COUNCIL MINUTES JANUARY 12.1995
The Regular meeting of the Council of the Village of Vienna was held in Council
Chambers. Present were: Reeve,Gundy Goutouski, and Councillors, Keith Underhill,
Rick Marlatt, Douglas Brackenbury and C. Valerie Donnell and Clerk, Lynda Millard.
There was no disclosure of Pecuniary Interest.

THAT WHEREAS the Ontario Government has used unprecedented interference in
municipal jurisdiction through Bill 143 and waste management policies
AND WHEREAS Ontario Municipalities want the responsibility of finding
environmentally responsible solutions to their municipal waste
AND WHEREAS Ontario municipalities are not prepared to eliminate alternatives to
waste management that have been well researched and will offer solutions to these
municipalities
AND WHEREAS there is inadequate research to support the environmental and health
aspects of mega dump alternatives
BE IT RESOLVED that the municipality of the Village of Vienna condemns the Ontario
Government's intrusion into this traditional area of municipal jurisdiction
AND that the municipality of The VILLAGE OF VIENNA demands that the Ontario
Government permit municipalities to examine all environmentally responsible alternatives
and halt the present process for mega dump site selection so that research may proceed to
determine the most environmentally sound answers to waste elimination and disposal

An update was given by C. Valerie Donnell concerning a recent B.E.A.T. ( Beneficial
Environmental Action Team)meeting. Various alternative ideas were discussed regarding
costs associated with the Local Transfer Station. A letter is to be sent to Bayham
Township with suggestions.

The Council of the Village of Vienna met with Village Engineer Cyril Demeyere on
Thursday,January 19th, at 7:30 p.m,in Council Chambers. The meeting, attended by all
Council members and clerk was chaired by Reeve G. Goutouski.
Cyril Demeyere updated Council on recent discussion with M.O.E. representatives
regarding various items of concern and requesting direction.
A letter from Reeve Tom Nesbitt, regarding a study report required to determine the
capacity of the Port Burwell Sewage Treatment Facility was discussed. Council did not
embrace the need to commit funds to such a study at this time.
Clerk L. Millard is to supply mapping information to Mr. Demeyere.
Mr. Demeyere then made a presentation on behalf of the Tillsonburg District Memorial
Hospital regarding review of services among the three hospitals in the Tillsonburg Tri-
County area. Discussion followed. A Resolution is to be prepared for the next regular
meeting of Council on February 9th.

THAT WHEREAS a review of hospital services in Oxford County is being conducted by
the Oxford Hospitals Planning Study
AND WHEREAS goals of the study include exploration of the feasibility of shared
governance and the identification of ways to reorganize/combine services among Oxford
County hospitals
AND WHEREAS it is commonly conceived that, although the Government of Ontario
and through its various agencies, encourage input at the local level in regard to decisions
affecting local services, in many cases ignore the very information submitted
THEREFORE BE IT RESOLVED THAT THE COUNCIL OF THE VILLAGE OF
VIENNA DEMAND THAT:
1) the GOVERNMENT OF ONTARIO and its agencies respect the opinions,
direction, and input from the local populace in regard to the above noted Study,
2) consideration of access and proximity be given to those living in areas of Elgin
County, outside of Tillsonburg,namely in the Village of VIENNA, Village of Port
Burwell, and the Township of Bayham
3) there be no rationalization of services in the areas presently served without the
level and quality of services being maintained or improved,
4) oppose the shared governance concept for the three hospitals in Oxford County, as
we believe it would not be in the best interests of our local inhabitants,the majority
of which are served by the Tillsonburg District Memorial Hospital
AND THAT the Premier of Ontario,the Ministry of Health, Peter North M.P.P.- Elgin,
the Oxford Hospital's Planning Consultants(Carolyn Sherk Consultants Ltd.),Thames
Valley District Health Council be so informed.

The Council of the Village of Vienna met in Council Chambers at 7:30 p.m. Present were
Reeve Gundy Goutouski, and Councillors Doug Brackenbury, Keith Underhill and C.
Valerie Donnell, and Clerk Lynda Millard. Allen Spicer of Harbour Lights attended at
8:00 p.m.

Koolen Electric in the amount of S19,461.00 plus G.S.T.,to install Air Exchange Heat
Recovery Ventilation at the Vienna Community Centre dated January 6, 1995, and also
subject to requirements of Owen Glendon of Chorley&Bisset Ltd., as agreed per fax of
March 21/95 by Peter Koolen,in accordance with S.M.A.C.N.A Standards, Ontario
Hydro inspection and permits, and a written guarantee by the Contractor that this installed
equipment will keep the air quality at an acceptable level CARRIED

Also received was a letter from the Ontario Federation of Anglers&Hunters
requesting action. As a result it was:

WHEREAS the Federal Government has released"The Government's Action Plan on
Firearms Control"and given this plan form in the draft legislation Bill C- 68;and
WHEREAS the Federal Minister of Justice has not established that this Action Plan will
reduce crime or improve public safety;and
WHEREAS the Action Plan and legislation, if implemented, contain severe sanctions and
restrictions on the continued ownership of firearms by responsible,law-abiding citizens by
subjecting them to unnecessary and unjustified controls,limits, stipulations, red tape and
financial burdens;and
WHEREAS the existing controls on firearms ownership as contained in the Criminal
Code of Canada and the Regulations pased pursuant to the Criminal Code are more than
adequate to ensure public safety and that crime could be controlled throught enforcement
of the existing laws along with those in proposed Bill C- 68 to counter criminal firearms
use;and
WHEREAS implementation of further controls on law-abiding Canadians as proposed in
the Federal Action Plan on Firearms Control will place an overwhelming burden on scarce
police resources at the local,regionall, and provincial levels;such costs that would be
better used fighting crime;
THEREFORE BE IT RESOLVED:
THAT the Council of THE VILLAGE OF VIENNA is opposed to those measures in •
the Government's Action Plan and in Bill C- 68 that impose needless burdens on law-
abiding Canadians such as universal firearms registration and licensing;
THAT the Council of the Village of Vienna opposes any measures that prohibit or ban
any firearms that are presently, or were prior to January 1, 1995,legally owned by
registered owners in Canada;
THAT the Council of the VILLAGE OF VIENNA insist that the Government of Canada
abandon those sections of the Action Plan on Firearms Control affecting the continued
ownership and legal use of firearms by responsible Canadians;
AND THAT the Right Honourable Jean Chretien,Justice Minister Allan Rock,Gar
Knutson, M.P. Elgin-Norfolk,the Clerk of the Standing Committee on Justice and Legal
Affairs,and Peter North,M.P.P. Elgin,be advised of this resolution CARRIED

SPECIAL COUNCIL MEETING Thursday March 30, 1995.
The Council of the Village of Vienna met with the Council of the Village of Port Burwell
in the Vienna Council Chambers at 7:30 p.m. All members of Councils and clerks were
present. Also present were interested persons: S. Straub, S. McKibbin, as well as I-IL
editor A. Spicer.
The purpose of the Joint-Council meeting was to discuss the alternative of Vienna
residents hooking in to the Port Burwell Sewage Treatment Plant as a possible solution to
Vienna's ongoing pollution problem.
Vienna Reeve Gundy Goutouski welcomed those present.
Reeve Goutouski presented estimated figures that would put the Port Burwell Treatment
Plant at designed capacity with a combined total population of 1,886. Present populations
were estimated,would put the plant at approximately 71%of capacity.
The need to collect as much information prior to another Public Meeting, and before an
application is submitted was stressed by Reeve Goutouski.
Port Burwell Reeve Tom Nesbitt stated the concern over possible beach closures and that
although hook-up to the Port Burwell plant would not be cheap,he hoped it would be the
preferable solution. It is felt that ongoing development will require the present capacity.
Various thoughts discussed included available room for addition to the plant, increased
summer population growth, outer harbour development,continual transfer finding cuts,
joint co-operation,development charges, Elgin County restructuring,possibility of
Pembina spin-off benefits,possible funding from Vienna to assist in harbour dredging, the
Environmental Bill of Rights and future growth capacity requirements.
• Stuart McKibbin, a former Police Village Trustee offered comment on a past similar
situation in regard to proposal for a water system for Port Burwell,and urged that
action be taken soon.

The Council of the Village of Vienna met in Council Chambers at 7:30 p.m. Present were
Reeve(lundy Goutouski,and Councillors Doug Brackenbury,Rick Marlatt, Keith
Underhill and C. Valerie Donnell, Village Engineer Cyril Demeyere and Clerk Lynda
Millard.
The meeting was held so that Mr. Demeyere could update Council on the status of the
Environmental Assessment process.
Vienna Council,having met with the Council of the Village of Port Burwell on March 30.
1995,in regard to Vienna's efforts to remedy the Pollution of the Otter Creek,was
• requested by Mr. Demeyere to have Vienna Clerk, L. Millard write to Port Burwell
Council asking that the position of Port Burwell be put in writing so that a Public
meeting date in Vienna can be arranged.
It must be determined whether or not Port Burwell is willing to negotiate committment of
sewage plant capacity to the future needs of Vienna and that the information be available
prior to any further public discussion.
It is hoped that a Public Meeting may be held May 24th.
A meeting will be held May 4/95 to discuss this further.

The meeting was held to further discuss plans for the next Public Meeting in Vienna m

Clerk Lynda Millard reported that still no answer had been received from Port Burwell in
regard to their willingness to commit future sewage treatment plant capacity to Vienna.
It was noted by Dr. Wilson that the Health Unit is no longer involved in lot size
requirements once a municipality has both water and sewage systems available.
Mike Auger stressed the importance of water efficiency in regard to any application for
funding that is submitted
After further discussion, the tentative date of May 24th for a Public Meeting was
postponed, pending further information availability, until the end of June.

The Council of the Village of Vienna met with Township of Bayham Council in Council
Chambers in Straffordville at 700 p to Present were. Reeve Gundy Goutouski, and
Councillors Doug Brackenbury, Keith Underhill and C Valerie Donnell, Village Engineer
Cyril Demeyere and Clerk Lynda Millard,
Barham Reeve Vane Chute welcomed those present Vienna Reeve Goutouski gave a
short response.
The meeting was then turned over to Cyril Demeyere who gave a presentation and
preliminary figures for discussion in regard to the possible alternative of a joint
Vienna/Bayham solution to Vienna's ongoing Otter Creek pollution problem.
Reeve Goutouski reported that an answer to Vienna's letter of April 21, 1995, had still not
been received from Port Burwell Council in regard to their willingness to commit future
sewage treatment plant capacity to Vienna, and so additional alternatives should be sought
before proceeding with a Public meeting in Vienna
Various discussion followed.
It was agreed that Mr Demeyere prepare approximate sewage plant and pumping station
operating cost estimates, prior to further discussion between the two Councils.

8:20 p.m.: A letter which had previously been registered and refused, was handed to
Corrie Reddecopp by the Clerk. Steve Straub stated that he would act as interpreter so
that Mr Reddecopp would be aware of the Village's By-laws concerning chickens
running at large and the penalties for non-compliance
8:30 p.m.: Steve Straub made a presentation in regard to Village policy concerning work
on private property by the village workman and equipment Mr Straub had questions
regarding the issuance of work orders, and requested Village reimbursement and an
apology by the Reeve and her resignation.
Reeve Goutouski responded to Mr. Straub's concerns and made out a cheque for 520 00
to the Village, on behalf of the Anglican Church for the ten to twenty minute work time
spent, valued at S16.70 per 1/2 hour and did not resign.
Only Councillor Donnell disagreed with the cleanup of the bricks from the Church at

THAT WHEREAS: the Federal Government has released"The Government's Action
Plan on Firearms Control" and given this plan form in the draft legislation Bill C-68,and
WHEREAS: the Federal Minister of Justice has not established that this Action Plan will
reduce crime or improve public safety;and
WHEREAS: the Action Plan and legislation, if implemented, contain severe sanctions
and restrictions on the continued ownership of firearms by responsible, law-abiding
citizens by subjecting them to unnecessary and unjustified controls, limits, stipulations, red
tape and financial burdens,and
• WHEREAS: the existing controls on firearms ownership as contained in the Criminal
Cade-of Canada and the Regulations passed pursuant to the C aminal Code are more than
adequate to ensure public safety and that crime could be controlled through enforcement
of the existing laws along with those proposed in Bill C-68 to counter criminal firearm
use,and
WHEREAS: implementation of further controls on law-abiding Canadians as proposed
in the Federal Action Plan on Firearms Control and in Bill C-68 will place an
overwhelming burden on scarce police resources at the local, regional and provincial
levels, such costs that would be better used fighting crime,
THEREFORE BE IT RESOLVED:

THAT we are opposed to those measures in the Government's Action Plan and in Bill C-
68 that impose needless burdens on law-abiding Canadians such as universal firearms
registration and licensing,
THAT we are opposed to any measures that prohibit or ban any firearms that are
presently. or were prior to January 1, 1095, legally owned by registered owners in Canada.
THAT we respectfully request that the Senate of Canada refuse to give their approval to
this legislation and send it back to the House of Commons so that those sections of the
legislation affecting the continued ownership and legal use of firearms by responsible
Canadians can be removed,
• AND FURTHER BE IT RESOLVED:
THAT the Honourable Senator Gerald Beaudoin, Chair of the Senate Committee on

The Council of the Village of Vienna met with Village Engineer Cyril Demeyere, and Greg
Ford of Septech Environmental. on Monday, October 23rd,at 7.30 p.m., in Council
Chambers.
The meeting, attended by Councillors D. Brackenbury, R Marian, K. Underhill&C V
Donnell, and clerk, L Millard, was chaired by Reeve G. Goutouski.
The purpose of the meeting was to update Council regarding recent soil testing and
further information on costs for a Modified sewage system
It was agreed to further assess availability and suitability of a further site and set a
tentative date of January 23/96 for a Public Meeting.
Greg Ford is to make arrangements for on-site viewing of similar systems, by Council in
Quebec at the earliest date possible.

The Council of the Village of Vienna met in Council Chambers at 7 30 p m to discuss
Vienna's response to the Elgin County Study Committee Fact Finding Questionnaire
Present were Reeve Gundy Goutouski, Councillors Doug Brackenbury, Rick Marlatt,
Keith Underhill and C Valerie Donnell, and Clerk Lynda Millard.
Following discussion of each question it was decided what the actual response would be
The Questionnaire is to be prepared accordingly, for final approval on Thursday.
November 30/95.
Vienna Council was in agreement with the Township of Malahide in regard to the reserves
for the East Elgin Area Water System and supported a meeting with O.C.W.A. to discuss
this matter and the future operations of the system, as opposed to the request for support
by the Village of Port Burwell, in their letter of November 8, 1945, to have the funds
released to the contributing municipalities.
The meeting adjourned at 10.10 p.m.

The Draft Emergency Plan for the Village of Vienna was discussed at length. A final
document is to be prepared for final approval as soon as possible.

A Public Meeting was held m Council Chambers at 7:30 p.m. The purpose of the meeting
was to address two Zoning By-law No 90-12 Amendment applications
Present were: Reeve G. Goutouski. Councillors D. Brackenbury, R. Marlatt, K. Underhill
and C V Donnell, Clerk L. Millard and Land Surveyor Kim Husted.
K. Husted made a presentation regarding the application by J. Wolfe to rezone a portion
of property from Parks and Open Space to Open Space- 2(OS-2).

In regard to the Village proposal to amend the Zoning By-law in regard to Accessory
building size in the Residential(R1)Zone,no objections were received
A letter was received from the Elgin St Thomas Health Unit requesting that
1) any new structure be located at least five(5)meters away from the on-site sewage
disposal system;
2) the land on which the structure is located is not needed as a contingency area for the
replacement of the on-site leaching bed.
There being no further correspondence, the meeting adjourned
