A special meeting with Conlin Engineering for Tuesday, January 12, 1988 at 6 : 30 P.M. was requested by Council to further discuss the reports . Council instructed the Clerk to contact Ostrander: to determine if the Village might be endowed with the lot on Robinson Street. Council were apprised of possible need for a water truck . B. Council discussed a possible problem with fire hydrants. C . Council discussed Bunker suits-to be put in budget for discussion. D. Volunteer Fire Committee will be purchasing a quick out circular saw and donating same to the Village. Approximately $800 . 00 . 3 . A resolution for petition for subsidy for 1987 expenditures for roads for $93709 . 28 was passed. See attached resolution. 4 . The County of Elgin requested Councils view whether the land division Committee should be reverted to each Municipality. See attached resolution. 5 . The building of a building on the property owned by the Village at the corner of Pitt and Robinson. The building to be used to store and display historical artifacts . See attached resolution 2. Council reviewed proposals for new on Lake Marina and discussed several aspects . 3. Mr . Hugh Brooks proposed to build a steel building at his residence . Council members expressed reser- vations about the building proceeding. The Central Mennointe Committee is requested to supply the labor through the East Elgin Employment Assistance program to assist in this worthwhile public building . WHEREAS the Council of the Village of Port Burwell is • desirous of constructing a building of approximately 2400 square feet ; The Reeve and Clerk are authorized to enter into an agreement with Glen White Industries to order a pre engineereed steel building; on agreement with Laemers for site preparation, a suitable contractor to pour the cement pad , and arrangements with the Central Mennonite Committee to erect the building. Roof to go over a bench or used for picnic area by Museum. • • jiclies„A /9 e €2), A-1/A--11. slet NN April 7, 1988 TO ALL COUNCIL MEMBERS : PETITION We, the undersigned neighbours , are strongly opposed to The Council of The Village of Port Burwell allowing Hugh Brooks to construct a gravel truck and heavy equipment depot at his residence known as • 48 Strachan Street , Port Burwell for the following reasons : 1 . His property will be a distressing anomaly to the neighbourhood environment . 2 . It will seriously depreciate the market resale value of the surrounding properties as well as the entire residential neighbour- hood . 3 . It will create an extremely distressing and unbearable noise factor for the neighbours . In fact , Brooks trucks are already disturbing the neighbours by roaring engines at early hours of the morning, late at night , and even worse, on Sundays . 4 . There will be a definite risk to the safety of small children playing and walking in the neighbourhood . 5 . Diesel trucks and equipment will pollute the air in the entire neighbourhood , resulting in a sickening foul odor and film of diesel fuel floating around . As well as being hazardous to the health of the surrounding neighbours , it is a known fact that this type of pollution is detrimental to the survival of grass , trees and all vegetation in the immediate area . 6 . It will cause serious traffic congestion on Highway 19, the main tourist thru way entering into Port Burwell . 7 . Highly explosive and flammable fuel supply storage tanks create an extremely hazardous situation to the surrounding area . 8 . Strachan Street will be used extensively by the heavy equipment and trucks thus resulting in serious damage to the road surface and of course in the future it will have to be repaired and resurfaced at the expense of the taxpayers of The Village. The Council surely must realize that a quiet residential neighbourhood is definitely and without any doubt the wrong location for a truck and heavy equipment depot as proposed by Mr . Brooks and , therefore, should refuse him a Building Permit . Dear Elwood: Re: Official Plan My family and I were away on a brief holiday recently at the time when the public meeting was held involving the proposed Official Plan for the Village of Port Burwell. I am therefore forwarding this letter to make a comment with respect to the Official Plan and also to seek clar- ification on a couple of points. My wife and I look at the Official Plan from our perspective as owners of a cottage property off Strachan Street and I believe for mun- icipal purposes we are labelled municipal number 34. Our main concern has been with respect to the lands designated as "hazard lands." The formula which the planners used to designate hazard lands appears in our experience to be excessive. Since the shore protection works were put in a number of years ago the bank behind the rubble wall has stabilized and at our location we have not lost any land for the past half a dozen years. As I say, once the bank stabilizes then virtually no land is lost so the definition of hazard lands as I understand it appears excessive in that it extends Northerly from the cliff into properties which as far as I can judge would not in any sense be "hazard lands." I under- stand that at the public meeting a number of comments in a similar vein were made and possibly the definition of hazard lands can be amended to take into account the reality that the shore protection works are doing • their job, the bank is stabilizing and as a result the risk of cliff erosion is continually diminishing. illNow with respect to our own property I have a couple of specific points on which I seek your reassurance and these points again deal with the definition of "hazard lands" as it would affect our property in the future: 1111 1. What if our cottage were to be partially or^destroyed b' r all • - 2 - • fire? If we are located in an area designated as "hazard lands" can we obtain a Building Permit to rebuild the damaged portion or to rebuild an entire cottage? I expect the answer is in the affirmative but we seek your reassurance on this point. • 2 . The only change which we have ever discussed with respect to our present cottage dwelling is the possibility of erecting a deck on the lake side of the cottage and the dimensions of any such deck would approximate 10 feet in a North-South direction by the width of the cottage which would be let us say 25 or 30 feet. After the Official Plan is in place with the result that our property would be in the area designated as hazard lands could we obtain a Building Permit to erect a deck along the lines indicated above? I trust that you will be able to send me an affirmative response to the two questions raised above. I understand that the public can still raise questions at the forthcoming O.M.B. Hearing but much better I am sure you will agree to clarify this type of question in advance of the O.M.B. Hearing and keep that process as brief as possible. FUNERALS AND PARADES No person shall drive any vehicle, except for an emergency response vehicle, between properly designated vehicles in any duly authorized 6 parade or funeral procession taking place on any highway in the Town of Aylmer. 33. EMERGENCY FIRE SITUATIONS No person shall drive a vehicle within 1E0 m of a building which is on fire, or across any hose line laid by the Fire Department. The Fire Chief may, at his discretion, place signs on any highways adjoining the burning building, closing parts of those highways until the fire is extinguished. No person shall drive a vehicle past such a sign, or approach nearer to the fire than such a sign. III34 . DRIVING ON SIDEWALKS No person shall drive any motor vehicle within, upon, across, or along any sidewalk, path, or boulevard,, except at a driveway. unless the need for such use of a motor vehicle is created by an emergency, or such motor vehicle is actually engaged in works undertaked by or on behalf of the Town of Aylmer. 35. U-TURNS No person in a motor vehicle shall make a U-turn on any portion of Talbot St. (Highway #3) or John St. (Highway #73) which lies within the Town of Aylmer. 36. PROHIBITED LEFT TURN No person operating a motor vehicle shall make a left turn, North onto John St. , from a private land opening on the West side of John St. , approximately 23.5 m North of Talbot St: , and being the exit from the Royal Bank of Canada parking lot, between the hours of 3 :00 p.m. and 6 :00 p.m. , on any day except Saturday or Sunday. 37. DESIGNATED LANES (a) On the highways or parts thereof listed in Column 1 of Schedule VI to this By-Law, having been divided into clearly marked lanes between the limits indicated in Column 2 of the said Schedule, each of the lanes indicated in Column 3 of the said Schedule is designated for traffic moving only in the direction or directions indicated in Column 4 of the said Schedule, at any time. • (b) The penalties provided in Section 133 of the Highway Traffic Act shall apply to offenses against this section of this By-Law. (c) Each designation made by subsection (a) of this section shall become effective upon the placement of official signs or markings. 38. ONE-WAY TRAFFIC Vehicles travelling on highways named in Column 1 of Schedule V to this By-Law, shall only travel in the direction permitted in Column 4 ill/ of the said Schedule, within the limits named in Columns 2 and 3 of the said Schedule. This section shall come into force when official signs indicating the direction of traffic have been erected and are on display at every intersection where movement in the opposite direction is prohibited. 39. THROUGH HIGHWAYS (a) The highways set out in Column 1 of Schedule VII to this By-Law, between the limits set out in Columns 2 and 3 of the said Schedule, are, except as provided in subsection (b) of this section, hereby designated as Through Highways. (b) The designation, in subsection (a) of this section, of a highway or part thereof as a Through Highway, shall not include any intersection thereon where the road intersected is a King'l Highway or where traffic control signals are installed. 40. MAXIMUM SPEED The maximum rate of speed for any vehicle travelling on any highway -10- • within the Town of Aylmer shall be 50 km/h, except for the portion of highway described hereunder, where the maximum rate of speed shall be 70 km/h: Highway #3, from the Westerly limit of Talbot St. West, then Easterly 1 046 m to a point being the former Town limit. IV. LOADING AND UNLOADING ZONES (a) All loading and unloading of vehicles shall be done while such vehicles are parked in accordance with the provisions of this By-Law, provided that where it is deemed necessary for the proper and efficient loading and unloading of a vehicle, it shall be permissible to back the vehicle to the curb, and no person shall park such vehicle but for the period of time that may be required for loading and unloading the vehicle and upon depositing sufficient coins of legal tender into the parking meter, if any. ' (b) No person shall permit a vehicle to remain backed up to the curb except during actual loading or unloading and in such case no longer than the actual loading or unloading may require. (c) No person shall back a vehicle up to the curb if such action would be likely to cause a disruption of traffic flow. 42. TRUCK ROUTE Due to the traffic difficulties which often arise at the intersection of Talbot St. and John St. , it is deemed necessary to designate an alternate route for large commercial trucks, in order to avoid as many such traffic problems as is possible. Signs will be erected to indicate that such trucks travelling East into Town, along Talbot St. West (Highway #3) and wishing to reach John St. North (Highway 473) shall turn North on Elm St. , then East on Beech St. Trucks entering Town on John St. North and wishing to reach Talbot St. West shall turn West on Beech St. , then South on Elm St. This truck route shall come into effect upon placement or erection of the appropriate official signs. 43. OVERSIZED LOAD PERMIT The Town Clerk may, upon application in writing, grant a permit for the moving of heavy vehicles, loads, objects, or structures in excess of the dimensional limits and weight limits as set out in the Highway Traffic Act of the Province of Ontario. The permit may be general or may limit the time and the particular highway that might be used, and may contain conditions relating the the protection of persons and property from injury or damage and may require a Bond or security sufficient to cover the cost of repairing any possible damage to the highway. The owner, operator, or mover of a heavy vehicle, load, object, or structure in respect of which a permit is issued under this section is nevertheless responsible for all damages that may be caused to the highway. 44. BICYCLES (a) No person shall operate a bicycle on any sidewalk located: (i) Along Talbot St. , on the North side between Myrtle St. and Queen St. , on the South side between Raglan St. and Queen St. ; // (ii) Along John St. , on either side, between Chestnut St. and Pine St. ; (iii) Along King St. , on either side, between Talbot St. and Sydenham St. ; (iv) Along Sydenham St. , on either side, between King St. and John St. ; (v) Along Centre St. , on either side, between Talbot St. and Sydenham St. (b) Any person who operates a bicycle on any other sidewalk shall dismount before passing any pedestrians.
