HomeMy WebLinkAboutPort Burwell By-Laws 1973 Port Burwell BrLaws 10111 3 Melia 411111 By-Laws # 248- 278 1971 - 1973 -13 -'01 BY-LAW NO. 272 THE CORPORATION OF THE VILLAGE OF PORT BURWELL A By-law to regulate the keeping and or harboring of dogs within the Corporation of the Village of Port Burwell, Ont. 1. That wherever referred to in this By-law-- "A" Dog -- shall inclide, bitches or spayed bitches of any 110 age (except where otherwise stated.) "B" Owner--includes any person who possesses or harbors any dog. "C" Owns or Owned--shall have a corresponiing meaning. No person shall suffer on permit any dog of which he is the owner or custodian to run at large or trespas3 on any property in the Village of Port Burwell. 3 (1) For the purpose of this By-law, any dog shall be deemed L at large when found on any highway or other public place, or an any property other than that of the owner and not in charge of any person. (2) To provide that dogs when at large shall be restrained upen leash. Every dog within the Village of Port Burwell, when not visibly confined or restrained to the dwelling or property of its' owner or of the person having the care and custody of the sane, shall at all times be restrained upon leash in charge of some person. 4. (1) In accordance with the provision of the Statutes of Ontario Chapter 133. (2) Subject to sub-sections. An animal Dog Tax shall be levied in every Municipality upon every person who is assessed as owner or tenant of any land and who is in occupation thereof in respect of every dog which he owns within the Municipality or which is habitually kept upon the premises for which he is assessed although such dog nay be owned by some other person. (3) In every Municipality in which a Dog Tax is levied every person in each year on or before the 15th day of April shall procure from the Clerk or other person designated for that purpose, a tag for each dog in amount of which he is liable for the dog tax and sholl keep the tag securely fixed on the dog at all times during the year and until he procures a tag for the following year, excepting, that the tag may be removed while the dog is being lawfully used for hunting in the bush. (4) The tag shall bear a serial number and the year in which it was issued and a record shall he kept by the Clerk or ocher officer designated for that purpose, showing the name and address of the owner, the serial number of the tag and the amount of the fee paid in respect of the tax. • 5. A pound keeper, appointed by the Council of the Village of Port Burwell, shall and any Police Constable may seize any animal found at large contrary to any of the provisions contained in the. preceeding sections of this. by-law. When- ever any animal is seized by a Police Constable he shall forthwith deliver same to the Pound Keeper of the Municipality of Port Burwell. It shall be the duty of the Pound Keeper to impound any dog seized by him or delivered to him by a Police Constable. 6. The owner of any dog impounded as provided in the preceeding sections of this By6law, within seventy-two hours after such dog shall have been impounded, claim such animal on application to the Pound Keeper and proof of his -ownership. The fee for impounding such animal shall be five Dollars and shall be paid to the Pound Keeper plus One Dollar daily for board of animal. If said dog has not a license for the current year it shall be the duty of the Pound Keeper to sell' the owner a Dog Tag before `releasing said dog. • 7. If such animal be not reclaimed by the owner or person having the care and custody thereof, the Pound Keeper may retain such animal for such further time as he may consider proper and further may destroy or otherwise dispose of such animal at his discretion. $. PENALTIES (l J In this section "person" shall mean any owner or person having the care and custody of any dog, or any person harbouring or being the tenant of any premises on which any dog is habitually kept. (2) Any person who contravenes or fails to comply with any of the provisions set forth in section 2 or 3 shall be guilty of an offence, and upon conviction, shall forfeit' and pay at the discretion of the convicting Magistrate ✓ a penalty exclusive of costs not exceeding Ten Dollars ($10.00) for the first offence, and not less than Ten Dollars 410.00) and not more than Fifty Dollars ($50.00) for each subsequent offence and the same shall be recoverable under the provisions of the Summary Convictions Act. (3) Any person who contravenes section 4, or who uses a Tag upon a dog, other than that for which it was issued shall be guilty of an offence and on Summary Conviction shall be liable to a penalty of not more than Fifty Dollars ($50.00) and the same shall be recoverable under the provisions of the Summary Convictions Act. (4) Destruction of a dog on failure to pay tax When a tax is demanded and not paid the person assessed may be summoned before a Magistrate, and who may order the dog destroyed unless the tax and costs shall be paid before a time named therein. (5) Authority tj enter and destroy For the purpose of carrying out such an order, and officer may enter upon the premises of the owner or person having the care and custody and destroy such dog. No kennel license shall be granted within the Municipality. 11. That By-law, 168A, 199, and 240 and all other By-laws not in , accord with the provisions of this By-law be and the same are hereby repealed. Port Burwell Public Utilities Commission to provide in part the funds required for the purchase of utility equipment and for extensions and improvements to the electrical distribution and street-lighting systems. WHEREAS the Council of the Corporation of the Village of Port Burwell has by By-law authorized the purchase of utility equipment by the Port Burwell Public Utilities Commission. AND WHEREAS it is deemed expedient to borrow for the 'aid purpose a sum not exceeding $6000.00 upon the credit of A the Corporation �o be raised by way of promissory notes. THEREFORE the Council of the Corporation of the Village of Port Burwell E"TACTS AS FOLLOWS: (1) That a sum not exceeding $6000.00 be borrowed from the Canadian Imperial Bank of Commerce in the Village of Port Burwell for the purposes aforesaid. (2) That the loan of $6000.00 be repaid over a period not exceeding three ;'ears being 1974, 1975, 1976. (3) That three promissory notes in the amounts of $2000.00 $2000.00, $2000.00 be drawn in favour of the Canadian Imperial ' Bank of Commerce, and each of the said notes shall become due and payable in the respective years 1974, 1975, 1976 on the Anniversary of the date of signing thereof. (4) The Corporation of the Village of Port Burwell shall levy on all the rateable property in the municipality an amount over and above all other rates sufficient to meet such payment' including interest. (5) That each promissory note shall bear interest at the rate of 7 1/4% per annum. In this By-Law "trailer"means any vehicle so constructed tl.at it is suitable for being attached to a motor vehicle for the purpose of being drawn or propelled by the motor vehicle, and capable of being used for the living, sleeping or eating accommodation of persons, notwithstanding that such vehicle is jacked-up or that its running gear is removed. WHEREAS paragraph 86 of Subsection 1 of Section 354. of The Municipal Act, 1972, provides that councils of ]oval municipalities may pass By-Laws for prohibiting the use of trailers. THEREFORE BE IT ENACTED BY THE MUNICIPAL COUNCIL OF THE CORPORATION of the VILLAGE OF PORT BURWELL. 1. No trailer shall be used, and no owner or lessee of any trailer shall permit the use of said trailer for the living, sleeping, or eating accommodation of persons within the Village of Port Burwell, except in a licenced mobile home park or a licenced tent and/or trailer park, for more than 60 days in any period of ten consecutive months. 2. This By-Law shall not apply to any trailer for which a building permit has been issued at the date of the passing of this By-Law. 3. This By-Law shall not apply to any trailer located in the Village of Port Burwell for the purpose of sale or storage only. 4. Every person who contravenes the provisions of this By-law 111/1 shall be guilty of an offence and liable to a penalty of not less than $10.00 and not more than $50.00. exclusive of costs, and each day that a person contravenes this By-Law shall be deemed to constitute a separate offence. The lands comprising that portion of the said street is hereby stopped up and closed, and the subsequent sale or other disposition of the said lands shall be subject to easements for the maintenance repair and use of such utilities as may now be located upon or under the said lands.
