott Wistow
in accordance with the agreements of purchase and sale.
And that the Reeve and the Clerk are hereby authorized to execute such
documerts as may be necessary therefore, and attach the Corporate seal
thereto. This by-law comes into force and effect on day of passing.

• AND WHEREAS The Education Act, 1974 provides that the rate to
be levied on residential and farm assessment in each year shall be
eighty-five (85%) per cent of the rate to be levied on commercial,
industrial and business assessment;
NOW THEREFORE THE COUNCIL OF THE VILLAGE OF PORT BURWELL ENACTS AS
FOLLOWS:
1. The estimates of the Corporation of the Village of Port
Burwell for the year 1992 be and they are hereby adopted and
attached as schedule "A";
2. The sums to be raised by means of taxation for the year 1992
be as follows, subject to the adjustments are by law required
to be made:
(a) For general municipal purposes, -a sum of 324779 such amount
to be reduced by a sum of 153,700 representing the
municipality's share of the 1992 resource equalization grant
payment under The Ontario Unconditional Grants M.T.O. - Act,
1975; and further reduced by a sum of 4079 representing the
municipality's share of that telephone and telegraph gross
receipts payable under section 161 of The Municipal Act: and
further reduced by a sum of 22,500 representing the
• municipality's share of payments - in - lieu of taxes from all
sources payable during the year; and final' .y reduced
(increased) by a sum of any available surplus (deficit) from
any previous year in respect of general yielding a net levying
for general municipal purposes of 144,500 which includes
2,020 for Long Point Conservation Authority
(b) For County purposes, a sum of 68,367 as requisitioned by the
County of Elgin, such amount to be reduced by the sum of
2004 representing the County's share of that portion of
telephone and telegraph gross receipts payable under section
161 of The Municipal Act; and further reduced by the sum of
....... representing the County's share of payments - in -lieu of
taxes from all sources payable in the year; and finally
reduced (increased) by a sum of ....

4. In addition to the rates and taxes authorized to be levied
pursuant to clause 2 of this by-law, all other municipal local or
direct taxes, rates and charges, the collection of which is the
responsibility of the collected in the manner directed and
authorized by the provisions of any General or Special Act of by-
law of the municipality.
The local improvements to be collected are to include water
frontages, water connections and sewer connections.
The taxes shall become due and payable on the 30 day of June, 1992,
but may be paid in instalments on the 31 day of March, 1992, the 29
day of May, 1992, the 31 day of July, 1992 and the 30 day of
f
• September provided that upon failure to make payment on any
instalment date, the whole amount shall become due and payable
forthwith.
There shall be imposed a penalty for non-payment for taxes on due
date of any instalment thereof, the amount of 1 1/4% of the amount
due and unpaid on the first day of default, and an additional
penalty of 1 1/4% shall be added on the first day of each calender
month thereafter in which default continues, but not after the end
of the year in which the taxes are levied.
That where any taxes or other rates remain due and unpaid after the
31st day of December in the year in which they were levied, there
shall be added thereto interest at a rate of 1 1/4% per month or
faction thereof until the said taxes and rates are paid.
The Collector is hereby authorized to mail or cause to be mailed
the notice of taxes due to the address of the residence or place of
business of the person to whom notice is required to be given.
All taxes shall be paid into the Office of the Treasurer or at the
Canadian Bank of Commerce, Port Burwell, pursuant to Section 386
(8) of The Municipal Act.
• Where a tenant of lands, owned by the Crown or in which the Crown
has an interest, has been employed either within or outside the
municipality by the same employer for not less than 30 days, such
employer shall pay over to the Collector on demand out of any
wages, salary, or payable for taxes under this by-law and such
payment shall relieve the employer from any liability to the
employee for the amount paid.
The Collector and the Treasurer are hereby empowered to accept
part -payment from time to time on account of any taxes due. All
collections are to be applied first to interest and penalty.
Secondly, to outstanding work orders and utility collections placed
on the roll, and finally, to principal tax amounts most outstanding
year.
This by-law shall come into effect upon the date of its final
passing.

BY-LAW 92-16
A By-law to exempt from Part Lot Control
Whereas pursuant to Subsection 50 (7) of the Planning Act, R.S.O. 1990 and pursuant to
the request from Mario Chirico, it is expedient to exempt the proposed 9 lots with frontage
along Brock Street, Part 1 thru 21, Lot 11, Plan 12, Village of Port Burwell
from Part Lot Control;
1. Part 1 duu 21, Lot 11, Plan 12, in the Village of Port Burwell and County of Elgin,
are hereby exempted from Part Lot Control, pursuant to Subsection of the Planning
Act, R.S.O. 1990, which lands are zoned to permit commercial buildings in conformity
with C-3 zoning of the Village of Port Burwell Zoning By-law 91-03, covering the
subject area.
2. This by-law comes into force when approved by the Ministry of Muncipal Affairs.

By -Law 92-17
Being a By -Law to allow
temporary use at the Northwest corner of
Hagerman and Erieus St.
WHEREAS, the Council of the Village of Port Burwell has the authority
under the Planning Act 1983 to pass temporary use by-law.
Therefore, the Council passes the following:
1. Location Northwest corner of Hagerman
and Erieus St.
2. Permitted Use Season Residential - to allow the
placement of three temporary
structures.
3. Term
4. Conditions

Development Agreement entered into between Mario
Chirico and the Village of Port Burwell. The agreement
will deal with such items as but not limited to
a) The Waterfront Development Project
b) Water and Sewer connections
c) Use of Hagerman St. for parking and access.
In addition $500 will be deposited with the Village to
cover legal fees. The $500 is not inclusive and any costs of
above $500 will be paid by Mario Chirico and any unspent
funds under $500 will be returned to Mario Chirico.
2. Such plans as may be required by the Municipality and the
Long Point Region Conservation Authority, must be
prepared in a form acceptable to the Municipality and the
said Conservation Authority and be approved in writing by
the Municipality and Conservation Authority. If required
by the Municipality and said Conservation Authority. said
plans shall be prepared by a member of the associations of
professional engineers of Ontario. The owner covenants
and agrees that upon approval of the plans set out (above).
the owner shall carry out all works shown on said plans in
accordance with said plans at his own expense.
3. All fines and building permit fees must be paid prior to the
issuance of a building permit.
Season Residential Use shall mean providing lodging to the travelling
public.
This by-law comes into force and effect when the above 3 conditions
have been compiled with.

Being a By -Law to authorize the purchase C. P. Rail land
WHEREAS, pursuant to the Municipal Act 1980 chapter 302
section 208 and 210 the Council of The Village Of Port Burwell
deems it expedient to purchase the Canadian Pacific Limited
land within the Village limits and the land situated in Bayham
Township from the Village boundary to Highway 19.
Council hereby authorizes the following:
(1) Council authorizes the purchase of said land Schedule A & B for
the amount of $110.000 plus closing costs.
(2) The Reeve and the Clerk are hereby authorized to sign the

WHEREAS, pursuant to the Municipal Act 1980 chapter 302
section 208 and 210 the Council of The Village Of Port Burwell
deems it expedient to purchase a portion of the federal waterlot
situated in the Township of Bayham and associated land in the
Village of Port Burwell.
Council hereby authorizes the following:

the department of public works. Government of Canada.

BY-LAW
THE CORPORATION OF THE VILLAGE OF PORT BURWELL
A BY-LAW OF THE CORPORATION OF THE VILLAGE OF PORT BURWELL TO AMEND
ZONING BY-LAW NO. 91-03 WHICH REGULATES THE USE OF LAND AND THE
CHARACTER, LOCATION AND USE OF BUILDINGS AND STRUCTURES IN THE VILLAGE
OF PORT BURWELL.
BY-LAW NO. 92 - 22
WHEREAS the Council of the Corporation of the Village of Port Burwell
deems it advisable to amend By-law No. 91-03 in accordance with the provisions
of Section 34 of the Planning Act, 1983;
NOW THEREFORE the Council of the Corporation of the Village of Port
Burwell enacts as follows:
SECTION 1
Application
1.1 Section 2.1 of this By-law shall apply to the text of By-law No. 91-03.
• 1.2 Section 2.2 of this By-law shall apple to Schedule 'A' of By-law No. 91-03.
Schedule "A-1" attached hereto forms part of this by-law.
SECTION 2
Amendment
2.1 Amendments to tent of By-law No. 91-03
2.1.1 By-law No. 91-03 is hereby amended by deleting Section 2.137 and
replacing it with the following:
2.137 TOURIST COMMERCIAL ESTABLISHMENT, shall mean s use
or establishment which provides goods, entertainment,
recreation, lodging or meals to the vacationing public,
including, but not so as to limit the generality of the
foregoing, an indoor or outdoor theatre, private or
public recreation facilities, bingo hall. Ontario
Government approved casino, convention facilities,
restaurant, hotel, motel, health club, lounge, bar, and
coffee shop. It is the intent of this definition to allow
development of a tourism complex within which any of
the above -noted uses may be permitted. This may also
include other uses not specifically identified in this
definition, provided these other uses provide goods,
entertainment, recreation, lodging or meals to the
vacationing public.

2.1.2 By-law• no. 91-03 is hereby amended by adding the following as Section
4.42:
"4.42 Bonus Provisions
Notwithstanding the regulations that apply to a lot for height,
density, minimum landscaped area and maximum Floor Area Ratio
(FAR), these regulations may be modified in accordance with special
bonus provisions, as identified below:
a) The accumulative impact of these provisions shall result in no
more than a density of 150 units/hectare for residential uses
and a Floor Area Ratio of 2:1 for non-residential uses.
b) For every 1% of public open space/parkland or cash -in -lieu in
excess of 5% that is dedicated to the municipality, 10
units/hectare in increased density or .1 Floor Area Ratio (FAR)
may be awarded up to a maximum increase of 30 units/hectare
or .3 FAR.
c) Height may be increased to up to 10 storeys, provided the
buildings do not exceed a height equivalent of 6 storeys above
the top of the cliff at the east beach. If there is dispute
regarding the elevation of the top of the cliff, the elevation
at the approximate centre point of the intersection of Brock
Street and Erieus Street shall be used as the benchmark. To
• obtain this bonus, a specific site plan proposal must be
presented at a public meeting for public review and comments.
These comments may be used by Council to guide its final
decision on the site plan proposal.
d) For every 5% of landscaped area provided on the development
site in addition to the minimum requirement identified, up to
5 units/hectare or 0.05 FAR may be awarded in increased
density up to a maximum of 20 units/hectare or 0.2 FAR.
e) If a parking structure is required, up to 10 units/hectare in
increased density or 0.1 FAR may be awarded if the parking
is provided underground or the parking structure, excepting
ingress and egress points, is hidden from view from public
streets and public open space.
f) If building height is less than the maximum allowed, up to 5
units/hectare in density or 0.05 FAR may be awarded for
every storey less than the maximum allowed, up to a maximum
of 20 units/hectare or 0.2 FAR. This provision is only to be
applied when the building height is reduced from the maximum
identified for the relevant zone. It is not intended for
application in conjunction with Part (c) of this section.
These "Bonus Provisions" have been formulated specifically for
application in the "Special" Tourist Commercial Zone (C2-1) for
the Marina Complex at the east beach. However, Council may
consider application of these "Bonus Provisions" in other
• zones based on the merits of each application and the
relevance of these provisions to the site and its particular
zoning.

These provisions are not intended to be "as of right"
regulations. They are tools available to Council to negotiate
overall improvement to development proposals. Council should
be satisfied that granting density increases to the project will
enhance the proposal, the area around the site, and the
Village."
2.1.3 By-law No. 91-03 is hereby amended by adding the following as Section
11.15:
"11.15
Special Provisions
This Section applies special or unique regulations to certain "Tourist
Commercial" sites within the Village, notwithstanding regulations to the
contrary in other sections of this By-law. If a regulation is not specified.
including special limits for uses, buildings or structures, the relevant
regulations of the By-law shall apply. The sites and relevant special
regulations are identified as follows:
11.15.1 C2-1
.1 Permitted Uses, Buildings and Other Structures
No person shall use any land or erect, alter or use any building or
structure for any purpose in the C2-1 zone, except one or more of
the following:
a) All those permitted in the "C2" Zone;
b) Office, General or Professional;
c) Block Townhouse Dwelling;
d) Stacked Townhouse Dwelling;
e) Multiple Dwelling;
f) .Apartment Building;
g) Home Occupation or Profession;
h) Public Park and Recreational Use;

.2 Prohibited Uses
Dwelling units are prohibited uses in buildings wherein gasoline,
petroleum products, paint, or any other highly flammable, toxic, or
explosive products are handled in quantity, such as buildings for
boat storage and repairs which are necessary to a marina.

carried on therein any trade or business other than that of
DISPLAYING OF MUSEUM ARTIFACTS AND ACTIVITIES RELEVANT TO THE
OPERATION OF THE LIGHTHOUSE AS A TOURIST ATTRACTION.
AND will not carry on upon the said premises any business that may
be deemed a nuisance.
AND that he/she will leave the premises in good repair, reasonable
wear and tear and damage by fire, lightning and tempest only
excepted.

THE Lessee covenants that he/she is the sole owner of all goods and
chattels that are to be brought upon the premises, and that they
are free from any mortgage, lien or other charge.
PROVIDED that the Lessee may remove his fixtures if all rent due
hereunder has been paid.
PROVIDED that in the event of fire, lightning or tempest, rent
shall cease until the premises are rebuilt.
PROVIDED that, in the event of the destruction or partial
destruction of the said premises, the Lessor may declare the term
hereby granted to be forthwith terminated, and in such event rent
shall be payable up to the time of such destruction or partial
destruction.
PROVIDED also that during the last two months of the said term any
stranger or strangers may inspect the said premises on any day
except Sunday, on producing a written order to that effect signed
• by the Lessor.
PROVIDED that the Lessor may place upon the said premises at any
time during the said term a notice that the said premises are for
sale, and within two months prior to the termination of the said
term may place a notice on the said premises that they are to be
let, and the Lessee agrees that he/she will not remove such
notices, or permit them to be removed.
PROVIDED that in cases of removal by the Lessee of his/her goods
chattels from the premises, the Lessor may follow them for thirty
days in the same manner as is provided for in the Act Respecting
Fraudulent and Clandestine Removal of Goods.
The Lessee covenants that he/she will not permit to be done any act
or thing which may make void or voidable any insurance upon any
building, or part thereof, upon the said premises, or which may
cause any increased or additional premium to be payable for any
insurance.
THE Lessee shall not allow any ashes refuse, garbage or other loose
or objectionable material to accumulate in or about the building,
yards or passages of the said premises, and will at all times keep
the said premises in a clean and wholesome condition.

THE Lessee covenants that he will keep the sidewalks in front and
at the sides of the said premises free from snow and ice; and that
the Lessee shall not, during the said term, injure or remove any
shade trees, shrubbery, hedges or other tree or plant which may be
in, upon or about the said premises, and that he/she will keep in
good condition the boulevard and other shoulder spaces about the
said premises.
PROVISO for re-entry by the said Lessor on non-payment of rent or
non-performance of covenants.
• PROVIDED also that in the case of a seizure or forfeiture of the
said term for any of the causes herein set forth, the Lessor shall
have the same right of re-entry as is given under the next
preceding proviso.
PROVIDED that notwithstanding anything herein contained the
Lessor's right of re-entry hereunder for non-payment of rent or non
performance of covenants shall become exercisable immediately upon
default being made.
THE said Lessor covenants with the said Lessee for quiet enjoyment.

And it is hereby agreed between the parties hereto that should the
Lessee remain in possession of the said premises after the
determination of the term hereby granted, without other special
agreement, it shall be as monthly tenant only, at a rental of
ONE HUNDRED DOLLARS per month, payable in advance on the
FIRST day of every month, and subject in other respects to the
terms of this lease, which he/she agrees to return upon quitting
the said premises.
IT IS agreed between the parties hereto that every covenant,
proviso and agreement herein contained shall enure to the benefit
of and be binding upon the parties hereto, and their heirs,
• executors, administrators, successors and assigns, and that all
covenants herein contained shall be construed as being joint and
several, and that when the context so requires or permits the

2. INDEMNIFICATION BY LESSEE
The Lessee shall indemnify and save harmless the Lessor from all
liabilities, damages, costs, claims, suits or actions growing out
of:
(a) any breach. violation or non-performance of any covenant,
condition or agreement in this lease set forth and contained on the
part of the Lessees to be fulfilled, kept, observed and performed,
and
( b ) any damage to property howsoever occasioned by the use and
occupation of the Demised Premises and Complex or of the buildings,
structures, improvements, fixtures, equipment, machinery and
facilities comprised therein and any injury to any person,
including death resulting at any time therefrom, occurring in or
about the Demised Premises and Complex or any building, structure,
improvement, fixture, equipment, machinery or facility comprised
therein and arising from or occasioned by any cause whatsoever,
and such indemnification in respect of any such breach, violation
or non-performance, damage to property, injury or death occurring
during the term shall survive the termination of this Lease,
anything in this Lease to the contrary notwithstanding.

If the Lessor shall be made party to any litigation commenced by
or against the Lessee, then, unless in such litigation or otherwise
it shall be established that the Lessor was solely at fault, the
Lessees shall protect, indemnify and hold the Lessor harmless and
shall pay all costs, expenses, and reasonable legal fees incurred
or paid by the Lessor in connection with such litigation. The
Lessees shall also pay all costs, expenses and legal fees(on a
solicitor and his client basis) that may be incurred or paid by the
Lessor in enforcing the terms, covenants and conditions in this
Lease.
3.TERMINATION
This Lease may be terminated prior to the expiry of the terms by
either party by giving of Thirty (30) days written notice,

The Municipal Council of the Village of Port Burwell enacts the following:
1. Schedule "A" the proposed modifications to Amendment No. 2 to the
Official Plan for the Village of Port Burwell 1990, as contained in the text
attached hereto and forming part of this by-law, is adopted.
2. The Clerk of the Municipality is authorized and directed to make
application to the Ministry of Municipal Affairs for the approval of the
aforesaid Amendment to the Official Plan for the Village of Port
Burwell.
3. This by-law comes into force on the day it is passed.

PROPOSED MODIFICATION
OFFICIAL PLAN AMENDMENT NO. 2

This proposed modification is prepared in response to comments received from the Ministry
of Municipal Affairs. The Ministry recommended that Bonusing Policies be included in
Section 5 of the Official Plan: Implementation and Administration. Should Council concur
with this approach, draft wording is proposed as follows:
A) Sections currently numbered 5.5 to 5.19 inclusive are hereby renumbered as Sections
5.6 to 5.20
B) Section 5.5 is hereby added as follows:
5.5 Bonus Provisions
5.5.1 Principle
Provisions of the Planning Act enable a municipality, through its
Zoning By -Law, to permit density and height bonuses (i.e. allow higher
densities than those normally allowed in a particular zone). These
bonuses are awarded to proposed development in return for private
assistance in achieving stated public objectives, such as the provision of
facilities, services or other matters as may be set out in the Zoning By-
law. This must result in a general benefit to the public and/or an
enhancement of the development to the extent that a greater density
or height is appropriate.
5.5.2 Objectives
The waterfront is considered a very important element to the
community at large. As such, Council hopes to obtain public
ownership or easements along Big Otter Creek and the Lake Erie
Shoreline for public use. Therefore, Bonus zoning will be used to
support Council's objective to obtain public ownership and/or public
easements, along Big Otter Creek and the Lake Erie shoreline within
the Waterfront Mixed Use Development designation (WMD). It is
Council's intent to apply these provisions in the East Beach area for
tourist -oriented development.

Thus, Bonus Zoning may be used to support one or more of the
following objectives:
a) To protect significant public view points and vistas of the lake front from the top of
the bank and from the existing downtown area.
b) To enhance new tourist oriented development proposals in the East Beach Area
through the provision of additional landscaped open space and hidden or
underground parking areas.
c) To support the provision of, and improved access to, public open space, in addition
to the parkland dedication requirements normally allowed by the Planning Act.
5.5.3 Policies
5.53.1 Council may encourage the provision of increased amounts of public open
space and parkland and the protection of views, and vistas, through the use
of bonus regulations in the Zoning By-law, provided the development proposal
responds to one or more of the following:
Is a) public open space/parkland or cash in lieu in excess of 5% is dedicated
to the municipality;
b) the development provides additional landscaped open space and where
existing views are disrupted by development, public access is available
to alternate view points and vistas on the development site.
c) maximum building heights are limited in accordance with specific
policies in Section 3.
d) the development is intended to principally cater to or support the
tourism industry in Port Burwell.
5.53.2 Specific zoning regulations shall be set out in the Zoning By-law, to allow
densities to increase, provided proposals satisfy one or more of the criteria in
Section 5.5.3.1.
5.533 Specific zoning regulations shall be set out in the Zoning By-law to allow
maximum heights to increase, provided proposals satisfy one or more of the
criteria in Section 5.5.3.1.
5.5.3.4 Specific policies limiting bonuses that may be awarded are set out in Section
40 3 - LAND USE POLICIES, of this Official Plan.

WHEREAS The Development Charges Act, Chapter D-9, s. 3, R.S.O., 1990, as amended, provides

increase the need for services and the development requires,

thereto under section 34 of the Planning Act;

the approval of a minor variance under section 45 of
the Planning Act;
(c)
A conveyance of land to which a by-law passed under
subsection 50(7) of the Planning Act applies;

of the Planning Act;
(e)
a consent under section 53 of the Planning Act;

the approval of a description under section 50 of the
Condominium Act; or
(g)
the issuing of a permit under the Building Code Act

AND WHEREAS the Council of the Village of Port Burwell passed bylaw 91-30 providing for

AND WHEREAS the Council of the Corporation of the Village of Port Burwell deems it necessary
to amend section thereof of bylaw 91-30.
Now therefore the council of the Corporation of the Village of Port Burwell hereby amends Section
6.0 as follows;

BEING A BY-LAW TO AMEND VILLAGE OF PORT
BURWELL BY-LAW NO. 91-30, AS AMENDED WITH
REGARD TO DEVELOPMENT CHARGES.
WHEREAS at its meeting held on November 14'", 1991. the Council of the Corporation of the
Village of Port Burwell enacted and passed By-law 91-30, pursuant to Bill 20, a By-law to
implement development charges;
AND WHEREAS By-law 91-30 was subsequently amended on January 10, 1993 by By-law
Number 92-31 and on April 29 h, 19% by By-law Number 96-27;
AND WHEREAS By-law 91-30 established a development charge of S4056 per lot to take
effect on January 1" , 1993 in accordance with the development charges legislation of the day
which was based on assumed population projections and planned growth related development;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems that the
former Village of Port Burwell By-law 91-30, as amended should be further amended to a
development charge of S3,000 per lot until such time as a by-law is adopted by Council in
accordance with the Development Charges Act, 1997 and any accompanying Regulations;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF BAYHAM HEREBY ENACTS AS FOLLOWS:
THAT Paragraph 5 of the Village of Port Burwell By-law 91-30, be deleted in its entirety
and the following substituted therefor.
"The Development Charge will be $3000.'
2. THAT amending By-law 92-31 be and is hereby rescinded.
3. THAT this By-law shall take effect upon the date of its enactment and sh,,ll be in effect
