The Head and the Treasurer are hereby authorized on behalf of the Municipality to borrow from time to time by way of promissory note from THE CANADIAN BANK OF COMMERCE a sum or sums not exceeding in the aggregate i 20,060.00 to meet until the taxes are collected the current expenditures of the Municipality for the year, including the amounts required for the purposes mentioned in subsection (1) of Section 341 of the Municipal Act, and to give on behalf of the Municipality to the Bank a promissory note or notes sealed with the Corporate Seal and signed by the Head and Treasurer for the moneys so borrowed, with interest, which may be paid in advance or otherwise, at a rate not exceeding per centum per annum. 2. All sums borrowed pursuant to the authority of this by-law, as well as all other sums borrowed in this year and in previous years from the said Bank for any or all of the purposes mentioned in the said Section 341, shall, with interest thereon, be a charge upon the whole of the revenues of the Municipality for the current year and for all preceding years as and when such revenues are received. 3. The Treasurer is hereby authorized and directed to apply in payment of all sums borrowed as aforesaid, together with interest thereon, all of the moneys hereafter collected or received either on account or realized in respect of taxes levied for the current year and preceding years or from any other source which may lawfully be applied for such purpose. THE COUNCIL OF THE CORPORATION OF THE VILLAGE OF PORT BUR.;ELL ENACTS AS FOLLOWS; In this by-law (a) "Nursing H ome" means any house or other building or portion thereof other than a hotel, hospital, home for the young or aged or instituti©n that is licensed, approved or supervised under any general or special Act, in which more than three persons are harboured, received of lodged for hire and where in addition to sleeping accommadation and meals, personal care, riursin g services, medical care and treatment are provided or made available. (b) "Personal Care" means personal services such as the provision of aid to residents in walking or in climbing or descending stairs, in getting in or out of bed, in feeding, dressing, bathing or in other matters of personal hygiene, and includes the preparation of special diets, the provision of tray service for meals, the supervision of medication and other similar types of personal assistance. (c) "Residant" means a person who is cared for or lodged for hire in a Nursing home. (d) "Occupier" means the person who operates a nursing home under this by-law. 2. No person shall, within the limits of the Corporation of the Village of Port Burwell, operate a nursing home unless or until he has obtained a license therefore. 3. Any such license issued shall be for the calander year and shall expire on December 31st next following date of issue. 4. No license is transferable. 5. All applications for licenses shall be in writing and in such form as may from time to time be prescribed by the License Inspector. 6. There shall be levied and collected from and apyable by every applicant for a license under this by-law, and from every person carrying on the business of a nursing home in the Village of Port Burwell, an initial license fee of $25.00, and $15.00 yearly thereafter. 7. Each license shall be issued in respect of a specified location and the license shall not be used by the occupier for a location other than the one specified therein. $. Each license sh.:11 be issued in respect of a specified number of persons and the occupier shall not permit a number of persons greater than that specified in the license to be cared for or lodged for hire at the location in respect of which the license is issued. U (2) 9. Every applicant for a license or renewal of a license to operate a nursing home shall submit a written application in which he shall state: (a) the name and address of the applicant • (b) location of the premises for which the license is sought (c) the number of rooms used for sleeping accommodation by the residents and the number of beds in each (d) the maximum number of residents which the applicant proposes to accommodate at one time (e) the number of bath tubs or showers, wash -basins and flush toilets available for use by the residents and their location (f) such other information as may be required. 10. Each application for a license or renewal of a license shall be accompanied by (a) a certificate of the CU of of the Port Burwell Fire Department certifying that the premises have been inspected by him or his representative within 3 months of the date of the application and that they are reasonably safe from fire hazard; and (b) a certificate of the Medical Officer of Health of the County of Elgin certifying that the premises have been inspected by him or his representative within 3 months of the date of the appli- cation, and that, in his opinion, they are in reasonable compli- ance with the requirements of the By-law. 11. The occupier shall provide sleeping accommodation for residents in rooms with a minim= of (a) 400 cubic feet of air space and fifty square feet of floor space for each resident under sixteen years of age, (b) 600 cubic feet of air space and seventy-five square feet of floor space for each person sixteen years of age and over, and each room so used shall contain at least one window opening directly to the outside air, and the size of the window shall be not less than 10 per cent of the floor area of the room and shall be capable of being opened or closed at all times. 12. Sleeping accommodation shall not be provided in any space in the premises used as a lobby, hallway, closet, bathroom, stairway, kitchen, attic or cellar. 13. The occupier shall provide toilet and bathing facilities which are readily accessible to all residents with a minimum of one wash -basin and one flush toilet for every eight residents and bath -tub or shower for every twelve residents. 14. The occupier shall not admit or retain as a resident wW maternity case, or any person who requires treatment for alcoholism, drug addiction, mental illness or disease, or arty person who requires active medical or surgical care or treatment of a kind usually provided in a hospital. 9 0 A (3) 15. The occupier shall (a) provide fo- nursing services for patients by or under the supervision of a registered nurse, and (b) ensure that medical care and attention are made available by a duly qualified medical practitioner to patients as required, 16. The occupier shall provide (a) nourishing meals at regular intervals and special diets, where required, prepared by or under the supervision of a competent person, and (b) adequate and card tart' supplies of milk and drinking water. 17. The occupier shall employ such persons who are in the opinion of the Medical Officer of Health sufficient in number and qualified to pro- vide the nursing services and personal care required by the residents. 18. The occupier shall keep or cause to be kept a register of persons resident in the nursing home which shall set forth (a) the full name, age, sex and former place of abode of each resident and family physician, (b) the name and address of the next -of -kin, closest relative or friend, (c) the date and circumstances of his admission to the home, (d) a record of all medical examinations after admission, the diagnoses and orders of duly qualified medical practitioners, and the medicines, medications, and treatments prescribed or administered, (e) the date, the circumstances of his discharge from the home and the name and address of the person or institution in whose care or to which he was discharged, (f) in the event of the death of the resident, a record of the circumstances of the death and the name and address of the person claiming the body, and (g) such other information as may be required by the Medical Officer of Health. 19. The occupier shall maintain the nursing home in a thoroughly clean, safe and sanitary condition, and without limiting the generality of the fore- going, he shall (a) el Adnate fire hazards including the provision and maintenance of (i) protection from radiators or other heating equipment, (ii) water supplies adequate for all normal needs including those of fire protection, and (iii)at least two separate means of egress to the grade level from floors with sleeping accommodation, and (iv) first aid fire fighting equipment as required and approved by the fire chief. (b) maintain a minimum temperature of 68 degrees Fahrenheit in the 0 nursing home from the 1st of October to the 31st of May; (c) maintain a private line telephone; (d) have the premises inspected at least once in every six months by the Fire Chief or his representative; (4) (e) have the premises inspected at least once in every 6 months by the Medical Officer of Health or his representative; (f) keep all parts of the building free from rubbish, garbage, ashes, flammable materials and other debris; (g) keep the cellar of the nursing home well drained and ventilated; (h) keep the nursing home weatherproof, free from dampness, adequately heated, and all heating equipment in good repair; (i) maintain adequate kitchen equipment and facilities to ensure the proper preparation and protection of foods (j) take all necessary steps to keep the building free from vermin, insects and pests. 20. The Medical Office of Health or his representative, the Fire Chief or his representative or any employee of the Corporation required to administer or enforce the provisions of this By-law may enter a nurs- ing home at any and all reasonable times for the purpose of inspecting the premises and every part thereof to ascertain whether the provisions of this By-law are being or have been complied with and it shall be an offence for any person to prevent or obstruct any such official from carrying out his duties under this By-law. 21. In every nursing home, the license shall be posted in a conspicuous place near the main entrance and a printed copy of this By-law shall be made available by the occupier for examination upon the request of any resident in the nursing home. 22. The Council may at any time revoke any license issued under this By-law, and notice thereof shall be given by registered letter mailed to the occupier at the address in respect of which the license was issued. 23. Any person convicted of a breach of any of the provisions of this By-law shall forfeit and pay at the discretion of the convicting magistrate a penalty not exceeding Fifty Dollars, exclusive of costs, or be imprisoned for a term not exceeding six months or to both such fine and imprisonment. 24.
