Councillors present were: A. Goethals, D. Brackenbury and R. Marlatt,Clerk, L. Millard. Also present were Gene Ketchabaw and Robert Reiser representing the Masonic Hall and Darlene Abuda representing the Lioness;Fran DeGelder and Dennis Wilson. MOVED BY: A. Goethals SECONDED BY: D. Brackenbury THAT the minutes of the regular meeting of Council of the Village of Vienna on December 9, 1994 be approved CARRIED. • DELEGATIONS 10. The representatives of the two groups present discussed interest concerning the sale of Nevada Tickets. Their respective groups are to be consulted and the representatives are to inform the Clerk as to their intentions in this matter. 13. Fran DeGelder discussed water billings with Council and problems with the meter and readouts. As a result it was MOVED BY: A. Goethals SECONDED BY: D. Also present were representatives of the Masonic Temple Club, Gene Ketchabaw and Robert Reiser. Interest in the sale of Nevada Tickets in Vienna was discussed. The regular meeting of the Council of the Village of Vienna was held in Council Chambers,with Reeve Gundy Goutouski presiding. Present were Councillors Doug Brackenbury, Rick Marlatt and Sue Hughes, and Clerk Lynda Millard. Councillor Arthur Goethals was absent. DELEGATIONS present were: Bayham Township representatives Reeve Vane Chute and Clerk Don MacLeod; Shelley Clark representing a Vienna Women's Baseball Team;and Real Estate Agents Joe Dionne and Sylvia Brady and Client David Doyle. 1111RESIDENTS present were Steve Straub and Don Whitney. MacLeod of Bayham Twp. were present to discuss the possibility of Vienna doing water meter reading and billing for the proposed waterline extension in Bayham Twp. north of Vienna. There will be approximately 22 new customers. D. MacLeod updated Council regarding extra billing charges by GreenLane. 17. Shelley Clark was in attendance regarding having a baseball fundraising dance at the Community Centre. As a result it was MOVED BY: D. Brackenbury SECONDED BY: S. Hughes THAT a girl's baseball benefit dance be held at the Community Centre on April 30/94 as requested by Shelley Clark,with a suitable chaperone list to be supplied prior to use, and that a Police Officer be hired CARRIED 18. Joe Dionne, Sylvia Brady and David Doyle were in attendance concerning questions regarding property located at #12 Front St. Mr. Dionne is to contact Village Planner, Gary Blazak concerning requirements. • BUSINESS 1. Brackenbury THAT the Village of Vienna draw up an agreement with Bayham Township in regard to Vienna being responsible for water meter reading and water billing for the proposed waterline extension north of Vienna, and that a water meter chamber be installed at the entrance to Bayham Township with the new line....CARRIED 5. The letter and resolution from the Village of Port Burwell re: pollution of the Otter Creek were discussed. In a further attempt by Council to determine what the actual situation is and the possible solutions available it was S I = MOVED BY: S. Hughes SECONDED BY: R Marlatt AND RESOLVED THAT the Village of Vienna apply to the Ontario Clean Water Agency for financial assistance under the Municipal Assistance Program to complete an Environmental Study Report at an estimated cost of$25,000. on the pollution of the Otter Creek caused by private septic systems CARRIED 6. Brackenbury SECONDED BY: R Marlatt AND RESOLVED THAT the Clerk be hereby instructed to prepare and submit an application to Canada Employment and Immigration for two(2)students for the Edison Museum under the SEED program. CARRIED 7. MNR Discussion Paper OUR SHARED RESOURCES: PLANNING TOGETHER FOR THE FUTURE is to be studied by Councillor Hughes who is to report back at the next meeting. 11. MOVED BY: S. AMO info request is to be filled out and returned regarding Gross Receipts Tax. 15. The status of Bill 45 in the Ontario Legislature is to be determined. Council was very concerned with the implications of this Bill. 16. Cyril Demeyere is to be contacted in regard to Roads Costs for 1994 in regard to infrastructure monies. To be discussed further at the April meeting. 19. Discussion on support for the Community Initiatives in Vienna/Bayham is to be tabled until the April meeting. CORRESPONDENCE FILED 2. Hilliard Willson made a presentation to Council requesting that the Village maintain a zero percent budget increase for 1994. It was noted that the County requisition has increased from$31,686 to$36,988 for 1994. An increase of $5,302. Mr. Willson commended the Village of Port Stanley for implementing the Tag System for garbage. 2. Joe Oud did not appear as scheduled 2.5 Don Whitney requested compensation for his loss of ducks killed by dogs. The matter is to be looked into further. OLD BUSINESS 3. Bill 45-to redefine marital status and extend it to include gay&lesbian couples This Bill is being reviewed by the Standing Committee for the Adminis- tration of Justice. Letters from GreenLane Environmental Group re rates for garbage disposal/recycle FILED In response to a letter from the County of Elgin regarding Waste Management it was MOVED BY: Rick Marlatt SECONDED BY: Art Goethals WHEREAS, the municipalities in the County of Elgin and the city of St. Thomas support the Environmental Assessment Board's Decision to permit the interim expansion of GreenLane Landfill for five years;and WHEREAS by the Conditions of Approval in said Decision,the Proponent, St. Thomas Collection Service Ltd. is required to set aside part of the tipping fees charged at the landfill to provide the following: (1) The creation of a Financial Assurances Reserve Fund in the amount of$6,600,000 by the end of five years, (2) An allowance for the treatment of leachate generated at the site, (3) A road upkeep payment of $22,400 per year. And further that by agreement with the Proponent the tipping fees charged at the site include the allowance of$2,000,000 over five years for the ongoing EA Planning program to identify and approve a long-term landfill for the County and the City, and WHEREAS,the EA Board's Decision recognizes that by adopting the costing principles, the City and the County have demonstrated their commitment to 3R activities,and • WHEREAS,the County and the City are of the view that it is in the interests of all municipalities in the County to develop a long-term waste management system, and WHEREAS,no supplier of waste management services other than the Proponent is required to fulfil these obligations, and WHEREAS,in view of these conditions of the EA Board's Decision,tendering for waste management services does not serve the long-term interests of the municipalities in the County,nor does it provide a real comparison of the benefits being offere /d WHEREAS,given that the St. Thomas Collection Service Ltd has provided its "shopping list", including prices,to all the Elgin County municipalities in good faith and in keeping with the EA Board's Decision(and conditions of approval),with the understanding that these prices would not be used by or given to competitors to under- mine the Proponent's desire to comply with the EA Board's Conditions of Approval or to detract from developing a long-term system, NOW THEREFORE be it resolved that the Municipal Corporation agrees to negotiate a five year contrat with St. Thomas Collection Service Ltd. for the provision of waste management services at a price consistent with the costing principles and such other • terms as are agreed to by the parties. NOTICE of the meeting had been given in The Tillsonburg News and The Aylmer Express, as well as being posted at the various Commercial outlets in the Village. REPORTS were given by: (1) Dave Beretta outlined and summarized the results of the Pollution Survey and Dye Testing conducted in the Village during periods in 1992-1994. (2) Dr.Thomas Wilson reported that there were 26 households in violation,but that a village-wide solution would be preferred. (3) Cyril Demeyere presented Information Report No. 1 of his Class Environmental Assessment, Pollution of the Big Otter Creek. This Report outlined the Background Information, Identified the problem as failing or malfunctioning septic systems discharging continually to the Otter Creek,available Study funding,and possible alternative solutions to the identified problem,and approximate costs of those alternatives A question period followed the presentation of the Reports. Pt. Burwell-Vienna Santa Claus Parade will be held Sat. Dec. 3/94 at 3:00 p.m. Theme is"A NURSERY RHYME CHRISTMAS". The Clerk is to check with the Lions Club in regard to a donation towards candy. 2. Elgin County Roads letter re Winter Control - FILED Menard's&Louks'have agreed to continue snow plowing&removal at previous rates. Laemers will continue sanding&salting at the same rates as well. 3. Update re Waste Management meeting at Pt. Stanley. County Council voted to assume authority to prepare a Master Plan. 4. Update on Bill 163 revision of Planning&Conflict of Interest Acts was given by Reeve Goutouski. A request for Tenders is to be advertised for the infrastructure project for the Ventilation system at the Community Centre. 13. File: Min/1194 COUNCIL MINUTES NOVEMBER 10/94 A special meeting was held in Council Chambers at 7:30 p.m. Present were Reeve Gundy Goutouski, Councillors Doug Brackenbury and Rick Marlatt, Clerk Lynda Millard. Also present were a delegation of ratepayers who had received letters recently from the Elgin-St. Thomas Health Unit regarding malfunctioning septic systems. Discussion took place in regard to the alternative options available to correct the situation in Vienna. Making their prescribed declarations and oaths of allegiance were: Reeve, Gundy Goutouski, and Councillors, Keith Underhill,Rick Marlatt, Douglas Brackenbury and C. Valerie Donnell. Also,present were: Clerk,Lynda Millard, Ratepayer Sheldon Godby, and press Allan Spicer of Harbour Lights. Allan Spicer took a group picture of Vienna's new Council. Reeve Goutouski congratulated Council members Donnell and Underhill upon their election and Brackenbury and Marlatt upon their re-election to office.
