MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham 1 Introduction 1 .1 Purpose The purpose of the Official Plan Review is to establish new land use policies that affirm the Municipality's vision and goals over the next five years. This review addresses land use changes to meet our communities' needs and to create opportunities for economic growth. It investigates land use planning issues and directions related to: agriculture, environment, settlement areas, industrial policies and implementation. This information and policy directions will be used to guide the development of draft Official Plan policies and amendments, to support prosperous and sustainable communities in the Municipality of Bayham. 1 .2 Official Plan Review Approach This review addresses a number of land use planning issues impacting the Municipality of Bayham. These issues are land use planning matters identified by staff; introduction of the Elgin County Official Plan in July 2012; changes to the Provincial Policy Statement 2014 (PPS 2014); and changes to the Planning Act—Smart Growth for Our Communities Act 2015. Each of the following issue topics include a short introduction, the provincial context within the Planning Act and PPS 2014; the County context; and the Municipal planning context. Each section ends with a direction to be taken through the Official Plan review regarding each issue. Revised and new land use planning polices will be prepared and made available in January 2018 in response to each issue. 1-1 IBI GROUP ERROR! REFERENCE SOURCE NOT FOUND. MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham 2 Land Use Planning Issues for Discussion 2.1 Agriculture Policies 2.1.1 Supplementary Workers Accommodation The changing type of agriculture in the Municipality has created a demand by farmers to accommodate seasonal offshore farm labour. These temporary labourers are needed to plant, maintain and harvest labour intensive high value crops that are becoming more important in the Municipality. In some cases these farm types are replacing former tobacco farms with ginseng, apples and in the future possible marijuana cultivation. Current Federal farm labour regulations allow the temporary use of farm labour from other countries. Workers are limited to working at farms operated by the sponsoring farm business and cannot be hired out to other farm corporations. The land use planning problem is that as farms are become larger, own large areas and sometimes lease large areas, the need for seasonal labour increases. Recently the Municipality considered an Official Plan and Zoning By-law amendment application to permit a permanent bunkhouse facility to accommodate a maximum 50 seasonal offshore farm workers. They would be accommodated on one location, with the farm operation transporting the labourers to and from the farm parcels daily. This approach contrasts with the traditional forms of supplementary farm accommodation where the labourers live on the same lands that they are working on. This eliminates the need to transport the labour from site to site. The farmers suggest that a higher quality of housing can be provided where the larger number of farm labourers are needed. A farmer commented that they could not operate the types of intensive ginseng, asparagus or cucumber production without seasonal farm labour accommodated in supplementary farm dwellings (bunkhouses). The level of amenity and supervision of the farm labourers may be easier to provide where there are larger forms of accommodation. Their request is to have large bunkhouse accommodation located on a central farm and the labourers transported to the fields on a daily basis. Normally accommodation for large numbers of people and higher intensity is directed to villages, and hamlets, where municipal water and sanitary services are available. If they are located in a hamlet or village, the farm labourers would have access to amenities that are part of the larger community. The farmers could then purchase lands with municipal services and build purpose designed accommodation for the labourers. The farmers would then transport the labourers from the settlement area to the farm fields\orchards for their work. Provincial Policy Statement The PPS 2014 permits and protects farm related uses on prime agricultural land. Section 2.3.3.1 specifically promotes and protects all sizes of and intensities of agricultural uses in accordance with provincial standards. The definition of agricultural use includes accommodation for full time farm help where the size and nature of the farm operation requires additional labour. Elgin County Official Plan Section C2.5 of the Plan sets out policies which permit accessory accommodation on farm properties where a need can be demonstrated by the farm. It must be permitted in the local Official Plan and appropriately zoned to allow the use. Temporary structures are the preferred form of accommodation, recognizing the changing nature of farm operations. 2-1 IBI GROUP ERROR! REFERENCE SOURCE NOT FOUND. MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham Bayham Official Plan The applicable policy is set out in 2.1.10 Supplementary Farm Dwellings. This section sets out policies for the need, location, size and type, services and vehicular access for this form of intended use. The intent of this policy is to allow supplementary farm labour to be accommodated on the same farmland on which the labour would be employed. This provides the greatest efficiency for location and maintenance of the accommodation by the owner of the farm. Over time farms have evolved into larger and larger farm corporations requiring larger workforces to operate the farms. Supplementary farm labour may be accommodated in the main accessory farm dwelling; onsite in supplementary farm accommodation such as bunkhouses; or they may commute from offsite accommodation to the farm operation. New policies are needed to set out criteria for larger forms of accommodation of seasonal farm labour. 2.1.2 Agricultural Tourism The changing nature of agriculture has demanded that farmers look to other streams of income to complement their farming activities. These include activities which are "on-farm diversified uses" and "agriculture-related uses". On-farm diversified uses are those uses that are secondary to the principle agricultural use of the property and limited in area including agri- tourism, home industries, home occupations and uses that provide value-added agricultural products. These uses are supportive of the agricultural use or can co-exists with agriculture without conflict. Provincial Policy Statement 2014 Changes to the provincial policy statement introduced a broader range of on-farm uses to accommodate agri-tourism and provided flexibility for larger agriculture related uses to serve the broader farming community. Section 2.3.3.1 introduces new on-farm diversified uses and agriculture-related uses where they are compatible and shall not hinder surrounding agricultural operations. The Ministry of Agriculture Food and Rural Affairs has a guideline document entitled Guidelines on Permitted Uses in Prime Agricultural Areas published in 2016. The policy establishes criteria intended to require it must be located on a farm that is in active agricultural use; the use must be secondary to the main agricultural use on the property; and must minimize the amount of land taken out of production and limited in area. It is not intended to permit a broader range of uses associated with a small rural residential use. These uses may include bed and breakfasts; winery; small scale brewery; greenhouses; pick your own operation; value added processing; retail sales of food grown on site. Elgin County Official Plan Section C2.7 of the Plan sets out policies for a broad range of rural secondary uses including home occupations; home industries; farm related tourism; agricultural research; estate wineries and homegrown produce stands. The Plan provides detailed criteria for each of the specified secondary land uses focused on the scale; traffic; impact on agriculture uses; changes to the agricultural character of the area; and provision of on-site private water and sewage systems. 2-2 IBI GROUP ERROR! MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham Bayham Official Plan Section 2.1.5 of the Bayham Official Plan sets out policies for a limited range of Agri-Tourism Operations where they meet certain criteria in the Plan. Consideration of a wider range of value added tourism opportunities such as wineries, bed and breakfast establishments could be added to the Official Plan. 2.1.3 Alternative Accommodation for Tourism Tourism is identified as way to broaden the economic strength of Elgin County found in Policy A5.3. These policies are intended to promote and upgrade existing tourism and tourism destination oriented uses; preserve cultural heritage resources; encourage the addition of attractions facilities and accommodation to support tourism industries. Alternative accommodation for tourism includes evolving forms of accommodation such as Air Bed and Breakfast, glamping (glamourous camping)and temporary event camping in the municipality. A unique opportunity may be the Ojibway Submarine as a possible location for overnight accommodation. Policies in the Bayham Plan should be added in both the rural and settlement areas designations to allow a limited amount of seasonal accommodation in support of the tourism industry provided certain criteria related to servicing, traffic and compatibility are established. 2.1.4 Agricultural Industrial Agricultural-related uses are those uses directly related to the farm operation, support agriculture, benefit from being in close proximity to farm operations and provide direct products and or services to farm operations. Agricultural industrial uses are included in this range of uses. Recreational or institutional uses do not fall under the category of agricultural-related uses. Provincial Policy Statement 2014 The PPS 2014 defines Agriculture-related uses: means those farm-related commercial and farm- related industrial uses that are directly related to farm operations in the area, support agriculture, benefit from being in close proximity to farm operations, and provide direct products and/or services to farm operations as a primary activity. Elgin County Official Plan Section C2.6 of the Plan sets out policies for small scale farm-related commercial and farm- related industrial uses directly related to agriculture and primarily serve the agricultural operation. Examples include storage and processing facilities for crops, livestock, milk, cheese produced in the local area. This policy reflects the direction in the PPS 2014. 2-3 IBI GROUP ERROR! MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham Bayham Official Plan Section 2.1.3 of the Plan sets out policies for farm related industrial and commercial uses. These uses are required to be "dry"farm related uses that do not require water for cooling, washing and processing. Specific policies set requirements regarding zone regulations; off-site environmental impacts; potable water and sewage treatment; off-street parking; and meeting of the MDS requirements. There have been no changes to the Provincial or County Policies regarding Agriculture-related uses. No amendments are needed to permit agriculture-related industrial uses. 2.2 Environmental Policies 2.2.1 Shoreline Management The Lake Erie shoreline in the Municipality of Bayham is continuously eroding east and west of Port Burwell. The Elgin County Shoreline Management Plan was completed in 2015 and presented to Elgin County Council in November 2015, but has not been adopted by the Long Point Region Conservation Authority. When evaluating the shoreline in Bayham the report indicates erosion rates of 2.8 m/yr for lands west of Port Burwell and erosion rates of 4.8 m/yr for lands east of Port Burwell. Portions of Lakeshore Line have already been closed to public access due to erosion. The Shoreline Management Plan recognizes this risk and describes the approach as a managed retreat from the eroding shoreline. The Official Plan policies need to address the potential loss of buildings and protect potential injury to people resulting from unpredictable slumping of land down the steep embankment into the Lake. Provincial Policy Statement (PPS) 2014 Lands which are unsafe for development due to naturally occurring processes including: flooding, erosion or dynamic beach hazards. The erosion hazard limit is defined as the100 year erosion timeline. The PPS specifically states that all development is directed to areas outside of hazardous lands. Furthermore, municipalities shall consider the potential impacts of climate change that may increase the hazard risks (PPS3.1.3). Elgin County Official Plan Natural and Man-Made Hazards in Section D3. Specific reference is made to D3.2 Shoreline of Lake Erie where the direction is to establish design standards and /or development prohibition within established shoreline hazard lands. It is the intent that lower tier Official Plans show the limit of the hazard lands in the Official Plan and Zoning By-law schedules. Bayham Official Plan The existing Bayham Official sets out policies in Section 6.1.8 Lake Erie Shoreline. This policy sets out three different formulae to determine the 100 year erosion setback. The next section sets out the policies under which development is allowed or prohibited. In principle, no development is permitted in hazardous lands unless there is shoreline protection that will bring the erosion rate to zero and approval is obtained by the Ministry of Natural Resources and Forestry and the appropriate Conservation Authority. No development is permitted at the toe\bottom of the slope if it is unstable and susceptible to erosion. Future policy direction needs to recognize the loss of public roads and public access to property due to the erosion and the relocation of main and secondary buildings at risk due to erosion. The Official Plan can provide future direction for the substitution of public access where there is a loss of public access and establishing emergency approaches to protect the loss of property and risk to personal health. 2-4 IBI GROUP ERROR! MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham 2.2.2 Climate Change Climate changes means increasing surface temperatures, melting glaciers and rising sea levels. These changes are the result of increasing greenhouse gas emissions from human activities. At a regional and local scale the results include the following impacts: • More variable and extreme weather events such as heavy rain and prolonged drought; • Stressed ecosystems for wildlife and habitats; • Public health risks from increased hotter weather and insect-borne diseases; • Increased damage to public infrastructure such as sidewalks, roads and bridges; and • Changes to the type of crops that may or may not be grown in the Municipality. In response to these changes the municipal strategies include: mitigation of climate change through actions to reduce greenhouse gas emissions that create climate change; and adaptation to climate change where the municipality can prepare for these changes that are occurring or likely to occur in the future. The Official Plan is a policy document that can assist council, residents and developers to understand and respond to these impacts. Provincial Policy Statement (PPS) 2014 The Province of Ontario is responding to these impacts through Ontario's Action Plan on Climate Change and policy direction including the PPS 2014. Specifically Section 1.8 identifies the need to support reduced greenhouse gas emissions and climate change adaptation through land use development patterns. Section 3.1.3 requires consideration of climate change that may increase risks associated with natural hazards. These policies are new since the Official Plan was last updated and need to be addressed in this five year review. Bayham Official Plan The Elgin County Official Plan is silent on land use policies for climate change. Likewise the Bayham Official Plan does not reference climate change. These issues were not identified when the previous Official Plan that was adopted and approved. At the same time, Bayham is directly involved with climate change through the ongoing Municipal Energy Plan and Local Action Plan. Participation in these studies provide baseline information on greenhouse emissions and local actions to reduce emissions and energy consumption. Policy direction in this review should consider the following items to be consistent with the PPS 2014 and Provincial initiatives to address climate change: • Goals and objectives to mitigate climate change by reducing the potential for greenhouse gas emissions through land use planning • Policies to require consideration of adaptation to climate change in agricultural land uses; changing crops or agricultural practices; the environment; and public risks to natural hazards of weather and flooding. • Specific municipal programs and initiatives such as tree planting; green building and energy efficiency; water conservation; and active transportation complement the Official Plan policies. 2-5 IBI GROUP ERROR! MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham 2.2.3 Source Water Protection Source water protection land use policies are intended to address the risks associated with activities that may contaminate ground water drinking water sources. The requirements to address these risks are set out in the Clean Water Act, 2006, which provided the framework for local watershed-based source protection plans. One of the implementation tools are Official Plan policies being considered through this review and Zoning By-law regulations. The Long Point Region Source Protection Plan was finalized November 4, 2015. The municipality participated in preparing the Plan through staff and council in various meetings hosted by the Source Protection Plan Region staff beginning in the fall of 2014. At the completion of the Plan, there were no identified significant drinking water threats within the vulnerable areas in the Municipality. Other legislation related to the Nutrient Management Act and other Clean Water Act regulations apply in addition to Official Plan policies and zoning regulations. Provincial Policy Statement (PPS) 2014 The PPS 2014 addresses policies related to water in Section 2.2. Specifically, municipalities shall protect, improve or restore the quality and quantity of water by 2.2.1 e) restricting development and site alteration to protect all municipal drinking water supplies and ground water and sensitive ground water sources. The Elgin County Official Plan in section D2 incorporates many of the same policy direction from the PPS2014. It references the Source Protection Plans that were being developed at the time of the Official Plan preparation. Bayham Official Plan Land use planning consultants were hired by the County of Elgin and County of Middlesex to review the existing water protection policies and regulations for upper and lower tier municipalities. In February of 2017, they drafted possible Official Plan and Zoning By-law amendments which will be considered as part of this review. Specifically, it identifies the land uses which are a potential threat to source water and the location of wells that may be at risk. Specifically the municipal well in Richmond is identified for protection. The policies are intended to provide the basis for the Municipality to prohibit certain uses, limit the locations of large septic tanks systems and ensure the future availability of safe drinking water. These policies will be reviewed and draft amendments will be included in any proposed amendments. 2.2.4 Species at Risk Act 2007 The Ministry of Natural Resources and Forestry administers the Endangered Species Act 2007, to protect and conserve species at risk and their habitats. Species at Risk include animals and plants that are threatened or endangered with possible extinction within specific portions of the Province. The exact location of species at risk is not identified by mapping because this information may lead to unwanted exploitation of these species and lead to further losses. In addition, these species may or may not be located in significant habitat of threatened or endangered species. Some of the species may be found in developed locations, which may need specific land use interventions to protect the species. The Ministry has developed a protocol whereby the Aylmer Office of MNRF will respond to private or public enquires about species at risk in advance of potential development. 2-6 IBI GROUP ERROR! MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham Provincial Policy Statement (PPS) 2014\ Elgin County Official Plan The PPS 2014 in Section 2.1.7 prohibits development and site alteration in habitat of endangered and threatened species except in accordance with provincial and federal requirements. The Elgin County Official Plan identifies the MNRF as the ministry responsible to identify species at risk and responds to public enquiries (policy D1.2.5). The Plan also established the approach to Environmental Impact Studies to evaluate and determine the extent of habitat for species at risk. Bayham Official Plan Existing Official Plan policies recognize that significant habitat of threatened and endangered species must be protected. It includes specific Environmental Impact Studies to be completed in advance of development in or adjacent to significant features. Additional policies could be added to specifically address the role of the MNRF in identifying the habitat of threatened or endangered species on the listing of Species at Risk. 2.3 Industrial Policies 2.3.1 Industrial Designation Expansion The Municipality has a number of sites in the rural area and within the settlement areas which are designated Industrial. These sites recognize existing sites used for industrial purposes. One of the most significant sites is the Bayham Industrial Park located in Part Lots 19 and 20 Concession 11. The location is adjacent to the Town of Tillsonburg Industrial Park and is intended to provide a complementary location for industrial uses, without municipal sewer and water services. When all of the existing industrial lands are considered, there is a significant amount of land currently designated for industrial development for the long term needs. In order to consider expansion to the boundaries a comprehensive review or the need to remove land from agricultural uses and that the lands are needed in the long term for the employment. Based on the low uptake of industrial land in Bayham, it is unlikely to add new industrial lands. However, should the land owners wish to remove and reallocate industrial lands without a net increase, a comprehensive review is not necessary. Municipal staff will work the owners of the Bayham Industrial Park to identify lands that may be exchanged out of industrial to agricultural designations and from agriculture to industrial designations that better serve the industrial needs of the Municipality. 2.3.2 Brownfield Redevelopment The Ministry of Municipal Affairs leads government action on brownfields redevelopment. Brownfields are vacant or underutilized sites with potential for redevelopment and are often former industrial or commercial uses with contamination. The land can be reused to make way for other uses utilizing the existing infrastructure and rejuvenate neighbourhoods. Brownfield redevelopment also benefits the environment by improving air, water and soil quality, and by facilitating more sustainable development patterns that can protect valuable green spaces and agricultural lands. The brownfields area of Bayham includes the Port Burwell harbour lands area that were used for the transport and storage of coal. 2-7 IBI GROUP ERROR! REFERENCE SOURCE NOT FOUND. MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham Provincial Policy Statement (PPS) 2014 The PPS 2014 references brownfields in Section 1.1.3.3 whereby these sites should be identified as potential locations for intensification and redevelopment. Elgin County Official Plan The Elgin County Official Plan references brownfield redevelopment in Policy F6 Community Improvement Plans. One of the objectives is to foster redevelopment of existing brownfields sites or current industrial sites. Through implementation policies it identifies that Council may make grants or loans for the purpose of carrying out a community improvement plan including the redevelopment of industrial areas. Bayham Official Plan In order to provide municipal incentives for the redevelopment of contaminated sites, the Official Plan in Section 7 Community Improvement needs to be amended to establish the framework and criteria for these incentives. Currently this section allows for community improvement in residential and commercial areas without reference to industrial areas. Amendments to the Planning Act in the Brownfields Statute Amendment Act give municipalities the statutory authority to create incentives for redevelopment of areas such as the Port Burwell harbour. 2.4 Settlement Area Policies 2.4.1 Community Design Community design policies involve the creation and management of the built environment to ensure safe, healthy and attractive development occurs. Local governments have begun implementing these policies in order to have more control over new applications for development, such as plans of subdivision, infill development proposals and site plans. Provincial Policy Statement (PPS) 2014 The Planning Act has been amended to include a provincial interest in designing the built form. Section 2 of Planning Act includes new provincial interest relating to built form —"built form that is well designed, encourages a sense of place, provides for public places that are of high quality, safe, accessible, attractive and vibrant" This statement is reinforced in the PPS 2014. Policy 1.7 Long Term Economic Prosperity includes a policy to support design by: d) encouraging a sense of place, by promoting well- designed built form and cultural planning, and by conserving features that help define character, including built heritage resources and cultural heritage landscapes Elgin County Official Plan Elgin County Official Plan Policy A4.1 Planning and Design provides a framework for community design in the County. Strategic objectives include promotion of a built environment which provides comfort, safety and accessibility in all settlement area designations. Furthermore, policies for specific land use designations of C1.1.1 f) Residential, C1.2.1.1 f) Commercial and C1.3.1.1 f) Employment, reference a need for a high standard of urban design for development and redevelopment within the settlement areas. 2-8 IBI GROUP ERROR! MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham Municipality of Bayham The Bayham Official Plan currently does not include Community Design policies. The focus of community design is the relationship between people and the built environment in which everyday activities are undertaken. The policies should address the look and feel of the built environment of such community features as Village and Hamlet centres, public spaces and green spaces. Some community design objectives may include: • Attractive, comfortable and safe streetscapes • Heritage preservation • Well-connected walking and cycling pathways • More compact form of development • Environmentally sustainable neighbourhoods • Barrier-free walkways and buildings Community design policies should be added to the Official Plan to encourage urban design which enhances the quality of life in Bayham. 2.4.2 Secondary Suites Second Units are being promoted by the Province in order to expand housing options and to offer a wider range of affordable housing choices and can increase density without the need for expansion of municipal services. Second Units are "self-contained residential units with a private kitchen, bathroom facilities and sleeping areas within dwellings or within structures ancillary to a dwelling (e.g., above laneway garages)." The Strong Communities through Affordable Housing Act, 2011, amended the Planning Act to require that municipalities authorize second units in their official plans and zoning by-laws. The changes took effect on January 1, 2012. The last Official Plan Review was approved days after the legislation came into effect, so no current policies exist in the Official Plan. The Province continues to revise and update their strategy through the Long-term Affordable Housing Act, 2016. Planning Act The Province has required that policies be included in the Official Plan in Section 16(3)of the Planning Act. The Planning Act requires municipal OP's to authorize second units in detached, semi-detached and row houses or in accessory building or structure, but not in both — i.e. if you have a second unit in the main house you cannot have another above a detached garage. The planning Act also restricts appeals to the OMB for second unit amendments. Second units are self-contained residential units with a private kitchen, bathroom facilities and sleeping areas within dwellings or within structures ancillary to a dwelling (e.g., above laneway garages). Second units are also referred to as secondary suites, basement apartments, accessory apartments, granny flats, in-law apartments, or nanny suites. Elgin County Official Plan The Elgin County Official Plan includes Housing policies in Section C1.3. Within the General Policies in Section C1.3.2 there is a requirement for local municipalities to establish local policies and zoning regulations to allow second units in detached, semi-detached, row houses and 2-9 IBI GROUP ERROR! This approach will also assist in meeting residential intensification targets and the provision of affordable housing. Bayham Official Plan The existing Official Plan does not address secondary suites as required through the Planning Act. The provincial requirement is intended to increase the amount of affordable housing, using existing municipal infrastructure and have little or no land use impact on the surrounding residential land uses. The intent of the policy is to meet goals such as the following: • Creating affordable housing opportunities for fixed income homeowners; households with financial challenges; first time homebuyers; and new immigrants. • Allowing older adults with disabilities or special needs to live independently at home with live-in support staff or family. • Allowing families to provide independent accommodation for adult children or relatives in need. • Enabling supplemental rental income to increase home ownership viability. When considering these policies the following criteria should be considered: • The need for additional parking • The size and location of the secondary dwelling • Providing municipal services and infrastructure • Neighbourhood appearance and character • Property maintenance • Ensuring the safety of occupants of the secondary dwelling Official Plan polices to allow secondary suites for the range of housing should be included. It is not intended that secondary suite policies allow for the accommodation of seasonal farm labour. 2.4.3 Inclusionary Zoning Creating inclusive, complete communities with a broad mix and range of housing types is an important step in supporting Ontario's health and prosperity. The updated Ontario Long-Term Affordable Housing Strategy focuses on increasing the supply of affordable housing. On December 8, 2016, Bill 7, the Promoting Affordable Housing Act, 2016 was given Royal Assent. The resulting changes to the Planning Act will give Bayham the option of requiring affordable housing units as part of residential developments. The legislation for inclusionary zoning will provide that: • A municipal assessment report is to be prepared prior to adopting official plan policies for inclusionary zoning and reviewed every five (5) years. This report will be subject to criteria set out in regulation. • Municipal inclusionary zoning requirements must be outlined in municipal official plan policies. • While inclusionary zoning by-laws cannot be appealed to the Ontario Municipal Board (except by the minister), appeals of typical zoning matters, such as building height and density, are permitted even when used as measures and incentives to meet inclusionary zoning needs. 2-10 IBI GROUP ERROR! MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham • Landowners must enter into agreements with the municipality that may be registered on title and enforceable against subsequent owners, to ensure that the units remain affordable over time. The Bayham Official Plan should include policies which encourage inclusionary zoning criteria to create additional affordable housing. 2.4.4 Cash-in-lieu of Parking / Cash-in-lieu of Parkland Cash-in-lieu of parking and parkland provide the Municipality with a planning tool to receive monies from development projects in proportion to the amount of parkland or parking spaces that are not provided by the project. These monies are deposited into a specific account where Council can choose to spend the money to provide public parkland or parking spaces in a more appropriate location or amount, otherwise available at the development location. Provincial Policy Statement (PPS) 2014 The Planning Act provides legislative authority for the Municipality to adopt Official Plan policies and enacting By-laws to accept cash-in-lieu for parkland and parking. Section 40 Agreement exempting owner from requirement to provide parking, sets out the requirements for this form of planning including accounting for the funds; allocation to the creation of parking; registration of an agreement; and annual reporting of the funds. Section 42 (6) Payment instead of Conveyance of land for park purposes sets out the requirements for the amount of land and the substitution of land dedication with monies. Bayham Official Plan The Elgin County Official Plan does not include policies with regard to cash-in-lieu requirements. In order to enact by-laws for cash-in-lieu, Bayham must adopt policies in the updated plan to establish cash-in-lieu policies. These should include the criteria for accepting cash; the provision of alternative parkland or parking areas; the need for agreements; and methods to establish the rates of monies paid for the amount of parkland or number of parking spaces that are not being provided. 2.5 Official Plan Implementation Policies 2.5.1 Complete Applications Complete applications means that the information, background studies and supporting material for any type of development application, is provided to Council, commenting agencies and the public, before making a planning decision within the prescribed time frame. Where stakeholders have access to all the necessary information the decision will be based on a sound understanding of the issues related to the application. Through the pre-application consultation process the Municipality may decide to require additional information beyond what is prescribed by the Province. The scope of the information or studies required for a complete submission should be appropriate and in keeping with the scope and complexity of the planning application. The additional studies or information must be listed in the Official Plan. Planning Act Requirements The PPS 2014 promotes wise use and management of resources as well as protecting public health and safety. By incorporating complete application policies in the OP Bayham can identify additional information and materials that are consistent with the PPS. The Planning Act Sections 22(4) and (5), 34(10.1) and (10.2), 51(17) and (18), 53(2) and (3) provide the legislative authority for Council to require information relevant to the development application. 2-11 IBI GROUP ERROR! MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham Elgin County Official Plan Section F8 of the Plan sets out policies which elaborate on required materials for complete applications. This section goes on to set out requirements for Official Plan amendments, Zoning By-law amendments, subdivisions and condominium applications. Once the material has been submitted and accepted the Municipality deems the application to be complete, beginning the date for the processing of the application. The submitted material ensures that the public, planning staff and Council can make an informed decision on planning applications and that developers and planners are aware of the requirements in advance of making the applications. Bayham Official Plan Section 8.5.1 Amendments of the Bayham Official Plan sets out the policies regarding complete applications. It includes the background studies needed, the notice provisions, and OMB appeal procedures. In order to provide greater certainty and transparency, the Plan needs to be amended to identify the scope and range of studies that may be needed for a complete application. Criteria should be included regarding the quality of the background studies submitted for consideration by Council. 2.5.2 Pre-consultation A pre-consultation meeting may be held with municipal staff and other stakeholders prior to the applicant making a new planning application. The benefit of this meeting is for staff to inform the applicant of the relevant planning policies and help shape the application; the applicant can then refine the scope of the application; it provides an opportunity to discuss the requirements for a complete application; and finally, it will help to streamline the review and approval process when all the material is available prior to commencing the application. Bayham currently holds pre-consultation meeting, however, there is no requirement or by-law that has been enacted that the meeting take place. Planning Act Requirements The Planning Act Sections 22(3.1), 34(10.0.1), 41(3.1), and 51(16.1) provide the legislative authority for Council to request a pre-consultation meeting with the applicants for Official Plan, Zoning By-law, Site Plan and subdivision applications. Elgin County Official Plan The County of Elgin Official Plan in Section F8.4 Pre-consultation, sets out the need for a meeting with County staff prior to submitting an Official Plan or plan of subdivision application to the County. Bayham Official Plan Policy 8.5.1.1 of the Bayham Official Plan encourages pre-consultation prior to making a planning application and provides for the adoption of a by-law to make the meetings mandatory. Today staff regularly undertake pre-consultation meetings with the applicant to provide direction on policies and requirements. Consideration should be given to adopting a by-law to require the pre-consultation meeting on development applications which are more complicated and may have a greater impact on adjoining land uses. 2-12 IBI GROUP ERROR! MUNICIPALITY OF BAYHAM OFFICIAL PLAN REVIEW Prepared for Municipality of Bayham 2.5.3 Public Notice / Public Meetings Public notice of all development applications is important to provide the opportunity for the public to express the opinions they have on the application. This will ensure meaningful two-way dialogue and participation in forming decisions that affect various stakeholders. Municipal staff currently prepare, post on the municipal website, publish in the local newspaper and distribute notices to adjacent landowners. Notice requirements are prescribed by the Province through Planning Act regulations. Planning amendments provide the legislative authority to create specific public notice and meeting procedures for the Municipality. Planning Act Legislation Legislative changes to the Planning Act in Sections 17(19.3— 19.4); 34(14.1- 14.1); 51(19.3) allow municipalities to tailor notice provisions for who and how notice is given in the Official Plan. This provides local flexibility for Council decision making and greater opportunity for stakeholder input into the process. Elgin County Official Plan Section F7 of the County Official Plan sets out the principles of public participation and consultation. The policy requires that Council is satisfied that adequate notice is provided in accordance with the Planning Act, sufficient information was provided, the input is adequately considered in the reports and that Council balances the overall public interest against the interest expressed in the application. Specifically, proponents are encouraged to pre-consult with neighbouring land owners. The County will endeavour to consult with First Nations for application which may impact aboriginal treaty rights. Bayham Official Plan Policy 8.5.3 Notice Requirements for Comprehensive Official Plan Amendments, Comprehensive Zoning By-law Amendments, and Community Improvement Plan Amendments and Policy 8.5.4 sets out requirements for site specific amendments. The standard notice is to all property owners within 120 m of the lands subject to the planning application. Council may consider enhanced notice provisions where Council feels it is important to obtain a wider scope of public input. Council and approval authorities are required to explain the effect of public input, if any, on planning decisions. The Notice of Decision on Planning Applications must also include the effect the public input had on the decision. The effect of this process is to provide more transparency and consistency in the decision making across the municipality. The Official Plan policies should be updated allow alternative public notice and public meeting requirements to reflect the unique requirements of the application and to incorporate the effect of public input in the decisions of Council. 2.5.4 Ontario Municipal Board Procedures Proposed legal revisions to OMB procedures was introduced into the Legislature in May 2017 as the Building Better Communities and Conserving Watersheds Act, 2017. The purpose of the new legislation is to overhaul the province's land use planning appeals system, giving communities a stronger voice and ensuring people have access to faster, fairer and more affordable hearings. The new law would establish the Local Planning Appeal Tribunal to replace the Ontario Municipal Board. The legislation is currently being debated by a government standing committee and is not in effect. It will likely be phased in over time, giving municipalities opportunity to prepare for the new changes. The following reforms are highlighted to give municipalities a stronger voice in local land use planning: 2-13 IBI GROUP ERROR! REFERENCE SOURCE NOT FOUND. This is different from the current approach where the Ontario Municipal Board is permitted to overturn a municipal decision whenever it finds that the municipality did not reach the "best" planning decision. • The tribunal would be required to return the planning application to the municipality with written reasons when it overturns a decision, instead of replacing the municipality's decision with its own. The municipality will have 90 days to make a new decision. • The tribunal would retain the authority to make a final decision on these matters only when, on a second appeal, the municipality's subsequent decision still fails to follow provincial policies or municipal plans. Using this new approach the tribunal would give greater weight to the decisions of local communities, while ensuring that development occurs in a way that is good for Ontario and its future. There are also other reforms related to faster, fairer more affordable planning appeals. The province would provide free legal and planning support to advise and represent Ontarians on land use planning appeals modeled after the Human Rights Legal Support Centre. The proposed new legislation would also exempt a broader range of major municipal land use planning decisions from appeal, providing municipalities with greater certainty and timely implementation of major decisions. The following matters would no longer be appealable under the proposed law: Provincial approvals of official plans and official plan updates, including approvals of conformity exercises to provincial plans; Minister's Zoning Orders. Local Appeal Bodies would also be given more authority. They would be able to hear appeals on site plans, in addition to their current scope of minor variances and consents. The Municipality does not need to make specific changes to the Official Plan at this time. All stakeholders should be aware of changing roles of the Ontario Municipal Board in the future.
