Norm felt that council could make a decision more easily if they would wait and see what happens with the dredging, the C.P.R. railway, and the ferry service. r • -2- 6) Tony Lama; Tony Lama questioned council that if the harbour land was zoned for residential and commercial use and not for industrial use, would that in turn affect the Government 's decision in granting the Village any money for dredging. 1110 David Mason; David Mason, president of the Port Bruwell Ratepayers Association, stated that his Association fully supports the development plan. The Village of Port Burwell has the potential for tourism. • 8) John Verton; John Verton expressed his concern that the development might create a parking problem on the Village streets. 9) Alexander Ellens; Alexander Ellens reminded council of the problem in Bayfield. There are too many marinas there, and every one of them is full. PRESENT: Ron Bradfield - Reeve 110 Cindy Allin - Councillor Ed Bradfield - Councillor Brydon Guest - Councillor Elwood Varty - Clerk VISITORS: Tony Lama - Big Otter Marina Mr. Reid - Tillsonburg News 41/1 N 1. Tony Lama re: Big Otter Marina and Campgrounds. Tony gave council a report on the 1986 operation of the Marina: ( 15 campsites, 40 seasonal boats for season, boat rental, gas) For 1987: 300 feet of wall constructed, installed 5 new trailer sites, plus new docks. Tony had two requests for Council: 1 ) Would like 1,000 feet of road into the Marina tar & Chipped. 2 ) Would like 15 speed signs for the water. (Tony will install them) . 2. 1987 Budget . MOVED BY Brydon Guest, SECONDED BY Ed Bradfield WHEREAS council of the Village of Port Burwell are desirous of updating the East Elgin Official Plan and implementing comprehensive restricted area by-laws (zoning) in the Village of Port Burwell as soon as possible, the Province of Ontario through Ministry of Municipal Affairs is requested to supply a Community Planning Grant Program for a program of a total expenditure of approximatley $18,000. The Clerk is authorized to sign all application forms. • Carried. L4 .Appoint Recreation Board. By-law number 87-2 was passed. A by-law to authorize the carrying on of a program of recreation within the meaning of the Regulations under the Ministry of Culture and Recreation Act , 1975, to provide for operation, maintenance and management of parks and to provide for the establishment , operation, and maintenance of Community Centres pursuant to the Community Centres Act and Regulations amde there-under. -3- 15. By-laws. By-law number 87-3 was passed. 11/11 A by-law to rescind by-law number 86-17 which was a by-law to zone four parcels of land on the harbour. By-law number 87-5 was passed. A by-law to amend by-law number 86-15, a by-law to set • water rates. By-law number 87-6 was passed. A by-law to ammend by-law 260 being a by-law to construct and maintain a water works system. 16. The County of Elgin has a large farm assessment that has municipal Tax rebates provided to owners through the "Ontario Farm Tax Reduction Program" . The Village of Port Burwell is a repository for agriculture workers who do not share this subsidy of the burden the same as the agricul- tural owner. The Village feels that we should not be paying the same share as a Municipality which has a portion of its owners subsidized in this manner. 2 . A major expense on Elgin County' s 1987 budget is "library" which placed a burden of $801 ,430 on the tax levy. The Village of Port Burwell feels that this should be allocated on a "benefitting Area" basis rather than the present approach. Now that several areas have new facilities a clear line has been drawn between the haves and not have.., the haves should pay on a basis to reflect the benefitting area. 3 . The Village of Port Burwell does not adequately benefit from the County Road Expenditures of $6 , 315 ,000. These expenditures should be spread over the Municipalities that because of more usage of County roads should carry a greater burden. 4 . The questions that were put to County Council on the 26th of March 1987 , regarding the ammending of the budget perhaps would have had a different out come if the high number of absent Reeves and Deputy Reeves had been allowed to have stand in substitutes . 5 . The last two years apportionment has increased 19 . 5% and 22 . 9% respectively. his increased burden is beyond any reasonable increase and places too much of a hardship over a short period of time . With the lack of public washrooms a burden is put on the Harbour restaurant. Nola Redmond presented a petition to Council . The petition asked persons to support a difference in rates between commercial and residential . It was suggested that anyone using water in a business pay a different rate. Background On February 16, 1987 , the Council of the Village of Port Burwell passed a resolution which requested a community planning grant from the Ministry of Municipal Affairs . This grant would be applied to the cost of preparing the Village' s first Official Plan and implementing zoning by-law. Recent development propoz, s for the Village have brought the need for land use con ?r. to the fore. 2. Need for .'an ,Of • ial Plan and Zoning Regulations •.\. ',.''''` Since the dissolvt`lonQi` int planning areas , Port Burwell has been utilizing the• appl ' cable portions of the East Elgin Official Plan. This plan was initially prepared in 1976 . Port Burwell was identified as an urban area , targeted for residential development+ due to hard service capacity. The assumptions upon whicp•vEhis '1n was devised does not reflect the existing situttiSn, ,,tot only because they were established over a decade ago 'bdt alsecause they were designed to apply generally tall u, is areas in East Elgin. A plan which is responsive to he ,uni,qu r ituation of Port Burwell is required. } Several amendments to the East Elgin Official lan have been passed which have an impact on the Village;-of Port Burwell . In 1977 the "Hazard Land" designations Port Burwell were altered by Amendment No. 2. These provisions were further amended by Amendment No. 3 in 1978. Although flood line mapping was available for the Village in 1977 no implementing zoning by-law was enacted . The Longpoint Conservation Authority revised this mapping again in 1986 which would require further amendments to the East Elgin Official Plan. • The lack of zoning regulations has hampered development proposals which would have provided a much needed economic boost to the community. Council recognizes the importance of zoning controls and is unwilling to permit development without proper regulations . They also see the benefits of incorporating the land use controls provided for by the 1983 Planning Act . -2- 3. Rey Issues As previously mentioned , development pressures and changes in policy, external to the Village , are heightening awareness for the need of local policies and regulations . In addition IP to these , there is concern over the potential loss of Robinson Street as the commercial centre , particularly as marina facilities locate on the Lake- Erie shoreline rather than in the harbour . The silting problem in the harbour combined with the federal government' s decision not to maintain the port is also a cause for concern. In turn , this may impact on the recreation potential of the Village and recreation alternatives should be explored . C.P. Rail has a , ced their intention to abandon the rail line into the kV... ` . This will vacate strategically located lands . Int- . est in developing industrial , commercial , 'open spa e a d residential uses have already been expressed for t4ese ha front lands. Should these developments' cur , spin-off pressures for residential uses will bacUr . Policies for locating new subdivisions and infil4 ng are essary. In addition , the conversion of seasonal to persnan' residences must be addressed . Overcrowding ot‘house is a persistent problem. While zoning may not solve - the a isting problem it is hoped that these problems will be avoi, ed p future . 4. Existing Documents 4 , Several studies of Port Burwell exist and contain much of the statistical information utilized in the Background to an Official Plan . Since 1986 a Municipal Housing Study, Socio- Economic Study (Ministry of Tourism and Recreation) and Economic Plan (prepared by the village) have been produced . Information on hard services is readily available . Currently the village is undertaking a study of heritage structures . S. Project Tasks and Timing This project includes all the aspects of the Official Plan and zoning by-law coverage for Port Burwell . It is anticipated that the project will commence in August, 1987 and both documents completed by February, 1989 . Although the Official Plan may not be approved by the ' Ministry of Municipal Affairs prior to commencing the zoning by-law, the urgency of the matter warrants forging ahead in anticipation that both documents will be finalized , adopted and approved by the winter of next year . IP . 1 -3- 5.1 Phase I Initiation, Official Plan Background This phase is comprised of the project initiation and formulation of a Background to the Official Plan . The P consultant will compile and analyze the following information: a) Land Use and Facilities - the existing land use map areas of conflict and opportunities should be identified - mapping of historically significant buildings - inventory/map of community facilities including schools, chu ches , parks , libraries, service clubs and recreation ' lities and physical deficiencies should be outlined. b) Environment °°44N- identify hazard lan drainage problems - delineate shoreline h zard area - identify environmental protection areas if necessary c) Municipal Services"(Hard) - identify the capacity, cons mption levels and future consumption of sanitary and storm sewers - identify any problems related , he sanitary and storm sewers - identify the quality, supply consucption levels, capacity and future consumption .df waer supply - identify existing sanitary landfill sibss, future needs and any problems. Abandoned sites'will also be examined - identify existing utilities ( hydro, telephone and gas) and any problems d) Municipal Services (Soft) - examine police and fire protection services and any problems - identify available social services e) Population - examine population data and growth rates, assessment ' population to 1986 and population characteristics . Population projections shall also be done . Population characteristics and trends should be compared with those of the Province and the County - population capacity with respect to land and servicing . -4- f) Housing - trends in number and type of dwellings , tenure and persons per household 1/1 - housing starts and demand - inventory of vacant lots and proposed subdivisions - specialized housing including group homes and senior citizen housing including demand for specialized housing g) Economic Base - analysis of employment including sources of employment, income , labour force and male/female breakdown. The consultant shall prepare the background report including trends , problems and recommended solutions. As well , the implications of economic and population trends , particularly seasonal population , on land uses , employment , housing , transportation and municipal finances . The issues of site plan controls , community improvements , alternate notice and zoning techniques introduced in the 1983 Planning Act will be addressed. It is expected this phase will be completed by January 1988 . Council will have an opportunity to review this document. -5- 5.2 Phase II Draft Official Plan The consultant will prepare official plan policies based on the findings of the background report . The draft plan will be reviewed with council and circOlated to the Ministry of Municipal Affairs (Plans Administration_Branch) for draft - review by May 1988. 5.3 Draft Zoning By-law While the draft official plan is being circulated the consultant will commence preparation of the zoning by-law. A draft version will be presented to council for review by November 1988. 5.4 Finalization of Documents The Ministry of Municipal Affairs anticipates completion of a draft review for an Official Plan to be three months . During the fall of 1988 Council and the consultant will review suggested modifications to the Official Plan and the consultant will prepari a final draft. Both the Official Plan and Zoning By-law doc6ments will be presented at a public meeting pursuant t6 thQ Planning Act in January 1989. Any final alterations will be made so that the documents may be adopted and submitted to the Ministryyby February 1989 . rfftyr Throughout the project , the CommuPlanning Advisory Branch (CPAB) of the MinistryAd Muniicipal Affairs and the Council of Port Burwell will 'receive . month status reports from the consultant . 6. Costs The proposed budget for the entire project is $18 ,000 . If the consultant is not able to meet the terms of reference with the budget , an explanation of the need to exceed the budget must be provided. It is Council ' s desire that these documents be simple and easy to read . Previous attempts to institute zoning failed due to the complexity of the proposed document . 7. Consultant' s Proposal The proposal should describe the proposed study approach in detail. It should clearly distinguish between the tasks to • be performed and the costs to be incurred for each section of the program. The proposal should include a flow chart to show the timing of the major phases of the program. The total projected elapsed time for each phase of the program to its completion should be indicated. An indication should also be given of the timing of the meetings. The proposals submitted should be drafted in such a manner that it is absolutely clear as to which party, be it the consultant or 1!" -6- 7 . Consultant' s Proposal (continued) the client , is to be responsible for what duties within the total framework of the program. ' A brief summary of the / firm' s experience in undertaking similar projects , including a short list of the most recent municipal clients should be provided . Upon request , copies of similar projects should be made available to the client prior to an interview. These copies will be returned . An indication should be given of the number and levels of technical and professional staff being assigned to the project. The project manager should be present when the proposal is initially discussed in an interview before a contract is negotiated . An estimate of the number of days that the project mafaiger and each staff member will spend on the project must be rorovided . The study will examine various alternative outer harbour configurations in the area immediately east of the existing east pier at Port Burwell. The area to be considered for harbour development is south of Hagerman Street extending from the east pier to the extension of Victoria Street. SCOPE OF STUDY The scope of the study will include: I complete review of the history of Port Burwell Harbour and the problems (i.e. dredging requirement) associated with maintaining harbour facilities at the existing rivermouth location; II assessment of present and future demand for harbour facilities to support commercial fishing, sports fishing and recreational boating activity at Port Burwell; III review of the suitability and availability of land and water lot to accommodate alternative harbour development to the east of the east pier; but more specifically it will provide: -2- 1111/ IV a Master Plan for development of new harbour facilities (size configuration layout etc.); V the cost of developing new harbour facilities; VI an assessment of the economic impact on the community and area of new harbour development; VII the method of implementing a new development (financing, timing, approvals etc.); VIII an examination of alternative uses for the existing Federal rivermouth property and structures taking into account any other proposed adjacent development. SCOPE OF WORK A. BACKGROUND Assemble and review all available pertinent information regarding the waterfront of the Village of Port Burwell. Meet with groups interested in the development; specifically but not necessarily limited to: Small Craft Harbour Branch for historical and physical information related to existing harbour facilities, past engineering and • development studies, etc.; e -3- The Village of Port Burwell for historical information and municipal views on the existing harbour situation and current and future fact; ity needs; Provincial Ministries (Tourism and Recreation, Natural Resources, Municipal Affairs and Housing) for information on provincial development programs applicable to the site; Commercial Fishermen of Port Burwell for their views on development. The Operators of Port Burwell Provincial Park and Big Otter Marina, the Eastside Cottagers Association, Elgin Tourist Association and the local Conservation Authority. B. MARKET ANALY S I S Assess past growths in recreational boating and commercial fishing activity based on available records. Establish future demand based on population growth, socio-economic data, tourism needs and sports fishing for the Lake Erie north shore market area. Survey of existing major commercial fishing and recreational boating facilities along the north shore of Lake Erie from Port Dover to Leamington. Interview representatives of the major existing facilities and others interested in commercial fishing and recreational boating along the north shore of Lake Erie. 11/ 1 -4- C. ENVIRONMENTAL IMPACTS Complete an initial environmental impact assessment to identify possible difficulties and mitigating measures regarding new harbour development. Possible work in this regard would include the review of fish and wildlife habitats, sedimentation and circulation, noise, and water quality, shorelilne erosion impacts, etc. D. ALTERNATIVE DESIGNS Prepare a series of initial concept plans to reflect a range of berths and facilities that would be appropriate for the site. Analyze each scheme with respect to the following issues: - access to the marina and local traffic conditions; - parking; - servicing (water sewer electrical); - relationship of the site relative to other activities and surrounding land uses in the area; - compatibility with local and regional official plans; - cost estimates; - economic impacts on the community. Review concept plans with the client's Steering Committee to establish a preferred concept plan. E. PREFERRED PLAN • Complete the development of a detailed master plan from the preferred plan including implementation costs and economic impact. Review with the client's Steering Committee and make any minor revisions required as a result of discussions. 4 -5- PUBLIC PARTICIPATION I/ One public meeting organized by the Village of Port Burwell will be required following the Alternative Design stage to obtain public input and acceptance. TIMING Final Report to be received fourteen (14) weeks after contract award date.
