WHEREAS The Municipal Act authorizes the councils of all municipalities to enter into.agreenents with other municipalities for the use of firefighting equipnent or any of it: NOW THEREFuRE the Council of the Corporation of the VILLAGE ofPORT BURWELLENACTS AS FOLLOWS: 1. That the VILLAGE of PORT BURWELL Fire Department be authorized to leave the limits of the municipality or fire area, at.the discretion of the Chief and under the direction of the ELGIN County Fire Co-ordinator, to respond to calls for assistance from other municipal fire departments authorized to participate in the ELGIN, County Mutual Aid System or any other County Mutual Aid System on a reciprocal aid basis. 2. BY-LAW I THE CORPORATION OF THE VILLAGE OF PORT BURWELL A By-law to approve of the borrowing of One Hundred Thousand ($100,000.00) Dollars by the Township of Bayham for • the construction of a four room addition and school furnishings therefor for Straffordville Public School. WHEREAS the Township of Bayham School Area Board has applied to the Corporation of the Village of Port Burwell for its approval of the borrowing of One Hundred Thousand ($100,000.00) Dollars upon debentures to be issued by the Township of Bayham for a term of twenty years for the purpose of the construction of a four room addition and school furnishings therefor for Straffordville Public School. AND WHEREAS the Council of the Corporation of the Township of Bayham is passing a By-law, a copy of which is hereto attached, for the purpose of the said borrowing and issuing debentures and is arranging for the approval of the Ontario Municipal Board in respect thereof. THEREFORE the Council of the Village of Port Burwell enacts as follows: - 1. The Corporation of the Village of Port Burwell hereby approves of the said borrowing of One Hundred Thousand ($100,000.00) Dollars. 2. Commencing in the year 1967 and thereafter in each year in which an instalment of principal of the said debt and interest become due, the Corporation shall levy and raise its share of the said principal and interest and any other expenses in connection therewith as determined in accordance with the provisions of the Public Schools Act or any amendment, substitution, or any other law which may be in force from time to time, upon all the rateable property of its public school supporters in the Township of Bayham School Area, and forthwith pay the said amount to the Town*ip of Bayham to be used to pay the said debentures. A By-law authorizing the borrawin of One Hundred Thousand ($100,000.00 Dollars for the construction of a four room addition and school furnishings therefor for Straffordville Public School. WHEREAS the Township of Bayham has been requested by the Township of Bayham School Area Board to raise the sum of One Hundred Thousand ($100,000.00) Dollars for the construction of a four room addition and school furnishings therefor for Straffordville Public School. AND W1f1Z. AS it is expedieat for the said purpose to borrow for the financing thereof the said sum of One Hundred Thousand ($100,000.00) Dollars upon the credit of the Corpor- ation, and to issue debentures therefor bearing interest at the rate of six per cent (6z) from the date of issue until maturity and to provide for the discount and the expense incidental to negotiation and sale of such debentures; AND WHEREAS it is expedient to make the principal of the said debt repayable in annual instalments during the period of twenty years next after the date of issue of such debentures, of such amounts respectively that, with the interest in respect of the debt, the aggregate amount payable for principal and interest in each year shall be as nearly as possible the same; subject to the proviso that each instalment of principal may be for an even $100.00 or $500.00, or =iltiple thereof, and that notwithstanding anything herein contained, the annual instalment of principal and interest may differ in amount sufficiently to admit thereof; AND WHEREAS the amount of the whole rateable property of the Municipality, according to the last revised assessment roll thereof is $5,197,496.00. qo If•� 1 XEAp. r�rr miXtoo ca , -2 - AND tiitMEAS r) -.s- f—ront of Vizi• : vi-stf.-P debenture debt 0 of the Corporation is $186,766.49 and nc pert of the principal or interest of Etch debt is in arrears. Commencing in the year 1967 and thereafter in each year in which an instalment of principal of the said debt and interest become due, the Corporation shall levy and raise upon all the rateable property of public ¢chool supporters in the Township of Bayham an amount sufficient to pay said principal and interest to the extent that such amount has not been provided for by the special rates imposed on persons or property made liable therefor by the By-laws of the Township of 111alahide and the Villages of Port Burwell and Vienna, being the other municipalities involved in Straffordville Public School. 6. The said debentures may coa;ain a clause providing for the registration thereof pursuant to Section 323 of The Municipal Act. 7. Pending the sale of the cnil debentures, the Reeve and the Treasurer may raise for the pur;oscs aforesaid by way of loan on such debentures any sum or sums of coney not exceeding in all the sum hereby authorized to be borrowed and may hypothecate such debentures for such loan. 8. The Corporation shall have the right, at its option, to redeem that portion of the said debentures which mature in the twentieth year on any date prior to maturity at the places where and in the moneys in which the said debentures are expressed to be payable, upon payment of the principal amount thereof to ;ether with interest accrued to the date of redemption and upon giving previous notice of said intention to redeem by advertising once in the Ontario Gazette and once in a daily newspaper of general provincial circulation, published in the City of Toronto, and once in a local newspaper, such notice to be advertised as aforesaid at least thirty days before the date fixed for redemption. Notice of intention so to redeem shall also be sent by post at least thirty a days prior to the date set for such redemption to each person in whose name a debenture so to be redeemed is registered at the address shown in the Debenture I'egistry Book. 9. The proceeds from the sale of the said debentures or the sum of money borrowed thereon shall be forthwith paid to the fQ;Ai XERO. A By-law to regulate the keeping and/or harboring of dogs within the Corporation of the Village of Fort Burwell, Ont. 1. That wherever referred to in this By -law -- "A" Dog- shall include, bitches or spayed bitches of any age (except where otherwise stated.) "B" Owner -includes any person who possesses or harbors any dog. "C" Owns or Owned -shall have a corresponding meaning. 2. No person shall suffer or permit any dog of which he is the owner or custodian to run at large or trespass on any property in the Village of Port Burwell, Ont. 3. (1) For the purpose of this By-law, any dog shall be deemed at large when found on any highway or other public place, or on any property other than that of the owner and not in charge of any person. (2) To provide that dogs when at large shall be restrained upon leash. very dog within the Village of Port Burwell, Ont. when not visibly confined or restrained to the dwelling or property of its' owner or of the person having the care and custody of the same, shall at all times be restrained upon leash in charge of some person. 4. (1) In accordance with the provision of the Statutes of Ontario, Section 4, Chappter 107, Sub -section 2(1), 3 (5) (6), 4 (1) (3) (4). (2) Subject to subsections. An animal Dog Tax shall be levied in every Municipality upon every person who is assessed as owner or tenant of any land and who is in occupation thereof in respect of every dog which he owns within the Municipality or which is habitually kept upon the premises for which he is assessed although such dog may be owned by some other person. (3) In every Municipality in which a Dog Tax is levied, every person in each year on or before the 15th day of February shall procure from the Clerk or Assessor or other person designated for that purpose, a tag for each dog in amount of which he is liable for the dog tax and shall keep the tag securely fixed on the dog at all times during the year and until he procures a tag for the following year, excepting, that the tag may be removed while the dog is being lawfully used for hunting in the bush. (4) The tag shall bear a serial number and the year in which it was issued and a record shall be kept by the Clerk or other officer designated for that purpose, showing the name and address of the owner, the serial number of the tag and the amount of the fee paid in respect of the tax. 4 Ll 5. A pound keeper, appointed by the Council of the Tillage of Port Burwell, Ont. shall and any Police Constable may seize any animal found at Targe contrary to any of the provisions contained in the preceeding sections of this by-law. Whenever any animal is seized by a Police Constable he shall forthwith ddliver same to the Pound Keeper of the Municipality of Port Burwell, Ont. It shall be the duty of the Pound Keeper to impound any dog seized by him or delivered to him by a Police Constable. 6. The owner of any dog impounded as provided in the preceeding sections of this By-law, within forty-eight hours after such dog shall have been impounded, claim such animal on application to the Pound Keeper and proof of his ownership. The fee for impounding such animal shall be Five Dollars and shall be paid to the Found Keeper plus One Dollar daily for board of animal. If said deg has not a license for the current year, it shall be the duty of the Pound Keeper to sell the owner & Dog Tag before releasing said dog. 7. If such animal be not reclaimed by the owner or person having the care and custody thereof, the Pound Keeper may retain such animal for such further time as he may consider proper and further may destroy or otherwise dispose of such animal at his discretion. 8. PENALTIES (IT-ST-EtFiis section "person" shall mean any owner or person having the care and custody of any dog, or any person harbouring or being the tenant of any premises on which any dog is habitually kept. (2) Any person who contravenes or fails to comply with any of the provisions set forth in section 2 or 3 shall be guilty of an offence, and upon conviction, shall forfeit and pay at the discretion of the convicting Magistrate a penalty exclusive of costs not exceeding Ten Dollars (10.00) for the first offence and not less than Ten Dollars ($10.00) and not more than Fifty Dollars (i50.00) for each subsequent offence and the same shall be recoverable under the provisions of the Summary Convictions Act. (3) Any person who contravenes section 4 sub -section 3 or who uses a Tag upon a dog, other than that for which it was issued shall be guilty of an offence and on Summary Conviction shall be liable to a penalty of not more than Fifty Dollars ($50.00) and the same shall be recoverable under the provisions of the Summary Convictions Act. (4) Destruction of a dog on failure to pay tax. When a tax is demanded and not paid the person assessed may be summoned before a Magistrate, who may order the dog destroyed unless the tax and costs shall be paid before a time named therein. (5) Authority to enter and destroy For the purpose of carrying out such an order, and officer may enter upon the premises of the owner or person having the care and custody and destroy such dog. • r 9. WHEREAS Chapter 2499 Section 44 and clause (1) of the revised St4tutes of Ontario as amended 1960, provides that the day fixed for nomination must be at least 7 days prior to the day fined for polling.
