THAT Michele Noury is hereby dismissed as Dog Catcher for the Village of Port Burwell. THAT this by-law shall remain in effect from year to year unless repealed or otherwise amended by Council. THAT this By-Law come into force and effect on the 31st day of March, 1984. The Council of the Village of Port Burwell ENACTS AS FOLLOWS: 1. THAT the wages for village employees be established as follows: • a. Clerk—Treasurer $13,892.28 yearly b. Secretarial $5.50 per hour c. Roads Foreman $9.00 per hour d. Roads employees, other than Roads Foreman $5.25 per hour 2. THAT the Head and Members of Council receive the following remuneration: a. Reeve $58.00 per regular or special meeting proclaimed by the Reeve, plus $15.00 per hour for other meetings under two hours. $58.00 per day for conferences attended, including those out of municipality b. Council $48.00 per regular or special meeting proclaimed by the Reeve, plus $15.00 per hour for other meetings under two hours. $48.00 per day for conferences attended, including those out of municipality 3. THAT the following benefits be established for municipal employees: a. NOW THEREFORE THE COUNCIL of the CORPORATION of the VILLAGE of PORT BURWELL enacts as follows : 1. In this by-law (a) "biochemical oxygen demand" means the quantity of oxygen utilized in the biochemical oxidation of matter in five (5) days at twenty (20) degrees celsius; (b) "colour of a liquid" means the appearance of a liquid from which the suspended solids have been removed; (c) "combined sewer" means a sewer intended to function simultaneously as a storm sewer and a sanitary sewer ; (d) "matter" includes any solid, liquid or gas; (e) "Municipality" means the Corporation of the VILLAGE of PORT BURWELL (f) "pH" means the logarithm to the base 10 of the reciprocal of the concentration of hydrogen ions in grams per litre of solution; page 2 110 (g) "phenolic compounds" means those derivatives of aromatic hydrocarbons which have a hydroxyl .group directly attached to the ring; (h) " sanitary sewer" means a sewer for the collection and transmission of domestic, commercial and industrial sewage or any of them; (i) " sewage" means any liquid waste containing animal , vegetable or mineral matter in solution or in suspension , except uncontaminated water; (j ) "sewage works" means any works for the collection, transmission, treatment or disposal of sewage, or any part of any such works; (k) "Standard Methods" means a procedure set out in "Standard Methods for the Examination of Water and Wastewater" published jointly by American Public Health Association, American Water Works Association and Water Pollution Control Federa- tion , current at the date of testing , or a pro- cedure approved by an analyst of the Ministry of the Environment; (1) " storm water" means water from rainfall or other natural precipitation or from the melting of snow or ice; (m) " storm sewer" means a sewer for the collection and transmission of uncontaminated water, storm 11/ water , drainage from land or from a watercourse or any of them; (n) " suspended solids" means solid matter in or on a liquid which matter is removable by filtering ; page 3 11111 (o) "uncontaminated water" means water to which no matter has been added as a consequence of its .use , or to modify its use , by any person ; IIP 2 . No person shall discharge or deposit or cause or permit the discharge or deposit into land drainage works , private branch drains or connections to any sanitary sewer or combined sewer, matter of any type or at any temperature or in any quantity which may be or may become harmful to a sewage works , or which may interfere with the proper operation of a sewage works, or which may impair or interfere with any sewage treatment process, or which maybe or may become a hazard to persons, animals or property, and without limiting the generality of the foregoing any of the following: (a) Sewage that may cause an offensive odour to emanate from a sewage works, and without limiting the generality of the foregoing, sewage containing hydrogen sulphide, carbon disulphide , other re- duced sulphur compounds, amines or ammonia ; (b) Storm water , water from drainage of roofs or land, or from a watercourse , or uncontaminated water; except that which may be discharged into a com- bined sewer; (c) Sewage at a temperature greater than 65 degrees Celsius (149° Fahrenheit) ; Temperature has been cited in degrees • Celsius in conformance with international metric units. The Fahrenheit equivalent shown is not exact. 111 (d) Sewage having a pH less than 6 . 0 or greater than 10. 5 or which due to its nature or content , becomes less than 6 . 0 or greater than 10. 5 within a sewage works; • page 4 1,11 The pH limits have been adjusted upwards at each end since it has been found that corrosion of concrete occurs at pH 5.5 and since it has not been demonstrated that problems will be caused at pH 10. 5. (e) Explosive matter , gasoline , benzene , naptha , fuel oil , solvents or sewage containing any of these in any quantity; These substances have been prohibited as they are not normal constituents of sewage and they do represent a potential hazard. (f) Sewage containing more than 100 milligrams per litre of solvent extractible matter of animal or vegetable origin; The limit has been left to the dis- cretion of the municipality. (g) Sewage containing more than 15 milligrams per litre of solvent extractible matter of mineral or synthetic origin; (h) Sewage which consists of two or more separate liquid layers; This is intended primarily to control discharges of free oil. ( i) Sewage of which the biochemical oxygen demand exceeds 300 milligrams per litre; The limit has been left to the discretion of the municipality. ( )7 Sewage containing more than 350 milligrams per litre of suspended solids; 111 The limit has been left to the discretion of the municipality. page 5 IP° (k) Sewage containing any of the following matter in excess of the indicated concentrations; This is not intended to be a.complete list of materials which may be found in 110 - sewage. They are those commonly found in industrial discharges and are there- fore specifically regulated. All others are regulated by the general provision of Section 2. Aluminum and iron have been set at 50 mg/1 since these metals may be beneficial in the sewage treatment pro- cess, but are considered to be harmless at that concentration. Phosphorus has been set at 100 mg/1 in recognition that in the near future all sewage treatment plants will be capable of removing this material. No person shall discharge or deposit or cause or permit the discharge or deposit into land I 1110 drainage works, private branch grains or con- ngctions to any storm sewer, matter of any type or at any temperature or in any quantity which may interfere with the proper operation of a storm sewer, or which may obstruct a storm sewer or the flow therein, or which may be or may become a hazard to persons, animals or property, or which may impair the quality of the water in any well, lake, river, pond , spring, stream, reservoir or other water or watercourse and without limiting the generality of the fore- going any of the following: All of the following, (a) to (k) in- clusive, are based on the requirements of the Ministry of the Environment for protection of receiving waters. Except as otherwise specifically provided in this by-law, all tests , measurements , analyses and examinations of sewage, its characteristics or contents shall be carried out in accordance 4 with Standard Methods; Note that the definition of Standard Methods includes a method approved by an analyst of the Ministry of the Environment. 5 . (a) The owner or occupant of commercial or industrial premises with one or more connections to a sewage works shall install and maintain in good repair in each connection a suitable manhole to allow observation , sampling and measurement of the flow of sewage therein, provided that where installation of a manhole is not possible , an alternative device or facility may be sub- stituted with the approval of the Municipality; (b) Every manhole , device or facility installed as required by Section 5 (a) of this by-law shall be designed and constructed in accordance with good engineering practice and the requirements of the municipality, and shall be constructed and maintained on the lands of the owner or occupant of the premises at his expense ; (c) The owner or occupant of commercial or industrial premises shall at all times ensure that every manhole , device or facility installed as re- quired by Section 5 (a) of this by-law is at all times accessible for the purposes of observing, sampling and measuring the flow of sewage therein; This is considered to be a very important provision and should apply to all con- nections, existing or proposed. It is important also that it apply to the owner or occupant as this provides a more direct control of the discharge. An amendment to the Municipal Act may be required to allow this provision. • ' page 11 (d) The municipality may require the owner or occupant of commercial or industrial premises to install devices to monitor sewage discharges and to submit regular reports regarding the 4 discharges to the municipality. 6. A person who has entered into an agreement with the Municipality with respect to the discharge or deposit of sewage shall not be prosecuted ID under Section 2 of this by-law for the discharge or deposit of sewage in accordance with the terms of that agreement . This section replaces the provision known as the special agreements provision, by which it was intended that the municipality could accept wastes not in compliance with the limits set out for discharges into a sanitary sewer. It is considered that to prohibit and then to allow by agreement is unsatisfactory. The wording presented here merely confers immunity from pro- secution under Section 2 where an agreement concerning a discharge has been entered into. While the provision of itself is within the power of a municipality to enact, an amendment to the Municipal Act may be required to allow a municipality to enter into agreements respecting sewage. 7 . (a) The owner or occupant of commercial or industrial premises may submit to the municipality a pro- gram to prevent or to reduce and control the dis- charge or deposit of sewage or uncontaminated water into connections to a sewage works or to storm sewer from those premises. (b) The municipality may issue an approval to be 01, known as a 'program approval ' to the person who submitted the program. ,� page 12 (c) A person to whom a program approval has been issued shall not be prosecuted under Section 2 or 3 of this by-law for the discharge or deposit. of sewage during the period within which the ILprogram approval is applicable provided that the person complies fully with the terms of the program approval . This section is intended to allow discharge of a non-complying effluent during the period of design, construction and/or installation of treatment facilities. R . For the purpose of the administration of this by- law, an agent of the Municipality may, upon production of his identification , enter any commercial or industrial premises , to observe , measure and sample the flow of sewage to any sewer. This provision is considered to be very important. An amendment to the Municipal Act will be required, however, to give legal force to the provision. 9. No person shall break, damage, destroy, deface or tamper with: (a) Any part of a sewage works; (b) Any device whether permanently or temporarily installed in a sewage works for the purpose of measuring, sampling and testing of sewage. 10. Smyth, • b ,�t VILLAGE OF PORT BURWELL BY-LAW NO. 8V- /1 ENFORCED CONNECTION BY-LAW 110 A By-Law to require owner(s) of dwellings (and, or) buildings in the Village of Port Burwell to connect such dwellings (and,or) buildings to the sewage works of the Municipality. • WHEREAS pursuant to the provisions of section 219 of the Municipal Act, R.S.O. 1980, Chapter 302, as amended, the Councils of local municipalities may pass by-laws requiring owners of Buildings { or any class or classes of buildings in the municipality or in any defined area thereof to connect the said buildings or class or classes of buildings to the sewage works of the municipality. AND WHEREAS it is deemed expedient to pass a by-law requiring the owners of all dwellings(and, or) buildings in the municipality to connect such dwellings (and, or) buildings to the sewage works. THEREFORE the Council of the Municipality of Port Burwell enacts as follows: 1. In this By-Law, (a) "Buildings" means any structure used or intended for supporting or sheltering any use or occupancy with the land and premises appurtenant thereto, but shall not include a dwelling as defined in this by-law. (b) "Dwelling" means and includes any buildings, trailer, or other covering or structure, the whole or any portion of which has been used, is used or intended for use or is capable of being used for the purpose of human habitation, with the land and premises appurtenant thereto, and all out-buildings, fences or erections thereon or therein whether heretofore or hereafter erected. (c) "Main Sanitary Sewer" means a Main Sewer for the collection of Sewage, but does not include storm water. (d) "Sewage" means any liquid waste containing animal, vegetable, or mineral matter in suspension or solution and drainage from all sinks, tubs and toilets and washing facilities. 2. The owner .of a dwelling (and, or) building located on land in which a Main Sewer is located or on land abutting a street or alley through which access to a Main Sanitary Sewer located less than one hundred feet from the said land is available, shall connect the dwelling (and, or) building to the sewage works. 3. The owner of any dwelling, buildings or properties used for human occupancy, employment, recreation or other purpose situated within • the municipality and abutting on any street, alley or right-of way in which there is now located a main sanitary sewer of the municipality, is hereby required at his expense to install suitable toilet facilities therein, and to connect such facilities• directly with the lateral sewer in accordance with the provisions of this by-law. A notice shall be sent by registered mail to the owner of each dwelling (and,or) building not connected to the sewage works of the municipality which is required to be so connected at the owner's last known address which notice shall advise the owner that this by-law requires such connection and that if the owner fails to make the connection as required within nine months after the sending of the notice, the municipality has the right to make it at the owner's expense and to recover the:: expense by action or in like manner as municipal taxes/ ' — 2 — By—Law No. 4. The owner of a Building affected by this By—Law may be exempted from the provisions of Section 3 upon a Request for Exemption Application (Form 1) having been received by the Treasurer of the Corporation of the Village of Port Burwell. 5. The owner of a building electing to he exempted under Section 4, 111 shall, within twenty—one days of notice return to the Treasurer of the Corporation of the Village of Port Burwell, a Request for Exemption Application (Form 1). 6. Not withstanding the provisions of Section 4, no exemption will • be granted which are at variance with any orders made pursuant to the provisions of Section 95 of the public Health Act, R.S.O., 1970, Chapter 37 as amended, or part of the Environmental Protection Act, R.S.O. 1971, Chapter 86, as amended. 7. Such owner requesting to be.exerapted under paragraph 4, shall be billed a flat sewage charge as determined from time to time by the Corporation in lieu of user rates. 8. WHEREAS The Municipal Act provides that the Council shall appoint a Clerk and a Treasurer who shall perform the duties of the Clerk and Treasurer of the Municipality under The Municipal Act and other Acts of Legislation. • NOW THEREFORE the Council of the Corporation of the Village of Port Burwell enacts as follows: 1. That Kathie MacLeod be and is hereby appointed Clerk and Treasurer for the Corporation of the Village of Port Burwell. 2. That Kathie MacLeod shall perform all the duties required to be performed by Clerks and Treasurers under any statutory authority and any other duties that may be imposed by the Council. (see Schedule "A") 3. That Kathie MacLeod shall hold office during the pleasure and subject to the by-laws of the Council, and shall be paid such remuneration as Council shall from time to time determine. 4. That the salary of the Clerk and Treasurer shall be payment in full for all services required of her and all fees or emoluments of any kind accruing to her by virtue of any Act, Regulation or By-Law, shall be paid to the Corporation of the Village of Port Burwell and be credited to the general funds of the Corporation of the Village of Port Burwell. 5. To manage systems and procedures necessary to implement and administer Council's policy decisions. To provide information to the public with regard to municipal policies, programs, services and regulations. • Activities: • 1. Performs the statutory duties of the Municipal Clerk, the Municipal Treasurer and the Municipal Collector under The Municipal Act and other legislation. 2. Works with Council and its Committees on the development of policy options within the Village's jurisdiction; advises as to the probable legal, financial and administrative implications of each; consults with Village Auditor, Solicitor and appropriate Provincial representative as required; recommends best choice of action following analysis of all choices. 3. Advises Council, its Commiit;ees, ad hoc groups and local boards, if applicable on Federal—Provincial grants structure i.e. eligibility criteria, cost sharing arrangements, enabling legislation; discusses with appropriate Ministry; prepares necessary documentation to support funding applications. 4. Provides advice and assistance to Council and its Committees in the preparation of operating and capital budgets including procedures for interim levies, borrowing and banking arrange— ments, as well as the management of the Villages financial resources and the establishment of necessary controls and reporting procedures. 5. Reporting to Council and its Committees regularly on the status of programs, projects and general operations, verbally and in writing. 6. Implements and administers policies that are determined by Council; develops and manages systems and procedures necessary to ensure the support of the decision making process and to monitor its performance. 7. Manages the tax collection procedure according to the taxation by—law; takes action necessary to keep arrears at a low level and if necessary follows the Tax Registration • Procedure under The Municipal Affairs Act; responsible for the collection of various fees and rates according to Council policy. 8. Maintains all relevant accounts payable and receivable 1111, ledgers and payroll systems and observes all procedures necessary for the flow and handling of cash, calculations, posting and banking operations. 9. Drafts by—laws and resolutions for Council consideration, conducting necessary research and analysis, obtains legal advice as required, provides assistance in the negotiation of contracts and agreements and the determination of equitable conditions of employment, pay and benefits for Village staff. • VILLAGE OF PORT BURWELL SCHEDULE "A" to BY-LAW 84 - 13 Activities: (continued) 10. Interprets by-laws, resolutions and policies to interested citizens; ensures that citizens are aware of intent and content of Council decisions recognizing that a fair proportion of the Village's citizens are 111, part-time residents i.e. cottages, resort and tourism operators etc., maintains an even relationship with the media. 11. Co-ordinates responses to planning activities and proposals as required by Provincial planning legislation and the OMB requirements. • 12. Serves on inter-municipal boards and committees as required. 13. Represents Council at official and ceremonial functions, represents the Village at meetings and seminars arranged by various municipal associations and Provincial ministries as required. 14, Shares responsibility with the Works foreman for the purchasing function, ensures that equitable and effective tendering procedures are observed. 15. Maintains effective working relationships with others on staff to obtain co-operation on matters that cross departmental lines i.e. Administration/Roads/Buildings; works closely with the Village Auditor, Solicitor, County officials and Provincial representatives as required. 16. Manages business office activities including the work of part-time office assistants. 17. Responds to questionaires, surveys and other requests for information from County/Provincial/Federal governments. 18. Manages Municipal and School Board elections in capacity of Returning Officer. 19. Provides for administrative continuity of municipal services following municipal elections and during the early stages of the incoming Council's operation to minimize disruption; provides orientation to new Councillors. • a l • THE CORPORATION OF THE SW VILLAGE OF PORT BURWELL BY—LAW NO. 84 — 14 A By—Law to set the rates for water in the Village of Port Burwell. WHEREAS the PUBLIC UTILITIES ACT provide that a Village may increase the water rates to offset the costs of actual use: R.S.O. 1980 C 423 S. 27,30. III AND WHEREAS it is deemed expedient by the Council of the Corporation of Port Burwell that a new by—law be passed establishing increased water rates to be imposed against each user of the system. • NOW THEREFORE the Council of the Corporation of the Village of Port Burwell ENACTS AS FOLLOWS: 1.
